Abstract

Hazairin is an intellectual of Islamic law. Although most of his live and education are incommon education, not in speciality of islamic way, but Islam that was learned autodidactly makes hebecoming a great man as modern islamic reformer. He concluded that social system in what Quranwants is not a clan system or anti-unilaterality. In one side, seriousness of thinking that was produced byHazarin is considered as controversial statement. In the other side, his recent breakthrough has beenrealized through a number of Law rules.

Abstract

Abstract: Corruption is one of the most hated and combated criminal acts, because corruptors are grasped as taking away people?s welfare. At present, the penalties for corruptors are considered too light, so that many people think corruptors had better punished by cutting their hands. The call to enforce the law of cutting hands on perpetrators of corruption gets an idea from the law for thieves as stated in the Alquran surah Al-Maidah verse 38. But the big question is whether corruptors can be associated to the terms of the thief so that they can be punished by hand. Therefore the author feels the need for a thematic study of the interpretation of the Alquran surah Al-Maidah verse 38 in order to answer this question, in order to get clarity whether the meaning of theft can be equated with acts of corruption. The method that author use in this paper is a qualitative descriptive study with the main references to book of interpretations, hadis books and fiqh books relating to the law of cutting hands. The results of the study that author get, it turns out Al-Maidah verse 38 cannot be applied to criminal acts of corruption because the term thief in the verse is not the same as the corruptor. Keywords: sharia law, corruptors, cutting hands, tafsir ahkam Abstrak: Korupsi adalah salah satu tindakan pidana yang paling dibenci dan diperangi, karena koruptor dianggap merenggut kesejahteraan rakyat banyak. Saat ini, hukuman untuk koruptor dianggap terlalu ringan sehingga banyak orang berpendapat agar koruptor dihukumi dengan hukuman potong tangan. Seruan untuk memberlakukan hukum potong tangan pada pelaku korupsi mendapat gagasan dari hukum bagi pencuri seperti yang telah tertuang pada Alquran surah Al-Maidah ayat 38. Namun yang menjadi pertanyaan besar adalah apakah koruptor bisa disamakan seperti term pencuri pada ayat tersebut sehingga bisa diberikan hukuman potong tangan. Oleh karena itu penulis merasa perlunya kajian tematik tafsir Alquran surah Al-Maidah ayat 38 guna menjawab pertanyaan tersebut, agar mendapatkan kejelasan apakah makna pencurian bisa disejajarkan dengan perbuatan korupsi. Metode yang penulis gunakan dalam tulisan ini adalah penelitian deskriptif kualitatif dengan rujukan utama kitab-kitab tafsir, kitab-kitab hadis dan kitab fikih yang berkaitan dengan hukum potong tangan. Hasil kajian yang penulis dapatkan, ternyata Al-Maidah ayat 38 tidak bisa diterapkan pada tindak pidana korupsi karena term pencuri pada ayat tersebut tidaksama dengan koruptor.

Abstract

This research describes the protection of women victims of domestic violence in divorce cases. Domestic violence victims are hidden in divorce cases in the Religious Courts. The positivistic paradigm adopted by the Judges gives less protection to victims of domestic violence. The method used in this study is a qualitative method, a type of doctrinal legal research with a socio-legal  approach. Domestic violence victims in the Religious Courts need a new paradigm to provide protection for victims of domestic violence. Religious Court Judges who have a positivistic paradigm see the law as a book (act). The judge in examining the domestic violence in divorce only adheres to the law relating to marriage, namely Law No. 1 of 1974 and Compilation of Islamic Law. Paradigm of Critical Legal Studies. build critical awareness in law enforcement by improving the legal system and carrying out a reformation in the institutions responsible for the protection of victims of domestic violence, one of which is the Religious Courts. Also consider the PKDRT Law No. 23 of 2004 concerning the elimination of domestic violence even covering legal culture of family, community, health and psychological.

Abstract

Maqashid al-Sharia is sharia purposes or secrets which are established by Allah. Accordingto al-Syatib, there are four purposes of Allah to determine the shariah: (1). For the benefit of peoplein the world and the hereafter. (2). To be understood. (3). As a taklif law that must be implementedand to eliminate hardship. (4). Abstract

Terjadinya kontroversi dalam masalah kepemimpinan perempuan dalam Islam berasal dari perbedaan ulama dalam menafsiri sejumlah ayat dan hadis Nabi. Secara umum jika dianalisa kualitas hadis riwayat al-Bukhârî, al-Turmuzî, dan al-Nasâ`î serta Imam Ahmad  tentang kepemimpinan perempuan secara umum adalah shahîh li dzâtihi. Sanadnya memenuhi kaidah kesahihan sanad hadis, yaitu sanadnya bersambung, periwayatnya bersifat tsiqah, dan terhindar dari syudzûdz dan ?illah. Matannya juga memenuhi kaidah kesahihan matan hadis, yakni terhindar dari syudzûdz dan ?illah.Secara tekstual, hadis tersebut menunjukkan larangan bagi perempuan menjadi pemimpin dalam urusan umum. Oleh karena itu, mayoritas ulama secara tegas menyatakan kepemimpinan perempuan dalam urusan umum dilarang. Namun secara kontekstual hadis tersebut dapat dipahami bahwa Islam tidak melarang perempuan menduduki suatu jabatan atau menjadi pemimpin dalam urusan umum. Bahkan menjadi kepala negara, dengan syarat sesuai dengan kriteria  dan sanggup melaksanakan tugas tersebut. Oleh karena itu, hadis tersebut harus dipahami secara kontekstual, karena kandungan petunjuknya bersifat temporal.

Abstract

Abstrak: Kemaslahatan dan kebaikan manusia merupakan tujuan pokok setiap bentuk peratuan, termasuk fatwa-fatwa Majelis Ulama Indonesia (MUI). Salah satubidang fatwa yang diterbitkan MUI adalahhukumkeluarga. Fokusutamatulisaniniadalahmembacaulang dan menganalisa fatwa-fatwa MUI dalambidanghukumkeluargadenganperspektifkonsepmaslahatmayoritas fuqaha yang juga telahditerbitkandalam Fatwa MUI tentangKriteriaMaslahatNomor: 6/MUNAS VII/MUI/10/2005. Fatwa-fatwa tersebut, dilihatmenggunakanparadigmakonsepmaslahat, adakalanya masuk dalam kategori ma?la?ahmu?tabarah, ma?la?ahmursalah, dan adaindikasibeberapa fatwa yang masuk kedalam kategori ma?la?ah mulghah. Adapun fatwa MUI dalam bidang hukum keluarga yang dimaksud dalam tulisan ini yaitu fatwa tentang Aborsi, tentang Perkawinan Beda Agama, tentang Kewarisan Beda Agama, tentang Perkawinan Di BawahTangan (sirri, tidak dicatatkan), dan tentang Nikah Wisata.Kata kunci: Ma?la?ah, GradasiMa?la?ah, MUI, HukumKeluargaAbstract: Human benefit and goodness are the main objectives of every form of regulation, including the fatwas of the Council of Indonesian Ulama (MUI). One of the fatwa fields issued by MUI is family law. The main focus of this paper is to reread and analyze the fatwas of the MUI in the field of family law with the perspective of the concept of majority fuqaha masses which have also been published in the MUI Fatwa concerning the Maslahat No. 6 / MUNAS VII / MUI / 10/2005. These fatwas, are seen using the concept of maslahat, sometimes include to the category of ma?la?ahmu?tabarah, ma?la?ahmursalah, and there are indications of several fatwas that include to the category of ma?la?ahmulghah. The fatwas of the MUI in the field of family law referred to in this article is a fatwa on Abortion, concerning Differential Marriage, about Different Religions, About Marriage Under the Hand (sirri, not recorded), and about Tourism Marriage.Keywords: Ma?la?ah, Gradation of Ma?la?ah, MUI, Family Law

Abstract

The issue of polygamy is a hot issue that to be debated continuesly. One side polygamy is claimed as exploitation and hegemony of male to female. On the other hand, polygamy is seen have normative reference and it considered as one of the solutions to solve the problems of in infidelity and prostitution. The Indonesian government has been reform the rules of polygamy. In KHI, although it adheres to the principle of monogamy, but the government is still open opportunity for polygamy. However, this rule of KHI is critized bythe dayah scholars of North Aceh. The overview of Ulama dayah is that polygamy rules made by the government out of the Shari?a corridors. Also that issueto be politicied and adopt the rules of the west to complicate polygamy practise and legalized prostitution. Therefor, this study aim to examine and analyze the rules of KHI regarding polygamy from sharia aspect, social, cultural, welfare and others. Also, analyze and critize the views and thoughts of dayah scholar about the rules of polygamy in KHI.
