Abstract

Abstrak: Indonesia merupakan negara hukum yang demokratis. Salah satu konsekuensi yuridis dianutnya sistem demokratis tersebut adalah adanya pemilihan umum, termasuk dalam hal ini adalah pemilihan anggota legislatif, khususnya DPR dan DPRD. Sebagaimana konstitusi yang mengamanahkan bahwa peserta pemilu untuk memilih anggota DPR dan DPRD adalah partai politik, maka partai politik memiliki peranan yang besar dalam menentukan siapa-sapa saja yang akan mewakili partai dalam kursi parlemen. Salah satu wewenang yang dimiliki oleh partai politik adalah terkait adanya hak recall. Namun, keberadaan hak recall tersebut masih menimbulkan beberapa perdebatan. Berdasarkan hal tersebut, maka rumusan masalah dalam penelitian ini adalah: 1) Bagaimana keberadaan hak recall partai politik dalam konsep negara demokrasi? dan 2) Bagaimana implementasi hak recall partai politik di Indonesia? Penelitian ini dilakukan dengan penelitian normatif, dengan mengaji dan menganalisa peraturan perundang-undangan ataupun bahan hukum lain yang berkaitan dengan hak recall. Penelitian ini menggunakan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Berdasarkan pembahasan konsep hak recall, hak recall ternyata tidak sesuai dengan konsep negara demokrasi. Sekalipun hak recall merupakan kewenangan partai politik, namun hak recall tersebut pada hakikatnya telah mengkhianati konstituen yang telah memberikan legitimasinya terhadap anggota partai politik untuk menjadi wakil di parlemen.Kata Kunci: hak recall, partai politik, pemilu, demokrasi. Abstract: Indonesia is a democratic law state. One of the legal consequences of the democratic system adopted by Indonesia is general elections, including the election of legislators, specifically the DPR and DPRD. As the Indonesia constitution mandates that election participants to elect members of the DPR and DPRD are political parties, then political parties have a large role in determining who will represent the party in the parliament. One of the authorities possessed by political parties is related to recall rights. However, the existence of recall rights is still involves several considerations. Based on this fact, the problems in this study are: 1) How is the existence of the political party recall rights regarding to the concept of a democratic law state? and 2) How is the implementation of recall rights of political parties in Indonesia? This research was conducted by normative research, by reviewing and analyzing statutory regulations or other materials relating to the recall rights. This study uses a statute approach, conceptual approach, and case approach. Based on the result of this study, it found that indeed, the recall rights is incompatible with the concept of a democratic state. Even though the recall rights is the authority of a political party, the recall rights has essentially betrayed the constituents who have given the legitimacy for the political party’s member to become the member of the parliaments. Keywords: recall rights, political party, elections, democracy.

Abstract

Along with the enactment of Law No. 3 of 2006, Religious Court has been change related to law subject and principle of submission as well as added the Religious Court in resolving the disputes of Islamic economics. Non-Muslims or non-Islamic legal entity are allowed to be the subject of legal on dispute resolution in the Religious Courts. It is provided the legal relationship of civil underlies the Sharia. The presence of Article 1 paragraph 1 of Law No. 50 of 2009 is not to reduce the scope of the subject of law in the Law Religious Court previously, but this is related to law subject that have the meaning in narrow perspective, so that formulation of the notion in the article is need to be readjusted back in future.

Abstract

This paper discusses the rules that con?ict with the higher, so the local regulations must be canceled. If the local law has been withdrawn, the local laws cannot be enforced and cannot be guided due to invalid. On the contrary, if the local legislation has not been canceled, then the local regulations have binding force or valid until cancellation. The urgency of norms con?ict resolution of that theory, based on the deepest layer of law that is the legal philosophy in mining activities in forest areas is precisely the Forestry Act rests the preservation of forests while the regency government was grounded in economic interests.

Abstract

The Notary is a public official who was appointed by the Minister. Notaries are authorized officer to make authentic act of the civil. With this relationship beetwen the notary and the community, it would require a Notary professional supervision. Supervision of the Notary conducted by the Regional Supervisory Council who was inaugurated by the Minister as specified in the Notary Act. After the enactment of The Law Number 2 Year 2014 about The Amendment to Law Number 30 Year 2014 concerning Notary, there are some changes in regulations about supervision and guidance that will be undertaken by the Regional Supervisory Council. This law says that supervision of the Notary conducted by the Regional Supervisory Council, while the development under the authority of the Regional Supervisory Council before is now a Notary Honorary Council authority.

Abstract

Adanya pengakuan baik menurut Hukum Nasional maupun Hukum Internasional terhadap hak atas kesehatan tidak  berarti masyarakat mempunyai hak untuk sehat. Siapapun pada dasarnya tidak mampu menjamin suatu kondisi kesehatan tertentu, baik Pemerintah maupun masyarakat.  Kondisi kesehatan individu lebih banyak dipengaruhi oleh faktor lingkungan tempat tinggal dan  keturunan. Definisi-definisi hak atas kesehatan yang digunakan dalam instumen-instrumen  hak asasi manusia seperti yang telah dikemukakan,  umumnya mengacu pada “derajat kesehatan tertinggi yang dapat dicapai” (the highest attainable standard of health) sebagai sasaran hak atas kesehatan. Oleh karena itu substansi hak atas kesehatan sangat relatif, karena derajat tertinggi yang dapat dicapai tersebut dapat bervariasi sesuai waktu dan tempat.

Abstract

After the implementation of the Act No. 3 year 2006, the dispute of Islamic Economic is absolutely included as the domain of the Islamic Courts competence, and would be entirely resolved by this court as well. However, some regulations recently lead to reduce this competence belongs to the Islamic Court by making this court not the only institution to resolve the dispute of Islamic Economic. In fact, the domain of the Islamic Court that is extended to settle all the Islamic Economic disputes, is also reduced by a clause that potentially indicate to resolve the dispute outside from the Islamic Court (as stated in the contract), and also by a conflict settled on the of Islamic arbitration.

Abstract

Dalam upaya menemukan hukum yang digali dari sumbernya, para pengali hukum Islam seyogianya bertitik tolak dari prinsip kemaslahatan dengan metode yang telah ditawarkan oleh para pendahulu yang ahli dibidangnya. Abstract

Since test material to the provisions of Pasal 268 ayat (3) Undang-Undang No. 8 Tahun 1981on Criminal Proceedings in Mahkamah Konstitusi, Mahkahmah decided in its decision number 34 /PUU-XI / 2013, which states that the provisions was inconsistent with the Undang-Undang Dasar1945, so it does not have binding legal force. Therefore, Peninjauan Kembali (PK) in criminal cases maybe done more than once with the new circumstances or conditions found substantial novum new foundduring previous PK undiscovered. If problems associated PK novum criminal case is considered sub-stantial, and neither should Novum issues related PK in civil cases, as may be after the filing of the PKand disconnected, no new circumstances or substantial novum recently discovered that during theprevious PK undiscovered or if there is a decision of a judges mistake or a real mistake was discoveredafter PK decided. PK is an extraordinary remedy that aims to find justice and truth material. Justice cannot be limited by time or formal provision that limits that PK is only one time. Justice is a very basichuman needs, the more basic human needs of the rule of law. But in civil cases, the results of this studyindicate that the filing PK limited only once.
