Abstract

Perjanjian jual beli batu akik bongkahan adalah suatu perjanjian, dimana pihak yang satu mengikatkan dirinya untuk menyerahkan batu akik bongkahan dan pihak yang lain untuk membayar harga yang telah dijanjikan. Jual beli dianggap telah terjadi diantara kedua belah pihak, seketika setelahnya orang-orang tersebut mencapai kata sepakat tentang batu akik bongkahan tersebut dan harganya, meskipun batu akik bongkahan itu belum diserahkan, maupun harganya belum dibayar. Syarat sahnya sebuah perjanjian ada 4 (empat), yaitu : (1) sepakat, (2) cakap, (3) objek tertentu dan (4) kausa yang tidak dilarang. Tidak terpenuhinya syarat pertama dan kedua akibat hukumnya perjanjian dapat dapat dibatalkan dan tidak terpenuhinya syarat ketiga dan keempat akibat hukumnya batal demi hukum. Cacat kehendak dalam perjanjian batu akik bongkahan terjadi ketika terjadi ketidaksesuaian kehendak para pihak pihak karena adanya kesesatan dan/atau penipuan. Hakikat benda batu akik bongkahan terdiri atas jenis, kualitas dan/atau daerah asalnya. Akibat hukum adanya cacat kehendak ini yaitu : a). perjanjian batal ketika kesepatakan belum tercapai diantara para pihak; b). perjanjian dimohonkan gugatan pembatalan kepada pengadilan ketika kesepakatan sudah tercapai; atau c) perjanjian dimohonkan gugatan pembatalan karena penipuan beserta gugatan ganti rugi ketika kesepakatan yang sudah tercapai terdapat kesengajaan dari salah satu pihak untuk mempengaruhi keputusan pihak lainnya dengan cara melanggar hukum.

Abstract

Abstract: Criminal law is identical as miserable law, considering that criminal law is a means of last resort. Even though in its application, punishment must still prioritize the humanitarian element. Criminal law in Indonesia requires reform, because the substance of the Criminal Code is outdated and no longer in accordance with the objectives of criminal law as a means of protection and public welfare. This normative legal research uses a statutory and conceptual approach with prescriptive analysis techniques. The results of the research show that the Draft Criminal Code uses pro-Pancasila ideas and strategies as the philosophy of the Indonesian nation. Various forms of reform such as criminal alternatives, the development of the idea of balance, even the recognition of customary law which, although not written, upholds religious values, morality and humanity. Legal politics based on Pancasila, ideally contained in the formation of the concept of Indonesian criminal law, is an important substance and becomes a framework for the nation's morality from the threat of continued development of crime as a result of the evolving era.Keywords: Political Law, Criminal Law Reform, PancasilaAbstrak: Hukum pidana identik sebagai hukum yang menyengsarakan, hal ini mengingat hukum pidana merupakan sarana pengobat terakhir. Meskipun dalam penerapannya, pemidanaan harus tetap mengedepankan unsur kemanusiaan. Hukum pidana di Indonesia memerlukan pembaharuan, karena substansi KUHP telah usang dan tidak lagi sesuai dengan tujuan hukum pidana sebagai sarana perlindungan dan kesejahteraan masyarakat. Penelitian hukum normatif ini menggunakan pendekatan perundang-undangan dan konseptual dengan teknik analisis preskriptif. Hasil penelitian menunjukkan bahwa Rancangan Kitab Undang-Undang Hukum Pidana menggunakan ide-ide serta strategi pro-Pancasila sebagai falsafah bangsa Indonesia. Berbagai bentuk pembaharuan seperti alternatif pidana, pengembangan ide keseimbangan, bahkan pengakuan atas hukum Adat yang sekalipun tidak tertulis, menjunjung tinggi nilai religius, moralitas dan kemanusiaan.  Politik hukum dengan berasaskan pada Pancasila, idealnya terkandung dalam pembentukan   konsep   hukum pidana Indonesia, merupakan substansi penting dan menjadi kerangka moralitas bangsa dari ancaman terus berkembangnya kriminalitas sebagai dampak dari zaman yang terus berkembang.Kata Kunci: Politik Hukum, Pembaharuan Hukum Pidana, Pancasila

Abstract

Sandak is lien land that constitutes sale transaction in culture law (not as assurance institution). However, sandak purchasers could not have sandak land because they have obligation to take back the land at redemption. So, it has not expiration date. In this transaction practice, it has a strong relationship with elements of extortion and it is really disserve the sandak seller. Because of that, it is need to further regulation. On Laws No. 56/PRP/1960, sandak is limited the time period. Beside in that rule, sandak becomes more similar with assurance institution. However, on supreme court decision in 1981 toward sandak land that has passed certain period is not taken back and there is no claim refund, then sandak purchaser can become a sandak owner. While until this time, society is seldom to know about the exist of that rule, so the extortion is continuos. Besides, the new law, Laws No. 4 year 1996 about dependent rights, is not arrange this sandak problem as well.

Abstract

Abstrak:Institusi Hisbah merupakan sebuah institusi yang bertanggungjawab dalam melaksanakan prinsip al-amr bil makruf wa nahyu anil munkar. Pihak yang menguatkuasakan institusi ini dikenali sebagai Muhtasib. Objektif artikel secara umumnya membincangkan pelaksanaan konsep hisbah dan dakwah secara integrasi dalam prosedur dan modus operandi pencegahan maksiat dan jenayah khalwat di Malaysia. Sehubungan itu, artikel ini akan meninjau bidang tugas dan bidang kuasa bahagian penguatkuasaan dan pencegahan maksiat dan jenayah khalwat di Malaysia serta seterusnya menganalisis aplikasi konsep hisbah dan dakwah di kalangan pegawai penguatkuasa agama di Malaysia. Selain itu, turut membincangkan pendekatan amar makruf dan nahi mungkar dalam kerangka Hisbah yang mengkhususkan kepada operasi pencegahan maksiat dan jenayah khalwat. Kuasa ini diberikan kepada pegawai-pegawai penguat kuasa jenayah syariah di Jabatan Agama Islam negeri-negeri. Bidangkuasa penguatkuasaan jenayah Syariah khusus kesalahan jenayah khalwat adalah tertakluk kepada bahagian penguatkuasa, jabatan agama Islam negeri-negeri. Kajian literatur dan kepustakaan diaplikasikan secara kondusif bagi menjelaskan prinsip hisbah dan dakwah. Selain itu, kajian deskriptif dan analisis kandungan bersifat tekstualiti dilakukan terhadap peruntukan undang-undang terkandung dalam enakmen jenayah syariah negeri-negeri. Selanjutnya, kajian lapangan secara tembual dan observasi tentang aplikasi konsep hisbah di Bahagian Penguatkuasaan Jenayah Syariah, Jabatan Agama Islam negeri-negeri. Analisis perbandingan turut diaplikasi bertujuan untuk mencari persamaan dan perbezaan antara konsep dan realisasi hisbah dan dakwah oleh pihak penguatkuasa jenayah syariah bagi kesalahan khalwat. Umumnya, prosedur dan modus operandi pihak berkuasa dalam mencegah maksiat dan jenayah khalwat perlu memenuhi kriteria amar makruf nahi mungkar dalam kerangka hisbah. Akhirnya, artikel ini menghasilkan cadangan pendekatan alternatif terbaik yang lebih efektif iaitu integrasi hisbah dan dakwah dalam prosedur  pencegahan dan penguatkuasaan perundangan jenayah khalwat. Kata kunci: Hisbah, Dakwah, Maksiat, Khalwat, Undang-undang Jenayah Islam. AbstractHisbah institution is an institution responsible for implementing the principle of al-amr bil makruf wa nahyu anil munkar. The party that enforces this institution is known as Muhtasib. The purpose of this article is to discuss the implementation of the concept of hisbah and da'wah in an integrated manner in the procedures and operation modus in prevention of immoral and criminal of khalwat in Malaysia. In this regard, this article will review the areas of duty and the jurisdiction of the enforcement and islamic criminal in Malaysia and further analyze the application of the concept of hisbah and da'wah among religious enforcement officers in Malaysia. In addition, it also discusses the approach of the good and evil nature of the Hisbah framework which specializes in the prevention of immorality and the crime of khalwat. This authority is given to shariah criminal enforcement officers in the state Islamic Religious Department. The jurisdiction of Shariah criminal enforcement of special offenses against khalwat is subject to the enforcement division, the state Islamic religious department. Literary studies are applied conducive to explaining the principles of hisbah and da'wah. In addition, descriptive and content analysis of textual content is performed on the provisions of the law contained in the syariah criminal enactment of states. Furthermore, field surveys were conducted and observations on the application of hisbah concept in the Shariah Criminal Enforcement Division, the State Islamic Religious Department. Comparative analysis is also applied to find the similarities and differences between the concepts and realization of hisbah and da'wah by the shariah criminal enforcement of khalwat offense. Generally, the procedures and operation modus of the authorities in preventing immoral and criminal of khalwat should meet the criterion of a false morality.Finally, this article produces a more effective alternative approaches that are integration of hisbah and da'wah in the prevention and enforcement procedures of khalwat crime. Keywords: Hisbah, Da’wah, Immoral, Khalwat, Islamic criminal law.

Abstract

Children should live a life that is safe and comfortable with their parents and nanny. But the fact is happening, children often face persecution, violence, beatings and harassment, which often lead to death. Islamic law set some rules that may be subject to criminal perpetrators of violence against children committed by parents themselves, not others, while punishment requires an equal position between the perpetrators to the victim. There are scholars argue parents remain exposed qishash, and other scholars argue there is no qishash, just tazir and parents lose their right to inherit property. A lot of cases that occurred in the community in a variety of species, and most perpetrators have been sentenced. However the case that appears only a small part are revealed. In the midst of such conditions should be enforced once hadhanah principles stipulated in Islamic law. Hadhanah emphasize parenting to parents and close family, so that children can be cared for with love and responsibility. So the lives and safety of children will be more secure and protected.

Abstract

One of the pillars of Islam establishment is implementation of Zakat encashment. Zakatbecome one of the five pillars of Islam which one and others work in synergy. How important zakatis, Allah refers to people who are not fulfilled it as religion liars (Surah al-Ma'un). The importance ofthe Zakat can be seen from the mission of Islamic sharia as the teaching that committed toimplement physical and spiritual welfare, spiritual material. Zakat become instruments tend to thewelfare of the people. In Indonesia, it has entered the consciousness of the state. This was evidencedby the publication of two laws on zakat, Law No. 38 of 1999 and Law No. 23 of 2011 on Zakat. Thispaper explores the management of zakat as a part of the responsibility of the state, in addition tomanagement and ethical management.

Abstract

Al-Baihaky and al-Bazzar has narrated the hadith about "'Aqiqah after Adult." This hadith is not only famous among the scholars of hadith, but also on the part of Muslim society to exist among those who practice it, there are allow and do aqiqqah after adults, but some are rejected because they do not correspond to the meaning aqiqah itself. Aqiqah is the hair that grows on the head of the baby when born. Aqiqah also means the name of the slaughter of animals slaughtered for the newborn child. in terms the quality sanad of hadith is dlaif (weak). Then, why some jurists use these traditions to legitimize the permissibility of carrying out aqiqah as an adult? Or maybe the hadith hasan or even authentic quality. This question inspires the author to examine the hadith, whether authentic or dlaif? The findings of this study indicate that the quality is very dlaif and matan (the text of the report) contained irregularities..

Abstract

Penelitian ini akan membahas mengenai pelaksanaan remisi di Indonesia menurut Keputusan Presiden Republik Indonesia Nomor: 174 Tahun 1999 Tentang Remisi, pada dasarnya tidak terlepas dari prinsip-prinsip pokok hukum pidana Islam. Konsep hukum pidana Islam berpangkal pada kemaslahatan untuk pencegahan (ar-radu waz-zajru) pendidikan dan pengajaran (al-Islah al-Tahzib). Tujuan pemberian Remisi di Indonesia merupakan sebagai motivator atau stimulasi untuk berkelakuan baik, untuk mengurangi dampak negatif dari hukuman yang dijatuhkan. Abstract: This study will discuss the implementation of remission in Indonesia according to Presidential Decree No. 174/1999 on Remission, basically not apart from the basic principles of Islamic criminal law. The concept of Islamic criminal law stems from the benefit for prevention (ar-radu waz-zajru) education and teaching (al-Islah al-Tahzib). The purpose of Remission in Indonesia is as a motivator or stimulation to behave well, to reduce the negative impact of the punishment imposed.keywords: Remission, law, criminal, islam, prisoners.

Abstract

Joint property in marriage law in Indonesia comes from Indonesian tradition law which isthen used as the written law namely Undang-Undang No. 1 Tahun 1974 About Marriage and Compila-tion of Islamic Law with the aim to provide balanced position between husband and wife. The objectiveis in line with maqashid al shariah. But, the joint property that occur automatically in the written lawneeds to be reconstructed based on the ownership of Islamic law that the existence of joint property isin line with Islamic law.

Abstract

Zakat is charity of worship and included in the five pillars of Islam, because zakat is the foundation of Islam, in addition to an absolute obligation for a Muslim. It is also fully aware that the charity is a key instrument in growing the economy and improving the distribution tool. Then during the practice of Prophet Muhammad Saw in the compulsory zakat in times of Apostle in Medina, where nishab is set up, and stats is responsible in managing. This study explores how the concept of charity law as an instrument to improve the economy ummah, how positive law in Indonesia, which was formed to be able to institutionalize zakat order to function optimally, huge potential utilization of zakat can be achieved. The findings showed that generally, the presence of act No. 23 of 2011 on the management of zakat was instrumental in the development of the organization or institution of zakat in Indonesia, because the act provides legal certainty for the operational organization of zakat (OPZ), and increased public awareness in regular charity through zakat institution or organization zakat (OPZ). In addition, this act provides the foundation for the implementation of the concept of zakat productive.This law can be important instrument to achieve the goal of zakat as the remover of poverty, reduce unemployment and improve the ummahs economy.
