JURNAL HUKUM "DE'RECHTSSTAAT" adalah Jurnal Hukum yang diterbitkan oleh Program Studi Ilmu Hukum Fakultas Hukum Universitas Djuanda Bogor. Terbit pertama kali pada bulan Maret tahun 2015, dan terbit secara berkala 2 kali dalam satu tahun yaitu pada bulan Maret dan September, penggunaan nama "DE'RECHTSSTAAT" dalam jurnal ini disesuaikan dengan sistem kenegaraan bangsa Indonesia yang berasaskan sebagai negara hukum. "DE'RECHTSSTAAT" merupakan tinjauan/kajian berbagai aspek ilmu pengetahuan dibidang hukum yaitu berupa hasil karya ilmiah baik secara ius costitutum dan ius costituendum.

Abstract

The concept of the people’s economy developed by Mohammad Hatta is relevant to the principles of Islamic economics, as both emphasize public welfare, justice, social benefit, and the principle of family-based economic organization as fundamental foundations of economic life. This study aims to examine Mohammad Hatta’s thoughts on the people’s economy, particularly the factors underlying its development and the Islamic philosophical values embedded within it. This study employs historical and Islamic philosophical approaches. The historical approach is used to trace the development of Mohammad Hatta’s ideas on the people’s economy by examining his family background, education, Minangkabau traditions, religious life, and the influence of European intellectual traditions. Meanwhile, the Islamic philosophical approach is employed to analyze Islamic values related to welfare, justice, and public benefit based on the principles of Sharia. The findings indicate that, historically, Mohammad Hatta’s concept of the people’s economy was influenced by his family and educational background, Minangkabau traditions, religious values, and the development of European economic thought. From the perspective of Islamic philosophy, the people’s economy is consistent with the principles of welfare, justice, and public benefit oriented toward the interests of society as a whole. Therefore, Mohammad Hatta’s concept of the people’s economy has philosophical relevance to the principles of Islamic economics, particularly in establishing an economic system that promotes justice, public benefit, and the welfare of society.

Abstract

The crime of premeditated murder is a serious crime in the criminal law system regulated in Article 340 of the Criminal Code, with the element of “with premeditation” as the main differentiator from ordinary murder. This research examines the application of Article 340 of the Criminal Code in a murder case that occurred in Wonogiri in 2025, where the perpetrator allegedly killed his affair lover and made efforts to systematically disappear. The method used is normative juridical with statutory, conceptual, and case approaches, as well as descriptive-analytical qualitative analysis of primary, secondary, and tertiary legal materials. The results showed that proving the element of planning in Article 340 of the Criminal Code does not only refer to the intention of the perpetrator, but also to the existence of a time lag and a series of careful preparations, such as choosing a quiet place, removing traces by wrapping the body and casting the burial location. These actions indicate that the perpetrator had full control and awareness, so that this murder did not occur spontaneously or due to momentary emotional impulses. The complex motive of the affair strengthens the suspicion of a long-standing conflict that triggered the planning of the crime. Thus, the application of Article 340 of the Criminal Code against the perpetrators in this case is juridically and sociologically appropriate, providing a deterrent effect and maintaining the integrity of the criminal justice system in Indonesia. Proportional law enforcement against the crime of premeditated murder is important to uphold justice for victims and society.

Abstract

Legal reform is an urgent need in regulating the enforcement function of the Business Competition Supervision Commission (KPPU) related to monopolistic activities in Indonesia. This study aims to analyze existing problems in the law governing KPPU enforcement against monopolistic practices and formulate the necessary reform measures. This research method uses analysis of legislative approaches, literature studies and case studies in several cases that appear in several media. The results of the analysis show that the existing legal arrangements have not been fully able to overcome the monopoly problem effectively. Several obstacles such as limited sanctions, and limited authority of KPPU in the complicated enforcement process are the main obstacles in eradicating monopolistic practices. Therefore, the legal formation proposed in this study is to make significant changes to several aspects, namely increasing burdensome sanctions, and giving enforcement authority to the KPPU to simplifying enforcement procedures. In addition, there is a need for cooperation between KPPU, related institutions, and the private sector to ensure the effectiveness of enforcement. The implementation of information technology is also proposed to speed up the investigation and enforcement process. This legal reform is expected to increase the power of KPPU's authority in handling monopoly cases, protect consumer interests, and encourage healthy competition in the business world in Indonesia.
