Terbit pertama kali pada bulan Maret tahun 2015, dan terbit secara berkala 2 kali dalam satu tahun yaitu pada bulan Maret dan September, penggunaan nama "DE'RECHTSSTAAT" dalam jurnal ini disesuaikan dengan sistem kenegaraan bangsa Indonesia yang berasaskan sebagai negara hukum. Abstract

Industrial relations are a legal relationship between employers and workers/labourers or trade unions/labour unions. In industrial relations, rights disputes, conflict of interest, termination of employment, and trade/labour union disputes exist. This dispute usually occurs due to differences in views resulting in a dispute between the two. In its settlement, the Labor Office has a role in resolving industrial relations disputes, among other ways, through non-litigation or bipartite settlement (arbitration, conciliation, mediation). The related agency has made efforts to resolve this through mediation, which has several stages. The settlement process goal is an agreement between the two parties contained in a written recommendation issued by the mediator, namely a joint agreement (Perjanjian Bersama). If there is no agreement, the moderator will issue a written recommendation with full consideration, whose function is to continue carrying out the advanced settlement process at the Industrial Relations Court.

Abstract

It is not uncommon to hear about limited companies being declared bankrupt. The imposition of bankruptcy of a limited company is actually not the bankruptcy of the management, but the bankruptcy of the limited company itself, even though it arises which is usually caused by the negligence of the managers in the limited company. The purpose of this study is to determine the legal consequences of the bankruptcy of a limited company. The research method used in this writing is normative juridical which explains that the creditor can demand the dissolution of the limited company if there has been a reading of a bankruptcy order, only because the limited company is unable to pay its debts or the company's assets after being declared bankrupt. The results of the study indicate that the directors can be held liable civilly and criminally for the bankruptcy of a limited company. Civil liability can be in the form of joint and several liability for the losses of a limited company if the bankruptcy is caused by the negligence and negligence of the directors and the company's assets are insufficient to cover the losses arising from the bankruptcy. Criminal liability in the form of imprisonment, in addition to other obligations in the form of confiscation according to bankruptcy law, while the consequences of bankruptcy of a limited liability company are the termination of the company's business activities by creditors and guardians, or by the district court in the form of dissolution by request of creditors on the grounds that the company has failed to pay its debts after being declared bankrupt or the company's assets are insufficient to pay all its debts after the bankruptcy statement is revoked.

Abstract

Along with the dynamics of the global and domestic economy, the challenges faced by the monetary system are increasingly complex. The financial crisis, technological changes in payment systems, and developments in the global market have had a significant impact on the way money and banks operate. For example, the emergence of digital currencies and fintech has changed the traditional financial landscape, creating new opportunities and risks. This study aims to understand the relationship between money, banks, and monetary policy in the context of the Indonesian and Islamic economies. The methods used are the approach of revelation, the opinions of scholars, and fatwas as well as the results of other relevant research. The results of the study show that monetary policy is a policy made by Bank Indonesia in order to control the circulation of money so that it remains stable and aims to maintain the stability of the rupiah; maintain the stability of the payment system, and help maintain the stability of the financial system to support sustainable economic growth. The Prophet Muhammad SAW used two currencies, dinar (gold) and dirham (silver). The Prophet Muhammad established the dinar and dirham currencies as the monetary standards at that time. Where both types of currencies were adopted from Rome and Persia.

Abstract

This research is motivated by human rights issues that often occur in carrying out work to meet economic needs. However, this is regulated in the Job Creation Law which was passed in 2020 considering the protection of Human Rights (HAM) for workers. This study aims to determine and analyze the Protection of Human Rights for Workers in the Job Creation Law from an Islamic Law Perspective. The research methodology used is literature research (library research) involving analysis of primary and secondary legal materials. The results of the study show that although the Job Creation Law includes elements of protection such as PKWT compensation and social security, its implementation still faces several problems, such as limited supervision and bias towards employers. The Islamic law perspective emphasizes fair treatment and justice for workers, which can be used as a reference to improve the protection of human rights in employment. Strict supervision and strengthening of regulations in line with the principles of social justice and human rights must be used to improve the protection of workers' rights.

Abstract

Legal protection for home buyers is very important when developers default, one of which is by guaranteeing the house certificate that has been purchased to a third party, such as banks or other financial institutions. This practice is detrimental to buyers because it can cause the house certificate that should be the buyer's right to become collateral for the developer's debt. As a result, buyers risk losing the rights to the house they have purchased if the developer fails to pay off their debts. According to Consumer Protection Law No. 8 of 1999, these practices run counter to the idea of good faith in the agreement and infringe upon the rights of consumers. Buyers who suffer losses due to the developer's failure have the right to demand that their rights be fulfilled, that they be compensated, or that the agreement be cancelled, according to the Civil Code (KUHPer), particularly Articles 1320 and 1267. The goal of the guarantee cannot disregard the rights of other parties, such as homebuyers, as stated in Law No. 4 of 1996, which deals with Dependent Rights. Strict government oversight and openness in property purchasing and selling activities are necessary for more effective legal protection. Furthermore, in order to prevent any losses caused by developer default, purchasers are urged to exercise greater caution in verifying the certificate's legitimacy before to finalizing a deal.

Abstract

The communication media used by the Mobile Brigade Corps (Satbrimob) must be appropriate for operational purposes. There must be no misuse of communication devices, as communication facilities are still lacking.The purpose of this research is: To determine and analyze the accountability of Brimob members in the Mobile Brigade Corps (Satbrimob) Communications Division. To determine and analyze the obstacles faced by Brimob members assigned to the Communications Division within the Mobile Brigade Corps (Satbrimob). A research method is needed to gather research materials. The research method used is a normative juridical research method, where law is conceptualized as norms, rules, principles, or dogmas. Research findings: In carrying out police operations, Brimob acts as a backup unit for regional units, providing support, command, and control within the regional unit as the user. In police activities, Brimob personnel are directed towards routine activities in preparation and improving their capabilities in handling jihad, riots, search and rescue, and counter-terrorism. Meanwhile, police operations are carried out in the form of regional operational patterns, namely participating in police operations against forms of public order disturbances that disturb the community, especially local contingencies in the region and centralized regional operations, especially against threats on a national and international scale.

Abstract

This summary examines the crucial role of the principle of "freedom of contract" in international trade, which is an integral part of the global economy. This principle provides businesses with the freedom to negotiate contract terms, fostering fair and efficient agreements. However, its implementation faces challenges such as cultural differences and legal systems that can impact contract integrity. This study aims to determine the crucial role of the principle of "freedom of contract" in international trade. This study uses a normative approach. The results show that the principle of freedom of contract plays a crucial role in building business bridges in the international market. By providing flexibility in negotiations, increasing trust between parties, and providing an efficient dispute resolution mechanism, freedom of contract enables businesses to adapt to the dynamics of the global market. Despite these challenges, a sound understanding of applicable law and an awareness of the risks can help businesses leverage this principle to achieve success in international trade. Thus, freedom of contract is not merely a legal principle but also a strategic tool that can connect various business entities worldwide.

Abstract

Deviant sexual behavior by LGBT (Lesbian, Gay, Bisexual, and Transgender) groups, which initially developed in Western countries, has also emerged in Indonesia in recent years. This phenomenon raises legal, moral, and religious concerns in a society that upholds Pancasila values. This study uses a normative juridical approach by analyzing laws, literature, journals, and online sources to examine the legal framework related to LGBT issues in Indonesia. The study finds that while human rights are recognized in the Indonesian Constitution, they are limited by morality, religion, and public order. The existence of LGBT is considered contrary to these values. Same-sex marriage is not justified under Indonesian law, which defines marriage as a union between a man and a woman. LGBT behavior is viewed as a deviant act that must be addressed by the state to protect societal values and legal norms. The government is encouraged to implement treatment and rehabilitation policies rather than recognition or legalization of LGBT practices, in order to maintain national identity rooted in moral and religious values.

Abstract

Bukittinggi as a tourist city is inseparable from a social phenomenon, one of the phenomena is LGBT, according to the philosophy of "Adat basandi syarak, syarak basandi kitabullah" states that LGBT does not exist in culture, custom and religion. This research aims to find out how the role of Satpol PP and identify obstacles in handling LGBT cases in Bukittinggi City. The formulation of this problem aims to examine the functions of Satpol PP and the challenges faced by Satpol PP related to LGBT cases in Bukittinggi City. Descriptive in nature, this research falls into the category of empirical legal research. Based on the results of the research, Satpol PP uses preventive and repressive measures when dealing with LGBT. Preventive efforts are in the form of socialization about the dangers and impacts of LGBT, repressive efforts by way of after a report or caught red-handed, arrest by URC, making an incident report, incident reports and evidence are submitted and registered to the PPUD field to the PPNS section, examination, making BAP and given sanctions. The obstacles faced in LGBT prevention are the lack of public knowledge about LGBT and the lack of public participation by not reporting LGBT, repressively are the perpetrators who are less cooperative, the difficulty of distinguishing perpetrators from normal people, the absence of laws on LGBT and the absence of rehabilitation centers for LGBT.

Abstract

Adopsi anak merupakan praktik hukum yang telah lama ada di Indonesia, yang dilakukan dengan tujuan memberikan perlindungan dan kesejahteraan kepada anak yang tidak dapat diasuh oleh orang tua kandungnya. Namun, praktik ini juga berpotensi disalahgunakan untuk tujuan ilegal, seperti perdagangan anak. Sehingga di perlukan pengawasan dalam pelaksanaan adopsi baik selama proses maupun setelah adopsi. Pengawasan setelah adopsi sebagai langkah preventif terhadap tindak pidana perdagangan anak, dengan fokus pada implementasi regulasi yang berlaku di Indonesia, terutama berdasarkan Peraturan Menteri Nomor 3 Tahun 2018 tentang Bimbingan Pengawasan dan Pelaporan Pelaksanaan Pengangkatan Anak. Penelitian  ini merupakan penelitian normatif yang bersifat deskriptif analitis, dengan pendekatan perundang-undangan, kasus, dan konseptual. Peraturan Menteri Sosial Nomor 3 Tahun 2018 tentang Bimbingan Pengawasan dan Pelaporan Pelaksanaan Pengangkatan Anak kurang efektif dalam pengawasan setelah adopsi karena kekosongan hukum pada Pasal 15 terhadap pengawasan setelah adopsi bagi adopsi yang dilakukan oleh warga negara Indonesia. Kemudian, dalam kasus perkara Nomor 30/Pid.Sus/2023/PN Cbi, terlihat bahwa adopsi menjadi salah satu cara terjadinya tindak pidana perdagangan anak. Perkara ini menyoroti bahwa perlu dilakukan pengawasan dalam pelaksanaan adopsi maupun setelah.
