Terbit pertama kali pada bulan Maret tahun 2015, dan terbit secara berkala 2 kali dalam satu tahun yaitu pada bulan Maret dan September, penggunaan nama "DE'RECHTSSTAAT" dalam jurnal ini disesuaikan dengan sistem kenegaraan bangsa Indonesia yang berasaskan sebagai negara hukum. Abstract

The principle of ijbari in Islamic inheritance law reflects the obligatory nature of the distribution of inheritance, which is determined directly by the decree of Allah SWT as stated in the Qur'an and Hadith. This principle ensures that inheritance rights are granted automatically and cannot be changed by anyone, this is to maintain justice and avoid disputes between heirs. The ijbari principle also emphasizes that inheritance law is absolute and must be implemented in accordance with sharia guidelines. This study aims to analyze the application of the ijbari principle in Islamic inheritance law by reviewing its legal basis, distribution mechanism, and role in maintaining family harmony and social justice. This research also seeks to clarify how this principle functions in sharia, while highlighting its significance in achieving justice and equality in the distribution of inheritance. This study uses a normative juridical research method, with a legal approach, laws and regulations and other sources used as data sources related to research that provide an understanding of how the ijbari principle  is applied in practice. This research shows that the ijbari principle plays an important role in ensuring the automatic and fair distribution of inheritance rights, which is the key to maintaining justice and preventing conflicts. The study also highlights that this principle not only protects the rights of heirs, but also reinforces Islam's core values of equality and justice.

Abstract

Legal issues related to trademark rights in Indonesia cannot be separated from the role of globalization, where the advancement of information technology encourages various industries to think creatively in creating trademarks. In the manufacturing industry itself, problems of trademark plagiarism often arise, which are contrary to intellectual property law. Indonesia adopts the principle of first to file to protect trading rights. This study aims to analyze the application of the first to file principle in Indonesian law, with a focus on the manufacturing industry and the role of technology in resolving trademark disputes. The method used is normative juridical with a literature and historical approach to explore relevant data and legal norms. This research explores trademark protection, the use of the first to file principle, and manufacturing industry products. In this era of globalization, the challenges and alignment of technology’s role in fostering creativity and protecting intellectual property rights become the main focus of this analysis.

Abstract

The death penalty in the Indonesian Criminal Code is found in Law Number 1 of 1946 (KUHP 1946) and Law Number 1 of 2023 (KUHP 2023). In the 1946 Criminal Code, the legalization of the death penalty is maintained in Article 10 and is positioned as a principal crime, this is different from the 2023 Criminal Code which includes the death penalty in Article 67, then changes the death penalty to a special crime, whereas in Malaysia the legalization of the death penalty is threatened The death penalty in Law 574 is formulated in 2 forms of punishment patterns, namely a single one that places the death penalty as mandatory and alternative. However, in 2023 Malaysia will change the mandatory nature of the death penalty in its state regulations, which are outlined in the Death Penalty Deed 2023 Act 846. In this research the author uses a normative juridical approach, namely a statutory approach; by analyzing the rules and regulations relating to these legal issues. The results of this research are: There are several motives that are most popular in the reasons for using the death penalty in Indonesia, namely that the death penalty has a higher level of effectiveness, has a frightening effect (shock therapy), and is also considered more economical and is used so that no action occurs. the main judge himself (eigenrichting) in society as well and the implementation of the Mandatory Death Law in Malaysia from the perspective of the Common Law System is the same as the hudud law in terms of the same type of jinayah punishment for the convicted perpetrator but is contrary to the hudud punishment in terms of making forgiveness and apology to the Yang diPertuan Agong for violations of hudud, seduction can be carried out if there is ambiguity in the case only.

Abstract

The purpose of this research is to analyze the position of the authentic deed in the evidence in the trial of civil cases and to find out and analyze the legal force of the sale and purchase deed before the official who made the land deed made based on the power of attorney stated in the deed of the notary sale and purchase binding agreement. This research method uses a normative juridical approach that emphasizes literature studies with the addition of literature, namely decision studies to strengthen the analysis and produce accurate conclusions. The results of the study show that first, the power of attorney listed in the PPJB deed is a unit that is not separate from the PPJB deed as an authentic deed and becomes full proof for judges in civil trials. Second, that the AJB made before PPAT based on the power of attorney stated in the PPJB Notarial deed has perfect legal force and is legally binding and the power of attorney listed in the notary deed is valid as authentic evidence.

Abstract

Before the enactment of Law Number 33 of 2024 concerning Halal Product Assurance (Halal Product Assurance Law/HPAL), various regulations governing halal requirements had already been in force. However, those regulations were still partial and not integrated into a comprehensive system capable of providing legal certainty. Therefore, it is important to examine the background of the establishment of the HPAL in order to fully understand the legislative process behind it. Through a normative juridical study with a historical approach, the foundation for the formation of the HPAL can be described. The findings indicate that the enactment of the HPAL provides legal certainty and protection for Muslims in Indonesia in using and consuming products in accordance with Islamic law, namely those that are permissible (halal) and avoiding those that are prohibited (haram). This law also serves as a significant milestone in raising public and business awareness regarding the importance of halal certification as both a guarantee of quality and a reflection of Islamic identity. Furthermore, the presence of the HPAL is expected to harmonize regulations among the government, certification bodies, and business actors. Thus, the implementation of halal regulations can proceed more effectively, systematically, and consistently. Ultimately, the HPAL not only functions as a legal instrument but also as a means of protecting the rights of Muslim consumers while strengthening the competitiveness of Indonesian halal products in the global market.

Abstract

This article explores the critical role of customs harmonization in advancing regional economic integration within the ASEAN framework. Despite significant progress in tariff liberalization, ASEAN continues to face operational and legal fragmentation in customs administration, which undermines intra-regional trade and supply chain efficiency. Through a normative comparative analysis with other regional blocs, such as the European Union, MERCOSUR, and SACU, this study identifies structural gaps, institutional asymmetries, and policy inconsistencies that hinder effective integration. It proposes a multi-dimensional strategy involving modernization, regulatory reform, cross-border cooperation, and legal alignment with international standards such as the Revised Kyoto Convention and WTO Trade Facilitation Agreement. The study emphasizes that harmonized customs procedures reduce transaction costs, improve clearance times, and foster mutual trust and institutional cohesion among member states. It concludes that achieving a fully integrated customs environment is fundamental for ASEAN to transition from a free trade area to a customs union and to ensure the long-term resilience of the ASEAN Economic Community.

Abstract

The purpose of this research is to find out the factors that cause children to commit the crime of murder and to find out and analyse, the judge's consideration in imposing a verdict on children as perpetrators of the crime of murder in Case No. 3/Pid.Sus-Anak/2022/PN Smr. The method used in this research is normative legal research method. This method includes research on library materials that are studied using a statutory approach and a case approach. The legal materials used include primary, secondary and tertiary legal materials. The results showed that the factors that cause children to commit the crime of murder include internal factors such as the psychiatric, biological, and moral conditions of children, as well as external factors including the socio-cultural environment, economy, and easy access to adult content through mass media. The judge's consideration in deciding case number 3/Pid.Sus-Child/2022/PN Smr by applying article 338 of the Criminal Code on murder was not appropriate, the judge should have applied article 340 of the Criminal Code on premeditated murder in trying and deciding case number 3/Pid.Sus-Child/2022/PN Smr.

Abstract

Traffic accidents (traffic accidents) are one of the problems in the city of Bukittinggi. Resolving cases through litigation is often considered less effective in restoring justice, social harmony and the rights of victims. The Restorative justice approach offers an alternative resolution to traffic accidents that focuses on restoring the relationship between the victim and the perpetrator. This research aims to determine the process of resolving traffic accident cases using a Restorative justice approach along with the obstacles that exist at the Bukittinggi Police.The results of the research show that the Restorative justice approach at the Bukittinggi Police has succeeded in resolving several traffic accident cases by reaching an agreement between the victim and the perpetrator. However, there are also several obstacles that underlie the failure of Restorative justice, such as the lack of evidence due to inadequate facilities at the crime scene and the imbalance in the nominal amount of compensation that the perpetrator cannot afford, the reluctance of the parties to resolve the case and also the lack of public awareness to provide testimony to shed light on the investigation process.

Abstract

Corporate Social Responsibility is governed by Government Regulation No. 47 of 2012, which pertains to the social and environmental responsibilities of Limited Liability Companies. PT. Bakrie Sumatera Plantations persists in executing its Corporate Social Responsibility program to the present day. This study seeks to assess the efficacy and efficiency of the Corporate Social Responsibility program established for the benefit of the Bunut Village community. This study employs a form of empirical legal research known as sociological legal research or field research. The research findings indicate that PT. Bakrie Sumatera Plantations has executed multiple Corporate Social Responsibility initiatives throughout Education, Religion, Economy, Youth, Infrastructure, and Disaster Response sectors. The established programs have been operating efficiently in compliance with Government Regulation No. 47 of 2012 and have positively influenced community welfare. Consequently, this has led the people to rely on the Company, diminishing their independence. This is due to the Company's failure to communicate and promote the Corporate Social Responsibility program to the local Community. Consequently, the community lacks comprehension of the concept, execution, and aims of Corporate Social Responsibility.

Abstract

The rapid development of technology in the era of the Industrial Revolution 4.0 has led to the emergence of Artificial Intelligence (AI), which offers various benefits in facilitating human activities. However, the misuse of AI technology has also created new legal challenges, particularly in the form of cybercrime. One emerging form of cybercrime is the use of deepfake technology to manipulate voices, faces, and personal data for pornographic purposes. This phenomenon has significantly contributed to the rise of online gender-based violence (GBV), in which women constitute the majority of victims. Such crimes pose serious challenges for governments and law enforcement agencies in providing adequate legal protection for victims. Considering that law must be dynamic and responsive to technological developments, it is necessary to strengthen legal frameworks addressing these issues. This study employs a normative juridical method using a statutory approach by examining relevant laws and regulations related to the legal issues under study. The findings indicate that the government is obliged to provide preventive legal protection through public education and the formulation of specific regulations governing Artificial Intelligence more comprehensively. In addition, repressive legal protection must be ensured through effective law enforcement, victim-oriented judicial processes, and strict punishment for perpetrators. Furthermore, victims should receive adequate rehabilitation and restitution due to the psychological, emotional, and social harms caused by such crimes.
