Abstract

Teachers are one of the key elements in the implementation of national education who have an important role in shaping the character, morals, and intelligence of students. in accordance with the provisions of Law Number 14 of 2005 concerning Teachers and Lecturers, which emphasizes that teachers have the right to receive protection when carrying out their professional duties, including legal protection, professional protection, and protection of occupational safety and health. This study uses a normative legal research method, by implementing a legislative approach and a conceptual approach. There is a fairly clear legal basis for protecting teachers as victims of violence in carrying out professional duties in schools. Law Number 14 of 2005 concerning Teachers and Lecturers guarantees legal protection, professional protection, and occupational safety and health for teachers when carrying out their duties. In addition, Law Number 20 of 2003 concerning the National Education System emphasizes the importance of organizing education in a safe and conducive atmosphere.

Abstract

This study examines the legal protection available to victims of sexual violence within educational institutions, viewed through a victimological perspective in the implementation of Law No. 12 of 2022 on Sexual Violence Crimes (UU TPKS). Sexual violence in educational environments remains a serious issue, with cases like “H.W” tragedy highlighting the inadequacy of institutions in providing safe spaces for students. Victims often suffer from psychological trauma, social stigma, and barriers to justice. This research employs a normative legal approach with qualitative methods to analyze the law’s application. Findings show that UU TPKS includes victimological principles, such as compensation, assistance, and rehabilitation for victims. However, its implementation faces structural and cultural challenges, such as power imbalances and victim-blaming. Effective protection requires institutional commitment, cultural transformation, and active engagement from the academic community to establish comprehensive and sustainable systems of support for victims

Abstract

Recognition of indigenous belief adherents in Indonesia is an essential part of the state’s efforts to ensure the fulfillment of citizens’ constitutional rights. For decades, followers of local beliefs have faced administrative barriers because the population administration system only accommodated officially recognized religions. This condition has resulted in various forms of discrimination in accessing public services, such as marriage registration, education, and other social services. This study employs a normative legal research method with statutory and conceptual approaches, using qualitative analysis of primary, secondary, and tertiary legal materials. The discussion shows that Constitutional Court Decision No. 97/PUU-XIV/2016 marked a significant turning point in transforming the paradigm of Population Administration Law by recognizing the identity of belief adherents in official state documents, such as electronic identity cards (KTP-el) and Family Cards. The decision has encouraged more inclusive population administration policies through identity inclusion and data integration in the Population Administration Information System (SIAK), providing legal certainty for belief adherents in accessing public services. However, in practice, administrative and social constraints still exist, including limited bureaucratic capacity and societal stigma toward belief adherents

Abstract

This study discusses legal protection for victims of sexual violence in higher education based on National Criminal Law and Islamic Law. In the National Criminal Law, victim protection is regulated in detail in Permendikbudristek Number 30 of 2021, specifically Articles 10 to 19, which regulate assistance, protection, victim recovery, and the imposition of administrative sanctions. Criminal sanctions for perpetrators are also regulated in Articles 289 to 296 of the Criminal Code. From the perspective of Islamic Law, victim protection is based on the principle of justice and respect for human dignity by applying hudud and ta'zir laws according to the level of the perpetrator's guilt, although it has not been specifically regulated in national legislation. The synergy between the provisions of Islamic Law and National Criminal Law is expected to provide comprehensive protection and encourage effective and just law enforcement for victims of sexual violence in higher education environments.

Abstract

Banking institutions function as financial intermediaries that channel funds from surplus units to deficit units, and their existence is highly dependent on the principle of trust.One of the most serious challenges faced by banks is the embezzlementofcustomerfundsby internal actors, sometimes using forged documents. This issue is exemplified in Decision No. 107/Pid.B/2022/PN.Pin, which highlights weaknesses in internal banking supervision, causing significant customer losses and undermining the stability of the national financial system. Normatively, embezzlement is regulated under Articles 372 and 374 of the Indonesian Penal Code (KUHP) and specifically addressed in Article 49 paragraph (1) of Law No. 10 of1998on Banking, which imposes criminal sanctions on bank officials or employees who abuse their authority.

Abstract

Indonesia, as a state based on the rule of law (rechtsstaat), places the supremacy of law and the protection of human rights (HAM) as fundamental pillars in governance and law enforcement. However, in practice, serious violations that undermine these principles still frequently occur, including incidents of error in persona or wrongful arrest accompanied by acts of violence perpetrated by law enforcement officers. The wrongful arrest of a snail collector in Grobogan Regency serves as a concrete example of abuse of power by investigators, which contravenes the principles of due process of law and human rights.This study aims to analyze the criminal liability of investigators who commit wrongful arrest (error in persona) accompanied by violence and to elaborate on the legal remedies available for restoring the rights of victims, using the Wrongful Arrest of a Snail Collector in Grobogan as the case study. The research employs a normative legal method with a legal principles approach, examining statutory regulations (KUHAP, KUHP) and relevant doctrines concerning criminal liability, abuse of authority, and human rights protections.

Abstract

Sengketa merek dagang antara MS Glow dan PS Glow merupakan contoh konkret dari ketegangan antara prinsip kepastian hukum dan prinsip keadilan dalam penerapan prinsip pendaftaran pertama. Studi ini bertujuan untuk menganalisis keseimbangan antara prinsip kepastian hukum dan prinsip keadilan dalam penerapan prinsip pendaftaran pertama serta bentuk perlindungan hukum yang diberikan dalam sengketa merek dagang. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan legislatif dan kasus, khususnya dengan menganalisis Putusan Pengadilan Niaga dan Putusan Mahkamah Agung. Hasil penelitian menunjukkan bahwa penerapan prinsip pendaftaran pertama tidak dapat hanya didasarkan pada formalitas pendaftaran, tetapi juga harus mempertimbangkan unsur itikad baik, penggunaan merek dagang yang sebenarnya, dan rasa keadilan untuk mencapai perlindungan hukum yang adil bagi para pihak.

Abstract

This study analyzes the legal implications of Indonesia’s failure to fulfill its obligations in addressing the Rohingya refugee crisis, viewed from both international and national legal perspectives. Although Indonesia has not ratified the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol, the state nonetheless bears legal and moral responsibilities to protect refugees based on the principle of non-refoulement, recognized as a jus cogens norm universally binding on all nations. Using a normative juridical method with statutory and conceptual approaches, this research finds that Indonesia’s current refugee management—regulated under Presidential Regulation No. 125 of 2016—remains largely administrative and fails to address the substantive fulfillment of refugees’ basic rights. Such inadequacy creates legal implications at both levels: internationally, it may constitute an internationally wrongful act under the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA) 2001; and domestically, it reveals inconsistencies between constitutional human rights principles and their implementation. Therefore, the study emphasizes the urgency of enacting a comprehensive Refugee Law to strengthen human rights protection and ensure Indonesia’s compliance with international humanitarian standards.

Abstract

Contemporary criminal law increasingly operates beyond formal adjudication and enters the public sphere through media exposure and communicative practices. As criminal cases are framed and circulated through public narratives, criminalisation functions not only as a legal process but also as a mechanism of social meaning-making with regulatory consequences for behaviour and expression. This study aims to reconceptualise media-driven criminalisation as a form of communication policy that produces informal and reputational punishment outside judicial control. Employing a qualitative doctrinal–normative approach with conceptual and analytical orientation, the research examines criminalisation as a communicative legal construct and analyses its regulatory effects on freedom of expression through publicity, narrative framing, and reputational harm. The study finds that criminal law increasingly governs through symbolic and anticipatory mechanisms rather than through formal sanctions alone. Media exposure operates as an informal punitive process that shapes public judgment, normalises stigma, and induces anticipatory self-censorship, thereby generating systemic chilling effects on expressive freedom. These effects emerge even in the absence of judicial decisions and remain largely unaddressed by legal doctrines centred on direct state coercion. The originality of this research lies in its integration of criminal law, communication governance, and freedom of expression by positioning reputational harm and chilling effects as constitutive dimensions of criminalisation itself. The study contributes theoretically by extending the concept of punishment beyond coercive sanctions, and practically by highlighting the regulatory risks posed by media-driven criminalisation for procedural legitimacy, democratic participation, and expressive freedom.
