Abstract

Performance appraisal of civil servants as stipulated in article 77 number (6) of Law Number 5 of 2014 concerning State Civil Apparatus, this article states that a civil servant whose performance evaluation is not in accordance with the established targets is subject to sanctions in the form of administrative sanctions until dismissal. Basically, the performance of civil servants is the result and assessment of work carried out by civil servants in quality and quantity that has been achieved by a civil servant in carrying out the duties, authorities, obligations and responsibilities that have been given. This changes the paradigm that has been formed so far that being a civil servant is impossible to be dismissed, and a civil servant is not an office employee who is assessed based on performance appraisal, from that background we formulate the issue What is the legis ratio of dismissal of civil servants based on performance appraisal in PP Number 30 of 2019 concerning work evaluation? and What are the legal implications of the dismissal of civil servants based on performance appraisal in PP Number 30 of 2019 concerning Performance Appraisal.

Abstract

Abstrak Konstitusi merupakan pijakan dasar atau norma yuridis fundamental yang mengatur kehidupan berbangsa dan bernegara dalam kondisi apapun, termasuk saat menghadapi pandemi Covid-19. Urgensinya konstitusi ini akan bisa dirasakan oleh setiap warga negara melalui proses pendidikan (pembelajaran).  Mengingat kondisi masyarakat yang terkena pandemi Covid-19 ini sangat pluralistik, sementara setiap warga negara secara konstitusionalitas mempunyai hak atas kebinekaan, maka setiap pihak, khususnya kalangan penyelenggara pendidikan untuk melakukan masifikasi pendidikan konstitusi, yang model ini diidealisasikan dapat menegakkan keadilan sosial dan mencegah disparitas dan radikalitas  di tengah  masyarakat.Kata kunci: masifikasi, pendidikan, konstitusi, proteksi, hak, kebinekaan Abstract The constitution is the basic foundation or fundamental juridical norms governing the life of the nation and state in any condition, including when facing the Covid-19 pandemic. The urgency of this constitution will be felt by every citizen through the process of Education (learning). Considering that the condition of the people affected by the Covid-19 pandemic is very pluralistic, while every citizen constitutionality has the right to diversity, then each party, especially the education providers to carry out the constitutional education masification, which this model is idealized can uphold social justice and prevent disparity and radicality in the community. Abstract

Article 1 paragraph 3 Indonesian Constitution 1945 said, “Indonesia is a state of law”, but current regulatory conditions often occur disharmony and overlap between regulations. The concept of “omnibus law” becomes one of the breakthroughs to reorganize regulations which currently reaches 43.233 regulations from central to regional level. This article is a normative legal research and doctrinal reseacrh based on primary legal material (positive legal legislation and judge’s decision) and secondary (doctrines from books, research results). Based on research, the authors concluded that the concept of “omnibus law” is an excellent plan as “Main Facility of Regulatory Arrangement”, in order to minimize disharmony and overlapping regulations based on the UU No. 12/2011. Therefore, the drafting of the omnibus law concept of shall not be done in a hurry, so that later it won’t be overlapped and disharmony. Also, society participation is needed so it won’t cause contradiction in the future. Pasal 1 ayat (3) UUD NRI 1945 berbunyi, “Negara Indonesia adalah negara hukum”, namun saat ini kondisi regulasi peraturan yang banyak terjadi disharmoni dan tumpang tindih antar peraturan. Konsep “omnibus law” menjadi salah satu terobosan untuk menata kembali regulasi yang saat ini mencapai 43.233 peraturan perundang-undangan dari tingkat pusat hingga daerah. Penelitian ini merupakan penelitian hukum normatif, yaitu penelitian doktrinal berdasarkan bahan hukum primer (hukum positif dan putusan hakim) dan sekunder (doktrin dalam buku-buku, hasil penelitian). Berdasarkan hasil penelitian, peneliti berkesimpulan bahwa konsep “omnibus law“ merupakan rencana yang baik sebagai “Sarana Utama Penataan Regulasi”, agar meminimalisir terjadinya disharmoni dan tumpang tindih peraturan perundang-undangan sesuai UU No. 12 Tahun 2011. Kemudian, penyusunan konsep “omnibus law” sebaiknya tidak dilakukan secara terburu-buru agar nantinya kekuatan undang-undang yang dibuat tidak kembali tumpang tindih dan disharmoni, serta tetap melibatkan partisipasi masyarakat sehingga tidak menimbulkan pertentangan di masa mendatang.

Abstract

The existence of indigenous peoples has been recognized and respected by the Constitution. The Wetu Telu indigenous people have traditions from their ancestors with Islamic nuances and their existence is recognized until now. Besides, the local government's strategy to develop the tourism sector to improve the economy and regional development which is designed in regional regulations can affect the existence of Indigenous people. The purpose of this research is to know the changes in the existence of the Wetu Telu community customary law and to know the implementation of Regional Regulations in the tourism sector in Bayan village, North Lombok Regency, West Nusa Tenggara. This research uses juridical empirical or socio-legal research, which is a type of sociological legal research or field research that examines applicable legal provisions. Cultural preservation and tourism development need a Regional Regulation on the Recognition and Protection of Indigenous Peoples to protect normatively and with legal certainty and harmonize Regional Regulations between tourism development and recognition of indigenous peoples.

Abstract

ABSTRACT       A funeral is a community need which is also the responsibility of the government because it considers Article 34 paragraph (3) of the 1945 Republic of Indonesia Constitution. . Researchers will use certain legal protection theories as a basis for analyzing them. The research method is normative juridical. This study uses 4 kinds of approaches, namely the statutory approach, the conceptual approach, and the case approach. This research is a descriptive analysis, descriptive means an attempt to express the symptoms in full in the aspects being investigated to make it clear the conditions and conditions. In the current situation of the COVID 19 pandemic, the family/heirs of the corpses of positive patients of COVID 19 who was denied his funeral could file a lawsuit in court with the demands of PMH (submit Onrechmatige Daad) and request for restitution in the Court that could detail the Immune losses suffered by the victim.Keywords: Funeral Rejection, Covid's Body 19.ABSTRAKPemakaman merupakan kebutuhan masyarakat yang juga menjadi tanggung jawab pemerintah, karena menimbang Pasal 34 ayat (3) Undang-Undang Dasar Negara RI Tahun 1945. Untuk menjamin terselenggaranya pelayanan umum dan pelayanan kesehatan maka disediakan pengadaan tempat (tanah) yang menjamin untuk pelaksanaan kepentingan umum tersebut. Peneliti akan mempergunakan teori perlindungan hukum tertentu sebagai landasan untuk menganalisanya. Metode penelitian bersifat yuridis normatif. Penelitian ini menggunakan 4 macam pendekatan, yakni pendekatan perundang-undangan (statute approach), pendekatan konseptual (conseptual approach), dan pendekatan kasus (case approach). Penelitian ini bersifat deskriptif analisis, deskriptif berarti usaha mengemukakan gejala-gejala secara lengkap di dalam aspek yang diselidiki agar jelas keadaan dan kondisinya. Dalam situasi pandemi Covid 19 sekarang keluarga/ahli waris dari jenazah pasien positif Covid 19 yang ditolak pemakamannya dapat mengajukan gugatan di Pengadilan dengan tuntutan PMH (Onrechmatige Daad) dan pengajuan permohonan restitusi di Pengadilan yang bisa merinci kerugian Immateriil yang dialami korban.Kata Kunci : Penolakan Pemakaman, Jenazah Covid 19.

Abstract

Pandemi corona berdampak terhadap hampir seluruh bidang termasuk ketenagakerjaan. kesulitan keuangan yang dihadapi perusahaan berimplikasi terhadap munculnya tindakan  pemutusan hubungan kerja (PHK) sebagai alasan efisiensi maupun alasan force majure. Tulisan ini menyajikan dua masalah pokok. Pertama, apakah pandemi corona dapat dijadikan sebagai alasan pemutusan hubungan kerja pekerja oleh perusahaan? kedua, bagaimana perlindungan hak pekerja yang diputus hubungan kerjannya oleh perusahaan menurut UU Ketenagakerjaan? Melalui kajian secara yuridis normatif, diperoleh penjelasan bahwa pengusaha dapat menggunakan pandemi corona sebagai alasan force majeure untuk melakukan PHK karena: berpengaruh terhadap keuangan dan kewajiban perusahaan kepada pekerja;  merupakan peristiwa yang sifatnya tidak terduga; serta corona sebagai bencana nonalam berskala nasional.  Selain alasan force majeure, efisiensi juga menjadi alasan untuk melakukan PHK. PHK karena alasan force majeure melahirkan hak bagi pekerja sesuai ketentuan Pasal 164 ayat (1), sedangkan bila PHK karena alasan efisiensi, maka hak pekerja sesuai ketentua Pasal 164 ayat (3) UU Ketenagakerjaan.Kata kunci: pandemi corona, pemutusan hubungan kerja, force majeure, efisiensi

Abstract

The growth of science and technology continues to accelerate enormously, technology advances not just years, months or days but hours, even minutes, primarily relating to information and communication based on online media and communication. The effects of the development of science and technology are widespread in many areas of life. In the development of technology, there are both negative and positive effects. The country's development goal, or the public ministry, has been referred to in the opening of the national development act to protect the entire nation and the whole of Indonesia, promote public welfare, clean up its life and contribute to world peace. The number 20 years of 2003, section 1 of the national education system states that education is a conscious and planned effort to bring about the learning and learning environment in order to enable learners to actively develop their own potential, but thus in the universe was jolted by the covid-19 pandemic. The ministry of education and culture of the republic of Indonesia has issued a 2020 bill number 4 on implementing education policies in emergency deployment of coronavirus disease (covid-19) at the second point in the home-learning process. The role of parents is crucial in the development of learners,  the community / parents participate in accompanying and supporting all efforts in the field of education. This pandemic is an important factor in the sustainability of the online learning process. Education is a process to increase dignity by having the potential of self, intelligence and interest in talents in accordance with the ability of learners. Students also have a positive impact on the development of developed nations, education needs to anticipate global competition in the field of science and technology

Abstract

The National Strategy on Corruption Prevention is a national policy direction that contains the direction of focus and targets for corruption prevention which are used as a reference for ministries, agencies, local governments and other stakeholders in implementing corruption prevention actions in Indonesia. The focus of the The National Strategy on Corruption Prevention includes licensing and commerce, state finances, and law enforcement. One of the challenges in the The National Strategy on Corruption Prevention is the lack of community involvement in these 3 focuses. Limited community involvement in these 3 (three) focuses is the background of the importance of strengthening participation of society in the implementation of The National Strategy on Corruption Prevention. Without community involvement in the corruption prevention agenda, the corruption eradication agenda will not run optimally. The Purpose of this researcher is to find how community participation in the implementation Stranas PK. The Research uses normatif law. Community involvement The National Strategy on Corruption Prevention can be done through the stages of formulating, implementing, monitoring, evaluating and reporting The National Strategy on Corruption Prevention.

Abstract

he limit value was a key part in the auction. The bank was as a seller who would determine auction limit value which was based on the assessor’s assessment and evaluator’s estimation ruled in the article 44 paragraph (1) and (2) and the article 45 of Minister of Finance’s Regulation 27/PMK.06/2016 on the instructions of auction. The problem was whether the auction cancellation could be performed based on the limit value determination below the market price? Second, what were the legal efforts which could be attempted by the debtor when the auction limit value determination from bank was under the market price? This research was a juridical normative research. Based on the research finding, the researcher drew a conclusion that the determination of auction limit value below the market price could not be a base of auction cancellation on pre-auction stage and auction stage, since the auction cancellation could only be cancelled upon the seller’s request or based on court’s decision or sentence. Furthermore, the debtor who might feel harmed over the auction limit value determination could do some legal efforts to file a lawsuit.

Abstract

The RT-PCR Test or rapid antigen test is a very profitable business for health service providers. This opportunity made the medical officer of Kimia Farma at Kualanamu International Airport Medan, North Sumatra took advantage of this situation by recycling the rapid antigen test kit. Therefore, it is necessary to study these problems with the formulation of problems that related to legal regulations that have been violated in the use of used rapid antigen test kit, as well as criminal threats that can be applied to the use of used rapid antigen test kit by the medical officer of Kimia Farma. The results of the study indicate that the actions of the medical officer of Kimia Farma are unlawful acts that violate various articles in the Health Law and the Consumer Protection Law. As well as the threat of criminal articles that can be applied to the medical officer is Article 196 of the Health Law (UU Kesehatan), Article 62 paragraph (1) of the Consumer Protection Law (UUPK), and Article 63 letter a of the Consumer Protection Law (UUPK).
