Abstract

Female prisoners actually have 15 trials to attend or 4 months in duration. However, most of them do not have adequate understanding concerning this legal process. Thus, this study is conducted as a field research by using qualitative approach. This study tends to describe the law enforcement and the legal awareness of female prisoners in correctional institution in Ponorogo. Moreover, how the coaching process given by the prison officers is conducted is another matter to be discussed. The result of this study presented that mostly, female prisoners are sentenced for 3-9 months in prison, but it turns out to be 1-3 months due to imprisonment. Had the verdict is responsibly announced and conducted, it will be appropriate. However, the fact is that the law enforcer, i.e. judge, police officer, prosecutor, and prison officer ask for some money from the female prisoners. This action, of course is breaking the law. After being sentenced, female prisoners actually realized that they are guilty. In this case, the coaching process in correctional institution in Ponorogo has conducted in a good way. However, the coaching process is not gradually conducted when the prisoners are released.

Abstract

In a development project activity, financing is a very significant thing. Therefore, in all its activities required a smooth transaction in terms of financing, because without it will certainly be many obstacles that will be experienced by the owners of the project. To avoid this, project owners often involve third parties to ensure liquidity of funds. In order to guarantee this, project owners often use the services of banking institutions. The provisions contained in Law No. 2 of 2017 concerning Construction Services (hereinafter referred to as Construction Services Law) in Article 57 paragraph (1) provides that: "In selection of service providers as referred to in Article 42, the service provider shall submit a guarantee to the Service User to fulfill the obligations as required in the Service Provider's selection document ". Guarantees referred to by the above article is nothing but the guarantee of the implementation of the bank guarantee (performance bond) .But in reality often found bank warranty issuance turned out to be fake and cause dispute.

Abstract

Indonesian population growth has increased rapidly. Therefore, it needs residential land to build schools, markets, and various public places. This condition makes land conversion increase as agricultural land in Indonesia is wide and relatively easy to be converted. However, if this happen continuously, Indonesia will face endanger of food resilience. Actually, a legal instrument, Law Number 41 of 2009 on Sustainable Food Agricultural Land Protection, is a law that prevents agricultural land conversion for the sake of national food resilience Practically, agricultural land conversion unstoppable and continuously keeps happening. Therefore, judicial approach is significantly required in to comprehensively prevent agricultural land conversion.

Abstract

The aims of this study are to know and to analyze the contribution of parking retribution on the side of the road towards the improvement of locally-generated revenue in Ngawi Regency. In addition, it is to measure the whether or not the parking retribution on the side of the road in Ngawi is in accordance with the regional regulation number 23/2011 on parking retribution on the side of the road. This study use empirical juridical research design.   The types of data used in this study are primary and secondary data. These data are obtained directly through interview, observation, and documentation. The data is analyzed qualitatively and quantitatively. Then, it is presented in a descriptive way. The result showed that the contribution of parking retribution on the side of the road towards the improvement of locally-generated revenue in Ngawi Regency in 2013-2017 is decreased. The biggest contribution was in 2013 with 4.69%, while the lowest contribution is in 2016 with 2.104%. Nowadays, the implementation of parking service in Ngawi Regency is not in accoradance with the regulation number 23/2011 concerning parking retribution on the side of the road.

Abstract

Investigating the aspects or arresting the intellectual perpetrators of corporate crimes has not been typically done by the public prosecutor in the trial concerning the responsibility of corporate crime in criminal act of illegal fishing. Even though it has been stated clearly in law of state, the corporate crime of illegal fishing is not strictly enforced. Moreover, the criminal act of illegal fishing is considered as general crimes instead of special crimes. In this case, illegal fishing is supposed to be considered as special crimes that should be solved distinctively. This article particularly discusses the improper enforcement of corporate crime in illegal fishing conducted by law enforcement agents. Terribly, this concern would not bring deterrent effects for the perpetrators, particularly the intellectual perpetrators and their corporate.

Abstract

Asas Legalitas merupakan asas yang fundamental didalam Hukum Pidana di Indonesia yang dimuat dalam Pasal 1 Kitab Undang Undang Hukum Pidana (KUHP) dimana dalam bahasa latin yakni Nullum delictum, nulla poena, sine praevia, legi pounali (tiada kejahatan, tiada hukuman pidana tanpa undang-undang hukum pidana terlebih dahulu). Tetapi terhadap kejahatan tertentu yang digolongkan dalam Extraordinary Crimes seperti Pelanggaran Terhadap Hak Asasi Manusia (HAM) Berat (gross violation of human rights), keberadaan Asas Legalitas ini dapat dikecualikan sehingga dapat berlaku secara Retroaktif atau berlaku mundur. Penelitian ini bertujuan untuk mengetahui seberapa jauhkah Asas Retroaktif dapat berlaku dalam pelanggaran HAM yang berat. Metode yang digunakan didalam penelitian ini adalah Doctrinal Research yaitu penelitian dengan penjelasan yang sistematis tentang aturan hukum dengan kategori hukum tertentu dan menggunakan Pendekatan perundang-undangan (Statute Approach), pendekatan konseptual (Conseptual Approach), pendekatan kasus (Case Approach) dengan tujuan akhir untuk mengetahui sampai kapan batas berlakunya suatu Asas Retroaktif dalam kasus pelanggaran HAM yang berat.

Abstract

Today's environmental pollution control has been set in national law. Through the Environmental Management and Protection Act No. 32 of 2009 it was explained that environmental pollution is a criminal act. Criminal action in positive law then its prosecution through imprisonment. In contrast to people who still have customary law, which is customary law used as a solution to legal problems. A contribution of society to support the retributive pattern. Optimizing the role of society and customary law into a replacement solution of existing imprisonment. Bids fines become a reference for developing an integrated pattern of society. The involvement of the community to be proactive with all actions or efforts of environmental pollution from certain parties become the commodity of emphasis of environmental pollution in order to keep the naturally. Customary law becomes an identity that is in accordance with the culture of the state of Indonesia and also as an alternative law that exists. The integration between customary law and positive law remains an option in balancing life processes.

Abstract

Hak merupakan unsur normatif yang melekat pada diri setiap manusia yang dalam penerapannya berada pada ruang lingkup hak persamaan dan hak kebebasan yang terkait dalam interaksinya antara individu atau instansi. HAM adalah hak dasar yang dimiliki manusia sejak manusia itu dilahirkan. HAM dapat dirumuskan sebagai hak yang melekat pada kodrat hidup sebagai manusia. Hak ini dimiliki oleh manusia semata-mata ia manusia, bukan karena pemberian masyarakat atau pemberian negara. Maka HAM itu tidak tergantung dari pengakuan manusia lain, masyarakat lain, atau negara lain. Masalah HAM adalah sesuatu hal yang sering kali dibicarakan dan lebih diperhatikan dalam era reformasi ini. HAM lebih dijunjung tinggi dan lebih diperhatikan dalam era reformasi daripada era sebelumnya. Perlu diingat bahwa dalam hal pemenuhan hak, kita hidup tidak sendiri dan kita hidup bersosialisasi dengan orang lain. Jangan sampai kita melakukan pelanggaran HAM terhadap orang lain dalam usaha memperoleh atau pemenuhan HAM pada kita sendiri.

Abstract

This article intends to analyze the use of the jury system in the criminal justice system of Indonesia, jury is a form of lay participation or the participation of lay that community of professional non-law in the judiciary, to make decisions which provide a more fulfilling sense of justice in society, in order to avoid the role of judges is absolute in the criminal justice process, in the legal system of modern states today dichotomy between legal systems tradition of common law or civil law is fading and towards the tendency to mix both the legal system in order to find substantive justice in the judicial process. Indonesia never make changes conceptually to the criminal justice system, so that the judicial process drab dominated the role of judges is great where law and justice seems to be the monopoly of a judge, the role of judges becomes absolute in determining aspects of the facts (fact finding) and the legal aspect in judge, legal research using law approach, conceptual, and comparative law. The results of this study is that morality is the essence of a sense of justice in society, morality can not be separated from the law, because morality is is what is considered correct by the general public, so the public will view the law as something that has no authority and can not be trusted, when morality is left in any decision of the judge in criminal justice. Entering jury in the justice system is able to raise the level of public confidence in the legal and judicial institutions that exist, because the inclusion of jury in the criminal justice system to prosecute in the aspect of fact (fact finding) addition will ease the task of the judge also made aspects of morality local is the living law in automatically entered in every decision, every decision so it is possible to better meet the sense of justice in society.

Abstract

The research entitled Principles Of Proportions In Cases Of Criminal Handling Connected With The Case Discussion Of Narcotics is aimed at different penalties relating to the proportionality of punishment under applicable constitutional rules. Judge, decision-making mechanism by the Panel of Judges, and indicted conditions. the criminal law factor is the principle of proportionality in decision making. Secondly, indicated in perpetrators of crime, crime victims. In this case, the Judge must play a role in determining matters relating law, even if the constitutional rule is unable to resolve.
