Abstract

Tindak pidana korupsi memiliki dampak yang membahayakan bagi  kehidupan bangsa. Bahkan masalah pengentasan korupsi ini belum bisa teratasi hingga sekarang, apalagi di tahun politik ini banyak mantan napi korupsi yang maju dalam kontes politik. Hal ini menyebabkan berbagai polemik ditengah masyarakat. Apakah dengan diloloskannya mantan napi ini memberikan keadilan bagi demokrasi di Indonesia dan juga apakah dengan diloloskannya mantan napi korupsi sebagai caleg bisa memberikan kemajuan dalam perkembangan demokrasi di Indonesia atau malah sebaliknya. Oleh sebab itu penelitian ini bertujuan untuk menelaah pro kontranya mantan narapidana untuk menjadi caleg. Jenis penelitian ini, merupakan penelitian kualitatif dengan pendekatan literature dan peraturan perundang-undangan, dengan analisis data secara deduktif. Hasil analisis ditinjau dari teori keadilan John Rawls, telah sesuai dengan HAM dan UU Pemilu, jadi UU Pemilu memberi ruang bagi caleg mantan narapidana korupsi untuk dapat dipilih. Sedangkan ditinjau dari teori moralitas Immanuel Khan, hal ini menyebabkan masyarakat dilema karena di satu sisi para eks koruptor terpenuhi hak pilihnya namun apakah nantinya mereka jika terpilih dapat mengemban tugas dan tanggungjawab sebagai wakil rakyat yang menjunjung kredibilitas, kejujuran, dan memberikan dampak yang positif dalam memajukan bangsa ini.

Abstract

The aims of this research are 1) to analyze the existence of mediating judges in the process of civil dispute mediation based on the Supreme Court Regulation (Peraturan Mahkamah Agung/PERMA) No. 1 year 2016 regarding the mediation procedures in court; 2) to analyze the supporting and the inhibiting factors which influence the existence of mediating judges in the process of civil dispute mediation in court.  This research is a normative juridical study with primary, secondary, and tertiary law materials. The manner and the instruments to collect the legal materials are using the method of documentation and document study. Data analysis is done by analyzing the research materials qualitatively.  The research results and discussion show that the existence of mediating judges in the process of civil dispute mediation based on the Supreme CourtRegulation No. 1 year 2016 regarding the mediation procedures in court becomes  the main choice of the parties who are in dispute. The supporting factors of the mediation by the mediating judges in a civil dispute are: human resources, economical budget, and infrastructure. The inhibiting factors of mediation by mediating judges in civil law disputes are: the parties are not present during the mediation, the number of certificated judges, and the society’s knowledge. Based on the research results and the discussion, it can be concluded that: 1) the mediation process by the mediating judges in the solving of civil law disputes becomes the main choice of the conflicting parties, 2) the supporting and the inhibiting factors which influence the existence of mediating judges in the processof mediating civil disputes are as follows: human resources, level of knowledge or  the society’s understanding, facilities and infrastructure, work burden of the judges, also the regulations in the implementation of the mediation. Suggestions regarding the results of this research are: 1) increasing the service of the mediation process by the mediating judges in court, 2) increasing the quality of the human resources, increasing the facilities and the infrastructure regarding mediation, 3) and increasing the socialization to the people regarding mediation and also the issuing of regulations on mediation which are more complete and detailed.

Abstract

Healthcare service has become the main priority of executors as it is one of the basic rights of the people, and that its service must be established by the government. As mentioned in the Republic of Indonesia’s 1945 Constitution Article 28H paragraph (1) and Article 34 paragraph (3), the government has the obligation to provide proper and worthy healthcare services which suit the needs of the people.   A state is an instrument which may give protection for all its citizens through a system built by that state. Economic gaps tend to bring out problems such as poverty and social gaps. Both of them are the central issues of social policies and of the welfare development.  In early 2014, right on January 1 st  the government of Indonesia through the Ministry of Health has operated the National Healthcare Security Program (Program Jaminan Kesehatan Nasional/JKN). The JKN program has also been applied in Tangerang. One of the focuses of the regional government and the BPJS (Badan Penyelenggara Jaminan Sosial/Social Security Administering Body) in Tangerang Regency is establishing social welfare for its citizens and to start a system of Healthcare Social Security.

Abstract

Fenomena pekerja anak di Indonesia dewasa ini merupakan persoalan yang  kompleks, berdimensi pada faktor ekonomi, sosial, dan budaya yang sudah ada sejak berabad-abad. Permasalahan  ekonomi pada keluarga merupakan persoalan dominan yang mengharuskan anak untuk  bekerja demi menunjang ekonomi keluarga. Pekerja anak saat ini tidak bisa di pungkiri, menurut Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan secara jelas telah melarang anak dibawah 18 tahun untuk bekerja. Hal Ini menggambarkan upaya perlindungan hukum bagi hak anak, namun kondisi masyarakat, maka Undang-Undang Nomor 13 Tahun 2003 membolehkan anak berumur 13 tahun sampai 15 tahun untuk melakukan pekerjaan ringan sepanjang tidak mengganggu perkembangan dan kesehatan fisik, mental, dan sosial dengan persyaratan (Pasal 69).  Disamping itu Undang-Undang Nomor 35 Tahun 2014 tentang  Perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak mengamanatkan untuk memberikan perlindungan yaitu perlindungan khusus bagi anak yang dieksploitasi secara ekonomi termasuk pekerja anak (Pasal 66). Dengan adanya berbagai peraturan perundang-undangan yang terkait dengan upaya melindungi pekerja anak dapat memberikan kepastian hukum dalam upaya perlindungan hukum bagi pekerja anak di Indonesia

Abstract

Selection for commission member of Central Indonesian Broadcasting is administered by house of representative; nonetheless, the implementation is managed by the selection committee formed by the ministry of Communication and Information. The house of representative will conduct proper test to selection committee in order to examine the element of community and academic capacity within broadcasting field. Indonesian Ministry of Communication and information as the official has unjustly determined lists of Central Indonesian Broadcasting Commission Member candidates that has passed proper test selection by the house of representative. As a result, it harms those who do not qualify. The non-transparent determination violates the applicable laws and general principles of good governance so that it has harmed the rights and interests of some prospective members of the Central Indonesian Broadcasting Commission who have spent their energy, thoughts and time, as well as costs to participate in the selection

Abstract

Relations which appear from legal actions do not always end well. It is not seldom that it may end with conflicts or disputes which end in court. To demand for the rights which appear from those legal relations, there needs to be some procedures and regulations so that the demand of rights may be carried out according to the law. The law which regulates those things are usually called the civil law procedures. The resolution of civil disputes in court (litigation) and the resolution of civil disputes through a non-court manner (non-litigation) in the context of the divorce dispute resolution in the Religious Court, is a combination between the litigation and the nonlitigation mmethods. This is rather interesting to be studied. The interesting part is its effectivity as a preventive or a repressive effort in handling the divorce cases in the Religious Court.

Abstract

Konstitusi bangsa Indonesia mengatur tentang demokrasi yaitu dalam UUD1945 Pasal 1 ayat 2 yang berbunyi “Kedaulatan adalah ditangan rakyat dan dilaksanakan menurut Undang-Undang.Apabila merujuk pada pasal tersebut jelas bahwa negara Indonesia bukanlah negara yang berkedaulatan Presiden,berkedaulatan Negara,maupun berkedaulatan agama dan golongan.Demokrasi juga sangat mempengaruhi pemilihan umum di Indonesia,apakah hasil dari pemilihan umum berkualitas atau tidak itu tergantung dari para penyelenggara Pemilu itu sendiri serta kesadaran msyarakat dalam memilih para pemimpin baik Presiden,Gubernur,Bupati dan Wakil Bupati maupun Walikota dan Wakil Walikota serta anggota Legislatif.Kalau Pemilihannya menggunakan asas Langsung,umum ,bebas dan rahasia serta calon pemimpinannya juga Sumber daya Manusianya baik dan berkualitas ,tidak ada politik uang maka hasilnya akan maksaimal.

Abstract

Elections in Indonesia since independence until now have experienced many  changes and dynamics, starting from the existence of guided democracy, Pancasila democracy, to the emergence of reforms showing how dominant the role (government) of the State is in giving color to the democratic system in Indonesia. Various electoral systems have implications for increasing state officials involved in corruption. The correlation between the electoral system and the eradication of corruption is closely related, because the stages and processes that are passed by the participants of this election require very high funding. Corruption that occurs is inseparable from the influence of factors, namely corruption by greed, corruption by need, corruption by opportunities, corruption by Exposus. Efforts to eradicate corruption have been carried out with various efforts and instruments of legislation, but there are still many regional officials involved in corruption, it needs improvement through political education for the community, an information center on election participants, professional and neutral law enforcement. efforts to prevent corruption from an early age, one of the methods used is Applied Neuroscience, because as well as and as much as legislation if people do not have integrity and an anti-corruption attitude, corruption will always be there.

Abstract

Banking institutions and insurance companies are two different finance institutions, both in terms of the type of business and in terms of the principles. The two of them undergo a cooperation (bancasurrance) through referential activities, distribution, and product integration. The cooperation activity of marketing integrated products is carried out by banks by offering and selling bundled products. Bundling is a marketing activity which is allowed, yet its implementation is almost the same as tying agreement, which is one of the prohibited agreements as it may lead to unhealthy business competition.

Abstract

Regional autonomy essentially pushes the regional government to take care of its own region’s affairs. In the regional autonomy, the orientation in its development is surely based on the region’s potentials in various aspects and legalities to push the region’s potential of productivity. One of the reasons is so that the region may be advanced in the aspect of development. It cannot be denied that online transportations – both those which are two-wheeled or four-wheeled – have become a trend in the society as it has the advantage of an eased system. With this ease, there needs to be strategic policies in the form of regional government policies to increase the region’s potentials especially in the aspect of regional retribution through the public transportations provided by the transportation companies. This is so that the Regional Original Income may increase. This regulation is hierarchic. Thus, it gives the regional government to form a policy regarding the collection of regional retribution through public transportation services. This may increase the Regional Original Income in the framework of regional autonomy. This research uses a normative approach to analyze the region’s potentials to collect regional retribution through public transportation services, and it is regulated in the Constitution No. 28 of 2009 regarding Tax and Regional Retribution
