Abstract

ABSTRACT The development of the regional government system has undergone substantial changes with the birth of Law Number 6 of 2014 concerning Villages. The regulation regarding the election of village heads has changed with a simultaneous election mechanism and the candidate who gets the most votes is entitled to be appointed as village head. The purpose of this study is to examine and analyze the regulation by mechanical election in the district of Maluku Tengah which in the Regional Regulation Number 03 of 2006 concerning Procedures for the Nomination, Election and Inauguration of the Head of the Negeri Government whose substance the article on elections still refers to Law Number 32 of 2014 which is no longer valid. The method used in this research is the socio-legal method whose data are taken from the interview process and study of Regional Regulation documents and by using literacy related to the research title.

Abstract

Legal research on the Libya’s obligations to Indonesia regarding the crude oil spilled that polluted Indonesia’s sea, which is created liability based on international agreements regarding marine pollution because the Libya has ratified the international agreement. Therefore Libya must comply with the provisions of the United Nations Convention on the Law Of the Sea 1982, International Convention on Civil Liability for Oil Pollution Damage 1969, Stockholm Declaration and Rio de Janeiro Declaration 1992. The purpose of this research is to find out the liability carried out by the Libya due to the crude oil spilled that polluted Indonesian’s sea due to an accident with the MV Sinar Kapuas from Singapore. Normative methods used in this study focus on the strict liability principle and sea international treaties, including the United Nations Convention on the Law Of the Sea 1982, International Convention on Civil Liability for Oil Pollution Damage 1969, Stockholm Declaration and Rio de Janeiro Declaration 1992. Marine pollution by crude oil carried out by the MT Alyarmouk from Libya created a liability which is determined as strict liability by the International Convention on Civil Liability for Oil Pollution Damage 1969.

Abstract

Proses dismissal merupakan proses penelitian terhadap gugatan yang masuk di Pengadilan Tata Usaha Negara oleh Ketua Pengadilan. Dalam proses penelitian itu, Ketua Pengadilan dalam rapat permusyawaratan memutuskan dengan penetapan yang dilengkapi dengan pertimbangan-pertimbangan bahwa gugatan yang diajukan itu dinyatakan tidak diterima atau tidak berdasar. Tujuan dari penelitian ini adalah untuk mengetahui dan menjelaskan tentang analisis yuridis dismissal proses dalam pengadilan tata usaha negara terkait tujuan hukum tentang keadilan dan menjelaskan proses hukum acara pengadilan tata usaha negara diterapkan dismissal proses.Adapun pendekatan yang digunakan dalam penelitian ini adalah pendekatan pendekatan yuridis normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan-peraturan dan literatur-literatur yang berkaitan dengan permasalahan yang diteliti. Berdasarkan analisa hukum yang digunakan maka penulis memberikan kesimpulan bahwa seharusnya dalam Undang-Undang lebih memperjelas dengan terperinci proses dismissal sebagaimana yang dimaksud dalam Pasal 62 Undang-Undang Republik Indonesia Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara. Sehingga dalam proses dismissal terhadap gugatan yang diajukan oleh individu dan atau badan hukum perdata dapat dengan jelas memahami fungsi dari proses dismissal, dan terhadap individu dan atau badan hukum perdata merasa tidak dirugikan nantinya dalam proses pemeriksaan dismissal.

Abstract

Saat ini melalui Surat Edar Kementrian ATR / BPN Nomor 2/SE-HT.02.01/VI/2019 tentang pemberian Hak Guna Bangunan untuk Persekutuan Komanditer telah memberikan peluang bagi CV untuk memiliki HGB. Hal ini menjadi dilematis, bilamana salah satu pesero dinyatakan pailit , sehingga semua aset yang dimiliki oleh pesero tersebut masuk dalam bundel pailit guna pembayaran hutang kepada para kreditor, sedangkan aset CV berupa benda tidak bergerak (tanah dan beserta bangunan) dibeli dari modal para pesero maupun diperoleh dari keuntungan bersama CV. Tidak adanya pemisahan antara harta pribadi para pesero dengan harta CV akan menjadi persoalan pelik diantara para pesero. Atas dasar tersebut peneliti akan menguji sejauh mana nilai keadilan dapat ditegakkan terhadap para pesero lain bilamana salah satu pesero yang dinyatakan pailit dan mampukah teori hukum keseimbangan (teori Roscoe Pound) digunakan sebagai mata pisau untuk membedah nilai keadilan yang seimbang?

Abstract

Kejaksaan sebagai salah satu penegak hukum pada dasarnya melaksanakan tugas dibidang penuntutan, melaksanakan penetapan dan putusan pengadilan. Kejaksaan juga mempunyai tugas dan wewenang pada Bidang Perdata/ Tun untuk dapat bertindak atas nama negara pemerintah untuk melaksanakan pemberian bantuan hukum, penegakan hukum, pertimbangan hukum, pelayanan hukum, serta tindakan hukum lainnya kepada pemerintah atau instansi pemerintah, BUMN/BUMD. Berdasarkan penelitian dapat dijelaskan bahwa: Pertama, pelaksanaan pendampingan pada proyek strategis telah dilaksanakan sebanyak 4 (empat) kali sepanjang tahun 2020, 2021, pendampingan hukum dimulai dengan adanya kerja sama bidang hukum (Moi) antara pemerintah Kota Pariaman dengan Kejaksaan Negeri Pariaman yang diikuti dengan kerja sama bidang hukum antara Dinas PUPR, Dinas Kesehatan dan Dinas Perumahan Rakyat, Kawasan Pemukiman dan Lingkungan Hidup Kota Pariaman dengan Kejaksaan Negeri Pariaman. Kedua, kendala-kendala yang dihadapi dalam pelaksanaan pendampingan pada proyek strategis tersebut adalah kendala internal: berupa kurangnya sosialisasi dan pemahaman fungsi tugas dan wewenang Kejaksaan kepada seluruh instansi terkait khususnya dalam bidang pendampingan hukum, kendala eksternal: permohonan pendampingan baru diajukan oleh pemerintah Kota Pariaman pada saat pelaksanaan pembangunan proyek tersebut akan dilaksanakan sehingga tim pendamping tidak dapat secara maksimal mengantisipasi segala potensi, kendala hambatan baik teknis, yuridis maupun administrasif atas proyek yang didampingi, serta rapat secara berkala untuk memberi masukan, saran, pendapat hukum terkait kemajuan / progres proyek hanya dilakukan diawal kegiatan, sehingga berbagai kendala permasalahan yuridis terlambat di antisipasi oleh tim pendamping.

Abstract

After the Amendment of 1945 Constitution, democracy and Rule of Law become two concepts. They are the concept on how to run the power and run the goverment of Indonesia. Both concept, are interconected among each others and can not be separated, because on one side, democracy gives the grounds and mechanisme of power based on the principles of togetherness and equality, while on the other side, rule of law gives guide lines that goverment in the state is not a human but the law of human being. The both of concepts have relation each other. This article are trying to connected and related both concepts in an unseperated function.

Abstract

Media sosial saat ini sudah mengalami perubahan pemanfaatannya secara massif dan signifikan, salah satunya, yaitu sebagai tempat melakukan kegiatan politik (kampanye). Aturan mengenai kampanye hitam berada pada berbagai peraturan perundang-undangan. Walaupun sudah ada aturan, akan tetapi masih banyak kampanye hitam di media sosial. Munculnya kampanye hitam menjadi cerminan bobroknya moral bangsa Indonesia saat ini. Tidak bisa dipungkiri bahwa black campaign amat sangat memberikan dampak yang buruk bagi pendidikan politik masyarakat Indonesia. Fenomena yang terjadi, yaitu keikutsertaan SARA dalam politik. Di mana kita ketahui bahwa negara Indonesia memiliki kemajemukan, tidak hanya memiliki satu agama, budaya, serta suku dan antar golongan. Penelitian ini merupakan penelitian hukum normatif yang memiliki suatu metode yang berbeda dengan penelitian lainnya. Penelitian hukum normatif berfokus pada peraturan-peraturan tertulis berupa literatur-literatur kepustakaan atau pendekatan kepustakaan (library research) baik yang bersandar pada sumber data sekunder yang meliputi bahan hukum primer dan bahan hukum sekunder. Adapun yang dapat dirumuskan dalam penelitian ini adalah: (1) Akibat hukum dari black campaign; (2) Unsur yang mempengaruhi penegakan hukum kampanye hitam (black campaign); dan (3) Upaya Menanggulangi Kampanye Hitam (Black Campaign) di Media Sosial.

Abstract

The judicial process prioritizes legal certainty both in time and minimizes costs for the parties as Law Number 48 of 2009 in Article 2 and Article 4 paragraph (2) requires the existence of important principles in civil procedural law, namely Simple, Fast, Low Cost. Settlement of disputes at the first level with the a quo principle is certainly the hope of the whole community, especially those who want to resolve disputes through the courts, with the application of this principle, it is hoped that the settlement of cases, especially in the civil sector, will not be delayed and can be resolved in a short period of time, so that the costs incurred by the parties are not too high. However, the settlement of civil disputes through a simple trial under examination is regulated in a limited manner with a material claim value of a maximum of Rp. 500,000,000.00 (five hundred million rupiah) preceded by a dismissal process and the settlement period of this case is not more than 25 (twenty five) ) working days. The results of this study explain firstly the application of Perma Number 4 of 2019 procedures for resolving simple lawsuits at the District Court in West Sumatra can run effectively such as providing convenience for parties to access and register simple lawsuits both online and offline, educating Registrars and Judges about simple lawsuits so that can degrade errors (human error), as well as proven by a matrix of cases per year that are decided through a simple lawsuit. Second, the obstacle that often occurs in the process of resolving simple lawsuits is that judges often do not read the lawsuit comprehensively and immediately set a trial day so that when the trial takes place it is proven that the dispute cannot be resolved with a simple lawsuit (there are provisions in Articles 3 and 4 of this Perma). met) and ended up not being able to continue (NO).

Abstract

Sexual abuse is an act of violence and treatment that degrades human dignity, which is contrary to the values of God and humanity, and disturbs the security and tranquility of the social community. Handling victims of sexual abuse is very important, because the violence has caused various injuries to victims, such as fear, prolonged trauma, feelings of shame, evidentiary problems, repetitive questions by investigators, and the police investigations report process was not carried out properly so that it was difficult for the victim to recount the sexual abuse they experienced. If we look at many cases of violence against women and children, there are still no clear legal solutions. The promulgation of Law Number 12 of 2022 about sexual violence (UU TPKS), it is an effort to reform the law and overcome problems in legal protection of women and children from sexual abuse, namely as follows: preventing all forms of sexual violence, handling, protecting, and recovering victims, carry out law enforcement and rehabilitate perpetrators, create an environment where there is no sexual violence, and ensure non-repetition of sexual violence. Therefore, the problems statement in this research are: First, how are the regulation for the victims management of sexual violence based on Law Number 12 of 2022 about sexual violence (UU TPKS) and the Penal Code. Second, what are the juridical implications of the Law Number 12 of 2022 about sexual violence (UU TPKS) on victims in an Integrated Criminal Justice System that is gender-equitable. The problem approach in this study is a normative juridical, with data sources being the Criminal Procedure Code, the Penal Code, the Law Number 12 of 2022 about sexual violence (UU TPKS), Academic Papers on the Draft Law on the Elimination of Sexual Violence and other relevant sources. The results of the research show that the regulation of the Integrated Criminal Justice System in the UU TPKS regulated in Articles 20-64 is an effort to complement and strengthen the provisions on the rights of victims as regulated in existing laws and regulations. Meanwhile, the juridical implications of the UUTPKS for the Integrated Criminal Justice System are a guarantee of legal certainty, justice and the benefit of law in law enforcement of the Crime of Sexual Violence. A gender-just criminal justice system is one of the breakthroughs to change a non-gender-oriented legal system into a gender-oriented legal system. The system is expected to be able to respond to situations that are always experienced by women and children who are victims of gender-based sexual violence.

Abstract

Deconcentration is an important element in the administration of the state. Its existence is not only in administrative law order, but also in Constitutional law because - like decentralization - it concerns the foundations and organization of the state. If decentralization gave birth to local government (autonomous region), then deconcentration gave birth to local state government (administrative area). These administrative areas are headed by what is known theoretically as a Prefector. For the Indonesian context, the prefector is held by the governor in such a way that the governor has a dual position, namely as the head of the autonomous region of the province as well as the prefector. The laws governing local government in Indonesia use the term representative of the center in the regions for the designation of prefector. Since the reformation until now, the administration of government from the center to the regions seems to have marginalized deconcentration as the governance structure. There was a strong impression during the reform era that looked at deconcentration as if were the antithesis of democracy. The impression was so strong that deconcentration and administrative areas were no longer included in the post-amendment 1945 Constitution. The deconcentrative authority possessed by the governor to revoke Regency/City Regional Regulations (Perda) that are contrary to higher laws, public interests, and decency, was annulled by the constitutional court in its decision in 2016. Furthermore, budgeting and regulation and formation the apparatus that assists the governor as the central representative in the regions appears to be running slowly. In this way the question arises: is the implementation of deconcentration effective by the governor as the representative of the central government in the regions? To answer this question, research was carried out on the implementation of the deconcentration. The results of the research show that the implementation of the deconcentration has not been effective due to various limitations: limited tools, limited rules, and limited authority
