Abstract Currently, Indonesia has not provided adequate protection of intellectual property rights (IPR) in the implementation of the Material Transfer Agreement (MTA). In providing the protection of the Indonesian nation's intellectual property on Genetic Resources (SDG) —especially those derived from genetic material in the form of biological material (DNA/RNA), clinical specimens, and non-biological material (related to human health), the Indonesia's Material Transfer Agreement (MTA) standard is still far from perfect. A Commercial Material Transfer Agreement (CMTA) is required which not only contains clauses on the exchange of genetic material but also contains more detailed provisions on Intellectual Property Rights such as Patents and Benefit Sharing. In this Journal, the author proposes a new framework for the Commercial Material Transfer Agreement (CMTA) which contains additional clauses from the current MTA, which is expected to further protect and encourage of new patentable invention in the future.

Criminal offenses related to gambling are regulated in Article 303 of the Indonesian Penal Code (KUHP) and Article 303 bis of the KUHP. Additionally, the criminalization of gambling conducted through electronic media is addressed in Article 27 paragraph (2) of Law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on Electronic Information and Transactions. However, the effective implementation of this law has not yet been enforced in the jurisdiction of the Padang Panjang City Police Resort. The research aims to address the following issues: (1) What efforts are being made by the police authorities in enforcing the law against online gambling in the jurisdiction of the Padang Panjang City Police Resort? (2) What are the inhibiting factors or obstacles faced by the police authorities in enforcing the law against online gambling in the jurisdiction of the Padang Panjang City Police Resort? This research adopts an empirical juridical approach and a descriptive method. Primary data collection involves interviews conducted at the Padang Panjang City Police Resort, while secondary data collection entails document analysis. The research findings reveal that law enforcement efforts against online gambling in the jurisdiction of the Padang Panjang City Police Resort can be carried out through preventive measures such as public awareness campaigns and collaborations with relevant parties. Repressive measures include gathering information from the community, investigation and prosecution, site blocking, and providing rehabilitation for offenders. The obstacles faced by the police authorities include weaknesses in the Electronic Information and Transactions Law No. 11 of 2008, lower penalties for online gambling offenses compared to those in Article 303 of the KUHP, difficulties in obtaining evidence through the internet, lengthy case processing, and inadequate understanding and skills of investigators in the field of information technology.

Sesuai dengan putusan MK Nomor 97/PUU-XI/2013, MK tidak lagi berwenang untuk menyelesaikan sengketa hasil Pilkada langsung, karenaPasal 236 C Undang-Undang Nomor 12 Tahun 2008 bertentangan dengan UUD Negara Republik Indonesia Tahun1945. Pasal 157 ayat (1) Undang-Undang Nomor 8 Tahun 2015 menentukan bahwa penyelesaian sengketa hasil Pilkada langsung menjadi kewenangan badan peradilan khusus. Namun sebelum badan peradilan khusus tersebut dibentuk, maka MK masih berwenang untuk menyelesaikan sengketa hasil Pilkada langsung. Kewenangan MK tersebut adalah kewenangan konstiturional yang bersifat sementara untuk mengisi kekosongan hukum (Rechtvakum). Oleh karena itu pembentuk undang-undang haru segera membentuk badan peradilan khusus yang mempunyai kewenangan untuk menyelesaikan sengketa hasil Pilkada langsung.

The emergence of the phenomenon of illegal investment which is often associated with Ponzi schemes is an issue that deserves to be studied because it is very close to our surrounding life. The Ponzi scheme that is developing in Indonesia is actually not the same as investment fraud, but is the method used to carry out this crime. In its development, ponzi schemes have evolved into various forms of investment products. However, the ongoing developments in Indonesia have not been followed by the strengthening of regulations governing ponzi schemes. Therefore, there are obstacles in handling cases that use ponzi schemes as well as in ineffective prosecutions due to sectoral regulations used to prosecute ponzi scheme users.

The purpose of this study is to analyze the validity of the SPKTNP without the SPTNP which has been regulated in the Customs Law which underlies the decision of the Supreme Court. The research is descriptive-analytical with a normative juridical approach. Collecting data by library or document study conducted by searching and studying and making an inventory of secondary legal documents or materials. As a result, the validity of the issuance of SPKTNP without SPTNP is regulated in Law Number 10 of 1995 Article 16 and its explanation which is closely related to Law Number 17 of 2006 Article 17 which is a re-stipulation. However, Article 16 paragraph (4) concerning the amount of the fine jo. Article 17 paragraph (4) which adds a fine from the construction of state administrative law is a positive fictitious decision considering that the function of government is active. Issuance of SPKTNP without SPTNP is a state administrative decision by Law Number 5 of 1986 concerning Administrative Court Article 1 point 3 jis Law Number 51 of 2009 concerning Amendments to Law Number 5 of 1986 concerning Administrative Court Article 1 point 9. The re-stipulation decision by the Supreme Court requires the issuance of the SPTNP before the issuance of the SPKTNP, then the Supreme Court did not defend the issuance of the SPKTNP without being preceded by the issuance of the SPTNP because it contradicted Article 17 jo. Article 16 of Law Number 17 of 2006 in conjunction with Article 7 of Law Number 12 of 2011 concerning the Establishment of Legislation.

Customary inheritance law in Indonesia is influenced by the existence of a family system such as in terms of the form of marriage and how to draw lineage to determine who has the right to be the heir and has the right to inherit. The indigenous people of Nias who adhere to an inheritance system based on a patrilineal descent system are generally known as honest marriages, namely marriages that are carried out by paying honestly (BÖwÖ) from the man to the woman. In the inheritance system in the Nias tribal community, the role of men is as the heirs of their parents, while women are not heirs. This study uses an empirical juridical approach. The problem in this research is how the division of inheritance and the role of the Notary in the customary law community of Nias. This research is important to carry out to find out the development of inheritance law and the role of the notary in the customary law community of Nias where there has been development in terms of inheritance of female heirs who have received a share of the inheritance of their parents even though the share is not larger than the male heirs and this is a family policy and agreement

Penelitian ini bersifat normatif, dengan pendekatan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum yang digunakan adalah primer dan sekunder, dimana Teknik pengumpulan datanya menggunakan studi kepustakaan dan wawancara. Bahan hukum yang telah dikumpulkan, dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa Postingan ujaran kebencian yang dilakukan melalui media sosial oleh FH dan RS sempurna sebagai tindak pidana karena memenuhi unsur Pasal 28 ayat (2) Undang-Undang ITE, sekalipun telah dihapus. Terpenuhinya alasan-alasan pertanggungjawaban pidana berupa sifat melawan hukum, kesalahan, kemampuan bertanggung jawab dan tidak adanya alasan pemaaf, sehingga FH dan RS dapat dikenakan sanksi pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp. 1.000.000.000, - (satu milyar rupiah) sebagai bentuk pertanggungjawaban pidananya.

Hermeneutics is a discipline or method of interpretation used to understand and interpret texts, especially complex texts such as literature, religious texts, or philosophy. Hermeneutics involves the process of studying texts comprehensively, analyzing the structure of the text, understanding the context, and searching for the meaning contained therein. A mark is a sign used to distinguish a product or service from similar products or services provided by other parties. A trademark is a mark that is registered with the Mark Registration Office and Geographical Indications, which grants an exclusive right to use the mark in business activities. This study examines the hermeneutical view of the GOTO vs GoTo trademark case contained in the Court Decision Number 71/Pdt.Sus-HKI/Merek/2021/PN Niaga Jkt.Pst. The purpose of this study is to find out the protection regarding Trademarks in Indonesia and how the hermeneutical view of the case of the GOTO vs GoTo Trademarks. The research method used in this journal is normative juridical, which is an approach made by examining the principles, theories, concepts, principles, and legislation related to the research problem being studied. The results of this study are that PT TFT has a class and type that is different from Gojek Tokopedia, therefore in the trial the lawsuit against PT TFT was rejected. In this case, hermeneutics or interpretation is also used so that we can find out the existing meaning and the causes of the case.

GB sebagai platform penyedia jasa layanan memiliki berbagai fitur yang dipergunakan untuk mempermudah hidup manusia. Salah satu fitur GB yang sering digunakan oleh konsumen dalam hal pemesanan makanan. Hal tersebut dikarenakan pemesanan makanan melalui GB memiliki berbagai keuntungan seperti menghemat waktu dan tenaga. Konsumen tidak perlu datang pada toko konvensional untuk mendapatkan makanan yang diinginkannya karena driver GB akan mengirimkan makanan sesuai dengan alamat yang diinginkan oleh konsumen. Lapchiong merupakan sosis keras berbahan dasar daging babi. Pelaku usaha lapchiong yang tidak mencantumkan keterangan tidak halal pada aplikasi GB mengakibatkan konsumen beragama Islam membeli dan mengkonsumsi lapchiong tersebut. Konsumen mengetahui bahwa lapchiong mengandung daging babi setelah konsumen tersebut mengkonsumsinya. Dalam Surat Al-Baqarah 173 terdapat larangan bagi Umat Islam untuk mengkonsumsi makanan yang mengandung daging babi. Dalam penelitian ini, penulis ingin mengetahui pihak yang bertanggung jawab akibat kerugian yang dialami oleh konsumen akibat mengkonsumsi makanan yang mengandung daging babi. Metode penelitian yang digunakan adalah metode yuridis normatif dengan menelaah peraturan perundang-undangan yang telah sah dan berlaku di Indonesia dan dikaitkan dengan kasus yang terjadi.

In buying and selling activities, business actors as product providers try to avoid losses as much as possible. Not a few frauds are committed by business actors who sell expired products that are detrimental to consumers. Consumer protection is urgently needed given the weaker position of the consumer. Indonesia and Malaysia as ASEAN members regulate consumer protection. Indonesia established Law No. 8 of 1999 concerning Consumer Protection and Malaysia holds Consumer Protection in the 1999 Consumer Protection Act (CPA). The problem formulation of this writing is to discuss the regulatory provisions regarding expired products and the perpetrators are responsible for losses due to expired products in Indonesia and Malaysia. In this paper the research method is normative legal research. The approach in this paper is the statutory approach and the comparative approach. The conclusion of this paper is that the provisions of Indonesian and Malaysian consumer protection laws both regulate business actors who are prohibited from trading expired products and require business actors to put information labels or explanations including the expiration date of a product. For the responsibility of business actors, Indonesia and Malaysia apply reverse verification in the Consumer Protection Law.
