Abstract

Perbuatan spamming dengan mencuri data pribadi dapat merugikan korban, sebagaimana berdasarkan Pasal 28 ayat (1) UU ITE. Salah satu kasus yang masuk kategori pencurian data melalui spamming terdapat pada Putusan No. 500/Pid.Sus/2019/PN.Jkt.Sel. Untuk itu perlu dikaji mengenai bagaimana pengaturan hukum terkait pencurian data dalam hukum pidana Indonesia dan bagaimana analisa hukum terkait tindak pidana pencurian data melalui spamming berdasarkan UU ITE pada putusan No. 500/Pid.Sus/2019/PN.Jkt.Sel. Jenis penelitian ini adalah hukum normatif. Sifat penelitian ini deskriptif analisis. Teknik pengumpulan data menggunakan penelitian kepustakaan. Analisis data dilakukan secara kualitatif. Dalam hukum pidana positif di Indonesia terdapat pengaturan mengenai pencurian atau penyalahgunaan data pribadi yaitu Undang-Undang Nomor 27 Tahun 2022 Tentang Pelindungan Data Pribadi. Analisa hukum terkait tindak pidana pencurian data melalui spamming berdasarkan UU ITE pada putusan No. 500/Pid.Sus/2019/PN.Jkt.Sel menunjukkan bahwa hakim telah tepat dalam menjatuhkan hukuman kepada para Terdakwa, yaitu Terdakwa I pidana penjara selama lima tahun, Terdakwa II empat tahun dan Terdakwa III empat tahun. Vonis tersebut sesuai dengan dakwaan penuntut umum yaitu Terdakwa didakwa melanggar Pasal 32 ayat (1) Jo Pasal 48 ayat (1) UU RI No. 19 tahun 2016 tentang Perubahan atas UU RI No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik jo Pasal 55 ayat (1) ke-1 KUHP, bersesuaian juga dengan De Verenigings Theori meskipun vonis tersebut belum maksimal.

Abstract

Perbandingan putusan yang di keluarkan oleh hakim adalah hal yang sudah sering terjadi dalam peradilan di Indonesia. Perbedaan pendapat dan penafsiran Hukum membuat banyaknya perbedaan putusan pada tingkatan pengadilan. Hal ini terjadi pada putusan yang di keluarkan oleh Hakim Pengadilan Negeri Payakumbuh mengenai tindakan pidana konten asusila yang diputus tidak terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana, dibebaskan dari tahanan dan putusan Mahkamah Agung RI terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana dan terdakwa menjalani masa percobaan selama 4 (empat) bulan berakhir. Metode penelitian yang dipakai dalam penelitian ini adalah normatif yaitu penelitian hukum yang hanya ditujukan pada peraturan- peraturan tertulis sehingga penelitian ini sangat erat hubungannya pada perpustakaan karena akan membutuhkan data- data yang bersifat sekunder dari perpustakaan. Penelitian ini dilakukan di Pengadilan Negeri Payakumbuh penggunaan teknik pengumpulan data, yaitu studi dokumen. Data primer diperoleh dari penelitian dan data sekunder diperoleh dari berbagai literatur, peraturan, dokumen dan pendapat ahli yang relevan dengan pembahasan penulis ini. Berdasarkan hasil penelitian ini, dapat dipahami bahwa pertimbangan Majelis hakim dan hakim anggota mempengaruhi hasil putusan yang terbukti secara sah atau tidak dalam melakukan tindakan pidana yang dilakukan oleh Terdakwa.

Abstract

Rapid economic development has created various goods and/or services that can be used and consumed. With the increasing variety of goods and/or services in circulation, and supported by advances in information technology, the distribution is increasingly expanding across national boundaries. So this is also a new demand for the government to oversee the distribution of products that are widely circulated in the market, especially in the health sector. One of the important human needs and cannot be left behind in daily activities is medicine. People's fear of the negative stigma of using modern medicine increases people's desire to seek alternatives to traditional medicine. However, there are many distributions of traditional medicines without a Distribution Permit (TIE) from the Center for Drug and Food Control (BBPOM) in Pekanbaru. Based on this, the researcher examines 1) What is BPOM's responsibility for the circulation of medicinal products without distribution permits in the community. 2) What is the legal protection for consumers who use medicinal products without a Distribution Permit from BPOM. Writing this thesis using the approach empirical juridical. From the results of the study, it was found that the most cases were found at Licensed Drug Stores (TOB) facilities. There are 2 (two) responsibilities of BPOM in conducting supervision, namely: pre-market andpost-market, both are supported by the Drug and Food Control System (SisPOM). The form of legal protection by BPOM is preventive and repressive efforts. Establishing a distribution permit is a preventive action taken by BPOM in carrying out aspects of security, comfort and safety for consumers. Repressive protection, namely by carrying out enforcement operations or spot checks on various drug distribution facilities. Furthermore, if a dispute occurs, it will be resolved through the courts and out of court.

Abstract

In the trademark, the term First to file system is known to grant rights to the brand. Under the First to file system, trademark owners, including well-known marks, must register their trademarks at the Directorate General of Intellectual Property (“DJKI”) to obtain exclusive rights to their trademarks and legal protection. Exclusive rights cannot be obtained by the owner of the mark only by showing evidence that he is the first user of the mark in Indonesia. The first-to-file system means that the party who first applies for registration is given priority to get the trademark registration and is recognized as the rightful owner of the mark. This principle is explicitly regulated in Article 3 of Law Number 20 of 2016 concerning Marks and Geographical Indications (“MIG Law”) which stipulates that rights to a mark are obtained after the mark is registered.. In writing this study, the author uses a type of normative research, namely legal research which is carried out by examining primary legal materials and secondary legal materials. Based on the considerations, the panel of judges is of the opinion that the claimant's claim has legal grounds to be granted for some of which will be stated in the verdict, in the conference, the exception stated that Defendant I's exception is unacceptable, in the main matter of the case rejecting the Plaintiff's claim, Ruben Samuel Onsu, in its entirety. . In the reconpension the counterclaims granted by the Plaintiff for reconsideration of PT Ayam Geprek Benny Sujono partially and stated that the Plaintiff of the Counterclaim was the owner and first legal user of the Mark “I AM GEPREK BENSU SEDEP BENEERRR + LUKISAN”. Declared null and void with all the legal consequences of registering a trademark in the name of Ruben Samuel Onsu, rejecting the claim of the Reconvention Plaintiff other than and the rest.

Abstract

One of the authorities of the Regional Government is the field of tourism, this delegation of authority is emphasized in several laws and regulations. However, North Toraja Regency, which has tourism potential, does not yet have derivative regulations to empower and improve the economy of business actors. This article focuses on disclosing the basis for the formation of local regulations on the implementation of tourism and content specifically related to business actors. The method used is normative-empirical, focusing on examining primary data through open interviews, and examining secondary data, analyzed qualitatively. Referring to several laws and regulations, it is regulated that the local government has the authority and even emphasized several obligations to take care of tourism affairs, so that the North Toraja Regency government is seen as important to form regional regulations, while the content material related to business actors is realized by setting the norms of obligation for the government to conduct training for business actors, where the material is prepared on the basis of research so that business actors in the tourism and culinary management sector are able to increase the number of tourists, the income of business actors, as well as regional original income, the article contains standardization of the construction of identical infrastructure for each regions, and facilitating special partnerships with the need for appropriate technology for business actors, as well as facilitating access to capital with banks and investors.

Abstract

Abuse of circumstances (Misbruik van Omstandigheiden or undue influence) is an interesting and frequent phenomenon in agreements. Abuse of circumstances can be in the form of a contract in an agreement or a contract used in doing business. Misbruik van Omstandigheiden or undue influence . The agreement of unequal cooperation can occur because there are parties who have a stronger position and are at the top to suppress or threaten the weaker parties. The existence of a bargaining position is the reason why a party in a weak position cannot get freedom of opinion and decide something related to their own interests or common interests. The writing of this article uses qualitative research methods. The material for writing this article was obtained by literature study and analyzed using legal interpretation. Sharia treaty arrangements that exist and are related to undue influence elements are a form of agreement that is prohibited and forbidden until it is called ikrah. Ikrah is the coercion of the strong against the weak, while doing ikrah is a deed and disliked by God. To do ikrah is to violate the elements and conditions of trade in Islam. The legal effect of this act is a null and void agreement.

Abstract

This article discusses two main topics; first, about the removal of the maturity of the spin-off implementation for LKS in UU PPSK, and second, an analysis of the implementation of the tadarruj fi tathbiq ash-sharia method on the existence of the UUS based on expert opinions and its suitability with the spin-off policy. The conclusion in this article is; 1) the removal of the due date for the implementation of spin-off in UU PPSK revives the debate on the implementation of the tadarruj fi tathbiq ash-sharia method. Based on the arguments of experts, the method of tadarruj fi tathbiq ash-sharia can refer to the current condition (condition base) or refer to the time of expiration of the temporary law (timeline base). The timeline base is more appropriate as a benchmark for the implementation of tadarruj fi tathbiq ash-sharia because temporary laws should not be implemented continuously, maximum efforts need to be made for the creation of ideal laws. For this reason, The Financial Services Authority needs to regulate the maturity of the spin-off implementation in POJK so that the principles of tadrij are still implemented.

Abstract

This research analyses the efficiency, effectiveness and impact of the resolving insurance claims disputes by the newly established The Alternative Dispute Resolution of Financial Services Centre (LAPS SJK) since The Indonesia Insurance Mediation and Arbitration Centre (BMAI) was closed (liquidated) by the order of the Indonesia Financial Services Authority (OJK), and its task and function in resolving insurance claims disputes was transferred to LAPS SJK. Juridical research method is used in writing this research with secondary data. The result of this research shows resolving of insurance claims disputes at BMAI was more efficient and effective than at LAPS SJK. In 2021, the first year of operation of LAPS SJK, there were 10 financial disputes resolved at LAPS SJK, of which 2 cases were insurance claims disputes. There is a total number of 13.516 financial disputes received by LAPS SJK in 2021 waiting for resolution of which 177 are insurance claims disputes. The very low achievement was very disappointed and not in accordance with one of the principle in resolving disputes that is efficient and effective at LAPS SJK. There is a bad impact of the bad achievement of LAPS SJK to the good reputation of insurance industry in the insuring public and the society. This research suggests LAPS SJK: 1 to immediately do a crash programme for resolving the pending financial disputes; 2 to adopt the Ajudication resolution method that is the most efficient and effective in time resolving the financial disputes, as it has only two hearings or three the maximum in the experience of BMAI during its services. With the Ajudication, the thousand pending financial disputes can be hopefully resolved more quickly; 3 to improve its infrastructures including the number of hearing and meeting rooms for arbitration, Ajudication, and Mediation, human capital with good experience, capacity and expertise, and 4 to appoint a new managing director or head of LAPS SJK with good experience in ADR, capacity, expertise, strong leadership, and good tract record.

Abstract

The National Police Commission (Kompolnas) is one of the state institutions whose functions and authorities are quite strategic in assisting the president in formulating the vision of the national police. Apart from being an institution that is expected to become an external "monitoring organ" of the Indonesian National Police (POLRI). However, many parties consider that the Kompolnas Institution has not shown real performance, which is due to its independence both institutionally and in authority. This article attempts to analyze the independence aspect of Kompolnas based on indicators of the concept of independent state institutions. The research was carried out using a normative and contextual approach to secondary data in the form of laws and related literature. The results of the analysis show that in the concept of independent state institutions, aspects of independence can be divided into formal and de facto indicators. Based on this indicator, Kompolnas still cannot be said to be an independent state institution which is actually due to the lack of an element of independence in institutional regulations and authority.

Abstract

The judge in making a decision must be based on two valid pieces of evidence and the conviction obtained by the judge that the criminal act really happened. Such juridical formulation truly guarantees the freedom of judges, so it seems that judges are not bound by the demands of the public prosecutor. Therefore, this study aims to examine the freedom of judges from the aspect of the reasons why judges do not accept the charges of public prosecutors. This research is a normative research, so the data needed is secondary data in the form of legal documents, journals and references relevant to the research problem. The data is analyzed descriptively based on the principles of substantive criminal law and formal criminal law. The results of the study showed that there was no seriousness of the public prosecutor in conducting the prosecution which was shown by the absence of guarantees to bring the defendant, thus violating the principles of fast, simple and low cost justice. This research provides information to the public that judges are not bound by the demands of the public prosecutor.
