Abstract

Sebagai respon terhadap tingginya kasus Korupsi di Indonesia, pemerintah melakukan berbagai upaya, antara lain melalui penerapan sanksi pencabutan hak politik terhadap terpidana kasus Korupsi. Hal ini kemudian menimbulkan permasalahan baru. Pidana pencabutan hak politik mampu memberikan rasa keadilan dan menimbulkan efek jera bagi para koruptor, namun di sisi lain, juga berpotensi melanggar ketentuan hak asasi manusia. Penelitian ini bermaksud untuk mengkaji persoalan legalitas Sanksi pencabutan hak politik dalam perspektif hukum dan hak asasi manusia. Penulis menggunakan metode penelitian normatif dengan pendekatan Konsep dan undang-undang. Berdasarkan hasil kajian, penulis menemukan bahwa sanksi pidana pencabutan hak Politik terhadap Koruptor tidaklah bertentangan dengan konsep dan pengaturan hak asasi manuia bila diterapkan dengan batas-batas tertentu. Based on survey results and a report from Transparency International, Indonesia did not show a significant increase in the corruption perception index. Efforts to eradicate corruption are generally still hampered by high levels of corruption in the law and political sector. In response to this, the government made various efforts, including through applying sanctions to revoke political rights against convicted of Corruption cases. On the one hand, the revocation of political rights is expected to be able to provide a sense of justice and cause a deterrent effect for corruptors. But on the other hand, the revocation of political rights also caused controversy in the field of human rights. This paper intends to examine the legality of sanctions for revoking these political rights in the eyes of the law and human rights. Based on the study, the authors conclude that the revocation of political rights against corruptors does not conflict with the concept of human rights when applied to certain limits.

Abstract

Pemenuhan atas hak konstitusinal warga negara, salah satu perwujudannya ialah pemberian perlindungan terhadap warga negara dalam hal penggunaan jasa perjalanan ibadah haji dan umrah bagi umat Islam terkhusus kepada masyarakat provinsi Sulawesi Selatan. Hal ini menjadi masalah besar bagi masyarakat Sulawesi Selatan. Dalam penelitian ini penulis menggunakan jenis penelitian normatif, sifat penelitian ini deskriptif dan pendekatan yang digunakan ialah pendekatan perundang-undangan dan konseptual. Berdasarkan data yang diperoleh, penulis berkesimpulan bahwa banyaknya kasus penipuan terhadap calon Jemaah haji dan umrah mengharuskan Pemerintah Provinsi Sulawesi Selatan untuk menyusun peraturan daerah yang memuat norma penguatan fungsi koordinasi dengan lembaga yang diberi kewenangan untuk menjalankan fungsi pengawasan. Hal ini dapat dilakukan dengan meyusun rancangan peraturan daerah provinsi Sulawesi selatan tentang perlindungan jemaah haji khusus dan umrah. Fulfillment of the constitutional rights of citizens, one of the manifestations is the provision of protection for citizens in terms of the use of pilgrimage and umrah pilgrimage services for Muslims especially to the people of south Solawesi Province. This has become a big problem for the people of South Sulawesi. In thi study the authors used a type of normative research, the nature of this research is descriptive and the approach used is statutory and conceptual approach. Based on data obtained, the authors conclude that the number of cases of fraud against prospective pilgrims and umrah requires the Government of South Sulawesi Province to draw up regional regulations tha contain norms for strengthening the coordination function with institutions authorized to carry out the supervisory function. This can be done by drafting a local regulation on the province of South Sulawesi concerning the protection of special pilgrims and umrah.

Abstract

Basically, every country is obliged to ensure quality education without discrimination against every citizen, including Indonesia. Recognition of the right to education is so important that it becomes one of the goals of the state as stated in the Preamble of the 1945 Constitution, namely to educate the nation's life. However, since the COVID-19 pandemic hit the world, the education sector has also been affected. People have no choice, but to implement the Covid-19 prevention habits and protocols. In the case of Indonesia, the government has closed the schools and universities since mid-March 2020 and switched to the online learning system. In this article, the author will explain the Indonesia’s legal policy in fulfilling the community’s right to education during pandemic, at the same time analyzing how government responds to the public demands. This normative legal research is conducted using a conceptual and statutory approach, which will then be analyzed descriptive-qualitatively. The result shows that educational policies during COVID-19 pandemic can be divided into two phases: early pandemic and new normal transition. In the first phase, the government focused on protecting the health and safety to all communities in the education institution areas by implementing certain protocols, closing the schools and switching to distance/online learning. Although public health and safety are top priorities, the policies resulted in disparities among students. While in the new normal transition phase, The government tends to respond to public demands on education problems by loosening its policies a little through schools disclosure and providing the internet support in online learning

Abstract

The establishment of the Independent State Commission and other non-structural institutions was one of the alterations in the structure of the Indonesian constitution during the transition era and after the 1945 Constitution was amended. It is not uncommon for these Commissions to face criticism and controversy due to their autonomous authority and independence from the major branches of power. The objective of this research is to examine and describe the primary traits of such an institution in order for it to be recognized as an Independent State Commission by comparing it to the concept and best practices in the United States. As well as to justify the legitimacy of its position within the Indonesian constitutional framework. As a doctrinal legal research, this study uses a conceptual and legal comparative approach to secondary data presented in a descriptive-analytical manner. The findings revealed that the independent State Commission's two key characteristics were its independence from the executive organs and its autonomous-regulatory power. In terms of legal position, the classical trias politica perspectives need be modified as the Independent State Commission is now viewed as a new branch of government under a new separation of powers framework.

Abstract

The city of Tangerang is a new area resulting from the development of the Tangerang Regency of Banten province. Tangerang City develops and shows itself as a supporting metropolitan city of the capital city of Jakarta. The Tangerang City Government has a large program to build a livable city, worthy of investment, worth a visit, and a smart city that is currently familiar with Tangerang Liveable, Investable, Visitable, E-City (LIVE). The purpose of this study is to introduce the Tangerang City government program. The benefits of this research are as a medium of information and promotion. The method used is by way of field observation and literature study. The problem approach is making analysis, story boards, shooting, video editing and rendering. In the making of this video using Adobe Premier Pro CC 2018 software and the results of the profile program LIVE Kota Tangerang program made in mp4 format then uploaded on youtube social media with the aim of being seen by the wider community, especially the citizens of Tangerang City. Abstract

This research aims to analyze the correlation between service quality and customer loyalty at the Oma Casa Hotel, Bengkulu City. Service quality is measured based on five main dimensions, namely reliability, responsiveness, guarantee, empathy, and physical evidence, while customer loyalty is analyzed through the variables of customer satisfaction, frequency of repeat visits, and the tendency to recommend the hotel to others. This research uses a survey method by collecting data through questionnaires distributed to 100 customers staying at the Oma Casa Hotel. The analysis technique used is Pearson correlation to test the strength and direction of the relationship between service quality and customer loyalty. The research results show that there is a significant positive relationship between service quality and customer loyalty at the Oma Casa Hotel, which indicates that improving service quality can have a direct effect on increasing customer loyalty. These findings provide implications for hotel management to focus more on improving service quality to strengthen relationships with customers and increase repeat visit rate

Abstract

The Constitutional Court's approach towards regional head election disputes is regarded as quite progressive and illustrates the growing trend of judicial activism. This article attempts to analyze the practice of activism by the Constitutional Court in the context of regional head election disputes and assess its consistency in simultaneous elections. This study uses a conceptual, statutory and case approach in analyzing several regional head election dispute decisions in 2020. The activism of the Constitutional Court in the context of regional head election disputes is at least practiced by judges through three things: first, the determination taken by the Constitutional Court to decide on re-voting and re-counting of votes; second, the willingness of the Court to consider election offenses that are structured, massive, and systematic; and third, the courage of judges to disqualify regional head candidates as well as determine the winner to provide legal certainty. This practice of activism is still being consistently pursued by judges in the 2020 simultaneous regional head elections. Even so, there is a tendency that structured, systematic and massive violations are not the main reason for terminating the election results, and even tend to be complicated by judges who demand more significant evidence. This condition will cause the burden of proving the structured, systematic and massive offenses to be much heavier in the future. This seems to be contradictory to previous decisions of the Constitutional Court which were known to prioritize substantive justice.

Abstract

In 2024, Indonesia held simultaneous regional head elections on the same day across the country, in contrast to the traditional patterns of regional head elections held in succession. Simultaneous regional head elections were held to increase stability and efficiency. However, there are several drawbacks, such as creating a vacancy in regional head positions that necessitates the appointment of an acting head and even forcing some permanent regional heads to step down before their terms are up. This study examines the contradictions in the 2024 simultaneous regional head election policies using the antinomy perspective. The study reveals two fields of legal antinomies under the policy of simultaneous local elections: norms and principles. This conclusion comes from normative secondary data analysis utilizing statutory and conceptual approaches. The legal antinomy on norms arises from a contradiction within the Regional Head Election Law. Article 201 Paragraph (8) orders simultaneous local elections for government stability. On the other hand, Paragraph (9) allows the appointment of acting heads of regional government, which has the potential to cause administrative, political, and social instability. In this context, a paradox emerges between the intended goal of stability and the potential for instability resulting from the policy. The legal antinomy on principles appears in the conflict between budget efficiency (expediency principle) and legal certainty. The goal of saving costs clashes with the principle of legal certainty because the fixed term of office for elected regional heads is set by law. This study helps better understand the challenges of moving from conventional to simultaneous local elections.

Abstract

Penelitian  ini bertujuan untuk menganalisis kebutuhan pengembangan video pembelajaran mata kuliah metodologi penelitian pada mahasiswa PG PAUD Universitas Negeri Medan tahun angkatan 2019 yang sudah mengikuti model perkuliahan abad 21. Penelitian ini merupakan penelitian deskriptif yang dilaksanakan melalui metode studi pustaka, wawancara dan angket pada bulan mei 2022. Subjek dalam penelitian ini adalah 115 mahasiswa PG PAUD Universitas Negeri Medan tahun angkatan 2019. Hasil penelitian berdasarkan studi pustaka menunjukan bahwa video pembelajaran yang dibutuhkan mahasiswa adalah video pembelajaran yan mampu meningkatkan keterampilan mahasiswa yang dilakukan dengan memperhatikan teknik dan komponen seperti; (a) bersifat informatif, (b) adanya potongan gambar, (c) adanya animasi diagram, (d) adanya video pembanding, (e) adanya contoh nyata, (f) adanya penjelasan ahli, (g) gaya bahasa, tempo, dialek dan intonasi suara (h) rekaman dari beberapa sudut pandang dan (i) adanya pertanyaan. Video pembelajaran yang dibutuhkan diharapkan mampu menambah pengalaman mahasiswa melalui video yang berisikan; (a) gerakan lambat atau cepat, (b) objek 3 dimensi, (c) kejadian langka dan, (d) lokasi yang sulit, dan selain itu video pembelajaran yang dibutuhkan diharapkan  meningkatkan motivasi mahasiswa dengan cara; (a) mengaitkan materi dengan manfaat, (b) mengundang rasa empati, (c) membangun rasa percaya diri mahasiswa. Keseluruhan dari hal tersebut dikemas dalam bentuk video dengan durasi 15 menit, pada resolusi 720pixel dalam platform youtube
