Abstract

The expansion of peat land use is increasing rapidly in several provinces that have large peatlands, including Riau Province. Base on Government Regulation Number 57 of 2016 concerning the Protection and Management of Peat Ecosystem Article 1 paragraph (1) explains that the protection and management of the peat ecosystem is a systematic and integrated effort carried out to conserve the function of the peat ecosystem and prevent demage to the peat ecosystem which include planning, controlling, maintenance, supervision and law enforcement. Formulation of the problem (1) how is the protection and management of peatlands in Riau Province ? (2) what are the constraints faced ? (3) how are the effort carried out ? This study used a socio-legal approach. Data used include primary and secondary data. Data collected through document studies and in-depth interviews. Descriptive qualitative data analysis technique.

Abstract

The present-day dynamic development of the world economy is creating enormous changes in trade. The increasing developments and needs of the global market today for adequate facilities and infrastructure for economic activities has created many forms of unhealthy competition, one of which is bid rigging which is carried out to avoid competition between business actors. This tender collusion is widespread among large business actors who want to obtain partnerships with the government in providing infrastructure. Hence, Law Number 5 of 1999 Concerning Prohibition of Monopolistic Practices and Unfair Business Competition was formulated which regulates administratif penalty due to bid rigging. Seeing that the problem of tender collusion is still occurring, this research was conducted to identify fines as the main administratif sanction to prevent collusion in tender activities. Therefore, this article was prepared with the title "The Urgency of Imposing Fines as the Main Administratif Sanction: Review of Cases of Tender Rigging in Unfair Business Competition". The object of this research is fines as administratif penalty with the aim that if fines are determined as the main administratif sanction before the main crime, healthy business competition will be created. The normative judicial with literature study is a method that will be used in this research so that we can see how fines as administratif penalty apply in cases of bid rigging.

Abstract

This article is motivated by the rapid development of the world of capital markets in Indonesia, and it cannot be denied that one of the crimes occurring in the world of capital markets is the practice of insider trading. This research uses a normative juridical approach, namely a type of approach that examines or analyzes secondary data such as library materials or secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Regulations regarding the practice of insider trading already have a legal umbrella in Article 95 and Article 99 of Law Number 8 of 1995 concerning Capital Markets, but in fact the existence of a legal umbrella with these articles still creates unclear implementation and law enforcement regarding insider trading cases. happened in Indonesia. Situations like this then contribute to losses felt by other public investors. Therefore, this research will discuss legal protection arrangements and legal remedies for public investors who experience losses due to insider trading practices based on Indonesian positive law. This research uses a normative juridical method with the Statute Approach. Legal protection for public investors for losses resulting from insider trading practices is regulated as immaterial losses which can take legal action through litigation, namely civil lawsuits with the argument of unlawful acts, or non-litigation through the Alternative Institution for Financial Services Sector Dispute Resolution which is provided by OJK.

Abstract

Advances in information technology also open up opportunities and challenges for Notaries and require that Notaries not only be able to work manually but can also utilize technology-based information. A professional code of ethics is a norm established and accepted by a professional group that provides instructions to its members on how to act and act while guaranteeing the moral quality of the profession in the eyes of society. The writing method applied is Normative Legal research. The aim of this research is to find out how technological developments influence and what challenges notaries face. Based on the results of this research, several influences and challenges due to current technological developments on Notary ethics include: a) Using social media as a promotional event. b) The existence of an electronic signature to be used as evidence. c) Cyber ​​crimes against personal data protection.

Abstract

Pemerintah telah menetapkan pemindahan Ibukota Indonesia dan menetapkan nama Ibukota yang baru menjadi Ibukota Nusantara sebagaimana tertuang di dalam Undang-Undang Nomor 3 Tahun 2022 tentang Ibukota Negara. Pemerintah juga membentuk Otorita Ibukota Nusantara sebagai lembaga yang berwenang untuk menjalankan pemerintahan daerah di kawasan Ibukota Nusantara. Di dalam Peraturan Presiden Nomor 65 Tahun 2022 tentang Perolehan Tanah dan Pengelolaan Pertanahan di Ibu Kota Nusantara, Otorita Ibukota Nusantara diberikan kewenangan untuk mengendalikan pengalihan hak atas tanah yang berada di kawasan Ibukota Nusantara. Salah satu metode pengendalian yang dimaksud adalah dengan mewajibkan Notaris untuk mendapat persetujuan sebelum membuat akta perjanjian pengikatan jual beli. Namun, hingga saat ini, tidak ada ketentuan secara khusus yang mengatur bagaimana pemberian persetujuan oleh Otorita Ibukota Nusantara kepada Notaris.Terlebih lagi, akta perjanjian pengikatan jual beli bukan merupakan alat bukti pengalihan hak atas tanah karena belum memenuhi asas tunai dan terang. Selain itu, ketentuan saat ini juga tidak mengatur akibat hukum apabila Notaris membuat akta perjanjian pengikatan jual beli tanpa persetujuan Otorita Ibukota Nusantara. Oleh karena itu, diperlukan perbaikan ketentuan mengenai pemberian persetujuan akta perjanjian pengikatan jual beli yang dibuat oleh Notaris untuk mewujudkan asas kepastian hukum.

Abstract

Notaris merupakan profesi yang ditentukan di dalam Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris jo. Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris (“UUJN”), dimana mengatur mengenai tugas, kewenangan dan kewajiban Notaris. Adapun salah satu kewenangan Notaris yang diatur di dalam UUJN adalah kewenangan Notaris untuk melakukan penyuluhan hukum. Di era teknologi yang maju seperti saat ini, teknologi komunikasi telah mampu menjangkau masyarakat yang lebih luas untuk waktu yang jauh lebih cepat. Maraknya penggunaan media sosial juga menjadi salah satu bukti bahwa teknologi komunikasi telah berkembang pesat. Media sosial saat ini juga telah dilengkapi dengan fitur-fitur yang semakin mempermudah interaksi antar penggunanya, tanpa perlu mengkhawatirkan jarak dan waktu. Dikaitkan dengan kewenangan Notaris dalam melakukan penyuluhan hukum, saat ini media sosial menjadi sarana yang mudah dan cepat untuk melakukan penyuluhan hukum kepada masyarakat. Penelitian ini menggunakan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach) untuk meneliti bagaimana pemanfaatan sosial media oleh Notaris sebagai salah satu sarana melaksanakan kewenangan Notaris. Penelitian ini menemukan bahwa berbagai media sosial seperti Instagram, Blog, TikTok dsb., menyediakan platform dengan fitur-fitur interaktif yang dapat dimanfaatkan oleh Notaris untuk melakukan penyuluhan hukum. Namun demikian, dalam menjalankan kewenangannya, Notaris tetap tunduk pada ketentuan Kode Etik Notaris yang mengatur larangan-larangan bagi Notaris. Salah satu larangan yang diatur adalah larangan untuk melakukan publikasi atau promosi Notaris melalui media sosial. Hal ini tentunya menimbulkan adanya ketidakjelasan, dimana penyuluhan hukum yang dilakukan melalui media sosial, dapat disalahartikan sebagai kegiatan publikasi atau promosi yang bertentangan dengan Kode Etik Notaris. Oleh karena itu, penting bagi seorang Notaris untuk selalu menjaga wibawa dan etika profesi terlebih ketika menjalankan kewenangannya untuk melakukan penyuluhan hukum. Notaris wajib memastikan bahwa kegiatan penyuluhan hukum melalui media sosial, tidak melanggar ketentuan larangan dalam Kode Etik Notaris. Selain itu, untuk menghindari keragu-raguan dan agar timbul kepastian hukum, Ikatan Notaris Indonesia perlu membentuk panduan khusus mengenai bagaimana tata cara penyuluhan hukum oleh Notaris melalui media sosial.

Abstract

Money Laundering (ML) is a significant threat to the economic stability and financial system integrity of a country. To address this issue, the roles of reporting parties such as Notaries, play a crucial role in efforts to prevent and eradicate ML. This research aims to analyze the roles of Notaries in performing their duties as reporting parties in the context of ML prevention and eradication efforts. Additionally, it aims to identify transactions that can be considered suspicious by Notaries in their capacity as reporting parties, such as a lack of training and sufficient understanding of suspicious transaction indicators. Therefore, further efforts are needed to enhance the understanding and training of Notaries. This research employs a normative juridical research method with an approach to various legal regulations governing the roles of Notaries in reporting suspicious transactions related to ML. Data is obtained through the analysis of legal documents encompassing laws, regulations, and guidelines related to the roles of Notaries in preventing and eradicating ML.

Abstract

Parents and guardians are authorized to represent the legal actions of minors. According to the Civil Code, the authority of parents to act on behalf of their children has limitations, namely to transfer immovable property belonging to minors must be determined by a permit to sell from the district court. In this case, the parents sold the minor's land without permission to sell from the district court, but with a Certificate of Guardianship from the village. The purpose of this study is to analyze the provisions regarding the appointment as guardian for parents who live the longest to be able to act on behalf of their children and the position of the deed of sale and purchase of land owned by minors made without court permission. The method used in this research is doctrinal research. The result of this research is that the appointment as guardian is not required for parents who live the longest to be able to act on behalf of their children. This is because according to the Marriage Law, Compilation of Islamic Law, and Supreme Court Circular Letter No. 7/2012, the longest living parent continues to exercise parental authority and does not change into guardianship even though the marriage ends due to the death of one of the parents. The position of the deed of sale and purchase of land owned by a minor in this case remains valid even without permission to sell from the district court because the seller is not subject to the Civil Code.

Abstract

Penelitian ini bertujuan untuk membandingkan konsep ultra vires dalam hukum perusahaan di Indonesia, Inggris, Jerman, Singapura, dan Australia. Ultra vires mengacu pada tindakan perusahaan yang melewati batas wewenang yang telah ditetapkan dalam anggaran dasar atau memorandum of association. Setiap negara memiliki kerangka hukum yang berbeda dalam mengatasi masalah ultra vires, dan tulisan ini akan menganalisis perbedaan dan persamaan dalam pendekatan hukum kelima negara tersebut.

Abstract

Cases of distribution of goods, especially illegal cigarettes, which are rife in Limapuluh Kota Regency, must be a serious concern. A very significant spike was found in cases resulting from prosecution during the 2019 to 2020 period where the number of illegal cigarettes of various brands destroyed was 4,180,352 (four million one hundred eighty thousand three hundred and fifty two) cigarettes. This research is legal research with descriptive analytical research specifications. The approach used is a normative juridical approach, supported by an empirical juridical approach. The data used is secondary data as main data and primary data as supporting data, which was collected through literature study/document study and field study using interview techniques. The data was then analyzed qualitatively and presented in analytical descriptive form. Based on the results of research, discussion and analysis, the following conclusions can be drawn: First, law enforcement at the level of investigating criminal acts of distribution of illegal cigarettes at the Fifty Cities Police Criminal Investigation Unit by applying the provisions of Article 199 in conjunction with Article 114 of Law Number 36 of 2009 concerning Health in conjunction with Article 62 Paragraph ( 1) Juncto Article 8 Paragraph (1) Letter I of Law Number 8 of 1999 concerning consumer protection Juncto Article 55, Article 56 of the Criminal Code. Second, the obstacles faced by the Limapuluh Kota Resort Police Criminal Investigation Unit in enforcing the law against the criminal act of distributing illegal cigarettes are the lack of personnel, lack of community role and the difficulty of finding illegal cigarette distributors. Third, the efforts made by the Limapuluh Kota Resort Police Criminal Investigation Unit in enforcing the law against the criminal act of distributing illegal cigarettes are by conducting examinations of health experts, conducting examinations of criminal experts and conducting examinations of witnesses of PT Leadon Tobacco, which is a factory that produces Luffman brand cigarettes.
