Abstract

The case study presented in this research is Decision Number 604 K/Pid.Sus LH/2017, the defendant named Hartono committed the crime of storing and collecting B3 waste without permission. The aim to be achieved in this research is to examine the enforcement of criminal law and the judge's considerations in handing down decisions in criminal cases regarding the storage and collection of hazardous waste in Decision Number 604 K/Pid.Sus LH/2017. The research method used in this research is doctrinal/normative legal research. Where this research is focused on examining the application of rules or norms in positive law. The results of this research show that law enforcement in Decision Number: 604 K/Pid.Sus LH/2017 has paid attention to Article 102 in conjunction with Article 59 Paragraph (4) of the Law. RI Law Number 32 of 2009 concerning Environmental Protection and Management in conjunction with Government Regulation Number 101 of 2014 concerning Management of Hazardous and Toxic Waste, Law Number 48 of 2009, Law Number 8 of 1981, and Law Number 14 of 2009 1985 as amended and supplemented by Law Number 5 of 2004 and the Second Amendment to Law Number 3 of 2009 as well as other relevant laws and regulations. The judge's considerations in this case also met the elements of justice and did not take sides towards the defendant or other parties. As well as considering the element of benefit, namely not causing unrest in social life because the Defendant has been given sanctions because of his actions which could endanger the environment and the surrounding community.

Abstract

In contrast to positive law, customary law does not recognize the distinction between criminal law and civil law. The settlement of cases in the community is carried out by means according to customary law. One of the cases resolved according to Riau Malay customary law was a case of insulting the Malay tribe in Dumai City. Using empirical juridical research methods, based on the results of the study, it was found that the settlement of cases of insults to the Malays was carried out by deliberation and sanctions ranging from light to severe sanctions, namely making yellow rice, slaughtering animals in the form of chickens, goats and buffaloes and disposing of the country which was divided into two, namely disposing of the country within a specified time and disposing of the country that was not determined.

Abstract

This study aims to investigate the essential role of the rule of law within the framework of a nation's constitution. Its focus lies in how the constitution provides a solid foundation for safeguarding the rights of citizens. The research objective is to gain a deeper understanding of how the rule of law ensures justice, freedom, and the protection of human rights for all citizens. This endeavor will aid in identifying the strengths and weaknesses within existing systems of constitutional law. Employing a thorough approach to legal and constitutional analysis, the study involves critical reviews of constitutions, legal regulations, and court decisions related to the protection of citizens' rights. Data will be gathered from primary and secondary sources, including legal documents, academic literature, and judicial rulings. The expected outcome of this research is to provide better insights into how the rule of law can function as a guardian of justice and human rights enforcement. This in-depth analysis is anticipated to lay the groundwork for further debate on the role of the rule of law in building a fair and inclusive society.

Abstract

A number of regulations include legal protection for legal subjects, both preventive and enforcement, which can be in the form of written or unwritten regulations. In the context of selling objects used as fiduciary collateral, creditors can be legally protected if the state confiscates the object. Fiduciary, essentially, involves transferring ownership rights to an item in the belief that the owner of the item will retain control of it. However, the state can confiscate items that are the subject of fiduciary guarantees if they are used for unlawful activities. Attention to this matter is important for finance companies which may experience losses due to state confiscation of objects used as fiduciary collateral.

Abstract

The reform of civil law plays a crucial role in guiding society towards better gender justice. This article investigates the impact of civil law reform on women's empowerment and the enhancement of gender equality across various aspects of life. The primary focus involves analyzing legal changes aimed at addressing gender disparities in civil rights, property ownership, and family responsibilities. The discussion includes evaluating the impact of civil law reform on traditional structures that may limit women's roles. Additionally, this article highlights concrete steps taken to provide stronger legal protection for women, encouraging active participation in social and economic life. Through an interdisciplinary approach, the article also reviews the psychological and social impacts of civil law reform on societal perceptions of gender roles. Thus, the author argues that civil law reform is not only about legal reform but also a critical step towards a more just and equal society. In conclusion, civil law reform is not merely a legal necessity but also a catalyst for profound social change. This article hopes to stimulate further discussion on how legal efforts can continue to promote gender equality within a broader legal framework.

Abstract

Regulation of sanctions for criminal acts of human trafficking in Indonesia is specifically regulated based on Article 1 number 1 of the Law on the Eradication of Criminal Acts of Trafficking in Persons which defines human trafficking as various acts of surveillance, transportation, harboring, sending, transmitting or receiving a person in various ways for the purpose of exploitation, including sexual exploitation, with laws that cause dilemmas, especially regarding prospective Indonesian workers who are vulnerable to becoming victims of human trafficking. The research method used in this research is normative juridical using a statutory regulation approach and a context approach in answering problems. The results of the research show that the application of sanctions for criminal acts of trafficking in persons as regulated in Article 2 paragraph (1) of the Law on the Eradication of Criminal Acts of Trafficking in Persons against perpetrators who exploit victims, fraud in aggravation, sanctions are also applied to state administrators, corporations and their administrators, groups organized criminal acts of human trafficking. Legal uncertainty in the application of sanctions for criminal acts of human trafficking is a serious problem that can disrupt eradication and law enforcement. This primarily relates to legal provisions governing the crime of trafficking in persons, which is very important for effective law enforcement. This uncertainty is found in two main regulations: the Law on the Eradication of the Crime of Human Trafficking and the Law on the Protection of Indonesian Migrant Workers.

Abstract

Market management and development in several areas has been carried out optimally, such as in the Medan City area. However, in the Tanjung Tiram Inpres market there are still several problems that have not been resolved. Regional Regulation Number 6 of 2016 concerning Market Management still has not achieved unity between law and society, which can cause obstacles to market management and development. Market effectiveness can be assessed based on the market management carried out, such as repairing public toilets, repairing market buildings such as kiosks, stalls and courtyards. Good lighting and security must also be considered, so that traders feel safe. The government must go directly to the field to monitor market developments so that it can take the right policies. Dialogue with the Market Association and traders must also be carried out to find out and resolve the problems faced. The government should have made regulations regarding Regional Market Companies (PD) so that PD Markets are available in every market in Batubara Regency. This will help with more effective and efficient market management and development.

Abstract

Strengthening of the role of OJK after the enactment of the P2SK Law, where after the enactment of the P2SK Law there was a regulation that all actions including decisions taken by the OJK based on the P2SK Law were not objects of lawsuits that could be submitted to the state administrative court. Of course, this will have a direct impact on the financial services industry and society if OJK's actions and decisions have a negative impact on them. Furthermore, the emergence of a new institution, namely the OJK Supervision Body which functions to assist the DPR in carrying out its oversight function as well as improving the performance, accountability, independence, transparency, and institutional credibility of the OJK. This paper aims to provide a better understanding of legal protection for the financial services industry and the public in the context of their relationship with the OJK after the enactment of the P2SK Law.

Abstract

Sustainable Development is one of the environmental principles to achieve which cannot be separated from the implementation of other environmental principles. One of the most important principles to be implemented so that the goal of sustainable development, where future generations can enjoy the right to a good environment, is to be careful in using the natural resources we have now. In practice, the precautionary principle is often violated by maladministration in the issuance of permits. If a pollution has occurred, the judge becomes one of the pillars in terms of efforts to obtain compensation to make the maximum possible repairs for the losses created.

Abstract

The development of financial technology (fintech) innovation is something that cannot be avoided by various parties. Its rapid development needs to be harmonized with the regulation and protection of business actors and consumers, especially with the rise of illegal fintech. One of OJK's efforts to mitigate this risk is to implement a Regulatory Sandbox mechanism as a fintech trial that will operate later. However, in the Regulatory Sandbox mechanism, there is a weakness in that there is no follow-up assistance mechanism for fintech companies that have been declared not recommended by the OJK. So that the authors in this paper use normative juridical research methods, to study laws and regulations regarding the Regulatory Sandbox and consumer protection, which results in research that it’s necessary to have thhe formulation off an advanced regulatory sandbox assistance mechanism which is then translated into the reassessment stage, the re-assistance stage. , and the recovery stage. Apart from that, the concept of an advanced mechanism also needs to be accommodated in POJK Number 13/POJK.02/2018 along with its technical provisions, namely SEOJK Number 21/SEOJK.02/2019.
