Abstract

This research aims to analyse the form of legal protection for parties who own land rights and analyse the legal certainty of land rights certificate holders through a case study of Banjarbaru District Court Decision Number 62/Pdt.G/2022/PN Bjb. This research uses normative juridical research by analysing secondary data in the form of primary, secondary, and tertiary legal materials. The results showed that the court decision provided legal protection for Sudjar Wadi as a party with land rights through recognition of the validity of the land sale and purchase transaction, the right to appear before the Land Deed Official (PPAT), to transfer the name of the land certificate, and to take care of the lost certificate. This decision also emphasises the importance of legal certainty in protecting the rights of land certificate holders by ensuring Sudjar Wadi has legal rights to the disputed land. Law enforcement in this case achieved the goals of legal certainty, social benefit, and justice by determining the defendant to bear the costs of the case, providing incentives for effective law enforcement, and is expected to increase public confidence in judicial institutions and compliance with the rule of law.

Abstract

Perjanjian BOT antara PT Hotel Indonesia Natour (Persero) dan PT Cipta Karya Bumi Indah (PT CKBI) merupakan sebuah skema kerjasama yang melibatkan pihak swasta dan pemerintah. Dalam perjanjian ini, PT CKBI bertindak sebagai pihak swasta yang membangun, mengelola, dan mengoperasikan aset milik PT Hotel Indonesia Natour (Persero) selama jangka waktu tertentu, sebelum akhirnya mengembalikan aset tersebut kepada pihak pemerintah. Perjanjian BOT antara PT Hotel Indonesia Natour (Persero) dan PT Cipta Karya Bumi Indah (PT CKBI) telah menimbulkan dugaan perbuatan melawan hukum dalam proses perpanjangan hak BOT. Hal ini disebabkan oleh adanya ketidaksesuaian antara Surat Menteri BUMN No. 5-136/MBU/2004 dengan waktu pelaksanaan perpanjangan yang dilakukan, serta dugaan penyimpangan dalam pengelolaan aset milik negara. Penelitian ini menggunakan metode penelitian doktrinal yaitu menganalisis hukum secara normatif, berfokus pada peraturan, prinsip, dan doktrin hukum yang bersumber pada peraturan perundang-undangan, yurisprudensi, dan literatur hukum. Sumber data yang digunakan dalam penelitian ini adalah sumber data primer yaitu peraturan perundang-undangan, yurisprudensi, dan kontrak, sumber data sekunder yaitu buku, jurnal ilmiah, laporan sumber referensi lainnya dan sumber data tersier yaitu kamus hukum, ensiklopedia, dan indeks. Teknik pengumpulan data dalam penelitian ini adalah penelitian kepustakaan. Analisis data penelitian ini dihubungkan dengan permasalahan yang kemudian diteliti dan diuraikan dalam bentuk narasi. Hasil dari penelitian ini yaitu berusaha untuk menginterpretasikan dan menganalisis dugaan perbuatan melawan hukum dalam perpanjangan hak BOT terhadap skema Build Operate Transfer antara PT Hotel Indonesia Natour (Persero) dan PT Cipta Karya Bumi Indah (PT CKBI) berdasarkan surat persetujuan Menteri BUMN nomor S-247/MBU/2004 tanggal 11 Mei 2004.

Abstract

In the provisions of Batak Toba Customary Law, especially Batak Toba Customary Inheritance Law, women are relatively weak legal subjects. As a result of the patrilineal kinship system adopted by the Batak Toba indigenous community, women have limited rights, inversely proportional to men. As subjects who are often considered 'passengers' in a family, women in the Batak Toba indigenous community face direct discriminatory treatment in the eyes of the Batak Toba customary law itself. However, along with the pace of development of the times, gender-based discrimination in various aspects is no longer considered relevant. Referring to Article 17 of Law No. 39 of 1999 concerning Human Rights and the Jurisprudence of the Indonesian Supreme Court No. 179K/Sip/1961, women's inheritance rights are equal to men. Where customary laws that are no longer able to adjust to the development of community life, such as not recognizing the position of women as equal to men, cannot be maintained. Departing from this, women in the Batak Toba indigenous community have a legal protection to be able to defend their rights and position in the eyes of the law to be equal to men. Regarding the issue of inheritance rights, women in the Batak Toba traditional community can take care of making a Certificate of Inheritance.

Abstract

The writing of this research is based on the aim that an assessment will be carried out regarding the extent of the authority of the constitutional court in handling the 2024 election dispute case submitted by the presidential candidate pair and also the vice presidential candidate in serial number 3 and serial number 1. The basis for submitting the petition to the constitutional court by of the candidate pair that there are indications that there was a massive structured and systematic act of fraud in the 2024 election carried out by presidential and vice presidential candidate number 2 where in the implementation of this year's election the principles of fairness and overflow were not implemented properly. Therefore, a problem that can be studied is whether the constitutional court has the authority to handle this case, as in accordance with Law Number 24 of 2003 which regulates the authority of the constitutional court in Article 10 paragraph 1 letter a. Therefore, in the implementation or results of this research, the author really hopes that it will be useful for the constitutional court and the parties involved in this matter. Apart from that, readers will also be able to find out about the extent of authority that the constitutional court has in handling disputes over election results.

Abstract

The Constitutional Court is one of the judicial power institutions appointed to carry out judicial functions to uphold the law and justice as fair as possible. According to Law Number 24 of 2003, the Constitutional Court has the duty and function to handle constitutional cases relating to certain constitutional issues. To ensure that the constitution is implemented responsibly in accordance with the will of the people and the principles of democracy, constitutional judges must have knowledge and skills in state administration as well as a commitment to implement and oversee public life. The Constitutional Court's decision on the age limit of presidential and vice-presidential candidates in Law No. 7/2017 on General Elections (Election Law) is considered a measure of the qualifications of a leader, and this decision has caused much debate in society. The purpose of this research is to identify how the Constitutional Court's decision impacts Indonesian politics as well as the ethical standards violated by the judges when making the decision.

Abstract

Notaris secara yuridis dilandasii berdasarkan UU RI No. 2 Tahun 2014 yang mengubah UU No. 30 Tahun 2004 tentang Jabatan Notaris. Salah satu ketentuan penting adalah Pasal 35 ayat (1) yang mengharuskan keluarga notaris yang meninggal untuk memberitahukan Majelis Pengawas Daerah (MPD). Namun, prosedur penyerahan protokol notaris tidak diatur rinci, menyebabkan kekosongan hukum dan potensi masalah seperti kerusakan atau penyalahgunaan dokumen. Ahli waris seringkali kurang memahami kewajiban mereka, sehingga dapat mengakibatkan kerugian hukum dan administrasi. Ketentuan ini perlu diperjelas untuk memastikan keamanan dan kelancaran penyerahan protokol notaris. Metode penelitian yang digunakan adalah yuridis normatif dengan mengacu kepada aspek hukum positif yang berlaku di Indonesia. Hasil penelitian menunjukkan bahwa Tanggungjawab ahli waris menurut Pasal 35 ayat (1) UUJN wajib memberitahukan MPD tentang meninggalnya notaris, sehingga ahli waris mengambil alih tanggung jawab notaris. Ini berarti ahli waris tidak hanya mewarisi harta benda tetapi juga tanggung jawab dan kewajiban profesi notaris. Pasal 63 ayat (2) UUJN mengatur penyerahan Protokol Notaris oleh ahli waris kepada notaris lain yang ditunjuk MPD. Ahli waris bertanggung jawab menjaga kelangsungan praktek notaris, memastikan aksesibilitas dokumen, dan menjamin keamanan dokumen Protokol Notaris. Penyerahan protokol harus dilakukan sesuai ketentuan hukum. Ahli waris bekerja sama dengan MPD dan notaris baru untuk menjaga keutuhan dan aksesibilitas dokumen penting ini, memberikan kepastian hukum dan melindungi hak-hak pihak yang terlibat dalam perbuatan hukum. Protokol Notaris harus disimpan dengan baik meskipun notaris pensiun atau meninggal dunia, sesuai Pasal 65 UUJN. Notaris bertanggung jawab atas setiap akta yang dibuatnya seumur hidup, bahkan setelah protokol diserahkan ke penerima protokol. Penyerahan protokol oleh ahli waris wajib dilaporkan ke Majelis Pengawas Daerah (MPD) dalam 7 hari kerja. Protokol harus diserahkan ke notaris penerima dalam 30 hari dengan berita acara. Jika notaris meninggal saat cuti, Pejabat Sementara Notaris menyerahkan protokol dalam 60 hari. Prosedur ini memastikan tanggung jawab beralih ke notaris penerima protokol, melibatkan ahli waris, MPD, dan pejabat sementara notaris, serta menghindari masalah hukum dan administrasi terkait dokumen notaris.

Abstract

Anak sebagai pedagang asongan menjadi salah satu fenomena yang paling sering ditemui di beberapa lokasi Ruang Publik Kreatif (RPK) di Jakarta. Mayoritas mereka memilih untuk bekerja sebagai pedagang asongan dilatar belakangi oleh kondisi ekonomi yang mencapai tahap kemiskinan, sehingga bekerja dengan berdagang diharapkan dapat membantu mereka untuk memenuhi kehidupan diri sendiri dan keluarga. Meskipun dilatar belakangi kondisi ekonomi, namun perilaku anak sebagai pedagang asongan merupakan hal yang melanggar hukum dan peraturan, terutama peraturan daerah DKI Jakarta karena dianggap tidak memenuhi kriteria kesejahteraan anak. Anak menjadi pedagang asongan dapat dikategorikan dalam viktimisasi struktural jika mengalami penyalahgunaan kekuasaan seperti eksploitasi, diskriminasi, dan penindasan. Penelitian ini menggunakan metode penelitian deskriptif dan pendekatan kualitatif. Dalam melakukan analisis, peneliti menggunakan konsep viktimisasi struktural oleh Ezzat Fattah yang berasa dari teori viktimologi. Pengumpulan data penelitian dilakukan dengan cara studi pustaka, wawancara serta observasi. Hasil penelitian menunjukkan, keempat subjek dalam penelitian ini mengalami viktimisasi struktural sebagai anak yang menjadi pedagang asongan di RPK Jakarta dengan analisis menggunakan empat faktor struktural yang diidentifikasi oleh Cameron dan Newmann yaitu, faktor ekonomi, faktor sosial, faktor ideologi, dan faktor geopolitik. Faktor-faktor ini turut menjadikan anak sebagai posisi rentan untuk dapat dieksploitasi oleh orang dewasa sebagai pekerja, salah satunya dengan menjadi pedagang asongan.

Abstract

The mode of Money Laundering Crime (TPPU) that often occurs in Indonesia is by utilizing the role of Notary and PPAT in performing their duties. Notaries and Land Deed Officials ("PPAT") become co-suspects in criminal cases, because they are suspected of assisting in the implementation of money laundering crimes, or other criminal acts involving deeds made. The research method used in writing this article is normative juridical research with a research approach using statutory regulations and using a theoretical or conceptual approach. The results of the analysis of the Notary and PPAT in carrying out their duties to anticipate money laundering apply the principle of Recognizing Service Users, if the Notary or PPAT finds suspicious transactions, they can report it to the Financial Transaction Reporting and Analysis Center (PPATK). In addition, Notary and PPAT are not responsible for the criminal act of money laundering committed by the parties or their clients who use the services of Notary or PPAT who require their services based on their authority. The position of the Notary and PPAT in exercising their authority to make authentic deeds is only as a recorder that is poured into a deed that gives rise to legal acts and has perfect evidentiary power. Notaries and PPAT are only obliged to report to PPATK if there are indications of money laundering committed by the parties or their clients through their services as Notaries or PPAT.

Abstract

The relationship between banks and customers is based on two most related elements, namely law and trust. Banks as processors of customer personal data are required to maintain the confidentiality of customer personal data. The government's role in protecting personal data is manifested in the establishment of the Financial Services Authority (OJK) and the ratification of the Personal Data Protection Law (UU PDP), as well as other laws relating to regulations in the banking sector. Regardless of the regulations made by the government and the principles/principles implemented by banking services, cases of personal data leakage still occur. To study this paper, the author used normative legal research with analytical descriptive methods. The author uses secondary data obtained by means of library research to examine some of the documents connected to this writing using a statutory approach, a historical approach and a case approach. The research data discusses the responsibility of banking services for leaking customer data through Decision Case no. 615/Pdt.G/2023/PN Sby.

Abstract

The need for adequate housing is a mandate of the Constitution. This is what encourages the growth of the house development industry and ready-to-live buildings in Indonesia. However, in its implementation, the community is often faced with the problem of developer companies being declared bankrupt, causing legal uncertainty for consumers. This is what makes researchers interested in examining these legal issues. This research uses normative juridical research with a statutory approach through secondary data searches. The result of this research is that when the developer enters PKPU and is even declared bankrupt, it is the consumers who suffer great losses. Because, if the developer is declared bankrupt and the Deed of Sale and Purchase (AJB) has not yet belonged to the consumer, the consumer's assets will also be confiscated and auctioned, and the consumer does not necessarily get a share of the proceeds from the auction because it is not certain that the results are sufficient to pay off his share. In this case, it can be seen that in bankruptcy cases, consumers are the most vulnerable. In the absence of AJB in addition to being the last creditor, the consumer is not the owner of the land and the land will be auctioned and divided by the separatist creditor. There needs to be an effort from the government to form a specific regulation governing further provisions and the position of creditors in bankruptcy, PPJB, reservation agreements, Pre-Project Selling obligations of developers, as well as sanctions if it is found that the development company has defaulted or broken promises. Because the Bankruptcy Law and GCPL have different solutions from each other, it is necessary to have clearer arrangements between bankruptcy and consumer protection to create legal certainty.
