Abstract

This study aims to explore the considerations made by judges of the Banten High Court in resolving Civil Case Number 173/Pdt./2023/PN.BTN. concerning a dispute over the sale and purchase of land, which involves marital property and is linked to the principles of nebis in idem and the fundamental theory of contract formation. The methodology involves inventorying primary and secondary legal materials related to land law, followed by the identification of these materials according to the central issues of the research. Through analysis of these legal materials, the researcher seeks to provide insights and solutions to the questions raised. The findings revealed that the judges of the High Court of Banten affirmed the decision of the Tangerang District Court in Civil Dispute Number 173/Pdt./2023/ PT.BTN. They found that the reasons behind the initial decision were correct, especially regarding the land and building ownership issue involving Mr. Arhan. Hence, it is crucial for judges to thoroughly review all aspects of a case, particularly the subject matter, to ensure a fair and just outcome that benefits all parties involved.

Abstract

Corruption in Timor-Leste has become a chronic issue that harms the country's finances and economy, as well as violates the social and economic rights of the people. Efforts to recover state financial losses due to corrupt practices through civil proceedings have not been optimal, with the focus being more on criminal prosecution, which has proven to be ineffective. This research aims to examine the concept of recovering state financial losses through civil processes in Timor-Leste, identify obstacles in filing civil lawsuits, and formulate an ideal model and specific regulations for civil lawsuits in the context of recovering the proceeds of corruption. The study uses a qualitative approach by examining relevant legal documents and analyzing the judicial process and financial management in Timor-Leste. The focus of this research is on the application of civil lawsuit rules in recovering the proceeds of corruption and the challenges faced. The results show that the use of civil forfeiture can be a solution to expedite the recovery of corrupt assets through civil proceedings. The research also found obstacles in civil lawsuits, such as the ineffectiveness of criminal prosecution in reducing corruption and the need for anti-corruption legal reforms to improve the mechanism for recovering corrupted state assets. The proposed ideal model includes strengthening the role of the administrative tax and accounts court in examining the management and financial responsibility of the state, as well as placing civil lawsuits as the primary legal effort in combating corruption. This research underscores the importance of legal reforms and the implementation of civil lawsuits as the main strategy in fighting corruption in Timor-Leste. The use of civil forfeiture and asset confiscation through administrative channels is necessary to expedite the recovery of corrupt assets and reduce state financial losses.

Abstract

This research was motivated by the marriage of couples with different beliefs, called interfaith marriages. This type of marriage was originally permitted based on Law Number 24 of 2013, amendment to Law Number 23 of 2006 concerning Population Administration, then it was not permitted (prohibited) based on the Supreme Court Circular. (SEMA) Number 2 of 2023. The aim of this research is to determine the dualism of interfaith marriage arrangements. This research uses descriptive analytical methods with a normative juridical approach. The research results show that this inconsistency occurs because it is explicitly stated in Article 2 paragraph (1) of Law Number 1 of 1974 concerning Marriage and Article 44 of the Instruction of the President of the Republic of Indonesia Number 1 of 1991 concerning the Compilation of Islamic Law which states that marriage between different religions is prohibited. The Surabaya District Court has decided case No.916/Pdt.P/2022/PN.Sby and has been confirmed by Supreme Court Decision Number 1400K/PDT/1986, the essence of the decision is to allow interfaith marriage between Rizal Adikara who adheres to Islam and Eka Debora Sidauruk who adheres to Christianity. The results of the research concluded that after the Supreme Court Circular Letter (SEMA) Number 2 of 2023, all interfaith marriages were prohibited.

Abstract

This research is motivated by the fact that resolving disputes regarding joint property in the household which can no longer be maintained is to resolve them peacefully by making a deed of agreement between the disputing parties, that would be better and fair. The purpose of this research is to determine the analysis of cumulative decisions on divorce cases and joint property linked to Law Number 50 of 2009 concerning amendments to Law Number 7 of 1989 concerning Religious Courts. This research uses descriptive analytical methods with a normative juridical approach. The results of the research show that after developing resources, infrastructure and technology, the court needs to provide education and training for the parties involved in the lawsuit accumulation process so that they understand the legal process that will be taken in order to increase the quality of management and the ability to analyze appropriately so that errors do not occur so there must be process delays, and most importantly the court must carry out continuous evaluation and revision to create fast, simple and low-cost principles. The entire authority of the Religious Courts is determined by Law Number 50 of 2009 regarding the revision of Law Number 7 of 1989 regarding Religious Courts. Among them are marriage, divorce due to divorce, contested divorce, inheritance, wills, grants, endowments, zakat, infaq, alms, and sharia economics. Regarding what is included in the scope of marriage, the settlement of divorce lawsuits and joint property is included in it, especially in the explanation of points 9 and 10.

Abstract

Due to the fast-paced population increase, land, a valuable natural resource, is becoming more and more scarce. A societal crisis could be sparked by land, which is equally susceptible. Consequently, it is critical that the State equitably regulates land ownership. The right to utilize and profit from land is granted to the possessor. Land might have primary or secondary rights, depends on the terms of the agreement between the landowner and the potential secondary right holder. Land rights are transferred through buy and sale agreements. The acquisition of land rights is governed by national land law, which places limitations on foreign nationals. Their ownership rights are not granted; only the right to use the land is. Nominee agreements with Indonesian citizens are used by some foreign nationals to own. To stop foreigners from gaining control, the Indonesian government gives priority to land owned by Indonesian nationals. Criminals also conceal assets through the employment of nominees. Therefore, Indonesian law forbids foreign nationals from owning land. Under the guise of Indonesian citizens, foreign nationals can lawfully smuggle land into Indonesia through nominee arrangements. An agreement between a foreign national and an Indonesian national is involved in this.

Abstract

Notary is a public official who has the authority to make authentic deeds and has responsibility for the deed, an authentic deed made by and before a notary after being read out is then signed by the faces, witnesses, and notary. The problem arises when the confronter is unable to affix his signature due to either physical limitations, the confronter cannot read or write, or also the confronter has a signature that changes. For this problem, for those who cannot affix their signatures, the signatures can be replaced where at the end of the deed the notary provides a statement called a surrogate. This writing uses normative juridical research methods by conducting library research to obtain various legal materials and applicable laws and regulations. This writing aims to obtain the fact that notaries must be able to be responsible for the authentic deeds they make, whether it is affixed with signatures by the confronters or those who use surrogates as a substitute for signatures. It is hoped that through the use of surrogates in the deed, the confrontants will not experience differential treatment between one another so as to get the same sense of legal certainty and justice.

Abstract

Indonesia sebagai negara yang memiliki kekayaan alam berlimpah dan membuat perusahaan asing ingin bekerja sama dengan menanamkan modal. Namun kenyataanya bukan hanya menanamkan modal tetapi ingin menguasai tanah dengan cara melakukan perjanjian pinjam nama yang dikenal dengan perjanjian nominee. Dalam prakteknya perjanjian nominee sangat dilarang karena dianggap sebagai penyelundupan hukum. Pasal 1320 dan Pasal 1338 Kitab Undang-Undang Hukum Perdata menjadi pertentangan dengan praktek perjanjian nominee di masyarakat. Prinsip privity of contract hanya dapat berlaku bagi para pihak yang mengikatnya

Abstract

In an increasingly advanced digital era, minors are increasingly exposed to various technologies and access to the internet. This brings potential consequences in the form of uncontrolled data dissemination. Threats to data security and privacy are becoming increasingly pressing issues in this context. This research aims to review and analyze legal liability for personal data leakage and privacy. The research method used is a literature review that investigates the literature related to data security issues, privacy, and children's behavior in the use of technology. The findings of this study show that minors tend to be unaware of the implications of their actions on data security and privacy. They often do not understand the risks associated with sharing their personal information widely. The main threats identified include: threats of violence, coercion, perpetrating a series of lies and other physical dangers. The research also highlights factors that contribute to data sharing by minors, including lack of supervision from parents or caregivers, children's ignorance about data privacy and security, and high exposure to inappropriate online content. Indonesia has regulations as a legal basis in protecting children in the digital world, including Law No. 35 of 2014 concerning amendments to Law No. 23 of 2002 concerning Child Protection, Minister of Communication and Information Regulation No. 20 of 2016 concerning Personal Data Protection, and Government Regulation No. 43 of 2017 concerning the Implementation of Rostitution for children who are victims of criminal acts.

Abstract

Tindak pidana pencucian uang merupakan tindak pidana yang semakin marak dan kompleks dan sulit untuk dibuktikan terkait kepemilikan aset dari tindak pidana tersebut. Bahkan pada tindak pidana pencucian uang, dimungkinkan terdapat aset milik korban yang mungkin tidak menyadari posisinya sebagai korban dari tindak pidana pencucian uang sebagaimana pada contoh kasus Indra Kenz. Sebagai negara hukum, pemerintah haruslah mampu dalam menjunjung tinggi upaya hukum yang difokuskan untuk menjamin kepastian hukum dan keadilan bagi korban tindak pidana. Oleh sebabnya artikel ini berfokus pada bagaimana upaya pemenuhan keadilan terhadap korban tindak pidana pencucian uang melalui pengembalian aset milik pelaku yang telah dirampas. Penelitian ini bersifat yuridis normatif dan berfokus pada penalaran dan telaah atas peraturan perundang-undangan dan didasari pada studi kepustakaan dan pendekatan analisis. Sehingga pada akhirnya didapatkan jawaban pembaharuan substansial pasal rancangan undang-undang perampasan aset untuk lebih menitikberatkan keadilan kepada korban melalui mekanisme pembuktian terhadap aset milik pelaku tindak pidana pencucian uang yang telah dirampas.

Abstract

This article focuses on studying and analyzing in depth the mechanisms of the political system in the superstructure and infrastructure. The political system is defined as a collection or total of various activities in the country related to the public interest, including the process of determining goals, efforts to realize goals, making decisions, and preparing priority scales. . Political structure, as a result of these subsystems, can be divided into political infrastructure and political superstructure. Political infrastructure involves the basic elements that support the functioning of the political system, while political superstructure includes more complex elements and is related to providing authority and control. In this context, mechanisms are important to maintain the balance and functioning of a political system. Each political structure needs to interact with other political structures, based on the special functions that each structure has. In a country's political system, there are 2 (two) main components that run the wheels of government, namely political superstructure and political infrastructure. The political superstructure is the institutions mentioned in a country's constitution and which carry out executive, legislative and judicial functions and are tasked with making policies related to the public interest. Meanwhile, political infrastructure is a group of political forces in society that actively participates in influencing government policy as a form of democracy. If classified, there are 4 (four) forces, namely: Political Parties, Interest Groups, Pressure Groups. , Political communication media.
