Abstract

Pemerintah menerbitkan peraturan berupa peraturan pemerintah Nomor 21 Tahun 2015 tentang Tata Cara Pendaftaran Jaminan Fidusia dan Biaya Pembuatan Akta Jaminan Fidusia, peraturan pemerintah ini merupakan peraturan pelaksana Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia Terpisah Peraturan Pemerintah Nomor 86 Tahun 2000 tentang Tata Cara Pendaftaran Jaminan Fidusia dan Biaya Pembuatan Akta Jaminan Fidusia. Sedangkan untuk perumusan masalah, apa peran notaris dalam mendaftarkan sertifikat fidusia secara online? Dan apa konsekuensi hukum dari sertifikat fidusia untuk kesalahan dalam pendaftaran pasal 3 jaminan fidusia yang telah kedaluwarsa? Metode penelitian, yang digunakan peneliti adalah metode analisis yuridis dengan penelitian normatif. Penelitian normatif adalah penelitian yang dilakukan terhadap data dalam bentuk Law In Book. Bentuk penelitian normatif merupakan bentuk penelitian dengan melihat kajian literatur, dilakukan dengan menelusuri atau mempelajari dan menganalisis materi perpustakaan atau bahan dokumen siap pakai. Dalam penelitian hukum, formulir ini dikenal sebagai Penelitian Hukum, dan jenis data yang diperoleh disebut data sekunder. Notaris memiliki kewenangan untuk mendaftar fidusia secara online berdasarkan Pasal 13 ayat (1) UU Jaminan Fidusia dan Pasal 2 PP nomor 21 tahun 2015 dikatakan bahwa permohonan pendaftaran Jaminan Fidusia, permohonan perbaikan sertifikat Jaminan Fidusia, permohonan perubahan sertifikat Jaminan Fidusia, dan pemberitahuan penghapusan sertifikat Jaminan Fidusia disampaikan oleh Fidusia, kuasanya atau wakilnya kepada Menteri, Pemohon yang melakukan kesalahan dalam input data dan berlalunya waktu akan mengakibatkan konsekuensi hukum, yaitu pemohon tidak memiliki status sebagai kreditur yang diutamakan dibandingkan kreditur lain sehingga terjadi perubahan status dari kreditur pilihan menjadi kreditur serentak. Konsekuensi lain dari jaminan salah input data dalam Pasal 3 PP nomor 21 tahun 2015 dalam sistem berbasis elektronik adalah tidak memberikan kepastian hukum dan perlindungan hukum bagi pihak yang berkepentingan dan tidak memenuhi kepastian hukum.

Abstract

This paper delves into the responsibility of the head of the national land agency in handling administrative defects in Land Ownership Certificates (SHM) within the purview of administrative law. Employing a normative juridical research method, the study discerns that deficiencies in SHMs arise from various factors, whether intentional or unintentional. Such shortcomings may manifest in the data supplied by applicants during the certificate creation process or result from errors, both intentional and unintentional, in the identification of objects and subjects. Object-related discrepancies include inaccuracies in land mapping and measurement, while subject-related errors involve misinformation provided by applicants. This research aims to elucidate the origins of administrative defects in SHMs and underscores the pivotal role of the head of the national land agency in rectifying and preventing such issues. By understanding these factors, this study contributes to the broader discourse on enhancing the efficacy and reliability of land ownership certification processes, emphasizing the need for proactive measures to address and mitigate administrative defects.

Abstract

Notary/PPAT accountability is a form of responsibility carried out by a Notary/PPAT legally for a certain action against his position, duties and authority in making an authentic deed. In a land sale and purchase transaction, when pouring all forms of data provided by the parties, if there is a sale and purchase of land based on fake document evidence to transfer ownership rights to other people's land which is not actually being traded. In this case the Notary/PPAT is not properly positioned as a party to this case, because the Notary/PPAT where all products issued by a Notary/PPAT are based on Law Number 30 of Year 2004. Meanwhile, the legal consequences of land sale and purchase agreements based on forged documentary evidence are that a deed only has the power of proof as a private deed. This study uses a normative legal method, using a case approach, statutory approach, and legal conceptual approach with primary, secondary and tertiary legal materials. The conclusion of this study is that a Notary/PPAT cannot be said to have committed a violation of the making of the Sale and Purchase Deed, because what is stated in a Notary deed is the will of the parties, and as a legal consequence of the land sale and purchase agreement based on forged documentary evidence, namely the deed becomes legally flawed because it is based on manipulative documents.

Abstract

Minister of Transportation Decree No. 106 of 2019 is a government reaction to soaring flight ticket fare on domestic routes. This Minister Decree aims to prevent unfair business competition practices as mandated by Law No. 5 of 1999. On the other hand, Law No. 5 of 1999 itself does not provide an explanation of what kind of price fixing referred to by Article 5 of the Act. This then raises a question regarding business competition between business actors. This legal issue starts from the most basic condition whether the airline have carried out the sale of airline tickets that do not harm passengers, and of course there is a legal basis. The society's need for air transportation is increasing every year, but is constrained by the increasingly expensive airline ticket rates. The society and business actors need the role of the government to be able to make policies that are impartial while still considering the interests of the society and business doers.

Abstract

Due to the fast-paced population increase, land, a valuable natural resource, is becoming more and more scarce. A societal crisis could be sparked by land, which is equally susceptible. Consequently, it is critical that the State equitably regulates land ownership. The right to utilize and profit from land is granted to the possessor. Land might have primary or secondary rights, depends on the terms of the agreement between the landowner and the potential secondary right holder. Land rights are transferred through buy and sale agreements. The acquisition of land rights is governed by national land law, which places limitations on foreign nationals. Their ownership rights are not granted; only the right to use the land is. Nominee agreements with Indonesian citizens are used by some foreign nationals to own. To stop foreigners from gaining control, the Indonesian government gives priority to land owned by Indonesian nationals. Criminals also conceal assets through the employment of nominees. Therefore, Indonesian law forbids foreign nationals from owning land. Under the guise of Indonesian citizens, foreign nationals can lawfully smuggle land into Indonesia through nominee arrangements. An agreement between a foreign national and an Indonesian national is involved in this.

Abstract

In the land registration process, there are tax payment obligations that must be carried out by the parties, both sellers and buyers, before obtaining a certificate issued by the Land Office. Final Income Tax on Transfer of Land and Building Rights (PPh F PHTB) is an obligation that must be paid by the landowner. In the case of uncertified land, PPh F PHTB is imposed on the landowner twice. In addition, the landowner is also charged a one-time Land and Building Acquisition Fee (BPHTB). The tax burden listed does not include other costs such as the cost of charging Non-Tax State Revenue (PNBP) and other costs associated with the transfer of rights which, when accumulated, tend to burden the landowner. The formulation of the problem discussed in this study is how the legal certainty of income tax imposition on sale and purchase transactions of uncertified land in Indonesia uses a normative juridical approach method to solve problems by examining secondary data in the form of laws and regulations, books, and related documents. The results of the study state that the imposition of final income tax on the transfer of rights to land and buildings (PPh F PHTB) that have not been certified or registration of certificates for the first time is considered not to fulfill aspects of legal certainty and justice. This is because there will be the imposition of Final Income Tax on the Transfer of Rights on Land and Building (PPh F PHTB) in layers on the same object and tax subject.

Abstract

A notary is an official who is authorized to make authentic deeds. An authentic deed is a deed whose proof is strong in court. As a Notary, caution is important, because the Notary is responsible for the deed and the parties who sign the deed. The problem faced in this study is how to be responsible for the falsification of the contents of the deed and signatures carried out by the parties by the notary and the plaintiff in the Surabaya District Court Decision Number 237/Pid.B/2021/PN. Sby and what are the legal implications for authentic deeds that are declared fake in the Surabaya District Court Decision Number 2370/Pid.B/2021/PN. Sby. The research method used in this writing is the research of normative juridical law. The results of the study show that if a Notary while carrying out his office commits a violation that causes losses to the parties or third parties, then a Notary can be sanctioned in the form of civil sanctions contained in Article 84 and sanctions of the code of ethics for the position of Notary or administrative in Article 85. The Notary Position Law only regulates Civil Sanctions and Code of Ethics Sanctions for Notary Positions, it does not mention the existence of Criminal Sanctions that can be given to a Notary. However, criminal sanctions can also be imposed on the Notary, if the act committed meets the elements of a criminal act. As with the process of imposing witnesses, it is necessary to prove the charges that are accused of the Notary, which in the imposition of witnesses and the authority to examine and adjudicate is the code of ethics assembly, while the criminal sanctions or civil sanctions that examine and adjudicate are the courts. Legal implications for authentic deeds that are deliberately filled with false information in their creation, the notary deed is null and void by court decision and the deed becomes degraded from the original authentic deed to a deed under hand.

Abstract

Tujuan dari analisis ini adalah: Menganalisis langkah-langkah yang dapat ditempuh untuk mengurangi risiko terjadinya kecelakaan kapal tanker sehingga dapat meminimalkan risiko tumpahan minyak/bahan berbahaya ke laut. Menganalisis tahapan dan cara penanganan serta penanggulangan yang efektif bila terjadi tumpahan minyak/bahan berbahaya ke laut akibat kecelakaan kapal tanker untuk meminimalkan dampak lingkungan. Menganalisis apakah regulasi desain keselamatan kapal tanker saat ini sudah memadai atau belum untuk mencegah kecelakaan dan risiko tumpahan ke laut. Menganalisis upaya dan cara penegakan peraturan terkait keselamatan kapal tanker agar dapat mencegah risiko tumpahan minyak/bahan berbahaya ke laut. Menganalisis cara melibatkan partisipasi berbagai pihak seperti perusahaan, pemerintah, dan masyarakat internasional dalam penanggulangan risiko tumpahan akibat kecelakaan kapal tanker. Hasil penelitian menunjukan bahwa Risiko terjadinya kecelakaan kapal tanker yang menyebabkan tumpahan minyak/bahan berbahaya ke laut merupakan ancaman serius bagi lingkungan laut. Oleh karena itu, berbagai upaya perlu dilakukan untuk mengurangi risiko kecelakaan, seperti peningkatan standar keselamatan kapal, kompetensi awak kapal, sistem bantuan navigasi, dan pengawasan pelaksanaan peraturan. Bila terjadi tumpahan, penanganan dan penanggulangannya harus dilakukan secara efektif untuk meminimalkan dampak lingkungan, melalui dekontaminasi, pembersihan, penangkaran biota laut, serta pemantauan daerah terdampak. Regulasi desain keselamatan kapal tanker telah mengalami perkembangan, namun masih perlu ditingkatkan untuk mengantisipasi tantangan seperti faktor manusia, cuaca ekstrem, teknologi baru, serta tekanan efisiensi. Penegakan peraturan perlu didukung dengan peraturan pelaksanaan yang tegas, peningkatan pengawasan, kesiapan tanggap darurat, serta kerja sama antar instansi terkait. Partisipasi perusahaan shipping, pemerintah, dan masyarakat internasional sangat diperlukan dalam pencegahan maupun penanggulangan tumpahan, melalui regulasi, investasi, tim tanggap darurat, serta kerja sama antarnegara.

Abstract

This research discusses legal protection for buyers who have good intentions in land buying and selling transactions based on Supreme Court Decision Number 20 PK/Pid/2020. The research method used is normative juridical research with a case approach. The data used is secondary data originating from primary, secondary and tertiary legal materials. In discussions regarding sale and purchase deeds, sale and purchase agreement deeds, or power of attorney deeds to sell, it is important to apply the principle of good faith to create a sense of mutual trust between the seller and the buyer. Good faith in an objective sense means that the agreement must be implemented by complying with the norms of propriety and decency so as not to harm either party

Abstract

This research discusses the inheritance system according to civil law in Indonesia. One of the cases that was the focus of the research was a dispute regarding the right to inherit a house in the Supreme Court decision Number 942/K/PDT/2022 involving Amin Sudartio and Fong A Foe alias Mrs. Mey. In this case, Amin Sudartio was initially recognized as the legal heir by the North Jakarta District Court, but the DKI Jakarta High Court declared Amin Sudartio's claim unclear and then the decision was annulled by the DKI Jakarta High Court. The Supreme Court also rejected Amin Sudartio's cassation request, resulting in the cancellation of the initial decision recognizing him as the legal heir. This research also discusses legal considerations and the implications of the court decision in this case. This research uses normative juridical methods and a statutory approach to discuss the inheritance rights of second wives according to the Civil Code. This study highlights the inheritance rights of second wives in second marriages and the inheritance rights of children or descendants. This research aims to determine the inheritance rights of the second wife according to the Civil Code and the extent of the rights obtained by the wife in the second marriage. In general, inheritance is a legal system that regulates the transfer of inherited assets from a deceased person to heirs or appointed people. The Civil Code differentiates between ab-intestato heirs and heirs, and determines who has the right to inherit according to law. Apart from that, this research also emphasizes the importance of inheritance law in providing legal certainty in resolving problems related to the transfer of assets after a person's death
