Abstract

The advent of technology and easier internet access has led to a surge in internet and social media users in Indonesia, with apps like MiChat facilitating social interactions that could heighten the risk of HIV spread due to online prostitution. Commercial sex workers, once predominantly victims of trafficking, are increasingly promoting their services independently without intermediaries. This study aims to examine the enforcement of laws against online prostitution practices. The research method employed is normative juridical with a conceptual approach and statutory approach. The study finds that legal analysis of the criminalization of commercial sex work in Indonesia highlights the need for legislative renewal that emphasizes social justice and avoids disproportionate social consequences due to excessive criminalization. The necessary criminal law reform should harmonize sanctions with efforts for prevention, rehabilitation, and social reintegration to create a legal framework that supports individual well-being while maintaining social and moral integrity

Abstract

Environmental law enforcement aims to ensure compliance with environmental law regulations and requirements, both general and individual, through administrative, criminal, and civil law approaches. This research examines the position of administrative law enforcement in the environmental field and its development after changes in related laws. Using doctrinal legal research methods with secondary data from literature studies, the results show that administrative law enforcement plays an important role in protecting, managing, and restoring environmental quality. Its main advantage lies in its preventive nature through supervision and licensing, as well as its repressive nature through the application of administrative sanctions for violators. Changes in the law on environmental protection and management cause the licensing mechanism to change, which affects aspects of supervision and the application of administrative sanctions in administrative law enforcement in the environmental sector.

Abstract

The frequent conversion of agricultural land in Indonesia encourages the government to carry out or make legal products in terms of protecting sustainable food agricultural land in accordance with Law Number 41 of 2009. The stipulations in the Law are realized in the regions through the Regional Spatial Plan, in practice the conversion of agricultural land still often occurs, for example in Mojolangu Village, Lowokwaru District - Malang City. This research aims to find out whether land conversion can be implemented and how it is implemented. This research was compiled using doctrinal research methods. The results of this study are, first, the conversion of agricultural land can be carried out due to several factors, namely population, area, government policy. And regarding its implementation through the renewal of Malang City Regional Regulation Number 4 of 2011 concerning the Regional Spatial Plan of Malang City 2010-2030 which is then Malang City Regional Regulation Number 6 of 2022 concerning the Regional Spatial Plan of Malang City 2022-2042, with several stages, namely preparation for preparation, review of the previous "RTRW", collection of data and information, analysis, formulation of plan concepts, legalization of plans into regional regulations in accordance with Government Regulation Number 21 of 2021.

Abstract

One of the legal acts in the agreement is leasing, which is regulated in Articles 1548 to 1600 of the Civil Code. In Article 1548 of the Civil Code, leasing is defined as an agreement, by which one party binds himself to give the enjoyment of an item to the other party during a certain time, with the payment of a price agreed by the latter party. People can lease various types of goods, both fixed and movable. Sometimes a lease agreement often raises various legal issues, such as default or breach of promise or unlawful acts. Unlawful acts in a lease agreement can be interpreted as a negligent act or any act that violates agreed rights and/or obligations and is contrary to applicable laws and regulations, causing material or immaterial losses to others. This research is intended to analyze the legal consequences arising from unlawful acts committed by the renting party through Supreme Court Decision Number 2925 K/Pdt/2019. By using a normative juridical approach, the results of this study show that the actions of the subletting party can be categorized as unlawful acts because it terminates the lease agreement unilaterally, while there is still a validity period of the lease to which the tenant is entitled. This caused the tenant to be materially and materially disadvantaged, so they sued until the cassation level.

Abstract

Forest and land fires have widespread and serious impacts. Environmentally, these fires cause ecosystem damage, loss of biodiversity, and contribute to climate change through high carbon emissions. In terms of health, the smoke produced from forest fires can cause respiratory problems and other diseases in local communities. Law no. 32 of 2009 concerning Environmental Protection and Management (UUPPLH) regulates the principle of strict liability which is limited to cases involving the use and management of Hazardous and Toxic Substances (B3). Article 88 of the UUPPLH states that every person whose actions pose a serious threat to the environment as a result of the use or management of B3 waste is absolutely responsible for the losses incurred without the need for proof of fault. The explanation of Article 88 also emphasizes that this principle is applied in the context of civil lawsuits, not criminal ones. In the Meulaboh District Court Decision Number 54/Pid.Sus/2014/PN.MBO, PT. Surya Panen Subur (SPS) was charged with Article 108 Jo Article 69 paragraph (1) letter h Jo Article 116 paragraph (1) letter a UUPPLH Jo. Article 64 paragraph (1) of the Criminal Code. The judge decided that PT. SPS is criminally responsible based on the principle of strict liability due to the burning of land managed by the company. However, this approach shows a lack of rigor and inconsistency in legal considerations.

Abstract

The legal implication for the Land Deed Official on the false statement given by the confrontant is the potential for PPAT to participate in the criminal act of making an authentic deed based on false information or document forgery. However, with the use of the analysis of Article 1365 of the Civil Code and regulations governing the duties functions and authority of PPAT. Then the PPAT has no material obligation in examining to prove the authenticity of the documents or information presented to him. If the formal examination has proven that there is no indication of document forgery and the PPAT makes an authentic letter to the applicant. Then the elements of criminal and unlawful acts are not included in the acts committed by the PPAT in making an authentic deed based on false information provided by the public/applicant to the PPAT.

Abstract

Penelitian ini bertujuan untuk mengkaji faktor-faktor yang mendorong keterlibatan dalam prostitusi online, khususnya terkait pemenuhan kebutuhan ekonomi dan gaya hidup mewah, serta menganalisisnya melalui perspektif feminisme radikal pada kasus istri yang dijual oleh suami. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi kasus dan wawancara mendalam. Hasil penelitian menunjukkan bahwa kebutuhan ekonomi yang mendesak, seperti kemiskinan dan tanggung jawab keluarga, merupakan faktor utama yang mendorong individu terlibat dalam prostitusi online. Selain itu, keinginan untuk mempertahankan atau meningkatkan gaya hidup mewah juga menjadi motivasi signifikan. Analisis feminisme radikal mengungkapkan bahwa prostitusi online merupakan bentuk eksploitasi dan penindasan patriarki, di mana perempuan dieksploitasi untuk keuntungan ekonomi laki-laki. Kasus istri yang dijual oleh suami mencerminkan bentuk ekstrem dari kontrol patriarkal dan kekerasan berbasis gender. Temuan ini menunjukkan perlunya upaya peningkatan akses pendidikan dan pekerjaan layak bagi perempuan, penegakan hukum yang lebih tegas terhadap pelaku eksploitasi, serta penyediaan dukungan psikologis dan sosial bagi korban prostitusi. Dengan demikian, penelitian ini berkontribusi pada pemahaman yang lebih mendalam tentang dinamika prostitusi online dan eksploitasi gender serta menawarkan rekomendasi kebijakan untuk mengatasi masalah ini.

Abstract

Hak ulayat merupakan hak atas tanah yang tertinggi dalam hukum adat, sehingga tidak heran dan tidak jarang ketika terjadi pencabutan hak atas tanah adat untuk kepentingan umum atau kepentingan swasta, timbul sengketa pertanahan antara masyarakat adat dengan negara. Permasalahan dalam penelitian ini adalah apakah hakim sudah mempertimbangkan asas keadilan dalam putusan Pengadilan Tinggi Tata Usaha Negara Makassar Nomor 01/B/2016/PT.TUN.MKS? Bagaimana perlindungan hukum eksistensi masyarakat adat dalam pengadaan tanah untuk kepentingan umum sebagai upaya mewujudkan keadilan? Metode penelitian yang digunakan adalah yuridis normatif dengan menggunakan data sekunder. Hasil penelitian memperlihatkan bahwa asas keadilan terhadap pertimbangan hakim dalam putusan Pengadilan Tinggi Tata Usaha Negara Makassar Nomor 01/B/2016/PT.TUN.MKS tidak terpenuhi. Hal tersebut dikarenakan Majelis Hakim Pengadilan Tinggi Tata Usaha Negara Makassar dalam memberikan putusan hanya mempertimbangkan dalam segi yuridis, yaitu wajib terpenuhinya Pasal 67 ayat (1) dan ayat (2) Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan terkait dengan wajib terpenuhinya pengukuhan keberadaan Masyarakat Adat sifatnya deklaratif, yaitu keberadaan Masyarakat Hukum Adat Saumolewa tersebut diakui dan ditetapkan dengan Peraturan Daerah. Seharusnya Majelis Hakim Pengadilan Tinggi Tata Usaha Negara Makassar dalam memberikan putusan juga wajib mempertimbangkan unsur sosiologis, yaitu fakta bahwa keberadaan Para Pemangku Adat Masyarakat Adat Saumolewa telah diakui dengan dibuktikannya Surat Keterangan Lurah Todombulu Nomor 593.2/I/2015, tanggal 21 Januari 2015 dan diketahui oleh Camat Sampolawa Kabupaten Buton Selatan yang pada pokoknya menerangkan bahwa Masyarakat Hukum Adat Saumolewa adalah merupakan komunitas Masyarakat Hukum Adat.

Abstract

Sebagai sebuah negara hukum, maka segala kegiatan yang terjadi di dalam negara harus dapat dilakukan dengan berlandaskan kepada hukum yang berlaku. Namun, dalam hal ini tidak menutup kemungkinan terhadinya pelanggaran hukum yang disebut juga dengan pelanggaran pidana. Salah satu pelanggaran hukum yang tidak sedikit terjadi adalah tindak pidana pembunuhan sebagaimana diatur dalam Pasal 338 Kitab Undang-Undang Hukum Pidana (KUHP). Pada kasus ini, kerap kali terjadi individu korban yang dijadikan sasaran oleh pelaku akan melakukan perlawanan balik sebagai bentuk perlindungan diri karena merasa terancam, sehingga individu yang seharusnya menjadi seorang Korban dapat terancam dengan melakukan perlawanan balik sebagai bentuk perlindungan diri. Adapun, metode yang digunakan di dalam penulisan ini adalah metode penelitian hukum normatif dengan sumber yang diperoleh oleh studi kepustakaan dengan menggunakan pendekatan perundang-undangan (statue approach) melalui data sekunder yang nantinya dianalisis secara deduktif. Apabila seluruh data tersebut telah terkumpul akan dijelaskan secara deskriptif agar dapat menjelaskan hal terkait secara sistematis di dalam penulisan. Muara dari penulisan ini adalah pentingnya pembuktian pembelaan terpaksa yang harus dilakukan di muka pengadilan sebagai pertimbangan bagi hakim untuk melakukan penalaran sebelum memberikan putusan atas tindak pidana yang terjadi. Di mana dalam hal ini hakim harus dapat memberikan keputusan dengan melakukan legal reasoning.

Abstract

: Street drifting is a phenomenon in which drivers perform high-risk manoeuvres on public roads without permission, has become an increasingly acute social and security issue. In Indonesia, the legality of this activity refers to compliance with the regulations of the applicable laws. Drifting permitted on the circuit under the provisions of the Indonesian Motor Union (IMI), however, often develops in an illegal context. The research uses a qualitative approach to explore the phenomenon of wild drifting in the Indah Pondok area, South Jakarta. Data collection methods involve field observations, interviews with two active perpetrators drifting wild in the area, and literature studies. The data obtained was then analyzed using the differential association theory by Edwin Sutherland (1939). The results of the analysis show that the motivation to engage in wild drifting is heavily influenced by social interaction, intimate groups, attitudes to the law, and physical conditions of the location. Wild drifters greatly appreciate the sensation of adrenaline, freedom, and flexibility offered by this activity.
