Abstract

ABSTRAK Notaris sebagai pejabat umum kepadanya diberikan kewenangan untuk membuat akta otentik. Alat bukti yang dapat dituntut kebenarannya adalah akta otentik yang dibuat oleh pejabat umum. Pejabat umum yang dimaksud adalah Notaris. Akta otentik memuat suatu kebenaran yang formal sesuai dengan apa yang diberitahukan para pihak kepada Notaris. Namun, Notaris juga mempunyai kewajiban untuk memasukkan bahwa apa yang termuat dalam akta Notaris sungguh-sungguh telah dimengerti dan sesuai dengan kehendak para pihak. Notaris juga berkenaan dengan perbuatan hukum terkait jual beli tanah. Dalam hal ini banyak permasalahan timbul terhadap peralihan Hak atas tanah yang selalu menjadi permasalahan utama. Persoalan tersebut sering terjadi dimasyarakat, dengan berbagai macam cara proses peralihan yang terjadi menimbulkan masalah baik dengan secara legal maupun ilegal dalam penerapannya. Pokok Permasalahan dalam penelitian ini adalah bagaimana peran dan tanggung jawab Notaris terhadap akta PPJB dengan merumuskan pemberian kuasa mutlak dan bagaimana keabsahan akta PPJB berdasarkan Putusan Pengadilan Negeri Nomor 27/Pdt.G/2019/PN.Krs. Penelitian ini bertujuan untuk menganalisis tanggung jawab Notaris terhadap terhadap akta PPJB dengan merumuskan pemberian kuasa mutlak berdasarkan Putusan Pengadilan Negeri Nomor 27/Pdt.G/2019/PN.Krs melalui penelitian yuridis normatif dan bersifat eksplanatoris ini, menggunakan data sekunder yang diperoleh dari studi dokumen dan kepustakaan. Digunakan pula tiga bahan hukum yaitu bahan hukum primer, bahan hukum sekunder, bahan hukum tersier.Kata kunci      : Tanggung Jawab; Notaris; Kode Etik Notaris; Jual Beli; ABSTRACT A notary as a public official is given the authority to make an authentic deed. The evidence that can be claimed for the truth is an authentic deed made by a public official. The public official in question is a Notary. An authentic deed contains a formal truth in accordance with what the parties have notified the Notary. However, the Notary also has an obligation to include that what is contained in the Notary deed has truly been understood and is in accordance with the wishes of the parties. Notaries are also concerned with legal actions related to the sale and purchase of land. In this case, many problems arise regarding the transfer of land rights which has always been the main problem. These problems often occur in the community, with various ways the transition process that occurs causes problems both legally and illegally in its application. The main problem in this research is how the role and responsibility of the Notary towards the PPJB deed by formulating the absolute power of attorney and how the validity of the power of attorney deed is based on the District Court Decision Number 27/Pdt.G/2019/PN.Krs. This study aims to analyze the responsibility of the Notary to the PPJB deed by formulating the absolute power of attorney based on the District Court Decision Number 27/Pdt.G/2019/PN.Krs through this normative and explanatory juridical research, using secondary data obtained from document studies. and bibliography. Three legal materials are also used, namely primary legal materials, secondary legal materials, and tertiary legal materials. Keywords: Responsibility; Notary Public; Notary Code of Ethics; Buy and sell.

Abstract

Penyederhanaan sistem perizinan dilakukan Pemerintah dengan menerapkan sistem perizinan berbasis elektronik Online Single Submission Risk Based Approach yang mengklasifikasikan tingkat usaha berdasarkan risiko. Data dari Kementerian Kordinator Bidang Perekonomian Republik Indonesia menyebutkan bahwa dari total 514 Kabupaten/Kota di Indonesia, saat ini baru 116 Kabupaten/Kota yang telah menyusun Peraturan Daerah RDTR. Penelitian yang dilakukan oleh Komite Pemantauan Pelaksanaan Otonomi Daerah (KPPOD) juga memberikan gambaran bahwa sistem OSS RBA belum siap dilaksanakan, kendala masih sering dihadapi khususnya pada izin yang akan diberikan oleh Pemerintah Daerah, beberapa daerah belum memiliki peraturan daerah terkait dengan pelaksanaan sistem OSS RBA, hal tersebut kemudian menyebabkan implikasi beberapa daerah menerapkan sistem perizinan lama/manual, tidak berkesesuaiannya antara perizinan melalui OSS RBA dan perizinan di daerah, ketidaksiapan penerapan dalam aspek regulasi, aspek kelembagaan, serta aspek digitalisasi, menyebabkan tidak efektifnya pelaksanaan perizinan berusaha melalui OSS RBA.

Abstract

In administrative science and administrative law, public information disclosure has universally recognized as important partway to good governance. There is an explosive recognition of the world to freedom of information act. Freedom of information or right to information is a inseparable part of transparency principle in governance. Enacting freedom of information act is an effort not only to make government better, but also to create trust among government, the business, and citizens. Indonesia has enacted Act Number 14/2008 (FOI Act) and run into force in 2010, which contains 14 obligations to State-Owned Enterprises (SOE’s). This paper will focus to elaborate SOE’s compliance with its basic obligations in this FOI Act, resulted in monitoring and evaluation conducted by Central Information Commission (CIC); the problems; the challenges, and the opportunities. This study uses library research, especially using secondary data from the CIC annual ranking reports. The results show that (i) good corporate governance is actually in line with transparency principle; (ii) there is an increase participation level of SOE’s in complying with the FOI Act; and (iii) most of SOE’s are placed in ‘uninformative’ category. It is important to find solutions to this compliance problems.

Abstract

Villages or other names have existed before Indonesia was formed. The existence of these regions is highly respected by the Republic of Indonesia and all of its regulations will serve as a reminder of the rights of the origin of the region. This research aims to analyzes Implementation of village government in realizing village independence. the research method used in this research is normative legal research. Implementation of the Village Law on the implementation of village government in Tanimbar Islands Regency has encouraged every village device to carry out its main duties in accordance with good governance, transparent and accountable, and has succeeded in increasing the village status index where no longer found villages are very left behind and most have become developed and independent villages.

Abstract

Undang-Undang Nomor 1 Tahun 2022 tentang Undang-Undang Hubungan Keuangan Pemerintah Pusat dan Pemerintah Daerah (UU HKPD) telah disahkan dan diundangkan. Kebijakan penggabungan Undang-Undang Perimbangan Keuangan antara Pemerintah Pusat dan Pemerintah Daerah (UU Nomor 33 Tahun 2004) dengan Undang-Undang Pajak dan Retribusi Daerah (UU Nomor 28 Tahun 2009) merupakan pilihan pemerintah dalam memperkuat pelaksanaan otonomi daerah. dalam hal belanja, alokasi transfer ke daerah. Penataan penguatan ini juga diikuti dengan penguatan belanja daerah, dengan menetapkan batasan penggunaan belanja daerah dengan tujuan agar pelayanan publik yang diberikan kepada masyarakat tidak berbeda-beda, sejalan dengan semangat negara kesatuan, melalui hal tersebut. UU HKPD apakah konsep desentralisasi masih utuh atau sedang menuju sentralisasi.

Abstract

Indonesia merupakan negara yang memiliki energi baru terbarukan yang sangat melimpah yang diantaranya dihasilkan dari sumber alami seperti matahari, angin dan air yang dapat dihasilkan secara terus menerus serta tidak merugikan lingkungan. Oleh karena itu pentingnya dilakukan pendekatan untuk memahami energi yang telah ada, untuk selanjutnya energi baru terbarukan dapat dimanfaatkan dan dikembangkan. Proses energi baru terbarukan belum dimanfaatkan secara maksimal dikarenakan aturan yang belum mengatur secara spesifik baik dari proses perencanaan, pelaksanaan secara teknis, hingga pengaturan terkait pemanfaatannya. Pembahasan manfaat dan dampak energi baru terbarukan menggunakan metode analisis data dengan pendekatan kualitatif, yaitu dengan menghasilkan data deskriptif analitis secara tertulis atau lisan dan juga melalui perilaku nyata. Penggunaan energi baru terbarukan memiliki manfaat yang lebih besar dibandingkan dampak yang dihasilkan terhadap lingkungan hidup, sehingga perlu untuk segera dilakukan pengaturan yang dapat dituangkan melalui regulasi, yang nantinya menjadi acuan dalam proses pemanfaatan energi baru terbarukan. Dengan adanya regulasi, dapat membantu target pemerintah untuk pencapaian pemenuhan penggunaan energi baru terbarukan. Pada akhirnya pengaturan energi baru terbarukan menjadi mutlak, guna mewujudkan kesejahteraan dan sebesar-besarnya kemakmuran rakyat sesuai dengan Pasal 33 ayat (3) Undang-Undang Dasar Negara Republik Indonesia 1945.

Abstract

In theory, decentralization is believed to have a good impact on improving public services. Japan is one of the countries that has succeeded in providing public services through granting authority to local governments. This paper discusses the application of the concept of decentralization to public services, particularly municipal solid waste management policies in Japan. The research was conducted on the Japanese government's policy regarding municipal solid waste management. The research method used is normative juridical. The results of the study show that community involvement, dynamic partnerships and funding creativity are the keys to the successful application of the concept of decentralization in municipal solid waste management in Japan. This shows a shift in the meaning of decentralization and the use of New Public Service, New Public Management and New Public Governance perspectives in the application of the concept of decentralization in municipal solid waste management in Japan. The Japanese government defines decentralization as a multidimensional process. To benefit from decentralization, lawmakers need to formulate appropriate configurations and relationships between stakeholders.

Abstract

Indonesia’s National Health Security (NHS) has begun since 2014 which give a lot of benefits to people in Indonesia. Access to health care become more easier without giving financial hardship. However, there are some obstacles that Indonesia NHS facing, which one is deficit in pool funding that is not enough to pay the benefits. One of newer solution to overcome this problem is by activating the resources from local government, especially from the funding. Basically, decentralization is the framework of the central and local government relation in Indonesia, by transferring power, authority and financial of health functional assignment to local government. Conversely, since Indonesia NHS is held, there is overlapping of authority and financial between administration of health functional assignment by local government and NHS. Then, it contributes to ineffective and inefficient of NHS. Conclusion: There is a need to rearrange the central and local government relation on decentralization context in order to maximize the role of local government to assure the sustainability of NHS in Indonesia.

Abstract

The enormous authority possessed by the fiscus in various matters, particularly in establishing tax reduction or abolition, is prone to abuse. Administrative act in the form of tax decision shall end up as a criminal offense of it is an abuse of authority or unlawful. In fact, there are many fiscus who perform taxation administrative acts that stray beyond the authority for their own personal interests or that of taxpayers. Certainly, theycause state loss; therefore, they can qualify as a criminal offense. Thesebeg a question: which taxation administrative acts are lawful and which ones constitute criminal offense?

Abstract

Indonesia adheres to the principle of decentralization in administering its government. Each region has the right and is given the authority to manage its own government affairs. The granting of broad autonomy to the regions is directed at accelerating the realization of social welfare through service improvement, community empowerment and participation. Law No. 23 of 2014 wants the birth of a new autonomous region in Indonesia. The implementation mechanism is further regulated in Government Regulation No. 78 of 2007. Expansion of regions is one of the efforts to accelerate national development. The conditions that must be met in the expansion of the new autonomous regions include: 1) basic territorial requirements; 2) regional capacity requirements; and 3) administrative requirements. The Nias Islands are an area that has been planned to be split into a new autonomous region. The research method used is empirical juridical, namely research conducted to analyze the implementation of legal norms that apply in society. Discussions regarding the plan for regional division of the Nias Islands have started since 2009 but until now there has been no realization from the central government. The obstacle to the expansion of the division is the existence of a moratorium set by the President. Regional expansion is also considered to be a burden on state finances considering that apart from the Nias Islands, there are still many other regions that have also proposed to do division. However, when an area meets the requirements for expansion as stipulated in Government Regulation No. 78 of 2007 and there is an urgency why the area must be divided immediately. It is better if the moratorium is lifted so that each region that has met the requirements to carry out expansion can become a new autonomous region and become more developed because it is given the authority to manage its own region.
