Abstract

Efficiency between authority and the burden of duties and responsibilities in improving consumer protection needs to be continuously updated both in terms of regulations and institutions. As a comparison country, Japan is considered the right country to make comparisons, especially in the field of supervision of the financial services sector, where Japan as a developed country has experienced many regulatory and institutional transformations, so this discussion is futuristic in nature. Japan itself had new consumer protection regulations in 1994, while consumer protection regulations in Indonesia are regulated in Law No. 8 of 1999. This research is normative juridical research with a computational approach and a statutory-regulatory approach. The results of this research show specific consumer protection in the financial services sector, both have almost the same instruments and institutions, OJK (Financial Services Authority) and BI (Bank Indonesia) in Indonesia, while in Japan there is the Financial Services Agency (OJK) and the Central Bank . Japan (BOJ), the difference is that the supervision process is carried out (on-site inspection), whereas in Indonesia it is still based on coordination based on the authority of each institution.

Abstract

This article analyses how the transfer of a majority of shares in an Implementing Business Entity (BUP) was applied in the Lulut Nambo Waste Processing and Management Site Private Public Partnership (KPBU TPPAS) Project from the viewpoint of business competition. The exemption from the applicability of the Prohibition of Monopolistic Practices and Unfair Business Competition Act Law No. 5 of 1999 was the Government of Indonesia’s attempt to strike a balance in the need for the state’s ownership of production sectors which control the livelihood of many people with due attention to the balance between the interests of business actors and the public interest. This article has been compiled using a doctrinal research methodology. The prequalification stage and tender process is a form of competitive principle in PPP projects, in that the implementation of the PPP project begins with the procurement of a partner through a fair, open, and transparent selection stage with due attention to the principles of fair business competition. The transfer of a majority of shares in the Implementing Business Entity as the winner of the Lulut Nambo KPBU TPPAS Project to another party which did not take part in the prequalification stage and the tender process could be viewed as special treatment for that party according to the provisions of the laws and regulations. Nevertheless, this did not breach the business competition aspects because BUP fulfilled the elements for exemption for business actors which have statutory monopolies.

Abstract

Children are the hope of the nation. Children are the next generation, therefore continuous guidance and protection is needed for survival, physical, mental, social growth and development as well as protection from all possibilities that will endanger the child and in the future. Narcotics and other illegal drugs are one of the triggers for the destruction of children. Sometimes children are often the targets of narcotics dealers, because children are still unstable, easily influenced and have the potential to become entangled in the abuse of illegal drugs such as narcotics. Children as drug abusers are only victims. So it is not appropriate for the State to provide punishment by considering the child abuser the same as the actual adult (distributor). As victims, children as drug abusers are obliged to receive protection. Child protection is an effort made to create conditions so that every child can carry out their rights and obligations for the normal development of the child's growth, both physically, mentally and socially.

Abstract

The expansion of peat land use is increasing rapidly in several provinces that have large peatlands, including Riau Province. Base on Government Regulation Number 57 of 2016 concerning the Protection and Management of Peat Ecosystem Article 1 paragraph (1) explains that the protection and management of the peat ecosystem is a systematic and integrated effort carried out to conserve the function of the peat ecosystem and prevent demage to the peat ecosystem which include planning, controlling, maintenance, supervision and law enforcement. Formulation of the problem (1) how is the protection and management of peatlands in Riau Province ? (2) what are the constraints faced ? (3) how are the effort carried out ? This study used a socio-legal approach. Data used include primary and secondary data. Data collected through document studies and in-depth interviews. Descriptive qualitative data analysis technique.

Abstract

The present-day dynamic development of the world economy is creating enormous changes in trade. The increasing developments and needs of the global market today for adequate facilities and infrastructure for economic activities has created many forms of unhealthy competition, one of which is bid rigging which is carried out to avoid competition between business actors. This tender collusion is widespread among large business actors who want to obtain partnerships with the government in providing infrastructure. Hence, Law Number 5 of 1999 Concerning Prohibition of Monopolistic Practices and Unfair Business Competition was formulated which regulates administratif penalty due to bid rigging. Seeing that the problem of tender collusion is still occurring, this research was conducted to identify fines as the main administratif sanction to prevent collusion in tender activities. Therefore, this article was prepared with the title "The Urgency of Imposing Fines as the Main Administratif Sanction: Review of Cases of Tender Rigging in Unfair Business Competition". The object of this research is fines as administratif penalty with the aim that if fines are determined as the main administratif sanction before the main crime, healthy business competition will be created. The normative judicial with literature study is a method that will be used in this research so that we can see how fines as administratif penalty apply in cases of bid rigging.

Abstract

This article is motivated by the rapid development of the world of capital markets in Indonesia, and it cannot be denied that one of the crimes occurring in the world of capital markets is the practice of insider trading. This research uses a normative juridical approach, namely a type of approach that examines or analyzes secondary data such as library materials or secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Regulations regarding the practice of insider trading already have a legal umbrella in Article 95 and Article 99 of Law Number 8 of 1995 concerning Capital Markets, but in fact the existence of a legal umbrella with these articles still creates unclear implementation and law enforcement regarding insider trading cases. happened in Indonesia. Situations like this then contribute to losses felt by other public investors. Therefore, this research will discuss legal protection arrangements and legal remedies for public investors who experience losses due to insider trading practices based on Indonesian positive law. This research uses a normative juridical method with the Statute Approach. Legal protection for public investors for losses resulting from insider trading practices is regulated as immaterial losses which can take legal action through litigation, namely civil lawsuits with the argument of unlawful acts, or non-litigation through the Alternative Institution for Financial Services Sector Dispute Resolution which is provided by OJK.

Abstract

Politik merupakan panglima kehidupan bernegara. Semua aturan dan kebijakan yang mengatur hajat hidup orang banyak melalui proses politik. Begitupun dengan lembaga negara, hubungan bilateral, kebijakan moneter dan otonomi daerah. Sebagai negara demokrasi Indonesia menjalankan Pemilihan Umum (Pemilu) sekali lima tahun. Partai politik adalah instrumen utama negara demokrasi. Partai politik menjadi peserta Pemilu dalam penentuan kekuasaan baik eksekutif maupun legislatif. Melalui partai politiklah mandat rakyat dijalankan sebagai bentuk kedaulatan negara demokrasi. Partisipasi pemilih dalam setiap Pemilu menggambarkan kesadaran rakyat untuk berdemokrasi. Sehingga upaya peningkatan partisipasi pemilih dari Pemilu ke Pemilu terus dilakukan berbagai pihak, pemerintah, penyelenggara Pemilu, lembaga swadaya masyarakat, perguruan tinggi atau organisasi kemasyarakatan yang peduli terhadap momentun Pemilu. Salah satu komponen paling penting dari pemilih dalam Pemilu ini adalah pemilih pemula. Pemilih pemula adalah pemilih yang pertama kali mengikuti Pemilu, yaitu warga negara yang berusia 17-21 tahun. Pemilih pemula mesti mendapatkan pendidikan politik yang baik dan benar, sehingga mendorong partisipasi atau keikutsertaannya dalam memilih bahkan juga dipilih pada Pemilu 2024 mendatang. Tetapi pemilih pemula cenderung tidak pernah mendapatkan edukasi atau pendidikan politik yang baik dari partai politik dan penyelenggara Pemilu. Keinginan pemilih pemula untuk memilih pada Pemilu 2024 cukup tinggi. Namun mereka perlu diberikan informasi yang cukup tentang nama calon legislatif dan partai politik, calon presiden/wakil presiden dan teknis menggunakan hak suara. Artikel ini merupakan hasil penelitian yang dilaksanakan bersamaan dengan tugas sebagai Dosen Pembimbing Lapangan (DPL) mahasiswa Kuliah Kerja Nyata (KKN) mahasiswa Universitas Ekasakti yang dilaksanakan di Nagari Sabu, Kecamatan Batipuh, Kabupaten Tanah Datar pada bulan Agustus 2023. Metode yang digunakan adalah pendekatan kualitatif deskriptif dengan cara melakukan wawancara mendalam, observasi dan dokumentasi terhadap pemilih pemula yang berusia 17-21 tahun. Penelitian ini dilaksanakan sekaligus memberikan edukasi kepada pemilih pemula dengan harapan mereka memiliki pemahaman yang baik tentang demokrasi, partai politik dan Pemilu.

Abstract

Mergers are one way to maintain a company, which in this case has strategic efficiency in the survival of a company. When running a business, you definitely have many competitors, therefore you need a structure that can save a company. Regarding this corporate action, it was also carried out by the State-Owned Enterprise, namely Pelindo. Pelindo carried out this merger action in order to improve maritime connectivity throughout Indonesia and increase competitiveness within the State-Owned Enterprise. After the merger, all property/assets and responsibilities will be transferred to the company that can be established, therefore this journal will discuss the above matters further.

Abstract

Advances in information technology also open up opportunities and challenges for Notaries and require that Notaries not only be able to work manually but can also utilize technology-based information. A professional code of ethics is a norm established and accepted by a professional group that provides instructions to its members on how to act and act while guaranteeing the moral quality of the profession in the eyes of society. The writing method applied is Normative Legal research. The aim of this research is to find out how technological developments influence and what challenges notaries face. Based on the results of this research, several influences and challenges due to current technological developments on Notary ethics include: a) Using social media as a promotional event. b) The existence of an electronic signature to be used as evidence. c) Cyber ​​crimes against personal data protection.

Abstract

Pemerintah telah menetapkan pemindahan Ibukota Indonesia dan menetapkan nama Ibukota yang baru menjadi Ibukota Nusantara sebagaimana tertuang di dalam Undang-Undang Nomor 3 Tahun 2022 tentang Ibukota Negara. Pemerintah juga membentuk Otorita Ibukota Nusantara sebagai lembaga yang berwenang untuk menjalankan pemerintahan daerah di kawasan Ibukota Nusantara. Di dalam Peraturan Presiden Nomor 65 Tahun 2022 tentang Perolehan Tanah dan Pengelolaan Pertanahan di Ibu Kota Nusantara, Otorita Ibukota Nusantara diberikan kewenangan untuk mengendalikan pengalihan hak atas tanah yang berada di kawasan Ibukota Nusantara. Salah satu metode pengendalian yang dimaksud adalah dengan mewajibkan Notaris untuk mendapat persetujuan sebelum membuat akta perjanjian pengikatan jual beli. Namun, hingga saat ini, tidak ada ketentuan secara khusus yang mengatur bagaimana pemberian persetujuan oleh Otorita Ibukota Nusantara kepada Notaris.Terlebih lagi, akta perjanjian pengikatan jual beli bukan merupakan alat bukti pengalihan hak atas tanah karena belum memenuhi asas tunai dan terang. Selain itu, ketentuan saat ini juga tidak mengatur akibat hukum apabila Notaris membuat akta perjanjian pengikatan jual beli tanpa persetujuan Otorita Ibukota Nusantara. Oleh karena itu, diperlukan perbaikan ketentuan mengenai pemberian persetujuan akta perjanjian pengikatan jual beli yang dibuat oleh Notaris untuk mewujudkan asas kepastian hukum.
