Abstract

This study aims to propose a model of sukuk-wasiyyah. Since waqf fundraising is one of the activities of waqf management, this model applies wasiyyah or the will of waqif to sukuk. Wasiyyah will restrict the use of the fund by the will of Musi while sukuk is one of the Islamic capital market instruments. Like cash waqf, the fund of sukuk-wasiyyah will be managed by nazhir and its profit can be spent on Islamic philanthropy. This study applies exploratory research. The result of the study shows that (1) Musi or the bequeath testator still can gain the sukuk return during his life, (2) After Musi died, the sukuk is transferred under custody by Nazir. The author argues that the proposed product applies to Waqf Institution. This study is the first to introduce the terms of sukuk-wasiyyah and to propose the mechanism of sukuk-wasiyyah in the Islamic capital market

Abstract

The emergence of bitcoin as a means of transaction and investment in the virtual world is intriguing to be studied. Many countries in the world have different perspectives upon the law of bitcoin itself. In Indonesia, the regulation on electronic money is in Indonesian Bank Regulation Number 20/6/PBI/2018 and MUI Fatwa Number 116/DSN-MUI/IX/2017. However, both have not specifically regulated bitcoin. As something new, bitcoin is necessary to be studied in the perspective of Islamic law. The research is a literature study utilizing content analysis to approach the data. The findings of the results are that bitcoin as a means of transaction is permissible (mubah) since there is a similar handover (taqabudh)--that there is a bitcoin to handover, there is no gambling (maisir), speculation (gharar), haram, riba, and false, and that the transactions is on a willingness basis (antharodin) of the both parties. Second, bitcoin as a means of transaction is haram if there is an uncertainty which is close to gharah and maisir, bitcoin as an investment tool has more damages than benefits.

Abstract

Islam provides fundamental sources for human development, including ukhuwah Islamiyah, ashabiah and rahmatan lil 'alamin. These concepts are strategic in developing the economy of the state.  The current article aims to analyze the economic development in Medina carried out by the Prophet Muhammad. The authors employed a qualitative method through narrative reviews of the extant literature. The study shows that before the hijrah of the Prophet, Medina was already a multicultural and heterogeneous society with many prolonged conflicts.. The Prophet devised a strategic approach to build the Medina economy and society. Ukhuwah Islamiyah was used to unify differing, often conflicting cultures, beliefs, and ethnicities to form a strong brotherhood. Ashabiah was applied to tighten the glue among society members, creating high social solidarity. Upon the perfection of Medina, the apostolate of rahmatan lil 'alamin leads to a universal, inclusive, and sustainable economic development.

Abstract

The evaluation of the poverty alleviation program in Sorong City has not been carried out optimally. This can be seen from the percentage of poor people since 2015 which has only decreased by 0,07% -1,93% per year even in 2016 it has increased by 0,29%. The implementation of the program has not been effective due to the lack of optimal management of funds as a special autonomous region and the limitations of social assistance funds in the Local Government Budget (APBD). Therefore, other sources of assistance are needed that can be used as a driver of poverty alleviation. One of them is through zakat, infaq, shodaqoh, and waqf (ZISWAF) which was adopted from the Islamic economic system. This study examines the application of Islamic economics in improving the welfare of the population in Sorong City, especially the poor. The research was conducted based on statistical data related to poverty and the Gini ratio from the Statistics Indonesia (BPS), APBD, and ZISWAF funds from the National Amil Zakat Agency (BAZNAS) in Sorong City. With the acceptance of ZISWAF, the high income of the community will be distributed to the low society so that it can improve welfare.

The percentage level of Muslims and non-Muslims is also the largest in Teluk Keramat District, reaching 97.30% of the population is Muslim. Teluk Keramat is a sub-district that is considered the "golden triangle" in the economic sector. This research uses an associative explanatory method or correlational study with a quantitative approach. The population in this study were all Muslim communities in the Teluk Keramat District, amounting to 72,470 people. This study found that the halal literacy variable will only have a significant positive effect on the use of halal products if it is through the halal awareness variable. In other words, halal literacy will have a significant positive impact in increasing the use of halal products if halal awareness is well established. But if Halal Literacy cannot increase halal awareness, then halal literacy will not significantly impact the use of halal products.

Abstract

The purpose of this study are: (1) to investigate the implementation of partnerships in the VOK tobacco business in an Islamic perspective, whether include mukhabarah, muzara’ah, or musaqah contract; (2) to explore the partnership implementation of VOK tobacco business on social, economic, and finance. This study use the snowball method with in depth interview. This research captured that there are two contracts of Islamic partnership on tobacco business, namely mukhabarah and muzara'ah. The social impact is the availability of jobs for people who do not own land/rice fields, thus helping the government to reduce unemployment and create close kinship in the community. The manifestation of the economic impact is that people who do not own land can still earn income for live. This study shows that there is a difference formula in calculating the profit sharing between the net farm income (NFI) and local culture formula. The local cultural formula does not use the real cost to count the net profit which is considered injustice. It is important to note that injustice is something that is against Islamic belief. Profit-sharing ratio between landowner and land tiller is 50%: 50% of net income.
