Abstract

ABSTRACT Customary Land Tenure and Domination not infrequently can lead to disputes, such as custom land disputes that occurred in the customary village of Rules, Buleleng District. Therefore, efforts to resolve the dispute need to be known. How is the Implementation of Customary Land Tenure and Domination in Buleleng Regency as well as the Settlement? Furthermore, the type of research used in this study is empirical legal research. The results of this study indicated that (1) the implementation of Customary Land Tenure and Domination in Buleleng Regency is said to have legitimization due to the control and ownership of customary land especially in the village of Anturan, Buleleng Subdistrict, Buleleng Regency has been based on land tenure system according to customary law (2) The settlement of customary land dispute cases that occurred in Anturan Village and Buleleng District was preceded by mediation dispute settlement efforts, but because it could not be resolved through mediation so that the case of this customary land dispute was filed suit to the Singaraja District Court by examining the evidence and witnesses presented by both parties to the dispute. Abstract

Abstract The capital market is a meeting between the parties that have surplus funds and those who need the funds by way of trade in securities. The title of this research is “Legal Protection to Investor in Trading of Stocks and Bonds in the Capital Market. Problems raised in this study are: How is the regulation of the stocks and bond transactions in the Capital Market?, and How is legal protection for investors in trading of stocks and bonds in the Capital Market?. In this study used normative legal research with approach to legislation, the concept approach, approach to the history and philosophy of law approach, analysis of data using the normative method. Based on this result, it was found that Law Number 8 of 1995 current has arranged the matter that is very important in the Capital Market, namely Parties liability in the Public Offering to meet the principles of transparency, especially the provisions put in order the general public protection. This Law also regulates the liabilities coverage the Parties relating to the Public Offering as Underwriter, Accountant, Legal Consultant, Notary, Appraisers, and other professions, to comply with the liabilities that they must filled, accompanied by threats of indemnity sanctions or criminal sanctions on failure to comply with liabilities under this Law. Protection for investors in the Capital Market Law implemented in two ways namely transparency of information and manipulation prohibition rules. In facts, the protection of information disclosure alone is not sufficient. The various parties involved in the Capital Market possibility doing a disservice to investors, both fraudulent transactions or information deception and trading crime. Legal protection to investors is providing legal certainty through legislation and enforcement. Abstract

The trend of development in tourism world from year to year has shown a very rapid growth. The tourism is developed with the approach of growth and equity of the economy for the welfare of the people and is oriented to the development of the region, relying on the community, and empowering the community covering various aspects, such as human resources, marketing, destinations, science and technology, cross-sectoral linkages, intergovernmental cooperation, empowerment of small businesses, and responsibility in the utilization of natural and cultural resources. One of the opportunities for the development of tourism industry is in the field of health, especially the development of medical tourism. The aim of study is to examine the regulations on the medical tourism and the role of the tourism travel agencies in the development of the medical tourism in Indonesia. The method to achieve these goals is normative study with juridical and statute approaches. The results of data analysis indicate that regulations regarding medical tourism in Indonesia are set in the Regulation of the Ministry of Health of the Republic of Indonesia Number 76 Year 2015 on Medical Tour Service. The role of travel agency in the development of the medical tourism is very strategic, starting from partners of the hospital in order to integrate the health services with lodging facilities and travel planning medical tours to conduct external promotions.

Abstract

Abstract The development of the tourism industry in Badung regency is interesting to foreign investors to invest in Badung regency, especially in the area of ​​tourism accommodation services. What are the local government authorities of Badung Regency in granting approval and permission of foreign investment in tourism accommodation? How is the regulation of foreign investment in tourism accommodation services in Badung regency? The type of research used in this study was normative legal research. The results showed (1) the authority of the local government of Badung regency related to the granting of foreign investment permit in the tourism accommodation can be seen from the provision of Article 19 of Badung Regulation No. 2 of 2012 which generally states that the local government of Badung regency is entitled to regulate tourism activities in the region; (2) The arrangement of foreign investment in tourism accommodation services in Badung Regency has not been accommodated in a more specific way through the regulation of Badung Regency. The absence of the specification of this rule would also affect the legal security and legal protection for foreign investors for their investment in tourism accommodation in the area. Abstract

ABSTRACT Legal documents in the transactional process of land ownership transition are often neglected by parties in the registration of land ownership rights in Denpasar. This thesis discusses 2 matters which consists of the following ones : first, what the criminal responsibility in the document fraud towards the registration of land ownership rights is and secondly concerning what the legal protection for the land certificate holder in the registration of which contains fraudulent documents is. The findings are as follow. First, the criminal responsibility of the document fraud towards the registration of land ownership is the policy of case criminalization of criminal acts in the laws of land as based on criminal law which upholds the concept of being against the material law, in the sense that the criminal act is not only an act being against the written laws alone but also is an act being against unwritten laws. The reason for exception of such an action has to be based on written laws and unwritten laws in order for the legal certainty to be achieved. Second, legal protection for the land certificate holder in the registration process of which has fraudulent documents, the responsibility of the national land agency, who produces the products. In getting the firm legal certainty for certificate products which are issued as evidences of land ownership in Indonesia, it is also required to have legal certainty and legal protection in order to assure ownership of the citizens. Abstract

Ada tiga musuh besar bangsa Indonesia dewasa ini yaitu, kejahatan narkotika, terorisme, dan korupsi. Belakangan ini ternyata kejahatan kekerasan di dalam rumah tangga, yang untuk selanjutnya disebut sebagai KDRT mulai diperhitungkan sebagai salah satu musuh besar bangsa. Betapa tidak, akibat dari KDRT ini sungguh sangat luar biasa, bukan saja menimbulkan ketakutan dan trauma pisik dan kejiwaan berat dan mendalam bagi korban KDRT, melainkan dapat menimbulkan kematian dan rusaknya tatanan keluarga dan masyarakat. Sementara itu, soko guru bangsa dan Negara adalah rumah tangga yang harmonis, sehat, sejahtera, dan berpendidikan yang memadai. Rumah tangga yang harmonis, keluarga yang bahagia, dan sejahtera sangat berpengaruh pada kuat dan rapuhnya suatu bangsa dan negara. Begitu juga sebaliknya, keluarga tidak bahagia, rumah tangga yang berantakan seperti kapal pecah, akan mempengaruhi keteraturan masyarakat dan kokoh kuatnya suatu bangsa dan Negara. Penulisan ini berusaha untuk menjawab permasalahan, adakah dampak dari dimasukannya aturan tentang KDRT dan Narkotika ke dalam aturan desa adat yang disebut awig-awig terhadap pelanggaran hukum tentang KDRT dan narkotika di masyarakat. Produk keluaran dari pengabadian ini adalah, terbentuknya model awig-awig yang memuat KDRT dan narkotika, selain adanya perubahan prilaku masyarakat. Metode penelitian yang dipergunakan dalam penulisan ini adalah jenis penelitian hukum emperis, karena esensi penelitian adalah menganalisa dan mengkaji prilaku hukum masyarakat, dan menganalisa kesenjangan antara apa yang diharapkan oleh norma, dalam hal ini ketentuan Undang-undang Nomor: 23 Tahun 2004 tentang Penghapusan KDRT dan Undang-undang Nomor: 22 Tahun 1997 Tentang Narkotika dengan kenyataan di masyarakat. Model pemecahan masalah yang ditawarkan antara lain, melakukan sosialisasi tentang akibat buruk dari KDRT dan Narkotika, mengadakan musyawarah yang intens dengan para pemuka masyarakat, dan melakukan pelatihan tentang tata cara penulisan awig-awig desa adat. Simpulan yang dapat dirumuskan adalah, ternyata setelah regulasi tentang KDRT dan Narkotika dimasukkan ke dalam awig-awig, secara signifikan ke dua jenis kejahatan ini berkurang drastis dan nyaris tidak ada lagi di wilayah desa pakraman dimana penelitian ini dilakukan. Abstract

Land rights are rights to certain parts of the earth's surface, which are bounded, with dimensions of two in length and width. Certificate of Property Ownership on Land is a legal product issued by the National Land Agency (BPN) as a proof and proof of land ownership. This study aims to examine and understand the strength of the decisions of the State Administrative Court that have permanent legal force against the cancellation of Property Rights Certificates on Land through the authority of the Head of the Land Office and to examine more deeply the strength of binding law Cancellation Decree issued by the Head of the Land Office regarding cancellation of Property Rights Certificate on the land. The research method used in this study is Juridical-Normative research method. The research approach used by the author is a legal approach, conceptual approach, analytical approach, and philosophical approach. The technique used is document study or library study. Legal material collection techniques are carried out by inventory procedures to study and explore the primary, secondary and tertiary legal materials related to this research. The results of this study are the Strength of Administrative Court Decisions that have permanent legal force against the Cancellation of Certificates of Property Ownership over Land is a legal force that binds all people (erga omnes), has the power of proof and has the power of executive law. Legal strength of Cancellation Decree of Land Ownership Certificate issued by the Head of the Land Office has the executorial power/power to be carried out as a follow-up to the implementation of the PTUN ruling which has obtained permanent legal force, which is related to the cancellation order of the Land Rights Certificate. Hak atas tanah adalah hak atas sebagian tertentu permukaan bumi, yang berbatas, berdimensi dua dengan ukuran panjang dan lebar. Sertifikat Hak Milik atas Tanah adalah produk hukum yang diterbitkan oleh Badan Pertanahan Nasional (BPN) sebagai tanda bukti dan alat pembuktian terhadap pemilikan tanah. Penelitian ini bertujuan Untuk mengkaji dan memahami kekuatan putusan Pengadilan Tata Usaha Negara yang berkekuatan hukum tetap terhadap pembatalan Sertifikat Hak Milik atas Tanah melalui kewenangan Kepala Kantor Pertanahan dan mencermati lebih mendalam tentang kekuatan hukum mengikat Surat Keputusan Pembatalan yang dikeluarkan Kepala Kantor Pertanahan terhadap pembatalan Sertifikat Hak Milik atas Tanah. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian Yuridis-Normative. Pendekatan Penelitian yang digunakan oleh penulis adalah pendekatan undang-undang, pendekatan konsep, pendekatan analitis, dan pendekatan filosofis. Teknik yang digunakan yaitu studi dokumen atau studi kepustakaan. Teknik pengumpulan bahan hukum dilakukan dengan prosedur inventarisasi mempelajari dan mendalami bahan-bahan hukum primer, sekunder dan tersier yang berkaitan dengan penelitian ini. Hasil penelitian ini adalah Kekuatan Putusan PTUN yang telah mempunyai kekuatan hukum tetap terhadap Pembatalan Sertifikat Hak Milik Atas Tanah merupakan kekuatan hukum yang mengikat semua orang (erga omnes), memiliki kekuatan pembuktian dan memiliki kekuatan hukum eksekutorial. Kekuatan hukum Surat Keputusan Pembatalan Sertifikat Hak Milik Atas Tanah yang dikeluarkan oleh Kepala Kantor Pertanahan mempunyai kekuatan eksekutorial/kekuatan untuk di jalankan sebagai tindak lanjut dari pelaksanaan putusan PTUN yang telah memperoleh kekuatan hukum tetap, yang Amarnya berkaitan dengan perintah pembatalan Sertifikat Hak Milik Atas Tanah.

Abstract

Abstract Technological advance in medical field, especially concerning non-natural pregnancy, such as surrogacy that is present as a solution for couples experiencing infertility as outlined in contract can certainly have legal consequences. This study addresses legal consequences of a child born from surrogacy contract. Research method used in this paper is doctrinal legal research. The legal consequences of children born from surrogate mothers’ agreement lie in the legal standing for them and the right of inheritance they own. Reviewed from Indonesian legislation, a child born from surrogacy contract is a legal child of the surrogate mother and is not a legal child of his biological parents; in the case of inheritance rights, if a child is categorized as a legal child, he/she may inherit the full property of the surrogate mother and her husband, whereas if the child is classified as a child outside of marriage, she/he has only a cognate relationship with the mother who gave him/her birth. Abstract

The study was motivated by the increasingly influential technology against the executions carried out by the Bank as an alternative to the completion of bad debt. Online auction based on article 6, UUHT is the executable can cause conflict parate norms, because the existence of regulations implementing the Government-level, as article 26 UUHT, associated with article 7 (1) of law No. 12 of 2011. Parate executions required by Court Fiat. The theory is a theory of hierarchi theory of norms, legal certainty and the theory of legal protection. This study aims to examine the dependent object execution rights in the settlement effort as the execution parate bad debt at The Rural of Banks and to describe the legal protection for the winner of the auction as a result of the implementation of the execution rights of dependents. This type of research and the approach is normative, legal research with approach of legislation and cases. The result of this study gave conclusion on the dependent right execution parate conducted an online lender as an alternative to the last settlement of bad debt, for quick and efficient. Auction winner gets legal protection internally, because the lender makes a deal with the auction winner that the auction is legal transactions such as selling in General. External legal protection, the State provides legal protection to all parties in the execution of rights to dependents.

Abstract

The criminal justice system of children is very important in the effort to settle cases. Children are gifts of God that are entrusted to be cared for, guarded, and guided for a good future. In article 1 number 1 of Law no. 11 of 2012 states that what is meant by the juvenile justice system is the whole process of resolving cases of children dealing with the law from the investigation stage to the guidance stage after undergoing the crime. The aims of the study were to find out and analyze the juvenile justice system (SPPA) in conflict with the law and to examine the implementation of legal protection against children in conflict with the law based on Law Number 11 of 2012. The research method used to see the arrangement of this arrangement is juridical-normative legal research, this research is research that is attempted with the system reviewing applicable laws and regulations or applied to a particular legal case and concept. The method of collecting legal material with the document method is to collect library research contained in secondary legal materials, then analyzed deductively. The results of this study are to look at the process of the juvenile justice system based on subsystems, components, the process of achieving justice for restorative justice and the process of implementing child protection based on the applicable laws and regulations.
