Hadis merupakan salah satu sumber hukum Islam. Kehadirannya dalam kehidupan umat manusia dalam rangka menjawab persoalan manusia (dari waktu ke waktu) sampai akhir zaman. Sepakat ataupun tidak bahwa Nabi hidup di abad XIV yang lalu dengan segala persoalan, keterbatasan, dan kefitrahannya, namun ajaran yang dibawa Nabi Muhammad harus menjangkau zaman melebihi zamannya hidup. Dengan pemahaman seperti itu, Fiqh al hadits merupakan pemberi solusi terhadap pemahaman yang kurang tepat sesuai dengan kebutuhan zaman. Ada beberapa langkah agar fiqh hadits selalu sejalan dan tidak keluar dari metoda pemahaman yang benar. Sejalan dengan itu sebagai seorang peneliti dalam bidang hadits seharusnya memiliki kompetensi sehingga tidak salah dalam memahami kandungan yang terdapat dalam hadis tersebut.

The strong desire of officials’ government to dominate a political power is not only caused by the strong restriction of government toward their political aspiration. But also this is involved by such factors like some desires to increase their income and their career performance, reaching up their prestige, even gaining a popularity. Unfortunately, we could not deny if they were snatching away to compete in the election of a district head. The government must be taking a part to create a clear rule related with this case. The government should criticize to whom breaking the rules decided without any specification. So that, the pros and cons about their participation could be minimize in the election of a district head and the society could accept the problem for this case.

The issue in acquisition of land for public purposes until now is still create a problem in the midle of society even until create a conflict expecially between society and the govermment, in one side the goverment need the land for provision of public facilities but in the other side it arise denial from society to doing the submission and release land rights of them. Various laws have been formed for the acquisition of land for public use either in the form of a presidential decree to form of law, but the level of implementation is still causing controversy in the midle of society which often lead to social conflict. The reason is the regulation does not accommodate and provide legal protection to the public even tend to position people in a weak position, then the rules only focus on juridical aspects and prosedural aspects, but they ignore the sociological aspects so reasonable it will be repressive rule and does not reflect the sense of justice.

Abdullah Ahmad An-Na’im wants to understand Islam according to historical context at the time Islam all that rules were coming. The rule of Syaria, in every steps and in every period to ulama had proved that syaria was a kind of historical product which only compatible to the era, but there is no guarantee will be compatible for the modern era. Therefore, the way to understand syaria in this modern era is doing hermeunetic study, and it has proved that the An-Na’im theory has changed the understanding of the pioneer`s ulama and even rejecting all the rules which had been qath’i by the ulama before. Beside that, Abdullah is the one of the international fighter in humanism`s rights. He is really assure that for this time syaria should be understand in international rights`s context. It is exist to create the equality and the widely acceptance in international world to existence of Islam with its syaria.

The presence of dying exhortation in Islamic law takes part in an important rule to avoid the turbulences inside of a family. As we know, that sometimes a family member could not receive the wealth left by inheritance way. However, he or she has taken apart for supplying the inheritance wealth. By the existence of inheritance wealth (the obligated dying exhortation) arranged in Islam, the disappointments could be overcome.

Every year Muslims commemorate the feast of Idhul Adha. One form of celebration is done by sacrificing. Sacrifice is an amaliyah service whose provisions are regulated in Islam. Sacrifice according to etymology comes from Arabic, namely qaraba which means close. The word qurban is commensurate with the word al-udhiyyat which is defined as the name of an animal slaughtered on the Idhul Adha feast day and tasyrik days to draw closer to Allah. Whereas the term sacrifice means the slaughter of certain animals with the intention of drawing closer to Allah SWT, which is performed on the feast of Idhul Adha or in the days of Tasyrik which is the 11th, 12th and 13th of Dhulhijah. However, in Indonesia the implementation of slaughtering sacrificial animals in each region is carried out differently. Especially giving wages for slaughtering sacrificial animals. This article uses the analytical content method for the syllables' arguments and also uses the field research method, which is to gather information in the field related to the wages of slaughtering sacrificial animal sacrifices that occur in the middle of the community, especially the Tanjung Barulak district. Tanah Datar. The implementation of slaughtering sacrificial animals in the middle of the community is carried out differently. This is because this is a tradition that has been passed down for generations, both wages given in the form of meat, head, feet or parts of sacrificial animals are a reward for people who cut or clean sacrificial animals. The wages were still given but did not take from the sacrificial animal and then replaced the wages in the form of money taken or requested and collected from the sacrificial participants.

This paper attempts to review the typology of the approach taken by the contemporary jurists in determining the law against new problems encountered in the community. Typology method of Contemporary Fiqh ijtihad is a method for understanding the growing Islamic law in the nowaday context , and in the dynamics and dialectics understanding context which are strongly associated with the dimensions of space and time. Every jurist has its own perspective in understanding the law passages. From the results of the study, authors concluded that the typology method of ijtihad Jurisprudence used by contemporary jurists can be categorized into seven forms, mazhabi, Intiqa’i, insya'i, Intiqa’i ainsya ' i, istishlahi, Zahiri and taswighi

As one important branch of Islamic science, the science of usul al-fiqh occupies a crucial position. In the real fact, it’s maybe globally as a key science or the gate of the Islamic sciences. This view is not exaggerated, because the text of Islam’s doctrine of understanding is largely determined by the discipline of usul al-fiqh. Therefore it is not surprising and very logicaly if the Islamic scholars earlier (‘ulama) they put the usul al-fiqh as the science of logic (mantiq) of all the teachings of Islam. More specifically, if the key philosophy of science is the science of Greek logic, especially logic Aristotele, then the system logic of the teachings of Islam itself is the science of usul al-fiqh. However, the question that arises is the lack of interest in usul al-fiqh. This analysis can be seen in some of the side as described in this paper and presented some offers solutions to usul al-fiqh revitalization back and beneficial in many areas of life such as political issues, economics, education, environment and others. This is the meaning of fiqh in the broadest sense and universal. So, it’s look clearly related between “fiqh†(islamic law) and usul al-fiqh of Islamic scholarly discourse.

Over the past few years the study of Islamic economics are commonly carried out in line with the growth of Islamic financial institution. This study has encouraged the growth of Islamic economics literature with a variety of themes. This paper aims to describe the portrait of Islamic economics study in the Islamic College (PTAI) from the standpoint of academic works produced by graduates. There were 194 abstracts at the State Islamic Institute (STAIN) Bukittinggi, precisely in the Department of Islamic Economics analyzed using content analysis. The result of this study showed that Islamic economics was studied with various themes. Islamic financial institutions and financial products with a murabaha contract was at the top rank as the research theme. The findings of those studies encourage and strengthen the previous research, in addition to contributing toward the literature improvement. This study did not mean to say that the study of Islamic economics, particularly Islamic banking from academic research point of view has been drained, but it is expected that in the future the Islamic economics studies are more likely to be observed with a new approach, so that islamic economic studies is much more attractive.

Islam and Indonesia are two unseparated parts. The born and the existence of Republic of Indonesia was a big result of the community of the nation and Islam has taken the biggest part of it. Islamic political views and Islamic community with all of their problems are the historical richness that could not be forgetten. Nowadays, this Nation still needs the participation of Islamic political views and actors as majority. However, why they are important? How is the correlation between the actual Islamic political situations in Indonesia with the Islamic political views of Ibn Taimiyah as the most popular Islamic scolars all the time. In Indonesia Islamic have important role in politic because actually, this Nation will be never founded without His bless. As the consequences, all of the Indonesian Moslem people should participate in any aspects such as in politic to build this Country as the expression of thankfulness. Islamic politic act and Islamic law, at present and future, will be an accordance each other if they are formulated in Islamic univesiality frame. The term “Islam rahmatan lil’ alamin” (in English means ‘the boon of the universe’) interpreted as the plurality of Indonesia. Ibn Taimiyah as the Islamic scholars who has born in modern age has political framework that aligned with Indonesia political views. The law reformation may be enforced if this Nation has good and clean government (wilâyat al-shâlih). The good and clean government is the trusted government that runs the Nation conforms to the mandate of the people and the constitution of the Nation. Islam dan Indonesia adalah dua hal yang tidak dapat dipisahkan. Lahir, berdirinya dan masih eksisnya Negara Kesatuan Republik Indonesia merupakan hasil perjuangan umat Islam bersama-sama dengan komponen bangsa lainnya. Dalam kontek tersebut, politik Islam dan Umat Islam dengan berbagai dinamikanya menjadi kekayaan historis yang tidak boleh dilupakan. Saat inipun, Negara Kesatuan Repoblik Indonesia sangat membutuhkan partisipasi politik Umat Islam yang secara kuantitatif masih mayoritas. Mengapa pentingnya peran politik umat Islam? Dan bagaimana politik hukum Islam saat ini dan dimasa yang datang jika dilihat dari kerangka berpikirnya Ibnu Taimiyah?. Pentingnya politik umat Islam ialah karena Negara ini lahir atas berkat Rahmat Allah SWT. Sebagai konsekuensinya, Umat Islam wajib bersyukur dengan berpartisipasi aktif dalam berbagai bidang dan tidak terkecuali dalam bidang politik. Politik Islam dan Hukum Islam sekarang dan dimasa yang akan datang akan senafas dengan keindonesiaan jika diformulasikan dalam bingkai universalitas Islam itu sendiri. Islam rahmatan lil ‘alamin diterjemahkan dalam pluralitas keindonesiaan. Ibnu Taimiyah sebagai seorang Ulama yang lahir di Abad Modern ini, memiliki kerangka berpikir politik yang selaras dan cocok dengan dinamika, kontekstual dan fundamental politik hukum Islam di Indonesia. Reformasi Hukum (isti’malul Ishlah) akan dapat dilaksanakan jika Negara ini memiliki pemerintah yang baik (wilayatus shalih). Pemerintah yang baik adalah pemerintah yang melaksanakan amanah kenegaraan sesuai dengan amanat yang diberikan oleh rakyat dan Undang-undang Dasar.
