Abstract

This article aims to analyze the dispute resolution mechanism at PT Satustop Finansial Solusi and the effective and efficient application of APS for fintech lending users. This article includes a type of normative legal research that is prescriptive and applied with a legal approach, a case approach, and a conceptual approach. Source materials obtained through primary legal materials and secondary legal materials. The technique used is the syllogism method through a deductive mindset. The dispute resolution mechanism applied by PT Satustop Finansial Solusi is through litigation (judicial institutions). The results show that dispute resolution through litigation is deemed less effective and efficient, so the authors use the provisions in Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, POJK Number 1/POJK.07/2014 concerning Alternative Dispute Resolution Institutions in the Financial Services Sector, and the Theory of Economic Analysis of Law proposed by Richard A. Posner. In this theory, states that the application of economic principles as rational choices to analyze legal issues.

Abstract

This study aims to obtain empirical data about whether or not there is a relationship between understanding of moral norms and social attitudes of students at SMP Negeri 139 Jakarta. The method used in this study uses a quantitative approach with a correlational method. The sampling technique used is simple random sampling, with a total sample of 72 seventh grade students at SMP Negeri 139 Jakarta. Judging from the calculation of the Hypothesis Test with the Product Moment Correlation technique, it was found that the Relationship between Understanding Moral Norms and Social Attitudes was moderate. The understanding of the material on moral norms contributes to social attitudes with the interpretation of the coefficient of determination, which is quite significant.

Abstract

Protection of human rights is an absolute guarantee that must be fulfilled by the rule of law.  Article 1 Paragraph 3 of the 1945 Constitution of the Republic of Indonesia mandates that " The State of Indonesia shall be a state based on the rule of law. " it shows Indonesia recognizes and protects human rights, one of which is the right or freedom to believe in a particular religion. The purpose of this study is to figure out how the regulation of religious tolerance ruled in the Constitution of the Republic of Indonesia/ Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. This research is descriptive research by describing, and analyzing, the issues of tolerance and human rights. The approach used is a legal approach by tracing all relevant laws and regulations. The data collection technique used in this study is a library research technique, which is a data collection technique by reviewing journals, laws and regulations, and other related materials related to the regulation of religious tolerance in Indonesia. That guarantees for the protection of human rights as mandated by the constitution can create religious tolerance among people of different religions in the plurality of Indonesian society. Religious tolerance in Indonesia will create inter-religious harmony to maintain peace, order, tranquility, and the prosperity of the people, nation and state of Indonesia.

Abstract

This study aims to determine the misconceptions that occur in junior high school students in the city of Medan in the science subject of vibration and waves. This research includes descriptive research. The research population is all junior high school students in Medan City. The schools that were sampled were selected using regional sampling techniques, namely the city center, mid-town, and suburbs. SMP Negeri 02 Medan was chosen for the downtown area, SMP Negeri 34 Medan was chosen for the mid-city area and SMP Negeri 29 Medan was selected for the suburbs. city. The sample group of respondents from each school was selected using a cluster random sampling technique with the details of SMP Negeri 02 Medan as many as 29 students, SMP Negeri 34 Medan as many as 27 students and SMP Negeri 29 Medan as many as 29 students. The instrument used in this study was a multiple choice test equipped with CRI. The test questions are given as many as 20 questions about vibrations and waves. Before the test questions are used, the instrument is validated and tested for reliability. After the tests were conducted on the three schools, the data obtained were analyzed using the CRI method. The data from the overall misconception research that occurred for the three schools studied were 23.1%, students who did not understand the concept of 63%, and students who knew the concept of 13.9%. Meanwhile, the highest misconception occurs in question number 7 by 43.5% and the lowest misconception in number 2 by 8.2%. So it can be concluded that the level of students' misconceptions about science (vibration and waves) in general in the city where the three samples studied are categorized as low.

Abstract

The impact of the COVID-19 pandemic in Indonesia is enormous, not only on the economy but also on education. Schools are required to close, and students must study at home using online platforms. The implementation of PJJ had an impact on reducing students' learning motivation. Therefore, an innovation is needed so that the learning process in the classroom can continue to run well and can make students motivated and excited to be involved in the learning process. One way to overcome these problems is to apply the ARCS learning model. This study aims to analyze the optimization of the ARCS learning model as a learning innovation after the COVID-19 pandemic. The method used in this study is a qualitative method with a literature study approach or literature study originating from several sources such as books, texts, e-books, and journals which are dominated from the last 2 years relevant to the research. The results of this study are that optimizing the ARCS learning model can increase student learning motivation in the post-COVID-19 pandemic because this model prioritizes learning motivation to improve student learning outcomes. In the learning and learning process, it is very important to practice these four motivational conditions to continue to be maintained so that students' motivation is maintained during the learning and learning process.

Abstract

. This paper is a study or comparative study between Indonesia and Russia on the regulation of one of the fundamental rights in human rights, namely the right to freedom of religion. As a constitutional state based on law, Indonesia and Russia have made arrangements for this in their constitutions, the most basic of which is contained in the 1945 Constitution (Indonesia) and The Constitution of the Russian Federation (Russia). Universal rules such as human rights play an important role as an instrument that ensures the preservation of the rights of citizens and the implementation of state functions to fulfill these rights. The right to freedom of religion is one of the rights guaranteed in Article 19 of The Constitution of the Russian Federation in Russia, and the 1945 Constitution, as well as several regulations on human rights in Indonesia. Article 19 of the Russian constitution states that The State shall guarantee the equality of rights and freedoms of man and citizen, regardless of sex, race, religion, and also of other circumstances. All forms of limitations of human rights shall be banned. And Article 28I paragraph 1 of the 1945 Constitution states that the right to religion is stated as a right that cannot be reduced under any circumstances, as well as the right to life, the right not to be tortured, the right to freedom of thought and conscience, the right not to be enslaved, the right to be recognized as a human being. person before the law, and the right not to be prosecuted on the basis of retroactive law. As one of the rights that cannot be reduced, the right to religion should apply universally and non-discriminatory.

Abstract

Since the start of the era of globalization, many countries have opened their borders in order to facilitate the exchange of information and the movement of people and goods, creating a borderless situation. The ease of interaction and activities on the one hand has a positive impact including creating a conducive economic situation, but at the same time on the other hand it also brings the threat of increasing crimes that are transnational in nature. The perpetrators of these crimes take advantage of differences in the structure and interpretation of law between countries and state sovereignty to avoid being chased by law enforcement officials. For Indonesia, participation in an MLA collaboration is a manifestation of Indonesia's role in international relations to overcome international problems that can threaten economic, political and legal stability. So far, Indonesia has been active in initiating MLA agreements with other countries to assist domestic law enforcement. As of August 2020, Indonesia has ratified ten MLA agreements with law. In addition to the agreement, Indonesia is also currently completing the process for the ratification of one other agreement, namely with Russia. Using a normative juridical method through a literature study that examines primary and secondary legal materials, this paper will discuss the implementation of Treaty between the Republic of Indonesia and the Russian Federation on Mutual Legal Assistance in Criminal Matters, especially in the crime of corruption.

Abstract

In today’s business world, the role of competitive intelligence in the growth and survival of business enterprises cannot be overemphasised. This reality stems largely from the backdrop of the cohesive and coordinating role of competitive intelligence in ensuring the resilience and productivity of businesses not only in Nigeria but all over the world. However in the face of these potent effects and relevance of competitive intelligence in business successes across the world, experts have clearly identified that competitive intelligence is apparently prone to failure. Consequently, the following have been identified as the correlates of competitive intelligence failure and they include; lack of understanding of competitive intelligence failure, lack of support from senior management executive and above all inadequate skills in competitive intelligence analysis by the personnel in-charge of that responsibility. Beyond these challenges, this work therefore elucidates on business strategies that will attenuate competitive intelligence failures while offering useful survival and success platforms for business enterprises in Nigeria and Port Harcourt City in particular. In arriving at the aforesaid position, the authors methodically obtained data from primary sources via questionnaires from respondents which were duly analysed, and from secondary sources such as related literatures, government and corporate documents that were logically arranged and presented accordingly.
