Abstract

The Indonesian Ulama Council is an independent institution to establish fatwas in Indonesia which is based on the test of ijtihad. Today, the fatwa designated by the Indonesian Ulama Council must adjust to the developments in accordance with the contemporary era. But its implementation, the various fatwas that have been set sometimes causing controversy from parties that have unequal interpretation and different interests. Like is the fatwa Number 31 of 2020 concerning Committee Jum'at and Jemaah Prayers for Preventing Transmission of the Covid-19 Outbreak and haram cryptocurrency fatwas invite various pro and counters. The method used in this research is a juridical Islamic legal approach so that the presentation of the results and descriptive form of analysis. Fatwas that correspond to contemporary ages should always be guided by strict sources according to Islamic legal sources as guidance of life people. Then it will be discussed more detailed about the Indonesian Ulama Council and MUI fatwa relevance to the contemporary era.

Abstract

Globalization can be interpreted as a global process and everything becomes more modern, easy, sophisticated, and faster without the limitations of distance, space and time. Globalization is supported by a variety of technological innovations that help human life a lot. Inevitably, globalization creates various phenomena in various aspects of life. One example is the lifestyle of hedonism among the younger generation. Hedonism itself is a view of life that is manifested in the form of a lifestyle that makes worldly pleasure the purpose of life. Many people mistakenly apply this lifestyle of hedonism, perhaps unknowingly this has become a social disease. This hedonism attacks many millennials, where millennials are the next generation of young people who should be far from the nature of hedonism. The lifestyle of hedonism itself is difficult to avoid, there needs to be an awareness of each person. Indonesia has a very strong ancestral heritage to help young people free from the hedonism lifestyle that has become a disease, namely the five principles of Pancasila. The young generation needs to inculcate the strong personality contained in Pancasila and always implement it in daily life. The values and meanings of Pancasila are the guiding principles of the nation, the personality of the nation, and the ideology of the nation that is most in line with the noble soul and personality of the Indonesian Nation.

Abstract

In the digital age, there are a lot of people or society who choose  e-commerce rather than the conventional transaction. E-commerce usually done in online marketplace applications such as Tokopedia, Bukalapak, Traveloka, and so on. Based on the data, Indonesia ranks as one of the highest e-commerce growth rate in the world. This is a good sign, because it means that marketplace companies in Indonesia can also compete and have a great opportunity to be more global.  However, as a result of these developments, of course there are also negative impacts that come together. One of the negative impacts is the issue of security/security of the linked accounts in the marketplace application. A lot of data-leak phenomena occur frequently and this is an urgent matter to be prevented and resolved. Marketplace’s account owners must have a legal things that protect them and prevent any various kinds of losses that can arise due to data leakage. And the marketplace platform providers also have to make some policies to protect their app users from the data leakage.

Abstract

The problem of corruption in Indonesia which is increasingly rampant starting from the central government, regional government, to the joints of people's lives in general requires an effective eradication strategy. One that must be involved in preventing and eradicating corruption is youth. Youth must take an active role in preventing corruption. One thing youths can do is carry out anti-corruption education to the general public. The process of cracking down on corruption cases carried out by the Corruption Eradication Commission together with the anti-corruption education movement is expected to optimize the process of eradicating corruption in Indonesia.

Abstract

Every Indonesian citizen must learn, understand, explore, implement, appreciate, maintain, and practice and implement the values of Pancasila in all areas of the life of the nation, especially for the next generation of the nation, one of which is the millennial generation. Changes that occur in this world feel so fast, increasingly modern and sophisticated, and the country of Indonesia is a plural country which means that Indonesia has a variety of ethnic, religious, gender (sex), class, culture, customs and so on, so that can trigger a potential conflict that will be a challenge in implementing the points of Pancasila values. Data collection techniques were carried out by documentation study. The approach method used in writing is descriptive-analytical method. The conclusion of the millennial generation is that it does not mean the basic values of Pancasila, causing various challenges such as can cause divisions that can destroy the unity and unity of the Republic of Indonesia. The millennial generation solution must understand and deepen to the soul so that they are aware and will not forget the struggle of the heroes who fall before them to the last point in order to maintain the NKRI, so that they feel a sense of enthusiasm and pride in the heroes' struggle, so millennial generation will apply the basic values of Pancasila to all areas of their lives, and be able to restore the role of Pancasila in changing their perspective to be better.

Abstract

Trading through Broker, one side is easy; the other side could be difficult. The difficulty here means determining the hidden defects responsibility and law risk of goods purchased by a third party. After further research on the existance law, the responsibility is determined by the law of the intermediary relationship with the parties involved in the transaction. Trading through agents and brokers, their legal relationship with the employer is the authority, so the agent is outside the parties doing transaction, then who shall be responsible for the third party is the businessman as a seller. While trading through distributors and commissioners, the legal relationship to the third party (the buyer) is the legal relationship where the commissioner and distributors are as sellers, they shall be responsible to the third party (the buyer) over the hidden defect and law risk of the goods he bought.

Abstract

As though a double-edged knife, on the one hand, Narcotics can be a panacea for various critical illnesses, but on the other hand, Narcotics can destroy all joints and organs of the human body. Both sides are very much determined by who the narcotics are used for. As one type of Narcotics, Drugs are the type most abused. However, the problems arising from drugs are in fact not only about abuse. Drug abuse is then used as a momentum to form an organized business sector with a structured and systematic sales mechanism. Of course, this is what makes drug abuse categorized as an extraordinary crime that requires extraordinary handling as well. This research will reveal various types of drug abuse as well as national and international efforts and efforts in fighting drug crimes. This research uses qualitative research methods with a literature approach. The data obtained comes from several regulations, such as Law Number 35 of 2009 concerning Narcotics and several other regulations and policies, as well as international cooperation carried out by Indonesia. The results of the study state that Indonesia is currently in a state of drug emergency, so it is necessary to strengthen and innovate government policies to tackle drug crimes that have been committed at this time, as a form of government commitment to eradicating drugs from the base to the upstream of the problem.

Abstract

This research will raise the issue that will be studied is, First, the regulation of dissenting opinion in the Constitutional Court's Event Law.  Second, the legal power of dissenting opinion in the Constitutional Court Decision.  Third, the legal implications of dissenting opinion in the Constitutional Court Decision. This resulted in the conclusion First, the arrangement of dissenting opinions in the constitutional court's guidelines in this case in the FMD cannot be found as a whole.   The arrangement of dissenting opinion in the PMK independence of constitutional judges in conveying their opinions is still maintained.  Second, explicitly, there is no setting on dissenting opinion. The phrase used in Law No. 24 of 2003 concerning the Constitutional Court is "the opinion of different members of the panel of judges". Third, the legal implications of dissenting opinion in the Constitutional Court's decision are legal uncertainty, violation of the hierarchy of laws and regulations, and the absence of legal order. The formulation of dissenting opinion is necessary to clarify its position in the law of events in the Constitutional Court. This can only be done if the legal instruments that govern it give full legitimacy to constitutional judges in dissenting. The author's advice in this study is   to strengthen the legal power  of dissenting opinion, as a preventive measure against future legal reforms to ensure certainty, justice. and the usefulness of the law for the whole society

Abstract

This research is descriptive analysis and uses a statutory approach. This research also uses qualitative juridical analysis which is conducted by using inductive deductive thinking method and vice versa. Conducted to find out and describe the corona virus impact on regulation in banking sector, and how the Financial Services Authority’s role for protecting banking consumers affected by Covid-19. The impact of Covid-19 has an economic activities impact, including in banking sector, which causes debtors to experience difficulties in carrying out achievements. Although, the government issued several policies including the existence of regulations regarding State Financial Policy and Financial System Stability for Handling the Corona Virus Disease 2019 Pandemic or in the Context of Facing Threats that Endanger the National Economy and Financial System Stability. Furthermore, the Financial Services Authority as a banking supervisory institution also took part in and supported the Government's policies, namely by issuing several policies in order to protect customers affected by Covid-19, through its policies, banking institutions are required to implement a credit relaxation program like credit restructuring for affected customers.

Abstract

People accustomed to all daily activities outside the home appear to have developed a sense of boredom as a result of being forced to adhere to the government's stay-at-home policy. And, of course, this program quickly became a popular issue on social media with the hashtag #dirumahAja, with the expectation that all Indonesians would comprehend and understand how to assist the government in breaking the chain of transmission of the fatal corona virus, which is a new form of virus. There are numerous examples of how this covid-19 epidemic may create havoc and disrupt human existence, and it feels very real to everyone in this country. Throughout this pandemic, the government was compelled to enact policies sufficient to ensure the nation's safety, and the hope that the national crisis would stop soon has become a global issue. Previously, if you encountered hoax news or news that was still confusing, you could immediately report it to the local police and face punishment for violating the ITE law. However, during this pandemic, and in relation to the pandemic issue that resulted in the emergence of HOAX news, it was not only the government that became the cause of this. enraged. But also among public people who turned out to be socially acceptable parties. This study used a qualitative descriptive technique to analyze life-affirming policies during the COVID-19 epidemic, which has caused widespread concern in all spheres of life.
