Abstract

Dinamika yang muncul dimasyarakat yang merasa hak hak asasinya dilanggar oleh beberapa ketentuan dalam Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 tentang Rencana Tata Ruang Provinsi Bali Tahun 2009-2029 maka analisa secara normatif terhadap Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 tentang Rencana Tata Ruang Provinsi Bali Tahun 2009-2029 mutlak dilakukan untuk menghindari konflik yang berkepanjangan sekaligus menciptakan keadilan bagi seluruh masyarakat Bali.Adapun rumusan masalah yang diambil : Apakah pembentukan peraturan daerah provinsi Bali No 16 tahun 2009 sudah memenuhi unsur filosofis, yuridis dan sosiologis dalam aspek keberlakuannya?dan Apakah peraturan daerah provinsi Bali No 16 tahun 2009 sudah mencerminkan nilai keadilan dalam masyarakat? Metode Penulisan yang dipergunakan metode hukum Normatif dengan pendekatan konseptual (conceptual approach) dan pendekatan perundang-undangan (statute approach) yang dianalisis dengan metode analisis kritis (critical analysis) melalui pendekatan analisis komprehensif (comprehensive analysis). Adapun Simpulan yang didapat Pertama, menurut teori keberlakuan hukum, pembentukan Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 sudah memenuhi unsur filosofis, yuridis, dan sosiologis dalam pembentukannya dan kedua Peraturan Daerah Provinsi Bali Nomor 16 Tahun 2009 Belum mencerminkan keadilan bagi masyarakat.

Abstract

Children marriage of children at a very early marriage performed under adult age which is prohibited by law or other rules and regulations because it can cause things that can harm women. The impact that occurs from marriage a serious problem that must be with appropriately and seriously by the parties as well as the relevant agencies. Because the results in future generations caused by first high number of children who experience unwanted pregnancy and childbirth. Second, this also results in divorce. Third, the birth of a baby who later does not grow properly. Fourth, children are victims of divorce have the potential to fall into poverty, fail in education, get trapped trafficking children, are placed in degrading work such as sex workers, drug dealers, slavery. These are all in violation of child rights. The method in research in using normative juridical research is by principles and theories reviewing books, documents, journals, as well as from invitation legislation relating to the problem to be studied. The result is the prevention of child marriage at a very young age is the protection of children's rights, especially the protection of the right to life, the right to grow and must remain protected.

Abstract

The need for land has become a very important demand explosion due to the vast area of ​​the city of Jakarata which is already very dense. So that reclamation becomes one of the efforts in increasing the region as well as regional income. The purpose of this research is to provide a clear and formal explanation for both the regional government and the general public. The writing uses an empiric juridical method with a positive written legal approach that is applied to in concreto legal events in society. . This can affect the legal subjects holding rights from land reclaimed by the beach. The legal status of the legal subject to management rights is still regulated by general regulations so that it can lead to multiple interpretations of legal subjects that hold management rights from land reclaimed by the beach. Regional Governments should be able to prepare legal infrastructure in accordance with the existing laws and regulations and can also have a positive effect on the business world as well as the economic sector.

Abstract

Putusan Hakim Mahkamah Konstitusi menyatakan Pasal 10 Undang-Undang Nomor 24 Tahun 2000 bertentangan dengan Konstitusi Indonesia dan tidak memiliki kekuatan hukum mengikat, namun secara bersyarat bahwa persetujuan legislatif hanya pada jenis-jenis perjanjian tersebut pada Pasal 10. Perjanjian internasional yang dilakukan eksekutif menimbulkan paradigma terkait pengawasan dan mengimbangi eksekutif terhadap penerapan perjanjian internasional ke dalam sistem hukum nasional sehingga paradigma tersebut menghadirkan prinsip checks and balances dikeduanya. legislatif memiliki kewenangan penuh berada untuk mengkaji peraturan yang hendak di ratifikasi yang bersumber dari perjanjian internasional bertentangan dengan UUD atau tidak. Kontrol legislatif terletak pada Pasal 11 ayat 2 UUD apabila perjanjian internasional itu menimbulkan dampak bagi kehidupan rakyat terkait dengan beban keuangan Negara dan perasyarat menurut Pasal 10 UU Nomor 24 tahun 2000 tentang perjanjian internasional. Sedangkan hak presiden untuk mengeluarkan Keputusan Presiden hanya sebatas evaluasi saja kepada Dewan Perwakilan Rakyat, dimaknai sebagai proses menilai norma-norma yang berlaku di Indonesia sehingga ratifikasi melalui Keputusan Presiden tidak bersifat menolak tetapi mengevaluasi dan dikembalikan kepada Presiden untuk di terbitkan dalam lembaran negara. Sama halnya dengan menteri, Dewan Perwakilan Rakyat diposisikan sebagai lembaga yang diminta pertimbangan atau konsultasi saja, Dewan Perwakilan Rakyat tidak memiliki kewenangan untuk membatalkan kebijakan yang akan diambil Menteri tersebut.

Abstract

The waste problem in Indonesia have become a national problem, nowdays the management and handling of household waste in Cities of Indonesia was not environmentally sound and not equitable social, some of the causes are the regulation and handling was not pro-environment and also not accompanied by participation of entire community. The implementation of Act No. 18 of 2008 about Waste Management not maximum running because law enforcement can not encourage the society to behave environmental conception in the management of waste based on maintenance and protection of environmental principal. The research method used is legal research using a statutory and conceptual approach. The management and handling of household waste should be sorting of waste based on the characteristic method and disposal schedule. These activity starting from household will forming the role and encourage the society to participate and handle their household waste. The result aims to reduce the amount of household waste. Abstract

Mining activities that tend to ignore or even damage the environment indicate an anthropocentrism behavior where human interests take more precedence than the environmental sustainability. Economic interests are often the main reason for mining activity such as cutting down protected forests, damaging and polluting watersheds, and etc. As an area that has been exploited for a long time, East Belitung has experienced the increasing number of its critical land and natural disasters such as floods because of tin mining that ignores the environment. This condition show that the legal culture of the miner's environment has not been developed yet, or it’s already exists but the clash with economic interests and dependence on tin has made anthropocentrism become more dominant. Policies, prevention efforts, socialization and enforcement have been carried out but the fact shows it’s not easy to harmonize between anthropocentrism and awareness of the environmental law of the community..

Abstract

Violence against women is a crime that almost occurs in all cultures and countries that occur both in public and private spaces. Based on Komnas Perempuan's annual records, almost all regions of Indonesia committed these crimes. The most common violence is sexual violence. In Jambi, during the period of 2017-2019 there were several cases of rape and sexual abuse and other violence. And what's interesting is that some cases have other dimensions of action that are actually important to study how the application of the law to the event. This research is empirical, because it examines facts or legal events by then examining how the application of the law. From the results of the study showed that, the type of sexual violence decided by the judge, generally related to the crime of rape and molestation as contained in the Criminal Code. In the imposition of sanctions, none of the judges has given the maximum sentence, even though the trial proved guilty. In the case of the application of the law, law enforcers in this case prosecutors and judges guide the Criminal Code, which indeed includes rape and molestation arrangements. Although in reality the actual cases have different dimensions of action (more than one) and deserve to be given threats that are in accordance with the perpetrators' actions. In this case, there is a legal vacuum that actually results in uncertainty in fulfilling a sense of justice for women (victims). So it is important to reform the provisions regarding sexual violence by adopting the value of protecting women and accommodating the wisdom principle of the Indonesian nation namely Pancasila and accommodating the principles of gender justice

Abstract

Regulations are chosen as a means to realizizing public policy by the Government. Law Number 11 of 2020 concerning Job Creation (Job Creation Law), as an omnibus law, was formed to create a conducive climate for investment by reforming regulations in the field of business licensing. In its journey, the Job Creation Law is inseparable from various polemics, starting from the reporting stages of the material regulated in it, including efforts to liberalize food import policy. Allegedly, the presence of the Job Creation Law is injustice and negates the little people. The progressive law put forward by Satjipto Rahardjo adheres to the understanding that law is said to be progressive when the law favors the weak, the law must be pro-justice and pro-people. Based on the study and analysis of progressive law on the Job Creation Law, it can be said that the content of the Job Creation Law in agriculture which is an effort to liberalize food imports is also not in line with progressive law because it does not pay attention to the interests of small farmers because it reduces farmers' right to life.

Abstract

This legal research aims to analyze the various applicable laws and regulations related to the rules on technology transfer in Indonesia. The legal research method used in this legal research uses normative legal research and uses secondary legal material as a reference for collecting data. This legal research would like to convey the need for regulation of Sui Generis technology transfer which has become an interesting old issue and needs to be discussed. That the rules of technology transfer which are spread in various laws and regulations are felt to be unable to provide legal protection for the host country where developed countries invest and establish their companies. Inability to provide protection is basically no strict sanctions if the country or TNC does not make efforts to transfer technology as mandated by the legislation. Therefore, by doing the preparation of technology transfer sui generis as well as special attention from the government about this condition, it will provide benefits and advantages for the host country to manage the transfer of technology that it obtains.

Abstract

Positive law in Indonesia stipulates that business actors are not allowed to produce and trade all products, including baby clothes that do not meet the Indonesian National Standard (SNI). However, in reality, baby clothing business actors still find violations, for example, in the city of Banda Aceh. Departing from these problems, this study aims to explain the role of the government in protecting consumers. These factors cause the sale and purchase of baby clothes that do not have SNI and legal measures that consumers can take as a form of responsibility for sellers of baby clothes who do not have SNI. This research is legal research that is juridical and empirical that seeks newness based on field research concerning legitimate science. Field research was conducted to obtain primary data through interviews and provide questionnaires with respondents and informants. Based on the results of the study, it is known that the role of the government in protecting consumers has carried out supervision, established several regulations and conducted socialization regarding mandatory SNI for baby clothes that are not SNI but not yet fully effective.
