Abstract

The annulment of marriage due to misconceptions about the husband or wife is found with different reasons for the application. However, neither the Undang-Undang Perkawinan nor the KHI provides an explanation regarding the definition or elements of the misconceptions. So, it is necessary to review the laws and regulations and judges' decisions on the annulment of marriage because of misconceptions about the husband or wife, especially when there is an element of fraud, in order to provide legal certainty for the applicants and the general public. The purpose of this study examines the legal arrangements for annulment of marriage due to misconceptions that there is an element of fraud regarding the spouse according to positive law in Indonesia as well as the judge's legal considerations in granting the marriage annulment application. This research is normative juridical research, using data collection methods by means of literature studies and document studies, and processed by data processing methods, namely data selection and data classification which are then analyzed qualitatively. The results of the research and discussion explained that the annulment of marriage due to misconceptions about the couple is regulated in Pasal 27 Ayat (2) of the Undang-Undang Perkawinan and Pasal 72 Ayat (2) of the KHI. This state of misconception in the annulment of marriage occurs when there is an element of intentionality on the part of one of the parties to disguise the actual state of affairs about him by deceiving the other party. In the case of the marriage annulment judgment No. 1845/Pdt.G/2020/PA. Gsg and No. 25/Pdt.G/2020/PA. Sak, which occurs because of a misconception about husband and wife, it is known that these false elements are related to fraud. The fraud is regulated in Pasal 378 of the Kitab Undang-Undang Hukum Pidana (KUHP). The circumstances of misconception in this marriage can also be sued with an unlawful act if the act committed by one of the parties is proven to be unlawful and the act causes harm to the other party.

Abstract

The use of three contracts, namely buying and selling, IMBT, and grants implemented by BMT UGT Nusantara is the background of this research. Before entering into an IMBT contract, a customer who applies for financing must first sell goods to the BMT using a sale and purchase agreement. This is very contradictory when combined with DSN-MUI Fatwa No. 27/DSNMUI/III/2002 concerning Ijarah Mutahiyah Bit Tamlik. The qualitative descriptive method that the researcher used to explain the implementation of the Al-Ijarah Al-Muntakiyah bit Tamlik contract in financing BMT UGT Nusantara. While the data collection procedure uses observation and interviews. Data were analyzed by using triangulation analysis techniques. We can draw the results of this discussion as the thread that the implementation of Ijarah Muntahiyah Bit Tamlik in the BMT UGT Nusantara financing product Pujer sub-branch is in accordance with the principles of muamalah. However, the Ijarah Al Muntakiyah Bit Tamlik contract practiced by BMT UGT Nusantara has a slight difference according to the standardization of permissibility in the book Fiqh Al Buyu'. However, the implementation and other procedures are very much aligned with the DSN-MUI Fatwa No. 27/DSN-MUI/III/2002 concerning the Ijarah Al Mutahiyah Bit Tamlik contract.

Abstract

So far, education is considered a failure, not just not meeting job standards. The bigger problem is that our education is not used to producing satisfactory graduates with noble character. The ancient nations that were destroyed by God, not because they did not master science and technology or were not smart, but because they had wrong intentions, methods, and did not know what the ultimate goal was and worst of all, they did not practice their knowledge, therefore they did not have good morals. . Is it not true that people who take a wrong step or do not know the procedure in seeking educational knowledge are very bad. As a religion that prioritizes education, throughout the life of Islam, there have been many thinkers who have contributed their thoughts in the field of educational concepts in particular, as well as from various other fields. Ibn Sina, Al-Qobisi, Ibn Taimiyah, Maskawaih, Al-Ghazali, Kh Imam Zarkasi, Az-Zarnuji who contributed their thoughts to the perfection and advancement of the concept of Islamic education based on the Qur'an and the Sunnah of the Prophet. The views of Islamic education thinkers or experts, especially Sheikh Az-Zarnuji in this study, have been brought back for joint study, so that we can use them as guidelines or guidelines and further study of systems or methods of educational concepts based on The Qur'an and the Sunnah of the Prophet SAW. This researcher seeks to express Az-Zarnuji's thoughts in the book Ta'limul Muta'alim in the form of messages about the concept of Islamic education. The type of research used is Library Research with a qualitative approach, based on that data is taken from the original source and is supported by related sources. The data collection method uses documentation. Data analysis techniques with three components: data reduction (data reduction), data presentation (data display) and drawing and verifying conclusions. Following the formulation of Miles and Huberman, while the method of checking the validity of the data with five components; (1) triangulation, (2) checking the truth of information, (3) munaqosah, (4) analysis of negative cases, and (5) extension of research time (if possible). From the research it was emphasized that the messages of Az-Zarnuji's educational concepts in the book Ta'limul Muta'alm; (1) good intentions to learn, (2) be grateful for what Allah has given, (3) focus and pursue knowledge, (4) may intend to seek knowledge with other intentions, (5) choose a teacher, (6) choose friends , (7) human nature, (8) trustworthiness, (9) memorization method, (10) causes of memory to be weak, (11) learning method, (12) time to study, and (13) worship.

Abstract

Conflict can happen to everything in diversity. Existing differences have the potential to trigger conflict. Conflicts can be avoided and can also be arranged in such a way as not to level up. Among the handling of conflicts can be resolution through local wisdom. This paper tries to describe the results of local government conflict resolution analysis in conflict resolution based on local wisdom. The research method uses qualitative with a literature study approach. The results of the research, the local government has succeeded in conducting dialogue on various conflicts that occurred in the Banyuwangi area. The village government as the government is most in touch with the community and knows best the condition of the community's character is considered capable of resolving village-level conflicts. Conflict resolution in the village uses resolution based on local wisdom. Community leaders as the main center function as referees who do not take sides with two interested parties, as well as provide input and direction, as well as joint solutions to the problems faced.

Abstract

Film is one of the literary works which also as mass media that contains moral value for people indirectly affect to people’s thought and behavior. Fil is also one of an effective communication media to convey message through dialog and scene. Therefore, writer made a film as a research subject. This research is discussed about Keluarga Cemara Film especially education of children character in this film. Family trough parents ‘role able to help build a good character of children. In development era, people demanded not only smart in intellectual but also has good character. Character is one thing that attached to person and made it as typical of personality as a driver and activator to distinguish one individual. This research aimed to analyze and recognize the education character of children in family. The research method applied in this research was qualitative descriptive. This research used technique sampling data to see and note dialog and scene in this film which describe or contain education character of children

Abstract

This article discusses the implications of the Gulen Movement toward the education system in Germany. This research used a descriptive method to describe a phenomenon. This study was a qualitative research technique that analyzes data based on text and images. Data collection uses library research techniques or literature studies from various sources, namely journals, books, and news portals. Data or journals collection used Publish or Perish. The Gulen movement is spread across many countries. This research focuses on Germany and its implications on the education system in Germany. The results of this study are that Gulen-based schools in Germany does not have full implications for the education system in Germany, but they are easily accepted because they have the same educational value.

Abstract

The practice of consuming alcohol has its own meaning for teenagers. Even though they understand and practice the rules of their religion, teenagers have their own knowledge about drinking alcohol. Through their knowledge, it is as if they can escape the rules of their religion. This study aims to identify the experience of consuming alcohol and adolescent religious practices in Surabaya. The study used qualitative research methods with a symbolic nonlism interaction theory approach to determine the perception of alcohol consumption; find out about alcohol consumption, thereby escaping religious rules. The results of this study indicate that adolescents have meanings about alcohol consumption, such as symbols of happiness, venting, breaking the atmosphere, gratitude, and togetherness. Teenagers give reasons that alcohol consumption is not a matter of halal or haram, as long as it does not harm others. The public stigma about alcohol is a social and religious deviation because it is used in a riot, to the detriment of others.

Abstract

The problem raised in this paper is the social setting of two religious-national figures. One represents religion, and the other represents nationalists. The ideas and movements of the two figures became an in-depth and broad discussion in this study. The research method is qualitative with a type of literature research. The object of study is in the form of a primary document that examines many figures between karno and Kh. Hasyim Asy'ari. Then grouping and analysis is carried out using deductive descriptions. Karno and Kh. Hasyim Asy'ari filled each other and colored each other for Indonesian independence. Both received education from childhood, under the care of their families and religious and nationalist leaders. Both are colored by bright thoughts that became the forerunners of the spirit of national unity for Indonesian society which was given a premodial arrangement. The two of them both carry a union. According to Karno, there is no independence without unity. Meanwhile, according to Kh Hasyim Asy'ari, unity is the main force in the struggle, especially in fighting for Indonesian independence, through a jihad fatwa that ignites the national sense of the Indonesian people, namely Hubbul Wathon Minal Iman.

Abstract

The COVID-19 pandemic has had a wide impact on all walks of life. One of the effects that is very pronounced is the social aspect. The purpose of this study was to determine the impact of learning loss on psychosocial students during and after the pandemic. The research method used is a qualitative research method with a phenomenological approach. The participants in this study were students from three Islamic universities in Yogyakarta, totaling 15 people. The selection of participants was based on criteria that had been determined purposively, namely from Islamic colleges, experienced social problems in particular and data could be taken. The data collection technique used in-depth interviews in accordance with the interview instrument guidelines that had been made. The data analysis technique went through three stages, namely reduction, data presentation and data interpretation to draw conclusions. The research findings lead to three conclusions. First, the impact of the pandemic is the loss of enthusiasm for learning or learning loss. Second, socially, the impact of the pandemic causes psychosocial problems, namely they tend to be aloof or introverted. Third, after the pandemic, most of the students are already comfortable with their conditions during the pandemic, so they experience laziness and boredom to carry out activities directly. The results of this study still have many weaknesses, especially in the selection of respondents who are still limited and data mining and analysis. Subsequent research will be urgently needed to provide more comprehensive reinforcement and additional results.

Abstract

The present study aims to determine how the service quality, customer satisfaction, and corporate image can impact on customer’s loyalty at BMT UGT Sidogiri Glenmore Branch. After exploring the literature review, this study determines that essential variables have strongly suspected of influencing customer’s loyalty, namely service quality, customer satisfaction, and company image. The variables identified is a basic strategy for developing customer loyalty. This research employs quantitative explanatory research to analyze service quality, customer satisfaction, and company image on customer loyalty using a survey method. While probability sampling with accidental sampling method was used to determine the sample, the sample size of the sample was determined using Ferdinand's theory. As a result, 325 respondents were collected. Multiple linear regression analysis tools, with the help of SPSS version 22 were used to analyze the data. The analysis results show that the service quality variable has a significant effect on customer loyalty with Sig. 0.037. Customer satisfaction has a significant impact on customer loyalty with Sig. 0,000. Company image has a substantial impact on customer loyalty with Sig. 0,000. These variables (simultaneously) have significantly impacted on customer loyalty with a value of F count 71.390 ≥ F table 3.20 and a significance of 0.000 ≤ 0.05. Then, the R2 test used (coefficient of determination) was 0.220 or 22%. However, the researcher did not examine further the other variables influence the remaining 78% in this study.
