Abstract

Penelitian ini menganalisis penguatan kelembagaan ekonomi berbasis zakat yang berkeadilan dalam sistem hukum Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif. Jenis data yang digunakan adalah data sekunder yang bersumber dari penelitian kepustakaan terhadap bahan hukum primer, sekunder dan tersier. Selanjutnya dilakukan pengumpulan dan pengolahan data dan dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa konstruksi hukum pengelolaan zakat di Indonesia saat ini didasarkan pada Undang-Undang Nomor 23 Tahun 2011 tentang Pengelolaan Zakat serta aturan pelasananya yaitu PP No. 14 Tahun 2014. Kelemahan utama pengaturan kelembagaan zakat di Indonesia adalah BAZNAS memiliki kewenangan rangkap sehingga menjadi lembaga superbody. Kewenangan ini juga sejalan dengan konsep “hak menguasai negara” yang diperuntukkan hanya bagi cabang produksi dan SDA, tidak untuk zakat, sehingga memunculkan ketidakseimbangan kewenangan antarlembaga pengelola zakat. Maka perlu dilakukan penguatan kelembagaan zakat melalui pemisahan tegas fungsi regulator dan operator, penguatan kedudukan LAZ setara BAZNAS, penerapan unified system yang berkeadilan, implementasi good zakat governance dan penguatan muzakki serta partisipasi stakeholder dalam proses legislasi. Abstract

Bid rigging reflects the intersection between competition law and corruption, particularly where collusive procurement practices result in state financial losses. This study examines the legal status and probative value of decisions issued by the Business Competition Supervisory Commission (KPPU) as documentary evidence in corruption investigations following the enactment of Law Number 20 of 2025 on the Criminal Procedure Code (KUHAP). The research employs a normative legal methodology using statutory and conceptual approaches. The findings show that final and binding (inkracht) KPPU decisions constitute admissible documentary evidence under the new KUHAP because they contain objective factual findings concerning the actus reus of bid-rigging. These findings also provide persuasive evidence from which investigators may infer mens rea, subject to corroboration with other admissible evidence. The recognition of KPPU decisions strengthens corruption investigations by enabling investigators from the Police, the Attorney General's Office, and the Corruption Eradication Commission (KPK) to build upon established findings of collusive conduct while coordinating with authorized audit institutions to establish state financial losses. The study recommends adopting cross-institutional technical regulations to facilitate digital evidence sharing and interoperability between the KPPU and criminal justice agencies, thereby improving investigative efficiency and supporting the principle of a speedy trial in procurement-related corruption cases..

Abstract

Law Number 5 of 1960 on Agrarian Principles and its related rules define land rights transfer as transferring ownership or control over land. The transfer of ownership rights raises questions about the minimum age to establish a legal entity. In land services, the age of majority is 18 or after marriage, under Circular Letter of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Head 4/SE/I/2015. In contrast, Article 330 of the Criminal Code defines adulthood at 21 or marriage. These discrepancies in rules create legal confusion for legal organisations who transfer land rights between 18 and 21. The researcher employed a normative legal method to evaluate Indonesian land transfer law and legal certainty among 18–21-year-olds. According to research, a property Deed Official (PPAT) is a public official authorised to issue deeds of transfer of ownership in Indonesia, and all property rights transfers must comply with the UUPA and its laws. In land services, Circular Letter of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (BPN) No. 4/SE/I/2015 is legally binding. When legally mature people transfer land rights according to procedures, their actions are valid and binding. This circular meets the public's land service needs without court orders.

Abstract

Multi-year infrastructure projects are inherently characterized by high legal and financial complexities, where conventional litigation and post-project arbitration often prove to be protracted, reactive, and deleterious to project continuity. While the Indonesian regulatory framework, specifically Government Regulation No. 22 of 2020, has formally recognized the Dispute Board (DB) mechanism, its practical efficacy remains constrained by a profound normative lacuna regarding executorial enforceability. This research employs a legal-doctrinal method with a comparative approach, analyzing the Indonesian landscape against the FIDIC international standards and the Statutory Adjudication models of the United Kingdom and Singapore. The findings elucidate a critical "legal gap" where DB decisions, despite being contractually binding, lack public executorial authority (executorial title). This institutional weakness incentivizes moral hazard, allowing non-compliant parties to evade immediate financial obligations through judicial delays. Consequently, this study proposes a regulatory reconstruction by integrating the principle of temporary finality into the national legislative framework, specifically through the amendment of the Construction Services Law or the Arbitration Law. The proposed model advocates for a "fast-track enforcement" mechanism within the District Courts, predicated on a limited judicial review that precludes the re-examination of technical merits. Such a reform is imperative to safeguard project liquidity (cash flow), ensure legal certainty (rechtszekerheid), and fortify the resilience of National Strategic Projects against systemic disruption.

Abstract

The capitalization of the agricultural sector has transformed seed governance from community-based agricultural practices into industrial systems dominated by corporate interests and intellectual property regimes. In Indonesia, the implementation of Plant Variety Protection (PVP) under Law Number 29 of 2000 has generated significant challenges regarding farmers’ rights, local seed sustainability, and agrarian justice. This study aims to analyze the impact of agricultural capitalization on farmers’ rights and local seed systems, as well as to evaluate the implementation of the PVP regime from an Islamic socio-legal perspective. This research employs a normative-empirical legal method using an Islamic socio-legal approach. Primary legal materials consist of national and international regulations concerning plant variety protection, while secondary materials include scholarly literature, policy reports, and previous studies related to agricultural capitalization and seed governance. The findings indicate that the implementation of the PVP system remains dominated by corporations and formal research institutions, while smallholder farmers face structural barriers in accessing legal protection. Technical requirements, administrative complexity, and unequal institutional access contribute to the marginalization of traditional seed systems and increase farmers’ dependency on commercial seed markets. From an Islamic socio-legal perspective, the concentration of control over seeds raises concerns regarding distributive justice, public welfare (maṣlaḥah), and monopolistic practices (iḥtikār). This study argues that Indonesia’s PVP system requires substantial reform through a more inclusive legal framework that recognizes farmers’ rights, protects local seed systems, and balances innovation incentives with social justice and collective welfare.
