Abstract

AbstractIndonesian National Police (INP) which has general authority and special police authority, in which article 75 of Law Number 11 of  2020 concerning Cipta Kerja. The Indonesian National Police is given the authority to grant business licenses and supervise business entities in the field of security services in accordance with statutory provisions in the business licensing. The provisions in the field of business licensing refer to Government Regulation Number 24 of 2018 concerning Electronically Integrated Business Licensing Services where the Police sector is one of the ones that are included in licensing regulatory reform in order to accelerate business services through the OSS (Online Single Submission) system. This authority contradicts the authority of the police universally and specifically in Indonesia where the Police are positioned as part of the economic, political and cultural sub-system. This authority can have an unprofessional impact on the Indonesian National Police and carry out the task of maintaining security and public order and law enforcement because it is contrary to the 1945 Constitution of the Republic of Indonesia. This research uses a normative research method, namely a process to find a rule of law, legal principles, as well as legal doctrines in order to answer the legal issues at hand. The research approach uses the legislation approach, historical approaches, theoretical approaches and philosophical approaches and conclusions are drawn deductively and inductively. Keywords : autority shift, Law No. 11 of 2020; Omnibus law, police duties AbstrakPolri memiliki kewenangan umum dan kewenangan kepolisian khusus, yang mana pasal 75 Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Kepolisian Negara Republik Indonesia diberikan kewenangan untuk memberikan izin usaha dan mengawasi badan usaha di bidang jasa pengamanan sesuai dengan ketentuan peraturan perundang-undangan dalam perizinan usaha. Ketentuan di bidang perizinan berusaha mengacu pada Peraturan Pemerintah Nomor 24 Tahun 2018 tentang Pelayanan Perizinan Berusaha Terintegrasi Secara Elektronik dimana pihak Kepolisian merupakan salah satu yang termasuk dalam reformasi regulasi perizinan dalam rangka percepatan pelayanan berusaha melalui OSS (Online Single Sistem pengajuan. Kewenangan tersebut bertentangan dengan kewenangan Polri secara universal dan khusus di Indonesia dimana Polri diposisikan sebagai bagian dari subsistem ekonomi, politik dan budaya. Kewenangan tersebut dapat berdampak tidak profesionalnya Polri dan mengemban tugas memelihara keamanan dan ketertiban masyarakat serta penegakan hukum karena bertentangan dengan UUD Negara Republik Indonesia Tahun 1945. Penelitian ini menggunakan metode penelitian normatif, yaitu suatu proses untuk menemukan suatu kaidah hukum, asas-asas hukum, serta doktrin-doktrin hukum guna menjawab permasalahan hukum yang dihadapi. Abstract

ABSTRAKTujuan riset ini adalah untuk mengetahui Langkah kepolisian dalam mengelola sumberdaya manusia yang jumlahnya terbatas untuk menangani ancaman penyebaran radikalisme dan terorisme. Hal ini sebagai bentuk tanggapan kepolisian terhadap perubahan spektrum ancaman radikalisme yang mengalami berubahan pada tataran modus dan media penyebaran yang tidak lagi berbasis pada interaksi tatap muka. Tantangan penyebaran radikalisme dan terorisme yang semakin kompleks dan semakin massif, yang dapat memapar kelompok masyarakat manapun membutuhkan penanganan yang lebih sistematis. Dalam riset ini yang menjadi permasalahan penelitian adalah bagiamana pendekatan kesisteman diterapkan dalam pengelolaan SDM Polri sehingga dapat memberikan impact yang lebih besar dalam penanganan ancaman penyebaran radikalisme dan terorisme.Penelitian ini menggunakan pardigma post-positisme dengan metode studi kasus. Teknik pengumpulan data sepenuhnya menggunakan wawancara dan studi dokumen, serta survai yang ditujukan untuk mengetahui pemahaman anggota polri di lapangan berkaitan dengan perubahan pola penyebaran radikalisme dan terorisme. Serta untuk memahami bagaimana mekanisme pembagian pekerjaan berdasarkan fungsi-fungsi yang ada di setiap satuan kewilayahan.Hasil penelitain mengungkapkan tingkat pemhaman yang masih pada derajat sedang, serta modalitas utama yang digunakan masih mengandalkan pendekatan pemolisian masyarakat. Masing-masing fungsi belum sepenuhnya melakukan pekerjaan penanganan radikalisme dan terorisme berorientasi pada sebuah system kerja yang organis. Kesesuaian focus dan hasil pekerjaan pada tingkat individual dengan tingkat satuan fungsi relative baik, namun kesesuaian focus dan capaian pekerjaan pada tingkat individual dengan tingkat satuan kewilayahan belum sepenuhnya baik Kata kunci : radikalisme, terorisme, pendekatan kesisteman, sumberdaya manusia ABSTRACThe purpose of this research is to determine the steps of the police in managing a limited number of human resources to deal with the threat of the spread of radicalism and terrorism. This is a form of police response to changes in the spectrum of radicalism threats that have changed at the level of modes and media of dissemination that are no longer based on face-to-face interactions. The increasingly complex and increasingly massive challenges of spreading radicalism and terrorism, which can expose any group of people require more systematic handling. In this research, the research problem is how the systemic approach is applied in the management of Police human resources so that it can have a greater impact in handling the threat of spreading radicalism and terrorism.This study used post-positism pardigma with a case study method. Data collection techniques fully use interviews and document studies, as well as surveys aimed at determining the understanding of police members in the field related to changing patterns of spreading radicalism and terrorism. As well as to understand how the mechanism of division of work is based on the functions that exist in each regional unit.The results of the study revealed that the level of understanding is still at a moderate degree, and the main modalities used still rely on the community policing approach. Each function has not fully carried out the work of dealing with radicalism and terrorism oriented towards an organizational work system. The suitability of focus and work results at the individual level with the unit level of function is relatively good, but the suitability of focus and work achievements at the individual level with the regional unit level is not completely good Keywords: radicalism, terrorism, systemic approach, human resources

Abstract

The aim of this paper is to define and compare provided sources in terms of defining the concept of Strategy and Performance in organisations and implementing a suitable framework in the collaboration case study. This outline will be in three parts. First, the collaboration case study is outlined in detail. Second, a definition of strategic management in organisations is provided. Third, the concept of performance management in organisations is explored. The case study that will be used in this paper covers the strategies employed by the Indonesian National Police (INP), the Covid-19 Response Acceleration Task Force (Satgas) and the Provincial & Regional government during the Islamic religious event “Pulang Kampung”, or homecoming, that is held annually by the majority of Indonesian’s Muslim population. The analysis is conducted by using a PESTEL and SWOT analysis, a Strategy Map, and a Performance Domain approach to examine the external and internal factors that emerged.Keyword: homecoming, PESTEL analysis, police strategy, strategic management, SWOT Analysis
