Abstract

This paper is intended to explored the revitalization of local custom or traditional institutions due to restorative justice concept and its implementation. Depicting several examples from other nations, the writer then describes potential problems within local custom or tradition in Indonesia whilst implementing restorative justice.

Abstract

Indonesia is a nation richly blessed in heritage and culture. Its population consisted of 656 ethnic groups that spread from one end in Sabang to Merauke at the other end, and occupying more than 30,000 islands. In the last few years, a number of conflicts in Indonesia had escalated significantly in their magnitude, whether seen from the area of occurrence, from the backgrounds that triggered them, or the impact and their victims. The Bali Nuraga case in Lampung was a chronicle about the conflict between the people of Balinese descent and the indigenous people from Lampung in Sido Mulyo, it was an interesting subject to analyze, considering that the Balinese were not newcomers to the region. It has been told that this conflict was not essentially about religion, instead it was a conflict triggered by the persistent efforts by the Balinese in Bali Nuraga village to hold onto their identity.This paper will discuss about the ethnic issue that occured in Lampung regarding the existence of Balinese in Lampung. This conflict between Lampung against Bali, as we have seen from the presentation above was not about the Balinese people with their Hindu faith against the people from Lampung who were mostly Muslims; however, it was packaged that way by some parties to intensify the conflict.

Abstract

Between 2014 and 2018, the Indonesian Ministry of Manpower recorded 89,625 cases of work accidents, and 1,193 of them resulted in death. During this period, 34,075 companies were reported for alleged work safety crimes. From the 2,074 cases, only four have been sentenced to prison. The most interesting issue is that the victims of work safety crimes do not get any kind of restitution or even compensation. This article aims to investigate the legal protection for victims of work safety crimes from the criminal law perspective. The method used is normative qualitative research on primary data, such as work safety legislation, the Criminal Code, and criminal court decisions. As a result, the work safety law stipulates that the purpose of law enforcement on work safety is recovery for victims, repairs and prevention. They are carried out to protect the public interest. Work safety regulations also regulate the qualifications of actions categorized as work safety crimes. Unfortunately, the regulation does not provide a mechanism for resolving work safety crimes. So that the settlement of work safety crimes relies on the general criminal justice system that adheres to retributive objectives in law enforcement. The purpose of law enforcement on work safety cannot be applied because victims do not get restitution or compensation. Thus, to obtain legal protection in accordance with the objectives of law enforcement on work safety, the alternative solution is a criminal policy to establish a special criminal mechanism for the settlement of work safety crimes.

Abstract

 Penelitian ini bertujuan untuk mengetahui akibat hukum identitas palsu debitur dalam akta notaris mengenai perjanjian kredit terhadap pihak ketiga pemberi jaminan serta upaya hukum yang dapat ditempuh untuk membatalkan akta notaris tersebut. Notaris seyogyanya teliti dan berhati-hati dalam membuat akta autentik, terlebih mengenai perjanjian kredit yang melibatkan pihak ketiga pemberi jaminan. Sebab, pihak ketiga pemberi jaminan memiliki kepentingan yang berbeda dengan debitur atau kreditur. Jika debitur secara beritikad buruk memberikan identitas palsu dalam suatu perjanjian, maka akibat hukum adanya identitas palsu tersebut perlu dianalisis dari perspektif Pasal 1320 KUHPerdata. Penelitian ini diharapkan dapat memberikan jalan keluar terkait perlindungan serta kepastian hukum bagi pihak ketiga pemberi jaminan. Penelitian ini menggunakan pendekatan yuridis normatif dengan menggunakan data sekunder melalui studi dokumen dan penelusuran literatur. Penelitian ini memiliki kebaharuan perspektif karena menganalisis akibat hukum identitas palsu dalam akta notaris terhadap pihak selain debitur dan kreditur, yakni pihak ketiga pemberi jaminan. Hasil penelitian ini menyimpulkan bahwa akibat hukum yang timbul terhadap suatu akta dengan identitas palsu adalah dapat dibatalkan karena terdapat penipuan di dalamnya, sebagaimana diatur dalam Pasal 1321 KUHPerdata. Penipuan mengakibatkan perjanjian dalam akta tersebut tidak memenuhi syarat subjektif berupa kesepakatan yang bebas berdasarkan Pasal 1320 KUHPerdata. Namun, untuk membatalkan akta notaris tersebut, penipuan harus terbukti dan tidak dapat dipersangkakan. Oleh karena itu, sangat penting untuk memperoleh putusan pidana berkekuatan hukum tetap yang membuktikan adanya penipuan agar gugatan pembatalan akta memiliki dasar yang kuat. Sebaliknya, akta tersebut tidak dapat dibatalkan jika unsur penipuannya tidak terbukti sehingga masih menjadi akta autentik dan tetap mengikat.

Abstract

Banyaknya kasus yang terjadi belakangan ini akibat dari perbuatan tidak bertanggungjawab yang dilakukan oleh para penghadap demi tujuan tertentu. Permasalahan yang akan dibahas disini adalah peran notaris dan keabsahan dalam pembuatan akta otentik yang didalamnya mengandung figur palsu. Metode penelitian yang digunakan disini adalah metode penelitian yuridis normatif yaitu terhadap penerapan aturan dan norma hukum yang berlaku di masyarakat luas, data yang digunakan yaitu studi dokumen. Bahan hukum yang digunakan yaitu bahan hukum primer, sekunder dan tersier. Tanggung jawab Notaris sebatas kebenaran formal yang meliputi, kondisi-kondisi dan ketertiban umum menurut pembuatan akta otentik oleh notaris saja. Notaris tidak memiliki pertanggungjawaban atas kebenaran materiil yang disampaikan oleh penghadap. Keabsahan akta otentik yang memuat figur palsu sama dengan keabsahan akta otentik pada umumnya. Sehingga dapat meminta hakim untuk pembatalan akta. Namun, jika notaris melanggar persyaratan subjektif, akta tersebut memiliki kekuatan pembuktian dibawah tangan.

Abstract

Restorative justice is a phrase that is very popular among law enforcers understood in various dimensions. Simple questions about restorative justice whether a "principle" or "value" or "mechanism or even" program "is interesting to look at the understanding of policymakers and law enforcers as executors in line with efforts to implement it within the criminal equity framework and preventive endeavors and wrongdoing anticipation based on the current legitimate framework that's broadly pertinent in nations around the world. This paper is a literature study that uses secondary data with a qualitative analysis that is used to describe the development of an understanding of restorative justice.

Abstract

As is known, the issue of blasphemy in Indonesia became sticking out and rife after the Al Maidah 51 blasphemy case committed by former DKI Jakarta Governor Basuki Tjahaya Purnama or better known to Ahok, continued with event 212 which became an essential moment in the development of the case other blasphemy cases. The concern is how relevant institutions and the ministry of religion are government representatives react in handling these cases. Because in reality, all these cases always end up in prison. Is this the right solution. This study aims to analyze the role of restorative justice in the handling of blasphemy cases in Indonesia. This research uses a qualitative approach with the literature study method in analyzing this problem.

Abstract

This paper will examine the concept of judicial pardon (forgiving judges) as a solution to the existing legal problems, which are perceived as an attempt to avoid incarceration. The law gives the judge the authority to forgive or pardon the convict without imposing a crime or action if they are influenced by certain factors. This article aims to convey the importance of the RKUHP's concept of judicial pardon to the future renewal of the criminal justice system. This article's research employs a normative, statutory, and conceptual approach to the law. The findings of this study indicate that the concept of judicial pardon can be viewed as the final gatekeeper for a case that disrupts social justice, or as a guide for the forgiveness of judges that functions as a safety valve or emergency door. Then in accordance with the noble values that exist in Indonesian society, such as those of the people of Jambi province, the Batak Karo, the Balinese, and many others. In order for future generations of Indonesians to realize the welfare and protection of the community, as a form of legal certainty in sentence execution.

Abstract

“Restorative Justice” is a model approach which emerged in the 1960s in an effort to solve criminal cases. Unlike the approach used in conventional criminal justice system, this approach focuses on the direct participation of perpetrators, victims and society in the settlement process. This theory of the approach is still debated, but the view is in fact growing and it exercises a lot of influence on legal policies and practices in several countries. The UN through its basic principles considers the approach of restorative justice as the approach which could be used in the rational criminal justice system. Restorative justice is a concept of thinking that supports the development of the criminal justice system with emphasis on the required involvement of the community. It is also involving the casualties who with the current criminal justice system are excluded. In several countries, restorative justice has been translated into a variety of formulations to accommodate a variety of values, philosophical basis, terms, strategies, mechanisms, and programs. Good consultation with the perpetrators and the victims themselves may provide the public with a different mindset in preventing emerging problems. This process can involve the police, prosecutorial institution or the traditional institutions. Therefore, without excluding the work in the formal legal system, the institutional mechanism for resolution through consultation was working in the community. In the various principles and models of the restorative justice approach, the process of dialogue between the perpetrator and the victim is a fundamental and the also the most important part of the application of the restorative justice. The direct dialogue between the perpetrator and the victim gave the victim the opportunity to express what he/she felt, hope for human rights and the desire to reach a criminal settlement.

Abstract

This research analyzes the legal aspects of resettlement within the context of Indonesian law. First, it discusses the laws that related to the interaction between refugees and the Indonesian people. Second, this research will discuss how Indonesia applies Indonesian national law when it comes to the treatment of refugees during their period of resettlement. Third, this research will offer a proposal in regards to the structuring of national policy in terms of how the treatment of asylum seekers that have received refugee status as they await the process of resettlement. In cohesion to these three notions, this research utilizes a judicial-normative approach to analyze the doctrines as well as the requirements in international law as well as the concept and the opinions of scholars combine with rules found within national laws about the procedure of resettlement of a third party state for the refugees. By observing refugee camps in Jakarta, Medan and Kupang during 2016, it concludes that national immigration law in Indonesia is heavily embedded within the Law No. 6/2011 about immigration and the Director-General’s decision No. IMI-1489.UM.08.06 at the year 2010 about the handling of illegal immigrants. Further, this article argues on the need of regulatory measures in place in regards to the capacity of institutions in Indonesia in the handling of refugees so that more extensive coordination can be achieved in.
