Abstract

This article discusses the differences in guarantee law in Islamic sharia and the Indonesian legal system. Both systems agreed that if the product is not in a good condition, it is a must for the seller to provide a guarantee as to his responsibility to the customer. It is called ‘khiyar disgrace’ in the perspective of Islamic law and ‘garansi’ in Indonesian law. Using library sources this article showed that khiyar disgrace has the relations and comparisons with the guarantee law on consumer protection. The similarity between both ‘khiyar aib’ and ‘garansi’ is that if the sold item is broken, flawed, or damaged, the buyer could make a complaint and receive a replacement for the broken item. The difference between the two is that in ‘khiyar disgrace’, the flaw of the transacted item should be found before the transaction whereas, in ‘garansi’, the guarantee is given to the customer when the flaw of the sold item is found after the items are traded.

Abstract

This article examines the practices of waqf that manage by the mosque in Siantar by comparing the adat law and Islamic law. This study used a qualitative descriptive method in the form of field research which aimed to find out the management of waqf funds carried out by Nazir of Mosque Jami' Darussalam Siantar city and a review of customary law and Islamic law on these activities. The results of the management of waqf land are intended for renovation and maintenance of mosque facilities and infrastructure while cooperation conducted in form of muzara’ah muthlaqah according to most Islamic jurisprudence scholars is mubah (may) caused by a contract of muzara’ah based on and aimed to help and prosper each other between both parties. In customary review, it showed that this management of rice fields has been for a long time with a system that has not changed even though the management of the mosque has changed. Controlling social that comes from the community makes the mosque function as it should to always be maintained, cared for, and prospered.

Abstract

The social conflicts that occurred in the community regarding the change in the direction of the Qibla at the Nurul Huda Mosque in Simpang Empat Village became a long-term problem. These measurements make the Simpamg Empat community divided into two groups, namely, there are groups that are pro (agree with the change in Qibla wine) and those who are against, causing problems that require mediation to resolve this conflict. This article discusses the dispute between these groups by observed the mediation and legal action in Simpang Empat. This article argues that mediation is failed when community take legal action as conflict resolution.

Abstract

The niqab and burka are manifestations (forum externum) of freedom of religion and belief (FORB) guaranteed by the UDHR. However, in practice, the niqab and burka, on the other hand, block the application of the FORB. In Europe, the niqab and burka are banned packages that should not be in public. Meanwhile, in Indonesia, after the reforms, the dynamics of the niqab and burka are increasingly diverse. Through the Minister of Religious Affairs, Fachrul Razi, the Ministry of Religious Affairs prohibited the State Civil Apparatus (ASN) women from wearing it while working. On the other hand, there are several regional regulations, such as in Central Lombok. Instead, it is required as a substitute for a medical mask. This paper analyzes the content of the law. It considers the extent to which it can be 'harmonized' so that it does not conflict with Indonesia's aspirations for civil society, non- discrimination, and pluralism. The argument is used as a source of comparison with similar regulations in other countries.

Abstract

This article examines public caning in Aceh using a psychological perspective. In 2018, the issue of the pros and cons of the implementation of public caning in Aceh did not have much attention. Suddenly, the new pros and cons emerged about the venue of caning which was initially held in public (courtyard) and then was held in a prison. The pros and cons emerged when the Government of Aceh did not plan to demonstrate public caning in order to protect the dignity of a convict. Using literature sources, this article sees that a psychological perspective can be taken into account in punishment policies in Aceh. The main argument in this article is that public punishment has a long-lasting psychological impact. This finding strengthens the opinion that there are differences in the objectives of the law applied by the Aceh government with the law implemented conventionally in Indonesia.

Abstract

This article discusses the deteriorating environmental conditions globally from the point of view of maqashid sharia. Awareness of the importance of preserving and protecting nature is still not widely seen from the perspective of Islamic law. Using the reconstruction of Islamic law through a critical reading of maqashid sharia, this paper proposes the views: (1) The old jurisprudence does not accommodate environmental problems as a separate system in the field of study of legal objectives, (2) the exacerbation of the environmental crisis needs to be a concern for future studies of Islamic law, (3) Muslims need a comprehensive legal framework/guidelines on environmental issues through understanding the goals of Islam. In the end, this article argues that the study of Islamic law needs to enrich the discourse on environmental sustainability through the reconstruction of maqashid sharia.

Abstract

The purpose of this study is to analyze the implementation of UU-JPH in Aceh Province and the extent to which halal product labeling is produced through e-marketing. The type of this research is qualitative research with literature review data collection method. In this study, the authors analyze the implementation of the UU-JPH in Aceh Province and the development of selling halal products through e-marketing. In this study, researchers also discussed the development of halal labeling. The conclusion of this research is that the implementation of UU-JPH in Aceh Province has not been maximized. In addition, in the e-marketing strategy, halal labels are essential to increase people's buying interest

Abstract

One important aspect that can encourage the optimization of the Islamic finance industry in Indonesia is good corporate governance (Good Corporate Governance). The reality on the ground, in the sharia financial sector, cases of law violations are still found. As an effort to encourage the implementation of Good Corporate Governance which is intended for sharia business managers in Indonesia, the KNKG issued guidelines for Good Governance for Sharia Business (GGBS). In this study, the authors used a descriptive qualitative approach to the literature study method. The samples or objects that are the source of data in this study are Islamic Commercial Banks (BUS) in Indonesia which publish annual reports for the 2020 period. The results of the analysis of disclosure and assessment using the self-assessment system show that 2 BUS have earned the title very good, 8 BUS received a good predicate, and 3 BUS received a pretty good predicate. However, even though in general the results of the GCG self-assessment were in the good category, violations of the law were still found. Thus, the implementation of GCG in accordance with the GGBS guidelines must be continuously improved, especially in efforts to optimize the Islamic finance industry in Indonesia

Abstract

This article aims to answer questions regarding the consideration of the judges of the Langsa City Syar'iyyah Court in the Decision Number: 0101/Pdt.G/2016/Ms-Lgs considering the annulment of marriages due to threats. The research method of this research is the normative juridical method. The researcher obtains the primary data from the Decision of the Syar'iyyah Court of Langsa City Number: 0101/Pdt.G/2016/Ms-Lgs. Based on the results, then there are two conclusions can be drawn. First, the judge's consideration in deciding the case based on two factors, those are the consideration of facts and legal considerations as stipulated in Articles 24 and 25, and Article 27 paragraph (1) of Law Number 1 of 1974 concerning Marriage. Second, the Panel of Judges has also carried out a mediation process against the Petitioner and the Respondent, but in that case the Respondent was never present at the trial and a summons was made by the court properly and officially. Therefore, the Syar'iyyah Court of Langsa City decides to grant the Petitioner's claim and annul the marriage that had occurred and stated that the Marriage Certificate between the Petitioner and the Respondent had no legal force.

Abstract

The article overviewed the practice of leasing palm oil tree transactions which is popular in the western-southern of Aceh community. The practice of the transaction involved the beneficiaries, the owner, and the lessee, for the commodities as the commercial object. The study investigated the mechanism of leasing practice with an Ijarah of economic sharia. The study employed a qualitative method to deliver primary data which was acquired through informants’ interviews, and secondary supporting data from a literature review of books, journals, and research reports. The study result provided the lease transactions which were formerly expected to be worth economically. However, the transactions were considerably opposed to the practice of Ijarah, where there is the existence of the Gharar (Speculative) factor and violated the pillars of goods beneficial for mutual profit in the concept of its Sharia regulation. The violations were acclimatized for the unfulfillment of pillars and legal conditions for aqad for its lease practices.
