Abstract

Ideally, the sale of prescription-only medicines should be strictly regulated by requiring a doctor’s prescription to ensure patient safety and prevent drug misuse. However, the reality in Dumai City shows that the sale of prescription-only medicines without prescriptions remains prevalent, reflecting weak supervisory functions and low legal awareness within society. This study aims to analyze the implementation of supervision over the sale of prescription-only medicines in Dumai City from a normative perspective based on Law Number 17 of 2023 on Health, while also identifying the factors influencing weak supervision and formulating effective preventive strategies. This article falls under the category of sociological legal research with a qualitative approach. The research method applied is empirical legal study, combining statutory analysis with field data obtained through observations and interviews with pharmacists, BPOM (Food and Drug Supervisory Agency), and the community. The findings conclude that weak supervision is caused by limited supervisory resources, low legal awareness, and lack of inter-agency coordination. Therefore, the necessary preventive strategies include strengthening the role of pharmacists, optimizing the functions of supervisory institutions, increasing community participation, and ensuring consistent law enforcement to achieve public health protection.

Abstract

Ideally, a curator in bankruptcy proceedings should act transparently, accountably, and professionally so that all company assets, including share deposit funds, are managed in accordance with legal provisions without causing harm to any party. However, the reality shows deviations, as in the bankruptcy case of PT Alam Galaxy, where share deposit funds were converted into debt with inflated values, even involving alleged document forgery and creditor claim mark-ups. This study aims to analyze the curator’s liability for share deposit funds recognized as debt in the bankruptcy case of PT Alam Galaxy based on Decision Number 54/Pdt.Sus-PKPU/2021/PN Niaga Surabaya. In addition, it examines the legal implications of recognizing capital deposits as debt for the legal position of the company, creditors, and shareholders. The research employs a normative juridical method with statutory, case, and conceptual approaches, supported by analysis of official court documents, literature, and bankruptcy law principles. The findings indicate that curators are obliged to bear responsibility for negligence or actions that cause losses to the bankrupt estate as regulated under Article 72 of the Bankruptcy Law and may even be held personally liable under Article 1365 of the Civil Code. Furthermore, the recognition of share deposit funds as debt leads the company into insolvency, disrupts the corporate capital structure, and undermines legal protection for creditors and shareholders.

Abstract

Ideally, in legal practice, the application of the methods of interpretation, argumentation, and exposition should create justice and legal certainty. However, in reality, these three methods are often applied inconsistently in various court rulings. This research aims to analyze the relevance of applying the methods of interpretation, argumentation, and exposition in contemporary legal practice in Indonesia. The methodology used is normative legal research with a qualitative approach and phenomenological study, analyzing relevant court decisions. The research findings indicate that although these three methods play an important role in upholding justice, their application remains varied, with some cases showing inconsistencies in the proper use of interpretive methods, resulting in legal uncertainty.

Abstract

The advancement of Artificial Intelligence (AI) technology ideally strengthens the criminal justice system by enhancing effectiveness, efficiency, and accuracy in the process of evidence examination. AI can process large volumes of data and assist law enforcement in systematically identifying crime patterns. However, in reality, Indonesia’s legal system still adheres to conventional evidentiary paradigms as stipulated in the Criminal Procedure Code (KUHAP) and the Electronic Information and Transactions Law (UU ITE), which have not yet explicitly recognized AI-based evidence. This condition raises issues of validity, accountability, and legal fairness, particularly because AI-generated outputs lack legal subjects that can be held responsible and are vulnerable to algorithmic bias. This study aims to analyze the validity of AI-based evidence within Indonesia’s criminal justice system through a normative legal study employing statutory, conceptual, and comparative approaches. The findings reveal a significant legal vacuum in the regulation of AI evidence, resulting in uncertainty and potential human rights violations. Therefore, legal reform is necessary through amendments to the UU ITE, the formulation of technical guidelines via Supreme Court Regulations (PERMA), and the strengthening of law enforcement capacity to ensure that AI utilization aligns with the principles of justice, transparency, and due process of law in a modern judicial system.
