Abstract

The enforcement of aqidah law in Aceh, from a normative perspective, should ideally be carried out through formal legal mechanisms that ensure legal certainty, accountability, and the protection of freedom of religion in accordance with the principles of the rule of law and the provisions of Qanun Number 8 of 2015 concerning the Development and Protection of Aqidah. Empirical reality demonstrates that the resolution of deviant sect cases is predominantly conducted through non-litigation mechanisms by the Aceh Ulama Consultative Assembly (Majelis Permusyawaratan Ulama/MPU) through fatwas, religious guidance, dialogue, and persuasive religious approaches. This condition reflects a clear gap between das sollen and das sein in the enforcement of aqidah law in Aceh. This study aims to analyze the settlement of deviant sect cases from the perspective of the sociology of law by focusing on the role of the MPU and the social implications arising from the dominance of non-litigation mechanisms. The research employs an empirical legal method with a sociology of law approach through statutory analysis, document analysis, and in-depth interviews with religious leaders and relevant institutional actors. The findings indicate that non-litigation settlement mechanisms are effective in reducing horizontal conflicts, maintaining social stability, and fostering legal compliance based on the legitimacy of ulama and the tradition of deliberative culture within Acehnese society. The dominance of non-litigation mechanisms also has the potential to weaken legal certainty, accountability, and the protection of religious rights if it is not balanced by proportional litigation mechanisms. A balanced integration between religious approaches and formal legal processes constitutes an urgent necessity in the enforcement of aqidah law in Aceh in order to achieve justice that is effective, constitutional, and sustainable.

Abstract

The practice of nempil chicken transactions in traditional markets should ideally be conducted based on the principles of justice, openness, transparency, and mutual consent, as emphasized in Islamic economic law and Law Number 8 of 1999 on Consumer Protection. In reality, however, asymmetric information remains prevalent, particularly regarding access to information about chicken prices and quality, placing consumers in a disadvantaged position in transactions. This study aims to analyze the practice of nempil chicken transactions from the perspectives of Islamic economic law and consumer protection, as well as to identify forms of information asymmetry occurring in such transactions. The study employs a qualitative method with a descriptive-analytical approach through observations and interviews conducted in several traditional markets in Surabaya. The findings reveal differences in prices offered to ordinary consumers and fellow traders, as well as limited consumer access to information concerning chicken prices and quality, potentially involving elements of gharar and tadlis. This study contributes to the development of a consumer protection model based on Islamic economic law by strengthening price transparency, educating traders and consumers, and enhancing market supervision to promote nempil transactions that are fairer, more transparent, and consistent with Islamic principles.

Abstract

Ideally, the regulation of crypto asset trading should advance digital economic innovation while simultaneously safeguarding environmental sustainability and long-term green economic stability. In practice, however, Indonesia’s regulatory framework remains largely oriented toward transactional legality and short-term market stability, with limited incorporation of green constitution principles as constitutional and normative foundations. This regulatory gap becomes increasingly problematic given the energy-intensive characteristics of blockchain-based activities and their potential environmental externalities. This study aims to reconstruct the governance of crypto asset trading through the integration of green constitutional principles to ensure sustainable green economic stability. Employing a qualitative library research design with normative legal analysis, this study applies statutory, conceptual, and philosophical approaches. The findings demonstrate that an effective regulatory reconstruction requires the institutionalization of sustainable development, ecological justice, and constitutional accountability as core governance principles. Such an approach positions crypto asset trading not merely as a technological or financial innovation, but as an integral component of a constitutional economic order that harmonizes digital transformation with environmental protection and long-term economic resilience.

Abstract

Ideally, informed consent constitutes an ethical and legal process that safeguards patient autonomy while providing legal certainty for medical professionals. In practice, however, informed consent may still be reduced to an administrative formality, creating a gap between das sollen and das sein, particularly in communication, patient understanding, documentation, and compliance with professional standards. This study aims to analyze the application of medical ethics in the informed consent process, identify factors affecting its effectiveness, and examine its implications for the legal risks faced by medical professionals. This study employs normative legal research using statutory and conceptual approaches. Primary legal materials consist of health-related legislation, particularly Law Number 17 of 2023 on Health, while secondary materials comprise legal scholarship, medical ethics literature, and relevant scientific articles. The materials are analyzed using descriptive-analytical and prescriptive methods. The findings indicate that the effectiveness of informed consent depends on the quality of information, communication, decision-making capacity, documentation, and compliance with professional standards. Substantive application of medical ethics strengthens the legitimacy of medical interventions while serving as a preventive mechanism for minimizing disputes and potential legal liability of medical professionals.

Abstract

Marriageable age is ideally designed as a legal instrument to ensure the readiness of prospective spouses while protecting children from the social, psychological, and economic risks associated with early marriage. However, marriages below the statutory minimum age continue to occur through various social pressures and judicial dispensation mechanisms, raising concerns about the effectiveness of legal protection and family resilience. This study aims to analyze the minimum marriage age from the perspectives of Islamic law and Indonesian marriage law and to examine the implications of early marriage for child protection and family resilience. The study employs normative legal research using statutory, conceptual, and case approaches. Primary and secondary legal materials are analyzed descriptively, analytically, and prescriptively by integrating the concepts of baligh, maslahah, and maqāshid al-sharī‘ah. The findings indicate that the statutory minimum marriage age of 19 is substantively consistent with the principles of maslahah and harm prevention in Islamic law. However, its protective function is weakened when judicial dispensations are granted without rigorous consideration of the child’s best interests. Early marriage may increase vulnerabilities in education, economic independence, health, and family resilience. The study underscores the need for consistent age restrictions and child-centered judicial dispensations.

Abstract

Ideally, a regional innovation ecosystem should be systemically integrated to encourage downstream research, economic growth, and public welfare. However, in reality, East Java Province faces an innovation paradox, where the high quantity of innovation is not accompanied by connectivity between actors (Triple/Quadruple Helix), resulting in innovation tending to be fragmented, seasonal, and with minimal economic impact. This study aims to analyze the condition of the regional innovation ecosystem and formulate strategies for strengthening it as a foundation for the development of the Jatim Innovation Connect (JIC) platform. The method used is descriptive qualitative, with data collected through in-depth interviews with key informants (BRIDA, academics, industry, and innovators) selected through purposive sampling, field observations, and literature review. The results indicate that the East Java innovation ecosystem is in a phase of active but immature growth (growing but fragmented). Strengthening the ecosystem requires BRIDA as an orchestrator and JIC as a digital innovation intermediary to match research potential (supply) with industry needs (demand). The success of this strategy depends on strengthening regional regulations, sustainable funding schemes, facilitating intellectual property rights (IPR), and establishing a culture of collaboration between actors.

Abstract

Ideally, negligence offenses lacking malicious intent should be resolved through a restorative approach emphasizing victim recovery and offender reintegration. However, in reality, negligence cases remain dominated by imprisonment and lack comprehensive mechanisms. This research aims to analyze philosophical foundations of restorative justice, evaluate its implementation in the Indonesian criminal justice system, and formulate an ideal legal reformulation model. The method used is normative legal research with statutory, conceptual, and comparative approaches, analyzing primary, secondary, and tertiary legal materials qualitatively-prescriptively. The findings show that restorative justice has a strong philosophical foundation for negligence offenses, supported by justice theory, reintegrative theory, concept of balancing legal values, as well as Pancasila and progressive legal values. However, its implementation is hindered by regulatory fragmentation across law enforcement institutions and absence of clear normative parameters. This research offers a contribution in the form of a Substantive Justice-Based Restorative Justice Reformulation Model built on three foundations and four cumulative normative requirements, expected to bridge the gap between the need for a restorative approach and the availability of an adequate normative framework.
