Abstract

The land registration system in Indonesia should be able to create legal certainty and protection for every registered land right, including the Right to Cultivate (HGU). The HGU certificate should be a valid and binding proof of rights so that it is not easily disturbed by claims from other parties. However, in reality, disputes still often occur between HGU certificate holders and the community who base claims on physical control of the land or the Statement of Physical Control (SPPF). This condition creates legal uncertainty regarding the evidentiary power of the certificate and the legal status of physical control in the Indonesian land system. This study aims to analyze the legal certainty of HGU certificates against claims of physical control of land and legal protection for HGU holders under Indonesian land law. This study is a library research with a qualitative approach using normative legal research methods through statutory, conceptual, and case approaches. The results of the study indicate that HGU certificates have strong evidentiary power and obtain legal protection as long as they are issued according to procedures, while physical control of the land only stands as factual evidence without providing complete rights until officially registered.

Abstract

Ideally, in Indonesia’s land law system, every transfer of land rights must be proven by an authentic deed made by a Land Deed Official (Pejabat Pembuat Akta Tanah/PPAT) as a requirement for legal certainty and land rights registration. However, in reality, in judicial practice, land sale and purchase transactions are still often proven merely by simple receipts that do not meet the requirements of an authentic deed as regulated under land law. This study finds that in juridical reality, receipts for land sale and purchase are positioned by judges as private deeds with imperfect evidentiary strength. In accordance with Article 1878 of the Indonesian Civil Code in conjunction with Article 291 of the RBg, such receipts are only binding upon the parties who make them and are not binding on third parties. Nevertheless, judges still accept receipts as valid written evidence; however, receipts cannot stand alone as primary evidence without being supported by other evidence such as witness testimony. Judges determine that land sale and purchase is materially valid if it fulfills Article 1320 of the Civil Code as well as the principles of publicity (open), cash (immediate payment), and real transfer. This decision is conditionally progressive because, although it protects good faith buyers in the contractual aspect, receipts cannot replace the function of PPAT deeds as an absolute requirement for land registration. After the decision, PPATs are required to apply the principle of prudence.

Abstract

Ideally, incentive systems and Islamic compensation implemented in Sharia insurance companies are expected to directly enhance agent loyalty through fair and Sharia-compliant rewards. However, in reality, agent loyalty is not solely determined by financial factors but is also influenced by psychological conditions such as job satisfaction, making the relationship among variables more complex. This study aims to analyze the effect of incentives and Islamic compensation on agent loyalty with job satisfaction as a mediating variable in Sharia insurance in Medan City. The research employs a quantitative approach with a causal associative design, using Structural Equation Modeling based on Partial Least Squares (SEM-PLS). The population consists of 400 agents, with a sample of 83 respondents selected using the Slovin formula. Data were collected through Likert-scale questionnaires and analyzed using SmartPLS. The results indicate that incentives and Islamic compensation have a positive and significant effect on job satisfaction, but do not directly influence agent loyalty. Job satisfaction has a positive and significant effect on agent loyalty. Furthermore, job satisfaction does not mediate the effect of incentives on loyalty, but fully mediates the effect of Islamic compensation on agent loyalty. These findings highlight the crucial role of job satisfaction in building sustainable agent loyalty.

Abstract

Abstract Tobacco control policy in Banda Aceh has a strong normative foundation through Law and Qanun on Smoke-Free Areas (KTR), yet the reality shows persistently high smoking rates, widespread KTR violations, weak law enforcement, and no effective policy. The novelty of this research is the application of Discourse Network Analysis (DNA) to map the discourse network of tobacco control in Banda Aceh within the context of Islamic Sharia, which has never been done before. This research is empirical legal research with a qualitative approach using DNA. Primary data were obtained from observation and public forum documentation, while secondary data came from regulations, media reports, and scientific publications. Data were analyzed through thematic coding and network mapping using DNA software. The findings identify three discourse coalitions the coalition of the Health Office and MPU with Sharia-based health narratives, the coalition of coffee shop traders and cigarette retailers with grassroots economic narratives, and the ambivalent position of the city government. The study also found the weakness of anti-smoking NGO coalitions due to perceptions of foreign funding and the absence of women's narratives in public discourse. The implication is the need for cross-actor dialogue and evaluation of the KTR Qanun.

Abstract

Ideally, the development of cloning technology should contribute to human welfare within an ethical and legal framework that upholds human dignity. However, the current reality demonstrates that the absence of clear regulations regarding human cloning creates a legal vacuum that may reduce cloned individuals to mere biological objects and raise ethical concerns regarding the value of humanity itself. This study aims to examine the ontological status and legal personality of cloned humans from the perspectives of legal philosophy and legal personality theory in order to determine whether cloned humans can be regarded as legal subjects possessing rights and obligations equivalent to those of naturally born humans. Employing a socio-legal research method through conceptual and legal-philosophical approaches, this study explores the nature of cloned human existence and the normative construction of legal personality by referring to the ideas of Kant, Bentham, and Radbruch. The findings reveal that cloned humans, based on their biological and rational characteristics, must be recognized as human beings entitled to legal protection and moral recognition, thereby qualifying as legal subjects. Nevertheless, the absence of specific regulations remains a significant obstacle to achieving legal certainty, highlighting the need for a comprehensive legal framework governing human cloning.

Abstract

Regional autonomy in Indonesia ideally accelerates development and public welfare, but in reality, it has created structural gaps that enable increasingly rampant corruption by regional heads. The novelty of this research lies in analyzing the direct relationship between three modes of regional head corruption (bribery, position trading, and fictitious projects) and the impact of structural impoverishment of the people, which has not been extensively studied in an integrated manner. This research employs normative legal methods with statutory, conceptual, and case approaches, supported by limited empirical analysis of five arrest operations of regional heads during the 2024-2025 period. The findings reveal that regional heads exploit the discretionary space of autonomy through three main modes: bribery and project kickbacks ranging from 10-30% of project value, trading of strategic positions priced from hundreds of millions to billions of rupiah, and fictitious projects that drain regional budgets without physical realization. These three modes form a systemic corruption cycle resulting in the collapse of basic public services, widespread illegal levies, and the creation of sustainable structural poverty in regions.

Abstract

The ideal condition in modern organizations requires Generation Z employees to possess a high level of employability as well as adequate soft skills to support job satisfaction and organizational effectiveness. However, the actual conditions in the workplace indicate that some Generation Z employees have not fully met these demands, particularly in aspects of communication, teamwork, and adaptation to technology-based work environment changes. Based on these conditions, this study aims to examine and analyze the influence of employability and soft skills training on the job satisfaction of Generation Z employees at PT Telkom Akses, Simpang Limun Branch Office. This study uses a quantitative approach with an explanatory design. The sample consists of 96 Generation Z employees selected using purposive sampling technique with the Lemeshow formula. Data were collected through a Likert-scale questionnaire using a cross-sectional approach and analyzed using multiple linear regression with the assistance of SPSS. The results show that employability has a positive and significant influence on the job satisfaction of Generation Z employees. Soft skills training also has a positive and significant influence on job satisfaction, with a more dominant contribution compared to employability. Simultaneously, both variables have a significant influence on job satisfaction. The coefficient of determination indicates that employability and soft skills training are able to explain a considerable proportion of the variation in Generation Z employees’ job satisfaction. These findings emphasize the importance of strengthening both technical competencies and soft skills in human resource development strategies within organizations.

Abstract

The rapid advancement of digital transformation requires university graduates to possess not only academic competencies but also the ability to utilize technology effectively and adapt to the increasingly dynamic demands of the labor market. However, various studies indicate that technological proficiency among students is not always accompanied by adequate work readiness, resulting in challenges during the transition from higher education to professional employment. This study aims to analyze the influence of digital literacy and adaptability on the work readiness of Generation Z students at the Faculty of Islamic Economics and Business (FEBI), Universitas Islam Negeri Sumatera Utara. The research employed a quantitative approach with an explanatory associative design. A total of 98 students were selected as respondents using the Slovin formula from a population of 4,553 active students. Data were collected through questionnaires and analyzed using multiple linear regression with SPSS version 26. The findings reveal that digital literacy and adaptability have a positive and significant influence on work readiness, both partially and simultaneously. Adaptability demonstrates a more dominant influence than digital literacy. Simultaneously, both variables make a substantial contribution to shaping students’ readiness to enter the workforce. This study contributes to strengthening the understanding of the importance of integrating digital competencies and adaptive capacities as fundamental determinants of Generation Z students’ work readiness in the digital era.
