Abstract

Ideally, the state should play an active role in ensuring the safety and comprehensive protection of Indonesian Migrant Workers as part of its constitutional responsibility and commitment to safeguarding human dignity. However, in reality, numerous cases of violence, exploitation, and work-related accidents continue to affect Indonesian Migrant Workers, indicating a persistent gap between legal norms and their practical implementation. This study aims to examine the efforts of the Indonesian government in guaranteeing safety and providing legal protection for Indonesian Migrant Workers within the framework of national law. The research employs a library-based study with a qualitative approach, utilizing normative juridical analysis of statutory regulations and relevant scholarly literature. The findings reveal that Indonesia has established a relatively comprehensive legal framework, particularly through Law Number 18 of 2017, which positions the state as the primary duty bearer in the protection of migrant workers. Nevertheless, the effectiveness of such protection remains constrained by structural challenges, including weak law enforcement, fragmented institutional coordination, and limited policy implementation capacity. Therefore, strengthening the state’s role through consistent, integrated, and human-centred governance is essential to ensure the safety and protection of Indonesian Migrant Workers in the context of global labour migration.

Abstract

Ideally, the relationship between the Central Executive Board (Dewan Pimpinan Pusat—DPP) of political parties and regional legislative factions (Fraksi DPRD) should be structured proportionally based on the principles of the rule of law, popular sovereignty, and constitutional democracy, thereby ensuring that party discipline operates in harmony with the institutional independence of legislative factions in exercising their legislative, budgeting, and oversight functions. In practice, however, the boundaries of authority between these institutions remain ambiguous, resulting in recurring jurisdictional disputes over regional policymaking that have not been comprehensively regulated under Indonesian positive law. This study aims to examine the constitutional and legal position of the DPP and DPRD factions, analyze the dynamics of jurisdictional disputes between them, and formulate an appropriate dispute resolution model from the perspective of constitutional democracy. This research employs normative legal research with a qualitative approach using the statute, conceptual, and case approaches. Data were analyzed prescriptively through statutory interpretation, legal doctrines, and relevant scholarly literature. The findings reveal that jurisdictional disputes primarily arise from the overlap between the organizational authority of political parties and the public authority vested in DPRD factions. The proposed model emphasizes a coordinative institutional relationship, normative limitations on DPP intervention, strengthened internal party dispute resolution mechanisms, regulatory reform, and judicial safeguards to balance party discipline, factional independence, and the constitutional mandate of the people.

Abstract

A democratic constitutional system guarantees the existence of checks and balances, the independence of state institutions, and electoral integrity as mechanisms to prevent the concentration of executive power. However, the reality in Indonesia demonstrates a pattern of executive aggrandizement, a gradual expansion of executive authority achieved through the weakening of legislative oversight, judicial independence, and bureaucratic neutrality while utilizing legal instruments that appear constitutionally legitimate. This study aims to analyze the anatomy of executive aggrandizement and its implications for electoral integrity in Indonesia. The research employs a normative-qualitative legal research method using both statutory and conceptual approaches. Data were collected through a literature review of legislation, Constitutional Court decisions, and relevant scholarly works, and were analyzed using content analysis and legal hermeneutics. The findings reveal that the expansion of executive power has been facilitated through the instrumentalization of legal regulations, the bureaucracy, the state budget, and social assistance programs, thereby creating an unlevel playing field in political competition. The study further finds evidence of judicial capture, which has shifted the principle of the rule of law toward rule by law. This transformation has undermined judicial independence, weakened constitutional oversight mechanisms, and substantially diminished the integrity of elections in Indonesia.

Abstract

Ideally, sanctions for the offense of fraud should be formulated proportionally by taking into account the objectives of punishment, including retribution, deterrence, offender rehabilitation, public protection, and the restoration of victims' losses. However, in practice, the Wetboek van Strafrecht (WvS) continues to treat imprisonment as the primary sanction without providing adequate room for fines as an alternative punishment better suited to the nature of economic crimes. This study aims to comparatively analyze the regulation of imprisonment and fines for fraud under the Indonesian Criminal Code (KUHP) and the Wetboek van Strafrecht (WvS), as well as to assess their conformity with the objectives of punishment. This research employs a normative legal method using statutory and comparative approaches through the analysis of primary and secondary legal materials. The findings reveal that the Indonesian Criminal Code adopts a more modern and proportionate sentencing approach by providing fines as an alternative to imprisonment, whereas the Wetboek van Strafrecht remains oriented toward imprisonment as the principal form of punishment. Therefore, the Indonesian Criminal Code is considered more consistent with contemporary sentencing objectives because it emphasizes a balance between justice, legal certainty, legal utility, and the restoration of victims' losses.

Abstract

Ideally, the regulation of medical malpractice should ensure patient protection while maintaining the professionalism of medical personnel through a balanced justice mechanism. However, in reality, the provisions of Article 440 of Law Number 17 of 2023 on Health remain oriented toward retributive punishment in the form of imprisonment and fines, without accommodating direct victim recovery, so that substantive justice has not been fully achieved. This study aims to analyze the elements of medical malpractice as a criminal offense within the Health Law and to examine it from the perspective of Islamic criminal law. This article is categorized as a qualitative library research, and the methodology used is normative legal study. The results of the study indicate that: First, medical malpractice under the Health Law requires the presence of gross negligence by medical personnel resulting in serious injury or death, with criminal sanctions differentiated based on the consequences. Second, Islamic criminal law views medical negligence as al-khatha’ or qatl al-khata’, with sanctions in the form of diyat, kafarat, and ta’zir, which emphasize victim recovery and the moral responsibility of the offender.

Abstract

Ideally, the development of Islamic modernism, Islamism, and ethnonationalism in Aceh should be understood as interconnected historical processes that collectively shaped the Acehnese people's collective identity. However, previous studies have generally examined these three intellectual currents separately, focusing primarily on political events while failing to explain the genealogical relationships among them. This study aims to analyze the development of Islamic modernism, Islamism, and ethnonationalism in Aceh, identify the factors underlying their emergence, and explain their implications for the religious, social, and political life of Acehnese society. This research employs a qualitative library research design using historical methods and genealogical analysis of both primary and secondary sources. The findings reveal that Islamic modernism laid the foundation for the reform of Islamic education and thought, Islamism developed as an articulation of the relationship between Islam and the state within the framework of the Republic of Indonesia, while ethnonationalism emerged in response to changes in the political relationship between Aceh and the central government. These three intellectual currents evolved continuously and collectively shaped Aceh's socio-political identity through the era of special autonomy.

Abstract

Ideally, determining the beginning of the Hijri month is viewed purely as a dogmatic religious procedure. However, in reality, the isbat hilal (crescent moon determination) hearing in Indonesia operates as a complex socio-legal phenomenon fraught with negotiation. This study aims to analyze this process as a distinctive manifestation of Indonesian fiqh (Islamic jurisprudence) that integrates the modern state, traditional religious authority, and local cultural wisdom. Employing a socio-legal approach and a qualitative legal study, this research analyzes government regulations, isbat hearing outcomes, and fatwas of the Indonesian Ulema Council (MUI). The findings reveal that the isbat hilal process forms a non-dichotomous hybrid authority model: the state acts as a constitutive facilitator and final arbiter, the ulema contribute epistemic authority through rukyat (moonsighting) and hisab (astronomical calculation), while the local culture of musyawarah untuk mufakat (deliberation for consensus) transforms it into a dynamic space for negotiation. This study contributes to reinforcing the trilogy framework of Indonesian fiqh, which pragmatically reconciles textual Islamic law, science, and the archipelago's socio-cultural context into a functional legal decision.

Abstract

Law Number 3 of 2020 shifted the mining licensing paradigm from decentralization to centralization, yet the reality on the ground shows an increase in Illegal Gold Mining (PETI) activities accompanied by environmental damage and socio-economic dilemmas for poor communities. This research offers novelty by integrating the analysis of licensing arrangements as a preventive instrument, the effectiveness of criminal law enforcement under Article 158 of the Mining Law, and procedural and substantive obstacles in the field simultaneously. The research method used is normative juridical with statutory and conceptual approaches, supported by primary data from limited interviews with law enforcement officers. The findings show that licensing centralization has not been effective in preventing PETI due to the undesignated People's Mining Areas, corrupt bureaucracy, and weak supervision. Criminal law enforcement faces obstacles such as limited investigators, difficulties in evidence gathering, and the presence of protecting officials. Officers experience a social dilemma as they must enforce the law amidst the reality of poor communities dependent on PETI. This study recommends bureaucratic reform, designation of People's Mining Areas, strengthening investigator capacity, and a progressive and just legal approach.

Abstract

The protection of indigenous communal land rights should be ensured through constitutional recognition, legal certainty, and meaningful participation of indigenous peoples in decision-making processes concerning their customary territories. However, the reality of the conflict between the Laman Kinipan Indigenous Community and a palm oil plantation company demonstrates that legal protection remains ineffective due to conditional legal recognition, unequal power relations, and the limited implementation of indigenous participation in licensing procedures. This study aims to analyze the protection of the communal land rights of the Laman Kinipan Indigenous Community from the perspective of responsive law and to examine the Free, Prior and Informed Consent (FPIC) principle as a normative instrument for strengthening the protection of indigenous peoples' rights. This research employs a normative juridical method using statutory, case, and conceptual approaches based on secondary legal materials, including legislation, court decisions, and relevant scholarly literature. The findings reveal that the protection of communal land rights has not been effectively implemented because the existing legal framework still reflects a repressive legal orientation. Therefore, strengthening legal protection requires harmonizing agrarian and sectoral regulations, reinforcing the administrative recognition of indigenous communities, institutionalizing FPIC as a substantive licensing requirement, and developing a more responsive agrarian legal framework to ensure justice and legal certainty for indigenous peoples.

Abstract

Ideally, Article 8 paragraph (5) of the Law on the Indonesian Prosecution Service should function as a preventive legal instrument to safeguard prosecutorial independence by preventing conflicts of interest, thereby ensuring that criminal proceedings are conducted objectively, impartially, and in accordance with the principles of due process of law. In practice, however, the prosecution of the Pinangki Sirna Malasari case reveals that the provision lacks clear operational standards, raising concerns regarding the effectiveness of conflict-of-interest regulation in cases involving prosecutors themselves. This study aims to examine the implementation of Article 8 paragraph (5) of the Law on the Indonesian Prosecution Service through the decision of the Central Jakarta District Court Number 38/Pid.Sus-TPK/2020/PN Jkt.Pst and to assess its implications for prosecutorial independence and the fairness of criminal proceedings. This research employs a normative legal method with a qualitative approach, using statute, case, and conceptual approaches. The findings indicate that the implementation of Article 8 paragraph (5) remains largely declaratory, as it is not supported by effective mechanisms for conflict-of-interest disclosure, recusal, or independent oversight. Strengthening the regulatory framework is essential to reinforce prosecutorial independence, enhance institutional accountability, and ensure a fair and credible criminal justice process.
