Marriage is an attempt to maintain human survival and protect nasab. But sometimes the protection is often tarnished with the existence of an adultery or relationship outside of marriage. Often these relationships result in an illegitimate offspring who is of course a descendant of which adultery results have a position in law different from the position of the legitimate child. Therefore, an outof-wedlock child as a result of an adultery by his or her parents will not be entitled as to the right earned by the child legitimately, especially in the case of inheritance, the outsider will not be able to obtain the inheritance of his biological parents before there is recognition from his biological parents, an outsider is a child born outside a legal marriage according to syara '. The scholars have agreed that one can not be denied to his father. As a legitimate child, if the child is born less than six months after the marriage contract, because according to them the shortest interval that must exist between the birth of the child and the marriage is six months. This means that if a child is born not reaching six months after the parents of the marriage contract, then the child can not be fathered to his father as a legitimate child

Development in the business sector is very dynamic and requires a number of legal fiqh which are then set forth in positive law in the form of legislation and regulations issued by financial institutions such as Bank Indonesia as the central bank that has the authority to regulate the operation of commercial banks in a country. One of the business instruments in Islam is the muamalah contract in the form of rent and sale and purchase which has now developed into Ijarah Muntahiya bit Tamlik (IMBT) as one of the financing instruments in sharia financial institutions. It was formulated in fatwa Number 27 / DSN-MUI / III / 2002 concerning IMBT. This article will answer how the process of the fatwa came out as a product of Ulama's Ijtihad? What are the legal actions formulated in the fatwa. What is the legal relationship in the IMBT agreement, and has the IMBT fatwa answered the needs of today's ummah in Indonesia? By library method approach it was found that legal actions in the IMBT fatwa were still partial between rent and sale and purchase or sometimes even though the formulation was harmonious and the conditions were put together. In the case of legal actions there is confusion in which one name is IMBT but contains a number of separate legal actions. Then between one legal act of lease and a legal act of purchase is bound by a promise that can be denied. Of course there are weaknesses that in practice will be parties who are harmed if the promise is not fulfilled. It has a weak legal relationship between the parties. Then it needs further study on how the IMBT really produces a strong legal relationship and mutual protection. Keywords: Fatwa, IMBT dan Hubungan Hukum Abstrak: Perkembangan dalam bidang bisnis sangat dinamis dan membutuhkan sejumlah kepastian hukum secara fikih yang kemudian dituangkan dalam hukum positif dalam bentuk perundang-undangan maupun peraturan yang dikeluarkan oleh institusi keuangan seperti Bank Indonesia selaku Bank sentral yang memiliki wewenang untuk mengatur jalannya bank komersial disuatu Negara. Salah satu instrumen bisnis dalam Islam adalah akad muamalah berupa sewa menyewa maupun jual beli yang kini telah berkembang menjadi Ijarah Muntahiya bit Tamlik (IMBT) sebagai salah satu instrumen pembiayaan pada lembaga keuangan syariah. Ketentuan ini kemudian dirumuskan dalam fatwa Nomor 27/DSNMUI/III/2002 tentang IMBT. Artikel ini akan menjawab bagaimana proses lahirnya fatwa IMBT sebagai produk Ijtihad Ulama? Bagaimana perbuatan hukum yang dirumuskan dalam fatwa IMBT. Bagaimana pula hubungan hukum dalam akad IMBT serta apakah fatwa IMBT sudah menjawab kebutuhan ummat masa kini di Indonesia? Dengan pendekatan metode kepustakaan ditemukan bahwa perbuatan hukum dalam fatwa IMBT masih bersifat parsial antara sewa dengan jual beli atau adakalanya hibah meskipun dalam perumusannya rukun dan syaratnya disatukan. Dalam hal perbuatan hukum ada kerancuan dimana satu nama IMBT tapi mengandung sejumlah perbuatan hukum yang terpisah. Kemudian antara satu perbuatan hukum sewa dan perbuatan hukum beli diikat oleh janji yang sifatnya boleh dingkari. Tentu ini ada kelemahan yang dalam prakteknya akan ada pihak yang dirugikan jika janji itu tidak ditepati. Tentu ini melahirkan hubungan hukum yang masih lemah antara para pihak. Maka perlu kajian lebih lanjut bagaimana dalam IMBT betul-betul melahirkan hubungan hukum yang kuat serta saling melindungi. Kata Kunci: Fatwa, IMBT dan Hubungan Hukum

Nowadays, the phenomenon of polygamy has become a social phenomenon in marriage which is much talkedabout and controversial. On the one hand polygamy is rejected with various arguments, both normative, psychological and even highly touched with gender inequality. On the other hand polygamy is promoted because it is considered to have a firm normative background and is seen as an alternative in solving social problems that arise in society. Controvercy araised due to the concept of justice to wives in polygamy tends to be understood in terms of quantitative. The article tries to discuss Hasbi Ash-Siddieqy?s opinion about polygamy and how the method of judgement extraction used by Hasbi Ashiddieqy about polygamy. According to Muhammad Hasbi Ash-Shiddieqy polygamy is not allowed, because justice in terms of love and affection is very difficult to be realized. The method of judgement extraction used by Hasbi Ash-Shiddieqy related to his opinion is the method of Mashlahah al-Murshalah, which is done by analyzing Al-Qur'an An-Nisa 'verse 3 and the relation of that verse with verse 129 and hadith which is narrated by Imam Ahmad. He takes an account on it?s mashlahat and mafsadat and the possibility of the realization of justice in terms of love and affection in the polygamy family.

This article aims to explain the nature of the market mechanism in Islamic economic thought and its practice. Historical and philosophical approach are used in this article to explore the ideas and insights of Muslim scholars on the market. The article concludes that within the framework of Islam, the market mechanism has been considered as an important part of economic activity. According to Islamic economy, market mechanism can occur naturally on the side of supply and demand as it should be. Furthermore, within the mechanism of the market economy perspective of Islam, its principle is to reject the existence of an intervention price if the price changes occur due to normal market mechanisms. However, the market here requires morality, such as: fair competition, honesty, transparency, and justice. If these values have been established, there is no reason to reject the market price. And if there are deviations, the obligation of the state to regulate it for the benefit of the people.

This article would like to explain about Fiqh thought of Asy Syatibi and Ibnu Taimiyah around Islamic Law. These two figures are known as innovators in Islamic Law. Asy Syatibi is popular in Granada and his thought in Islamic law certainly influenced by social culture in Granada. He applies the principle of ?Mura?at al-Khilaf?, which is a principle to honor dissenting opinion in a way that look at all the opinion as correct. Contrary to Ibnu Taimiyyah, his thought in Islamic law influenced by social culture in Damascus. As a result, the basic principle of Ibnu Taimiyyah?s fatwa more resemble to Ahmad ibn Hambal?s thought in the use of existing legal sources. Neverthless, Ibnu Taimiyyah keep looking ?illat? (legal reasoning) and base his opinion to that ??illats?.

After special autonomy through the mandate of Law Number 18 Year 2001 concerning special autonomy which was later renewed with Law Number 11 of 2006 concerning Aceh Government, there are big opportunities for the people of Aceh to legalize a separate family law aside from applicable national law as contained in the Act. Number 1 of 1974 concerning marriage and KHI. The desire of the Acehnese to make their own law can be seen from the fatwas which is made by Scholars of Aceh. In fact, toward the 17 years of special autonomy, family law legislation has not been carried out yet, it is very different from the jinayat and muamalah law which has been legislated in the form of the Aceh Qanun. This paper described scientifically the opportunity for legislation in a legal perspective, and the dynamics that require the legalization and strategies so that the family law qanun can be effective as a material law regarding marriage in Aceh. Keywords: Legislation, Family Law, and Special Autonomy Abstrak: Pasca otonomi khusus melalui amanat UU Nomor 18 Tahun 2001 tentang Otonomi Khusus yang kemudian di perbaharui dengan UU Nomor 11 Tahun 2006 tentang Pemerintahan Aceh, terbuka peluang yang lebar bagi masyarakat Aceh untuk melakukan legislasi hukum keluarga tersendiri selain hukum yang berlaku secara nasional sebagaimana terdapat pada UU Nomor 1 Tahun 1974 tentang perkawinan dan KHI. Keinginan masyarakat Aceh untuk membuat hukum sendiri terlihat dari fatwa-fatwa yang dikeluarkan pada Ulama Aceh. Hanya saja, menjelang 17 tahun Otonomi khusus, legislasi hukum keluarga belum juga dilakukan, sangat berbeda dengan hukum jinayat dan hukum muamalah yang telak dilakukan legislasi dalam bentuk qanun Aceh. Tulisan ini akan menggambarkan secara ilmiah mengenai peluang legislasi tersebut perspektif hukum, juga menggambarkan dinamika yang menghendaki dilakukannya legisasi serta strategi yang harus dilakukan agar qanun hukum keluarga tersebut dapat berlaku efektif sebagai hukum materil mengenai perkawinan di Aceh. With a qualitative approach, this research raises Khaled Abou El Fadl's thoughts on contemporary Islamic law discourse by analyzing one of his main works, namely Speaking in God's Name: Islamic Law, Authority, and Women. This paper will be focused on two important questions. First, how is the history of Khaled Abou El Fadl's life? Second, how is Khaled Abou El Fadl?s thought style in the tradition of contemporary jurisprudence? Based on those two questions, this research finally produces that; First, Abou El Fadl grew out of the dialectic of Islamic thought in the Middle East which has grown since the 1970s. His thought was actually a reaction to the rise of Salafi discourses, especially in Saudi Arabia and Egypt. The idea of Abou El Fadl is seen as a moderate wing representation in Salafi thought. Second, Atas Nama Tuhan, Khaled Aboul El Fadl's work is an experiment of his criticism of Salafism ideology which argues that Islamic reformism is also responsible for creating a creed closed, intolerant, and superficial in understanding the sacred texts of Islam should be taken seriously. His thought provides a discourse on Islamic law by combining classical Islamic thought with modern hermeneuticdiscourse.

this paper will be explained about how family justice the polygamy based on the gender perspective, which has interpreted through the Athirahh novel. Considering that in this novel tells about the conflict in the polygamous family life carried out by Haji Kalla. Therefore the contributions of this research are: Firstly, the gender justice concept: marriage commitment and relation. The impartiality for a polygamous family is quiet difficult because of the balance of a polygamous family it is not only about the living sharing but also the feeling sharing. There might be a polygamy justice if the couple has a commitment to remain for the couple and maintain the marriage even though there are those who getting hurt because of that polygamy. Secondly, as told in the Athirahh novel, the figure of the woman who was hurt because of the polygamy had been done by her husband, but she was able to manage her mental and keep her good behavior in front of her husband and her children, so that was why the marriage commitment was maintained. But there was an inequality in the relation and the task division because Haji Kalla spent his time with his new wife more than the old one. Athirah had to has burden more because of it. In addition to keep her family, she also had to work for them.

Cessie is the submission of accounts receivable in the name regulated in Article 613 of the Civil Code. Cessie in principle is the sale and purchase of receivables, but in its development the cessie can also be used as collateral for debt. In Islamic law, detailed discussion of cessie has not yet existed, but in general the issue of accounts payable has been discussed in the hawalah contract. In the DSN-MUI fatwas cessies are categorized as active subjective innovations or forms of subrogation accompanied by compensation. On the other hand, conceptually, cessie, subrogation and innovation are different. From this description, this research will discuss about cessie in Islamic law review with hawalah approach. The research method used is qualitative-descriptive-literature. The conclusion obtained from this study. (1) Cessie requirements according to the Civil Code have not fulfilled the entire requirements for the formation of the contract contained in hawalah. (2) Cessie in the sale and purchase of receivables is included in hawalah haqq. (3) Cessie as debt collateral is included in hawalah haqq based on kafalah (guarantee). The basic concept of fatwa in its position of binding law is legal opinion in Indonesia. But in certain cases fatwa has a legal binding which is must be obeyed by people. This article demonstrate how fatwa has a legal binding in the context of Indonesia. The objects of research specifically is banking sharia act in which it is said Islamic economy activities must be appropriate with the fatwa of national sharia council. As concluding remark, this article show the development of fatwa from legal opinion to legal binding through the constitution as represent by sharia banking act.
