Abstract

Notary is an official who owns the authority to produce authentic deed.  Authentic deed is a perfect evidence because it is created in such perfect form based on legal constituation and is made by authorized official who owns goverment trust.  An authentic deed has to obtain several elements as requered by the law.  One main requirement is the presence of “Penghadap”.  “Penghadap” is legit requirement of an agreement and is stated inside the body of an authentic deed.  Therefore presence of a “Penghadap” becomes very vital in determingning authenticity of a deed.  Studi in a case Kekuatan Hukum Akta Otentik Notaris Tanpa dihadiri  Penghadap (Studi Kasus Putusan MPWN Nomor: 03/PTS/MJ.PWN PROVINSI SUMATERA SELATAN/VIII/2014)” showed firstly, that notary TI created copy establishment of LBH Kesehatan stated all the elements were not available and did not signed the deed.Secondly, MPW gave written senction toward notary TI on doing ethical violation,thirdly the deed of establishment is cancelled for law because the “Penghadap” were not presence in the process of deed establishmentKeywords : Notary, Deep, Pengha

Abstract

The thesis title is "The Value Added Tax Regulation On Notary/Official Certifier of Title Deeds (PPAT) Services". The research formulates the problems of why Notary/Official Certifier of Title Deeds Notary (PPAT) have to collect Value Added Tax (PPN) on services, the criterias of Notary / Official Certifier of Title Deeds (PPAT) services which can be charged with Value Added Tax, and The Obstacles of its application and alternatives can be taken to these obstacles.  Based on Law Number 42 Year 2009, the Notary / Official Certifier of Title Deeds (PPAT) is one of the Taxable Person for any services rendered to the public. To examine and answer the problems mentioned above, this thesis uses normative legal study that analyzing law enforcement. Performed by examining the legal materials, such as the study of the principles of law, positive law, the rule of law, and rules of legal norms. The approach method used in this research was Legislation Approach, and Historical Approach.  The result shows that the Notary who have to collect value added tax is the Notary who included in the Entrepreneur category. Main obstacles encountered in the application of Value Added Tax is society refuse to pay value added tax, because they considered they are subject to double taxation, therefore to overcome these, Notary / Official Certifier of Title Deeds (PPAT) charged with  those. It can be done because in the Value Added Tax that is known as tax shifting. It is suggested that the Government should make special regulations in imposing value added tax on legal services provided by a Notary, so the Notary is not classified as an entrepreneur and then kept the image of Notary as an Public Officials. Key words: Value Added Tax of Notary’s services, Taxable entrepreneur, Taxable services and public officials.

Abstract

Camat selaku PPAT sementara mendapat kewenangan dalam hal melakukan perbuatan hukum dalam membuat akta yang otentik, dikarenakan jabatan yang melekat padanya, sebagaimana diatur dalam Pasal 8 ayat (2) Peraturan Pemerintah Nomor 37 tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah. Penelitian ini merumuskan permasalahan tentang bagaimanakah tanggung jawab camat selaku PPAT Sementara setelah tidak menjabat lagi sebagai PPAT Sementara terhadap akta yang dibuatnya, dan bagaimanakah kedudukan akta dan sanksi yang diterima Camat apabila akta otentik yang dibuatnya tidak memenuhi persyaratan dalam proses pendaftaran tanah. Penelitian ini merupakan penelitian normatif yang menganalisis suatu aturan aturan hukum, prinsip-prinsip hukum, maupun doktrin-doktrin hukum yang berlaku  untuk menjawab permasalahan hukum yang dihadapi. Penelitian tesis ini menggunakan metode pendekatan Perundang-undangan (Statue Approach), pendekatan Konseptual (Conceptual Approach). Hasil Penelitian ini bertujuan untuk mejelaskan akan tanggung jawab camat setelah tidak menjabat lagi sebagai PPAT sementara terhadap akta yang dibuatnya, apabila mengalami permasalahan hukum di kemudian hari,  serta menjelaskan sanksi dan kedudukan akta yang dibuat oleh PPAT sementara setelah tidak menjabat lagi jika tidak memenuhi persyaratan untuk dilakukan pendaftaran tanah. Manfaat Penelitian ini diharapkan dapat memberikan informasi mengenai pengembangan Ilmu Hukum Kenotariatan khususnya disiplin Ilmu Hukum Agraria dalam bidang pertanahan dan dapat memberikan kontribusi pemikiran hukum kepada Notaris/PPAT maupun calon Notaris/PPAT, Khususnya bagi camat yang mengemban jabatan sebagai PPAT Sementara

Abstract

Abstract : Government Regulation No. 42 year 2006 was on the implementation of Law No.41 year 2004 on waqf / endownment. According to the regulation, waqif could make the pledge deed of waqf (AIW) both before the notary and the Office of Religious Affair. The problem was whether all the notaries had authorization to make the the pledge deed of waqf (AIW) based on the regulation for pledge deed officer of waqf (PPAIW). This study was a normative study which analyzed a legal enforceability and was conducted by examining law materials, such as research on the principles of law, rule of law, and legal norm. This study used two approaches: statue approach and historical approach. The result showed that the authority of notary in making the pledge deed of waqf (AIW) was authorized in Goverment Regulation No. 42 year 2006 article 37. This authority did not contradict to the authority of notary as regulated in Government Regulation No. 2  year 2014 article 15 concerning to the amandment of law no. 30 year 2004 on notary. However, not all notaries could be appointed as deed officer of waqf (PPAIW). There were three basic requirements for becoming PPAIW:    1) a moslem, 2) trustworthy, and 3) having certificateof competency in waqf issued by the Ministry of Religious Affair.  It was associated with the waqf/endowment itself as a religious charity. Furthermore, if there is a dispute about it, the Ministry of Religious Affair who always handle the case of moslems will solve it. The role of notary as PPAIW is as a party who gives legal certainty, collects authentic information about waqf, and provides services to the community. It was suggested this information should be socialized and a notary should be appointed as PPAIW. Howeever, cooperation among the Ministry of Religious Affair, Indonesian Waqf Board, National Land Agency, Islamic Financial Institution, Professional Association of Notary, and the Land Deed Officer is needed.

Abstract

Notaris adalah Pejabat Umum yang berwenang membuat akta otentik dan kewenangan lainnya sebagaimana yang dimaksud dalam Undang-undang bahwa Notaris diangkat oleh pemerintah untuk dan guna melayani kepentingan masyarakat dalam pembuatan akata otentik. Penelitian ini menggunakan metode penelitian hukum normatif. Pendekatan yang digunakan pendekatan Undang-undang (statute approach), pendekatan konseptual (conseptual approach) dan pendekatan kasus (case approach). Kesimpulan penelitian ini menunjukkan Majelis Pengawas Notaris merupakan perpanjangan tangan dari Menteri Hukum dan Hak Asasi Manusia, dalam hal ini Majelis Pengawas mendapat Delegasi oleh Menteri Hukum dan Hak Asasi Manusia untuk melakukan pengawasan dan pemeriksaan terhadap Notaris. Dalam menjalankan tugasnya, Majelis Pengawas memiliki kewenangan untuk melakukan pengawasan, pemeriksaan dan menjatuhkan sanksi terhadap Notaris yang diduga dalam menjalankan jabatannya melanggar ketentuan Undang-undang Jabatan Notaris. Kewenangannya secara berjenjang yaitu: MPD, MPW, MPP.

Abstract

Abstract : This thesis examines the legal standing of acknowledgement letter of right to land as a right base to process a land registration that it has purpose to review and analyze the aspect of legal standing of acknowledgement letter of right to land in a system of valid agrarian law, rather related to the publishing authority, arrangement of society, function in process of land registration, analysis of legal power of the acknowledgement letter of right to land in land dispute and powerof authentication in formal and material. By using a normative legal research can be put forward that it meets with the legal standing of the acknowledgement letter of right to land that one of right of bases in process of land registration (certification) and legal power of authentication of the acknowledgement letter of right to land in land dispute represents an under-hand proof and therefore in land dispute must be seen the other proof as witness, admission, suspicion and oath, sp that in material, the obtained truth is not only formal legal truth. On the basis, this research recommends, related to the legal standing and the power of authentication of the acknowledgement letter of right to land that the National of Agency (BPN) keeps on making the massive certification in order to it can be stepped up becoming certificate of right to landand in settlement of land dispute to give prority in way and mechanism to engage in deliberation by relying on mechanism of formal legal settlement. Keywords :      Acknowledgement letter of right to land, Under-hand Documents, Certificate of Proprietary Right

Abstract

The results of this study indicate that the Sale and Purchase Agreements made before a Notary as Officer of Land deed is authentic deeds, but to be considered authentic deed, deed of sale before it is signed must be preceded by verification BPHTB for verification BPHTB is a requirement that has been determined by the Act that the Sale and Purchase Agreements will be signed after BPHTB paid and verified. The role of the Notary as Officer of Land deed in the manufacture of a deed of sale must ask the parties truth of BPHTB  tax payments BPHTB, if the parties can not submit proof of payment BPHTB the Notary as Officer of the Land Deed authorizes to order and help the parties to pay for and verify BPTHB in DPPKAD to be able to implement sales and purchase agreement something. Supposedly verification conducted by Revenue Service of the regional asset and finace management (DPPKAD) is about truth and completeness of SSPD BPHTB and supporting documents but not the price of the transaction. Then the result of the verification hindrance in BPHTB SSPD becomes obstacles in the issuence of the deed Purchase sale.

Abstract

In Doing Broadcasting, Trans7 Give Permission To Another broadcasting platform to broadcast its program and was also given permission by copyright holder to  broadcast its program. As mandated by the Copyright Act, those permits are made in the license agreement. Law No. 28 of 2014 on Copyright governing the license, which basically entitles the holder of copyright to grant a license to other parties via licensing agreements to implement or use a copyrighted work commercially by receiving royalties for the use of his creation. Licensor’s creativity is being protected in making a television broadcast program, and licensee’s right are protected to carry out broadcasting with the terms and conditions set forth in the license agreement. Licensor and licensee in the license agreement, including a license agreement the copyright to broadcast television programs on television stations TRANS7 which were not recorded in the Register of the General License Agreement Copyright remains protected of the rights held in the agreement, but the agreement was not have a legal effect to the third party.

Abstract

Masalah kewarisan dalam Hukum Islam merupakan hal yang sangat penting, karena berkenaan dengan segala sesuatu yang ditinggalkan oleh seseorang yang meninggal dunia, baik berupa harta benda maupun hak-hak kebendaan yang timbul sebagai akibat dari suatu kematian. Harta yang ditinggalkan oleh seseorang yang telah meninggal memerlukan pengaturan tentang siapa yang berhak menerimanya, berapa jumahnya, dan bagaimana mendapatkannya agar memberikan kepastian hukum terhadap hak milik seseorang dengan cara yang seadil-adilnya. Untuk penyelesaian hak-hak dan kewajiban sebagai akibat dari adanya  kematian, maka perlu pengaturan secara rinci agar tidak ada perselisihan antara sesama ahli waris sepeninggal orang yang hartanya diwarisi tersebut. Pembagian hak kewarisan dalam Islam yaitu dua bagian untuk laki-laki berbanding satu untuk perempuan. Firman Allah dalam Surat An-nisa ayat 11. Pada umumnya, usaha untuk memperoleh identitas jenis kelamin merupakan proses yang lancar dan bebas dari kesulitan. Manusia dikelompokkan sebagai pria dan wanita waktu lahir diperlakukan sebagaimana anak laki-laki dan perempuan oleh orang tua dan dengan mudah mempelajari jenis kelamin ketika dewasa. Namun sejumlah kecil orang, memiliki kesulitan dalam menentukan jenis kelamin. Yang dimaksudkan adalah berkelamin ganda atau di dalam Islam dikenal dengan sebutan Khunsa,yang memiliki kondisi fisik berbeda dari manusia pada umumnya dengan memiliki dua jenis kelamin sekaligus. Dengan adanya kondisi khunsa ini maka terdapat kebingungan dalam hal menentukan hak waris atau kewarisanya, oleh sebab itu pokok permasalah dalam penelitian ini adalah bagaimana penentuan status orang yang berkelamin ganda dalam Hukum Islam dan Hukum Nasional, serta bagaimana kedudukan ahli waris yang berkelamin ganda dalam Hukum Islam. Penelitian ini merupakan penelitian normatif yang bersifat deskriptif eskplanatif dengan pendekatan Perundang-Undanga, Sosiologis dan juga Kasus, serra  menggunakan sumber data sekunder yang diperoleh dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Abstract

Article 5 section 3 of Government regulation No 37/1998 about land certificate officer (PPAT) asserts that head of district has the authority to serve the society in establishing PPAT certificate in an area with less PPAT availability.Legal materials of this research will be taken from law regulation and research result which are interview and written data from participants. This research will use Statue Law Approach that examine the legal issues relate to Agrarian law No 5/1960, district law no 6/2014, government regulation no 37/1998 about PPAT position regulation, government regulation no 24/1997 about land registration, Ministry of Agrarian, Department of National Land Affairs no 1/1996 about PPAT formation, and Department of National Land Affairs regulation no 1/2006 about carrying out stipulation of the government regulation no 37/1998 about PPAT position regulation.  Case study approach is needed to answer the problem of head of village as temporary PPAT in relation to land right diversion in Banyuasin district
