Jurnal Simbur Cahaya merupakan jurnal ilmiah yang dikelola oleh Fakultas Hukum Universitas Sriwijaya. Penamaan jurnal ini tidak terlepas dari sejarah yang dimiliki masyarakat Sumatera Selatan, khususnya mengenai keberadaan Kitab Simbur Cahaya pada zaman dahulu. Kitab Simbur Cahaya merupakan peninggalan dan hasil tulisan dari Ratu Sinuhun (istri penguasa Palembang yang berkuasa antara tahun 1636 sampai 1650). Beberapa ahli sejarah meyakini bahwa Kitab Simbur Cahaya merupakan kitab pertama yang diterapkan masyarakat nusantara, berupa undang-undang tertulis yang berdasarkan syariat Islam. Cerita lain menyebutkan bahwa Kitab Simbur Cahaya berkaitan erat dengan cerita munculnya sinar terang benderang di Bukit Siguntang dalam rangka menyambut kelahiran keturunan Raja Iskandar Zulkarnaen dan menjadi penanda pengesahan tiga raja muslim di tiga serumpun Melayu, yakni Palembang, Singapura dan Malaka. Secara etimologis simbur cahaya diartikan sebagai “percik sinar atau cahaya”, cahaya yang dimaknai sebagai obor dalam peradaban masyarakat Sumatera Selatan. Dalam Kitab Simbur Cahaya terkandung nilai-nilai moral serta perpaduan antara hukum adat dan ajaran agama Islam. Undang-undang Simbur Cahaya merupakan kitab undang-undang hukum adat yang memadukan antara hukum adat yang berkembang secara lisan di pedalaman Sumatera Selatan dan ajaran Islam. Kitab ini terdiri dari lima bab, yang membentuk pranata hukum dan kelembagaan adat di Sumatera Selatan, khususnya terkait persamaan gender perempuan dan laki-laki. Secara garis besar, isi undang-undang tersebut adalah sebagai berikut: 1) Adat Bujang Gadis dan Kawin; 2) Adat Marga; 3)Aturan Dusun dan Berladang; 4)Aturan Kaum; 5)Adat Perhukuman. Berdasarkan optimisme dan nama besar Kitab Simbur Cahaya maka Fakultas Hukum Universitas Sriwijaya berusaha memberikan tempat bagi para peneliti, mahasiswa, praktisi dan akademisi untuk terhimpun dalam wadah ilmiah yakni Jurnal Simbur Cahaya. Jurnal Simbur Cahaya adalah jurnal berkala ilmiah Ilmu Hukum yang diterbitkan oleh Fakultas Hukum Universitas Sriwijaya. Terbit per-periodik bulan Juni & Desember dengan artikel yang menggunakan Bahasa Indonesia dan Bahasa Inggris. Jurnal Simbur Cahaya merupakan sarana publikasi ilmiah yang memenuhi standar kualifikasi jurnal nasional terindeks SINTA dan diharapkan dapat ditingkatkan menjadi jurnal internasional. Jurnal Simbur Cahaya diperuntukkan bagi akademisi, peneliti, mahasiswa pascasarjana, praktisi, serta pemerhati hukum. Lingkup tulisan dalam Jurnal Simbur Cahaya merupakan artikel hasil penelitian atau artikel review kasus hukum. Artikel-artikel tersebut seyogyanya mampu menjawab aneka permasalahan hukum yang dapat dipertanggungjawabkan melalui bentuk tulisan ilmiah. Sebagaimana sejarah awal terbitnya, Jurnal Simbur Cahaya banyak menyoroti kajian hukum kontemporer seperti Hukum Tata Negara, Hukum Administrasi Negara, Hukum Perdata, Hukum Pidana, Hukum Internasional, Hukum Lingkungan, Hukum Islam, dan Hukum Adat.

Abstract

As technology continues to evolve, health services are increasingly integrating telemedicine into their practices. With the enactment of Law Number 17 of 2023 concerning Health, further study is required to address the legal issues arising from the provision of telemedicine services, particularly those relating to informed consent. This article aims to analyse the regulation of informed consent in telemedicine under Law Number 17 of 2023 concerning Health. The research employs a normative juridical method, drawing on legal materials such as legislation, legal literature, journal articles, and other relevant sources. The findings indicate that, despite the enactment of Law Number 17 of 2023 concerning Health and its implementing regulations, Indonesian positive law does not yet provide a specific procedural framework for informed consent in telemedicine services. This regulatory gap creates legal uncertainty and fails to provide adequate preventive legal protection. This article concludes that a telemedicine-specific regulatory framework, incorporating the six-stage procedural model developed in this study, is required to ensure legal certainty, strengthen legal protections for patients, medical professionals, and healthcare professionals, and establish clear procedural guidance for implementing informed consent in telemedicine services.

Abstract

This study examines the legal issue (juridical polemic) regarding the status of "outer space" in the Basic Agrarian Law (UUPA). The UUPA includes outer space as part of the national wealth under state control (HMN). However, this view has led to a conflict of norms after Indonesia ratified the 1967 Space Treaty through Law No. 16 of 2002. This international treaty affirms that outer space is the common heritage of humanity and prohibits any country from claiming sovereignty there. In addition, there is also the issue of the unclear vertical boundaries of "airspace", which is part of state sovereignty. This study aims to analyse the regulatory regime governing Airspace and Outer Space under the National Agrarian Law, and to identify the obstacles to implementing the State's Right of Control (HMN) over Outer Space following the enactment of the 1967 Space Treaty. The research method used is normative law, which focuses on the analysis of primary legal materials (such as the 1945 Constitution of the Republic of Indonesia, the Basic Agrarian Law, and Law No. 16/2002) and secondary legal materials. The results of the analysis show that there are two fundamentally different legal regimes. Airspace is treated as a territory of full and exclusive state sovereignty. However, this sovereignty has weaknesses, namely that it is not mentioned in the 1945 Constitution and is limited by the right of passage in the Indonesian Archipelagic Sea Lanes (ALKI). Conversely, outer space is entirely governed by international law, which prohibits sovereignty. The conclusion reached is that the State's Right of Control (HMN) over Outer Space cannot be exercised. This is due to two main obstacles: unresolved conflicts between the UUPA and the 1967 Space Treaty, and Indonesia's technological backwardness in utilising strategic resources in space, such as the Geostationary Orbit (GSO).

Abstract

Indigenous legal communities are part of Indonesian society and have been constitutionally recognised through Article 18B paragraph (2) and Article 28I paragraph (3) of the 1945 Constitution of the Republic of Indonesia. However, the absence of a specific law governing indigenous communities means that regulations remain scattered across sectoral regulations, creating legal uncertainty in the recognition of indigenous territories, land rights, and natural resource management. This study aims to examine the feasibility of regulations to protect indigenous communities by evaluating the Academic Draft of the Indigenous Communities Bill against legislative-formation standards and measuring the policy's feasibility using the Cost-Benefit Analysis (CBA) approach. The research method used is normative legal research, employing a statutory-regulatory approach and analysis of legal documents and secondary data. The results of the study indicate that the Academic Draft of the Indigenous Communities Bill has a strong philosophical, sociological, and juridical basis, but still requires strengthening in terms of empirical data, harmonisation of sectoral regulations, and implementation mechanisms to protect indigenous communities. The novelty of this research lies in the use of a Cost-Benefit Analysis approach to complement normative legal studies, enabling the feasibility of establishing regulations to be assessed not only from a legal perspective but also from economic, social, and environmental perspectives. The CBA results indicate that the benefits of establishing regulations to protect indigenous peoples outweigh the implementation costs, making the Indigenous Peoples Bill worthy of development as a sustainable legal instrument for their protection.

Abstract

The revision of the Criminal Procedure Code (KUHAP) is an effort to build a criminal justice system that is more responsive to societal developments and the living legal values in Indonesia. The legal issue addressed in this study concerns how the theory of Volkgeist can serve as a foundation for formulating the KUHAP that reflects the character, culture, and sense of justice of the Indonesian people. This study aims to analyse the relevance of the Volkgeist theory in the formulation of criminal procedure law, particularly in regulating the concept of rechterlijk pardon (judicial pardon), restorative justice, and the fulfilment of customary obligations as a form of supplementary punishment. The research method employed is normative legal research, using a statutory and conceptual approach, through analysis of the provisions of the Criminal Procedure Code (KUHAP) and relevant legal theories. The research findings indicate that the provisions on rechterlijk pardon, restorative justice as stipulated in Article 1, point 18 of the Criminal Procedure Code, and the provisions regarding the fulfilment of customary obligations reflect the values of cooperation, deliberation, and the restoration of social relationships that have long been embedded in Indonesian society. Thus, the application of these concepts aligns with the Volkgeist theory because the law functions not only as an instrument for enforcing rules but also as a reflection of the nation’s spirit and the community’s legal culture, thereby enabling the realisation of a criminal procedural system that is more just and humane.

Abstract

The normative final and binding nature of the Election Organisers Honour Council (DKPP) decisions creates a complex juridical dilemma when they are followed up as a State Administrative Decree (KTUN) by executive agencies. Following the issuance of the Jakarta State Administrative Court (PTUN) Decision No. 82/G/2020/PTUN-JKT, a widespread academic misconception emerged, mistakenly assuming it as an expansion of PTUN's authority into electoral disputes. In reality, the genuine legal gap lies in the blurred legal demarcation line between upstream ethical violations and downstream state administrative disputes. This doctrinal legal research aims to rectify the theoretical basis of such judicial competence and formulate the ideal repositioning of the PTUN within the electoral justice system. Using statutory, case (ratio decidendi), and conceptual approaches, the legal materials were qualitatively analysed through deductive reasoning. The results demonstrate that the PTUN operates strictly within the corridor of conventional administrative disputes, serving as a procedural guardian and a reviewer of the legality of administrative execution rather than an electoral judge. Under the doctrine of derivative invalidity, it is established that upstream formal procedural defects committed during DKPP hearings (violations of notification deadlines and the audi alteram partem principle) automatically infect and invalidate the downstream execution decree. Consequently, the absolute finality of DKPP decisions collapses into "quasi-finality," reinforcing the inherent relationship between public ethics and administrative law, while shifting the paradigm toward the supremacy of procedural justice. To resolve this, positive law reform is required by amending Article 458, paragraph (13) of the Election Law to explicitly limit PTUN's competence for judicial review to the authority and procedural aspects of execution, and by internalising due process of law standards within DKPP's procedural law.

Abstract

Small islands in Indonesia possess unique ecological characteristics yet are highly vulnerable to the destructive impacts of extractive industries, particularly mineral mining. Although the legal regime under Law Number 27 of 2007 concerning the Management of Coastal Areas and Small Islands and its amendments (UU PWP3K) adopts a conservation paradigm, reality demonstrates a massive issuance of Mining Business Licenses (IUP) in these regions based on the regime of Law Number 4 of 2009 concerning Mineral and Coal Mining and its amendments (UU Minerba). The primary issue lies in the regulatory disharmony following the enactment of the Job Creation Law and the implementation of the Online Single Submission Risk-Based Approach (OSS-RBA) system, which systematically curtails the authority of the Ministry of Marine Affairs and Fisheries (KKP) as the guardian of coastal ecosystems. This research aims to examine the juridical implications of current licensing regulations for the principle of small island protection and to formulate measures to strengthen the KKP's authority. This study constitutes normative legal research utilising statutory and conceptual approaches. The results indicate that the current licensing system suffers from norm degradation by disregarding the standing of the UU PWP3K as lex specialis, as affirmed in Supreme Court Decision Number 403 K/TUN/TF/2024 and Constitutional Court Decision Number 35/PUU-XXI/2023. The absence of the KKP's substantive role results in the loss of ecological checks and balances mechanisms. This study concludes that the state must restore the KKP's authority by establishing technical regulations that make the Minister of Marine Affairs and Fisheries' recommendation an absolute prerequisite (conditio sine qua non) for the issuance of an IUP by the relevant agencies, thereby guaranteeing legal certainty and environmental sustainability.

Abstract

Child marriage remains a serious problem in Southeast Sulawesi Province, despite Law Number 16 of 2019 raising the minimum age for marriage to 19 years. In 2024, 221 children were recorded as having married before age 19, of whom 85.5% were girls. This study aims to analyse the factors contributing to child marriage and the urgency of establishing a Regional Regulation as a preventive measure in Southeast Sulawesi. The study used a normative-empirical method, combining a review of laws and regulations with an analysis of empirical data on child marriage. The results show that child marriage is influenced by educational, economic, socio-cultural, customary law, technological developments, and promiscuity factors that lead to premarital pregnancies. The establishment of a Regional Regulation is urgently needed because national policies have not effectively addressed the socio-cultural characteristics of local communities. This study found that the Regional Regulation on the Prevention of Child Marriage needs to include provisions regarding prevention, supervision, assistance, and the involvement of various stakeholders in child protection. The research conclusion indicates that the Regional Government has the authority to establish Regional Regulations as a preventive legal instrument to strengthen child protection and reduce the number of child marriages in Southeast Sulawesi. The novelty of this research lies in the formulation of a substantive model of the Regional Regulation on Child Marriage Prevention that is tailored to the socio-cultural characteristics of the Southeast Sulawesi community.

Abstract

Account blocking by third parties, such as the Financial Transaction Reports and Analysis Centre (PPATK), is a crucial issue within the human rights (HAM) paradigm because it restricts individual ownership rights and economic freedom. This study aims to analyse the legitimacy of account blocking without a court decision and to examine PPATK's legal standing among customers, banks, and law enforcement officials. Using a normative juridical method with a statutory and conceptual approach, this study finds that the PPATK does not have attributive authority to block accounts directly but rather has the authority to request a "temporary suspension of transactions" from financial service providers. As a key finding, this study identifies four parameters for assessing the legitimacy of blocking and ensuring it does not violate human rights: the principles of legality, necessity, proportionality, and procedural justice (due process of law). The analysis indicates that the policy of blocking passive (dormant) accounts solely based on administrative status, without any indication of criminal activity, exceeds its authority and contradicts the principles of legality and consumer protection. Therefore, this study recommends applying the Regulatory Impact Assessment (RIA) instrument in formulating blocking policies to ensure transparency, accountability, and a balance between eradicating financial crimes and protecting citizens' basic rights.

Abstract

The expansion of mining investments within the framework of national economic development is often accompanied by an increased risk of environmental damage that is difficult to prove through conventional means, especially in remote areas with complex licensing. This condition raises the issue of the effectiveness of evidence in environmental criminal law enforcement, considering that ecological crimes often occur covertly and require precise scientific analysis. This study examines the main problem of how geospatial technologies such as high-resolution satellite imagery, GIS-based mapping, LiDAR, and drone monitoring can serve as geo-forensic instruments to strengthen criminal evidence in mining cases. Using a normative research method, this study analyses the evidentiary regulatory framework in the 2009 Environmental Protection and Management Law (UU PPLH) and the scientific evidentiary standards in judicial practice. It juxtaposes them with actual case studies of mining crimes in Indonesia. The results of the study indicate that geospatial evidence has strong evidentiary value because it can present digital traces of environmental damage in real time and with traceability; however, there are still normative challenges related to data authentication, the digital chain of custody, and the capacity of law enforcement officials. This research concludes that there is a need to construct a Geo-Forensic Criminal Law as a modern evidentiary framework that integrates geospatial science into the environmental criminal evidence system to improve accuracy, effectiveness, and legal certainty in the supervision of the mining industry

Abstract

Business competition law requires the creation of national economic efficiency and the effectiveness and efficiency of business activities as contained in the purpose of the establishment of Law No.5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. The effectiveness and efficiency of business activities are directed at creating healthy competition between business actors. While national economic efficiency is directed at fulfilling the needs of the lives of many people with indicators of increasing public welfare. One of the efforts to achieve these two things was done by enacting the de-monopolization policy of State-Owned Enterprises (BUMN), in which state-owned companies that had monopoly rights in certain business sectors, their monopoly rights were revoked by giving opportunities to the private sector to compete. The study of how the de-monopolization policy of SOEs can create a healthy business competition climate for the fulfillment of the needs of the people's lives is the focus of the discussion in this article. The discussion will be conducted using the documentary research method that places secondary data as the main analysis material. Analysis using a legislative approach, and a historical approach will be able to answer the problems that use the principle of benefit and principle of justice that can be used as a government consideration in enforcing the de-monopolization policy of SOEs.
