Abstract

Clemency is a pardon in the form of changes, reductions, reductions, or abolition of the execution of a criminal offense granted by the President. Based on Article 14 Paragraph (1) of the 1945 Constitution of the Republic of Indonesia, it is regulated that the President grants Clemency and Rehabilitation by taking into account the considerations of the Supreme Court. The granting of clemency by the president can have legal implications for the convict who applies for clemency. Decisions taken by the President, whether the decision to grant or reject the request for clemency, will not aggravate the sentence decided by the court. Convicts who get clemency will feel freedom because they can get out more quickly and are free from all obligations to undergo the punishment imposed on them. Although Law No. 22 of 2002 concerning Clemency does not regulate the prohibition of granting clemency to convicted corruption cases, the President should support the spirit of eradicating anti-corruption that has been echoed for a long time. With the granting of the petition for clemency against the convicted corruption case, the Governor of Riau, Annas Maamun, President Joko Widodo has hurt the feelings of the Indonesian people.

Abstract

The aims of the study are to analyse the factors that affected collaborative governance and also efforts to build collaborative governance in spatial planning in the city of Depok. This research used qualitative method with post-positivist approach. The data collection method consists of (1) Primary data which were collected through in-depth interviews with Public Works and Spatial Planning Department of Depok city; Development Planning Board of Depok city; and stakeholders in Depok related to the research problem such as housing developers and social society. (2) Secondary data were collected through the literature and documentation at the Public Works and Spatial Planning Department in Depok city.According to Indonesian laws and regulations Article 26 of 2007 on Spatial Planning, each city in Indonesia is required to have a Green Open Space (GOS) of at least 30 percent of its territory. It is also purposed to increase cooperation of all elements for Depok’s spatial planning.This research indicates that the implementation of collaborative governance in Depok’s spatial planning has not been effective because Depok only has 3227.26 ha GOS less than 30 percent of 202.9 KM² city wide; the economic centralization in one particular region should have been intended for office or municipal services; and the role of government is still dominant in cooperation with stakeholders in spatial planning and management through public discussion, public hearing, and public consultation. Such a condition is influenced by several factors: lack of networked structure; lack of distributive accountability/ responsibility; and the lack of trust among the participants in spatial planning of Depok city. Keywords: collaborative governance, good governance, spatial planning, green open space

Abstract

In the last three years, it has been seen that the level of tourist visits in the City of Bukittinggi has increased significantly. Business actors and the government are also racing to improve tourism infrastructure, including lodging facilities. Based on observations, data was obtained that in 2018 the number of accommodations in the City of Bukittinggi was 107 inns. The number of guests staying in 2016-2017 increased by 1.51%, then in 2017-2018, it increased by 5.66%. This study aims to examine the effect of products and accommodation prices on the purchase interest of tourists in the city of Buktinggi using quantitative descriptive methods. The population used is tourists who have stayed at the accommodation in the city of Bukittinggi, with a sample size of 100 respondents. Primary data was obtained through distributing questionnaires, and secondary data was obtained from the Department of Tourism, Youth, and Sports, by testing the hypothesis of multiple linear regression techniques. The results showed that the products offered affected the purchase interest of tourists, while the price of accommodation did not affect the interest of tourists to stay in the city of Bukittinggi.

Abstract

Law No. 2 of 2002 concerning POLRI is regulated in full and strict regarding the duties and authorities of POLRI, but there are irregularities committed by the POLRI in carrying out its duties. Irregularities committed by POLRI is a violation of the code of ethics that is rarely heard but occurs a lot in POLRI members who are in certain cities that have a dense population. Efforts to enforce the Polri Professional Code of Ethics are needed for the realization of the implementation of the duties charged to the professionalism of POLRI. Unprocompany will greatly impact law enforcement or disclosure of crimes that occur in the community. In the framework of eradicating narcotics syndicates that have so widespread to the Unitary State of the Republic of Indonesia (NKRI), police officers have a very large role and responsibility to maintain the security and stability of the Republic of Indonesia, but facts and reality speak another that it turns out that the police themselves are the perpetrators of criminal acts of the syndicate. There has been a case that happened that the suspect is a police officer.  Therefore, it is not surprising that the perpetrators of narcotics abuse crimes are increasing even among the general public but also law enforcement officials, especially the police.Keywords:  Role, Police, Countermeasures, Narcotics Crimes

Abstract

Penelitian ini bertujuan untuk melihat bagaimana kegiatan pelatihan bagi karyawan pada saat pandemi covid 19 dengan jenis penelitian kualitatif melalui wawancara terhadap tiga orang informan selaku Human Resource Manager. Adapun hasil penelitian menunjukkan bahwa Pelatihan karyawan tetap harus jalan meski dalam kondisi pandemi virus corona agar produktivitas kerja karyawan tetap terjaga, pelatihan karyawan dapat dilakukan secara online, baik untuk kegiatan internal perusahaan, maupun kegiatan eksternal perusahaan, pelatihan karyawan juga dapat dilakukan oleh perusahaan dengan membangun portal e-learning

Abstract

Perubahan UUD 1945 membawa implikasi terhadap perubahan kekuasaan atau kewenangan kelembagaan MPR yang membawa akibat pada kedudukan hukum ketetapan MPRS/MPR yang dilahirkannya, baik itu sebelum dan sesudah perubahan UUD 1945. Kajian penelitian ini dilakukan dengan melakukan studi kepustakaan. Untuk itu metode yang digunakan adalah metode penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa dalam praktik ketatanegaraan sepanjang berlakunya UUD 1945 sebelum dilakukan perubahan, cakupan luas materi muatan yang diaturnya tidak hanya terbatas pada hal-hal ditentukan dalam UUD 1945. Jika diklasifikasikan, ada Ketetapan MPR yang memenuhi unsur sebagai peraturan perundang-undangan, Ketetapan MPR sejenis penetapan administrasi Negara (beschikking), Ketetapan MPR berupa perencanaan (GBHN), dan Ketetapan MPR semacam peraturan kebijakan (beliedregels) di bidang administrasi negara. Setelah UUD 1945 dilakukan perubahan, maka kedudukan hukum Ketetapan MPR menjadi sumir, di satu sisi perubahan pasal-pasal UUD 1945 dan adanya ketentuan Pasal 1 Aturan Tambahan UUD 1945 mengakibatkan hilangnya kewenangan MPR untuk membentuk Ketetapan-Ketetapan MPR (jenis peraturan perundang-undangan) bersifat mengatur (regeling), karena tidak lagi memiliki dasar konstitusioanal dalam UUD 1945. Namun di sisi lain dengan diberlakukannya UU Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan, kedudukan hukum Ketetapan MPR menjadi hidup kembali sebagai bentuk peraturan perundang-undangan dengan pembatasan sebagaimana disebut dalam penjelasan Pasal 7 ayat 1 huruf b, yakni Ketetapan-ketetapan MPRS/MPR yang masih berlaku sebagaimana ditentukan dalam Ketetapan MPR Nomor 1/MPR/2003.

Abstract

Disposal of feces is one of the waste materials that brings many problems in the health sector such as the increased risk of infectious diseases. Provision of feces disposal facilities is closely related to the level of economy, education and knowledge. Based on the initial survey of 20 houses in Ganting Parak Gadang, 15 houses (75%) did not have latrines. The purpose of this study is to find out the Factors Associated with Community Participation with Family Latrine Ownership in Ganting Parak Gadang Padang Timur District, Padang City in 2019. From the results of the univariate analysis showed that most (78.4%) families did not have latrines and from the results of observations found 21 families had latrines that met the requirements. Most (57.5%) respondents stated that the role of health workers was not good as a result of bivariate analysis showed that there was a significant relationship between the economic level and latrine ownership (P Value = 0.026): OR = 4.579). Multivariate results show that the most related are the economic level and the role of officers (P value= 0.000). It is recommended to health workers in Ganting Parak Gadang health center in Padang Timur City, Padang City Extension to family heads who do not have family latrines to immediately build family latrines and will have an impact on health if they do not have latrines and provide counseling to the community so as to increase community awareness family toilet.Keywords: Latrine Procurement, Knowledge Level, Education, Economy.

Abstract

Pt. Bank Riau is a continuation of the business activities of PT. BAPERI (PT. Riau Regional Development Bank) which was established based on the Notary Deed of Syawal Sultan No. 1 dated August 2, 1961, and the permission of the Minister of Finance of the Republic of Indonesia.No. BUM 9-4-45 dated August 12, 1961. Furthermore, with the Decree of the Governor of KDH. TK.I Riau No. 51/IV/1966 April 1, 1966, it was stated that all activities of PT. BAPERI was merged into the Riau Regional Development Bank in accordance with Law Number 13 of 1962, officially the activities of the Riau Regional Development Bank began with the status as a Bank Owned by the Government of the Riau Province. Various changes and developments in the Bank's activities, and since 1975 the status of the establishment of the Riau Regional Development Bank, Decree of the Deputy Governor of Bank Indonesia No. 5/30 / KEP.DGS / 2003 dated 22 July 2003, the legal entity status of the Riau Regional Development Bank changed from a Regional Company (PD) Regional Development Bank of Riau to a Limited Liability Company (PT). Bank Pembangunan Daerah Riau was abbreviated as PT. Bank Riau as of August 1, 2003. This research aims to Analyze the Influence of the Incentive Factor on improving the work performance of employees at PT. Bank Riau, Perawang Sub-Branch. The number of research samples are all All employees of PT. Bank Riau, Perawang Sub-Branch, as many as 60 with the sampling method saturated sampling technique or census. Saturated sampling or census is a sampling technique when all members of the population are used as samples.Meanwhile, the leadership is used as the key information in this study. Research result shows The influence of incentives on increasing work performance having a significant influence and positive means that there is a strong positive relationship between incentives and increased work performance of employees of PT. Bank Riau Perawang Sub-Branch, through regression model, the incentive variables and the indicators in the study, are able to contribute to an increase in work performance by 88.36%, and the remaining 11.64% is influenced by other factors who were not examined in this study. Abstract

The purpose of this study was to find out the management of local government budget in Kamang Magek Subdistrict, Agam Regency. This research is a descriptive analysis using a qualitative approach that uses primary data and secondary data. The technique of collecting data is in the form of field research by means of interviews, focus group discussions (FGD), and documentation studies with valid and accurate sources. The results of the study showed that the management of local government budget has not fully run well this is because there are still obstacles faced in accordance with Permendagri Number 113 of 2014 and Perbub Agam Number 8 of 2017. (1) Implementation of the principle of transparency consists of indicators, namely openness in meetings, openness of information, openness of procedures, and openness in accepting community participation. (2) Implementation of the principle of participation consists of indicators, namely the existence of active public participation, the existence of regulations that provide a place for community control, and the presence of proactive attitudes of regional governments in the budgeting process. (3) Implementation of the principle of accountability consists of indicators, namely the existence of honesty and legal accountability, the existence of process accountability, the existence of program accountability, and the existence of policy accountability

Abstract

The role and character of state institutions and the public sector are more directed to be oriented towards the community. This condition initially occurred in various developed countries, which then spread to developing countries. Of course, many factors caused this to happen, such as the economic and financial crisis of the state. Public administration reform towards public service is important enough to get attention and treatment as soon as possible. The dynamics of society as a social force cannot be ignored in the system of control and public accountability, both in service delivery and in the implementation of development. The purpose of this study is to find out the New Public Service paradigm as a new concept in administrative reform in the education, health and economic sectors of the local government. The results of the study indicate that public services in the education, health, and economic sectors of today's society are facing a trend towards the development of regional governance as a result of globalization and regional autonomy. In the management of local government, a change and renewal is needed so that the government can always accommodate the needs of change in society and enable public administration to reorganize people's lives. One of the trends in the need for public bureaucracy to reform is that local government bureaucracies must be more open in relation to the public interest. In other words, the local government bureaucracy can become more flexible so that it can more easily adapt to changing circumstances. With the administrative reform towards public service, it is hoped that it can encourage the realization of good governance, improve performance and improve unhealthy administrative practices.
