Abstract

Clemency is a pardon in the form of changes, reductions, reductions, or abolition of the execution of a criminal offense granted by the President. Based on Article 14 Paragraph (1) of the 1945 Constitution of the Republic of Indonesia, it is regulated that the President grants Clemency and Rehabilitation by taking into account the considerations of the Supreme Court. The granting of clemency by the president can have legal implications for the convict who applies for clemency. Decisions taken by the President, whether the decision to grant or reject the request for clemency, will not aggravate the sentence decided by the court. Convicts who get clemency will feel freedom because they can get out more quickly and are free from all obligations to undergo the punishment imposed on them. Although Law No. 22 of 2002 concerning Clemency does not regulate the prohibition of granting clemency to convicted corruption cases, the President should support the spirit of eradicating anti-corruption that has been echoed for a long time. With the granting of the petition for clemency against the convicted corruption case, the Governor of Riau, Annas Maamun, President Joko Widodo has hurt the feelings of the Indonesian people.

Abstract

In order for legal entities to interact in legal relationships such as making agreements, conducting certain business activities requires capital. The initial capital of the legal entity came from the founder's wealth which was separated. The initial capital becomes the wealth of the legal entity, regardless of the founder's wealth. This article looks at how the separation of limited company wealth from the wealth of shareholders, board of commissioners and board of directors. The research methodology used is the normative juridical research method. Company Organs are the General Meeting of Shareholders, Directors and Board of Commissioners (Article 1 number 2 of the Company Law). The Board of Directors is the Company's Organ which has the authority and is fully responsible for the management of the Company for the interests of the Company, in accordance with the aims and objectives of the Company and represents the Company, both inside and outside the court in accordance with the provisions of the articles of association (Article 1 number 5 of the Company Law). Whereas the Commissioners are the Company's Organs whose duty is to supervise general and / or specifically in accordance with the articles of association and provide advice to the Directors (Article 1 number 6 of Company Law). In PT, the shareholders delegate their authority to the directors to run and develop the company in accordance with the objectives and business fields of the company. In connection with this task, directors are authorized to represent the Company, enter into agreements and contracts, and so on. If there is a very large loss (above 50%) then the board of directors must report it to the shareholders and third parties, and then close it together. Abstract

One of the potential Regional Taxes to increase Local Revenue in Pelalawan Regency is the Parking Tax. Parking Tax is a tax on the operation of a parking space outside a body of a road, whether provided in connection with the principal of the business or that is provided as a business, including the provision of motorized vehicle day care. This research aims to explain the law enforcement of the implementation of the Parking Tax in Pelalawan Regency based on Pelalawan District Regulation Number 1 of 2011 concerning Regional Taxes. The method used in this research is socio-legal research. Parking Tax Implementation in Pelalawan Regency has not run optimally because in 2017 it is known that the Ramayana Pangkalan Kerinci and Kerinci Business Center do not deposit Parking Taxes. The efforts made by the Pelalawan Regency Financial and Asset Management Agency to maximize Local Tax revenue are forming a Regional Tax Control and Billing Task Force. Article 130 of Pelalawan District Regulation Number 1 of 2011 concerning Regional Taxes stipulates that a sanction of 400% (four hundred percent) of the principal tax payable will be imposed if any taxpayer who deliberately does not deposit the collected tax will cause losses on regional finance.

Abstract

Based on Article 11 of Riau Provincial Regulation Number 6 of 2012 it is stated that the corporate social responsibility work field can be carried out in the fields of education, health, infrastructure, sports and arts, social and religious culture, environmental preservation, populist economic enterprises, empowerment of indigenous peoples, and other fields of work that significantly impact on improving the quality of society. The problem in this research is how is the implementation of corporate social responsibility of PT Asia Forestama Raya towards improving the economy of the community based on Riau Provincial Regulation Number 6 of 2012? What are the obstacles in the implementation and how are the efforts to overcome these obstacles? The method used in this research is socio-legal research. The results of this research that PT Asia Forestama Raya did not implement corporate social responsibility to empower the economy of the community in the District of Rumbai Pesisir, Pekanbaru City. The obstacles in the implementation are from the company point of view, namely the financial condition of PT Asia Forestama Raya is currently in an unstable condition so that for three years there has not been implemented a community economic empowerment program, from the community point of view, namely the lack of community knowledge regarding Riau Provincial Regulation Number 6 Year 2012, while from the government side, there is still weak supervision of the implementation of corporate social responsibility of PT Asia Forestama Raya. Efforts to overcome these obstacles are based on Article 32 of Riau Provincial Regulation Number 6 of 2012 which states that if PT Asia Forestama Raya does not implement corporate social responsibility, then the company may be subject to administrative sanctions in the form of written warnings from the Pekanbaru City Government and restrictions on business activities, suspension of business licenses, up to revocation of business licenses.

Abstract

PT Asia Forestama Raya is a forest product processing factory for the wood industry's raw materials. Based on Article 74 Paragraph (1) of Law Number 40 of 2007 concerning Limited Liability Companies, it is stipulated that companies that carry out their business activities in the natural resources sector and / or fields related to natural resources are required to implement CSR. In Article 10 of Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility in Riau Province, it is stated that CSR programs can take the form of community economic empowerment. This research aims to explain the implementation of PT Asia Forestama Raya's CSR on community economic empowerment during the Covid-19 pandemic. The method used in this research is socio-legal research. During the Covid-19 pandemic, the public really expected a real contribution from PT Asia Forestama Raya. PT Asia Forestama Raya's obstacle in implementing community economic empowerment in Limbungan Village is that the financial condition of PT Asia Forestama Raya is currently in an unstable state. Efforts that can be made by the people of Limbungan Village if PT Asia Forestama Raya doesn’t carry out a CSR program are to convey their aspirations to Commission IV of DPRD Pekanbaru City. Based on Article 32 of Riau Provincial Regulation Number 6 of 2012 concerning Corporate Social Responsibility in Riau Province, it is stated that if PT Asia Forestama Raya doesn’t carry out CSR towards empowering the community's economy, the company can be subject to administrative sanctions by the Pekanbaru City Government.

Abstract

Initially, the scope of Copyright protection only focuses on creative works that are manifested in real terms. The development and advancement of technology make the scope of Copyright protection experience an expansion not only in copyrighted works that are realized in a real form but also protect copyrighted works that are digitized on internet media. The problem discussed in this research is how law enforcement to Copyright infringement of songs on the internet media is? The method used in this research is normative legal research using the regulatory approach. The results of this research indicate that the development and advancement of technology can facilitate the dissemination of songs in MP3 format uploaded on internet media. To prevent the occurrence Copyright infringement of songs on the internet media, in Law Number 28 of 2014 has been stipulated  strict criminal sanctions for anyone without permission who has violated the Copyright, especially the economic rights of the owner. Keywords: Copyright, Internet Media, Law Enforcement

Abstract

A company that carries out its business activities in the field and/or related to natural resources is obliged to carry out its Corporate Social Responsibility (CSR). This research was conducted at PT Riau Crumb Rubber Factory which is located in Sri Meranti Village. Raw rubber production activities into semi-finished rubbers have been routinely generating pollution for the environment and society, such as air pollution and water pollution. The problem is how the implementation of CSR PT Riau Crumb Rubber Factory to the community of Sri Meranti Village in Pekanbaru City? What are the obstacles and the legal effort based on Riau Province Regional Regulation Number 6 Year 2012? This research is a sociological law research. Source of data used in this research is primary data and secondary data. Data collection techniques used in this study are observation, interview, and literature study. Data analysis technique used in this research is qualitative analysis. The result of this research is PT Riau Crumb Rubber Factory has implemented CSR, but has not fulfilled the expectation the community of Sri Meranti Village because it is not comparable with the pollution and environmental damage caused by the company's operational activities. The obstacle from the company side is the limited budget of CSR funds owned by PT Riau Crumb Rubber Factory to be able to meet all the needs of the community, while from the community side is the lack of legal knowledge of the community of Sri Meranti Village about CSR. The legal effort is that if PT Riau Crumb Rubber Factory does not implement CSR, the community of Sri Meranti Village can convey their aspirations to the DPRD of Riau Province for the company to be recommended to get administrative sanction from the government, such as the suspension of operational license of the company.

Abstract

Bank syariah adalah bank yang menjalankan kegiatan usahanya berdasarkan prinsip-prinsip hukum Islam dalam kegiatan perbankan berdasarkan fatwa yang dikeluarkan oleh Dewan Syariah Nasional Majelis Ulama Indonesia. Penelitian ini bertujuan untuk menjelaskan perkembangan perbankan syariah di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan. Hasil dari penelitian ini adalah bahwa prakarsa mengenai pendirian bank syariah di Indonesia mulai dilakukan sejak tahun 1990 oleh Majelis Ulama Indonesia, yang diwujudkan dengan berdirinya Bank Muamalat Indonesia pada tanggal 1 November 1991. Perkembangan awal perbankan syariah dalam sistem perbankan nasional direspon dengan cepat oleh pemerintah dengan disahkannya Undang-Undang Nomor 7 Tahun 1992 tentang Perbankan, yang kemudian diubah dengan Undang-Undang Nomor 10 Tahun 1998. Selain menjadi kehancuran bagi sistem perbankan nasional, krisis ekonomi yang terjadi tahun 1998 juga menjadi titik tolak perkembangan perbankan syariah di Indonesia. Beberapa bank konvensional mulai mengembangkan usahanya dengan mendirikan bank syariah. Merespon perkembangan perbankan syariah yang signifikan dalam sistem perbankan nasional, maka pada tanggal 16 Juli 2008 disahkan Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah sebagai landasan hukum tersendiri bagi bank syariah di Indonesia.

Abstract

This research aims to explain the implementation of the company's CSR program in empowering the economy of rural communities during the Covid-19 pandemic based on Riau Provincial Regulation Number 6 of 2012. The method used in this research is socio-legal research. The results of this research explain that the Covid-19 Pandemic that hit Riau Province had an impact on the economy of the community, including the people of Palas Village. Apart from expecting financial assistance from the government, one of the opportunities that the Palas Village community can take advantage of to develop the village economy is to take advantage of the CSR programs of companies operating in Pelalawan Regency. Companies that carry out their business activities in the field of natural resources and / or fields related to natural resources are required to carry out CSR. Based on Article 32 of Riau Provincial Regulation Number 6 of 2012, it is stated that companies that don’t implement CSR are subject to administrative sanctions in the form of written warnings and restrictions on business activities, freezing of business activities, and revocation of business activities.

Abstract

Permasalahan mitra dalam kegiatan pengabdian kepada masyarakat ini adalah minimnya pemahaman karyawan PT Asia Forestama Raya mengenai perlindungan hak-hak tenaga kerja kontrak berdasarkan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Solusi yang ditawarkan dalam kegiatan pengabdian kepada masyarakat ini adalah peningkatan pemahaman karyawan PT Asia Forestama Raya mengenai perlindungan hak-hak tenaga kerja kontrak berdasarkan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Metode pelaksanaan yang digunakan dalam kegiatan pengabdian kepada masyarakat ini adalah dengan menggunakan metode ceramah, dialog, dan diskusi dalam rangka memberikan penyuluhan hukum. Partisipasi mitra dalam kegiatan pengabdian kepada masyarakat ini adalah dengan menyediakan waktu, menyediakan tempat beserta fasilitas pendukungnya, dan menghadirkan karyawan sebagai peserta kegiatan. Target luaran dari kegiatan pengabdian kepada masyarakat ini adalah draft artikel ilmiah yang rencananya akan dipublikasikan pada jurnal nasional tidak terakreditasi. Kesimpulannya bahwa kegiatan ini telah berhasil dilaksanakan dan manfaatnya dapat dirasakan langsung oleh para peserta. Hal ini dapat dilihat dari jawaban para peserta pada kuisioner yang diberikan setelah kegiatan dilaksanakan. Dari 31 orang peserta, 83,2% menjawab telah memahami materi yang disampaikan. Sarannya adalah sebaiknya kegiatan dengan tema ini dilaksanakan tidak hanya kepada karyawan PT Asia Forestama Raya, tetapi juga di perusahaan-perusahaan lainnya yang ada di Kota Pekanbaru.
