Abstract

Narcotics are substances or drugs derived from plants or non-plants, both synthetic and semisynthetic, which can cause a decrease or change in consciousness, loss of taste, reduce to eliminate pain, and can cause dependence, which are divided into groups as follows: attached in Law no. 35 of 2009 concerning Narcotics. Drug abuse (narcotics and dangerous drugs) is an international crime and an extra ordinary crime (extraordinary crime). This extraordinary crime is a crime that has a systematic impact on people's lives. The process of investigating the problem of narcotics crime is a method of investigation or a system used to find and collect evidence in order to find the suspect and determine related criminal acts that occurred in accordance with the Criminal Procedure Code. After the investigative action, the criminal justice system switches to investigative action in accordance with the mandate of Law Number 35 of 2009 concerning Narcotics. The legal politics of investigation in Law Number 35 of 2009 concerning Narcotics can be seen from the scope of criminal law which includes three provisions, namely criminal acts, liability, and sentencing. In the process of drafting this Narcotics Law, there is a legal policy policy from legislation which mandates four categorizations of unlawful acts that are prohibited by law and can be threatened with criminal sanctions.

Abstract

Local elections or regional head elections are a means of implementing popular sovereignty in the regions. This is part of the development of the government administration system of the Republic of Indonesia experiencing various changes. The change in question is the principle of autonomy which means the freedom to regulate their own regions in each region. One of the challenges in carrying out this Pilada is a violation that results in a criminal offense. The formulation of this research is: 1) What is the form of the type of criminal case for the election of Regional Head in the general court environment? 2) how to apply the principle of simple, fast, low cost in the resolution of criminal cases in the election of Regional Heads 2020 in the general court environment. The research method used is normative juridical. The results showed, first there were 36 types of criminal cases in the election of regional heads in the general court environment, for this reason the Supreme Court issued a regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2018 concerning Procedures for Settling Election and Election Criminal Acts. Second, the application of the principle of simple, fast, low cost in the resolution of criminal cases in the election of Regional Heads 2020 in the general court environment by combining several cases that are closely related. That is assessed from 36 types of post-conflict local election criminal acts that can be combined in one type in a practical and rational manner. Abstract

Pajak merupakan sektor vital yang sangat berpengaruh terhadap pendapatan Negara. Pajak dibebankan kepada setiap warga Negara yang memiliki kewajiban membayar pajak. Seiring berjalannya waktu, semakin banyak warga Negara yang memiliki kewajiban perpajakan. Dan pada kenyataannya masih banyak Wajib Pajak yang belum memenuhi kewajiban perpajakan. Ini didasarkan pada kesadaran Wajib pajak yang masih kurang akan pentingnya melaksanakan kewajiban perpajakan. Hasil penelitian menunjukkan bahwa, faktor-faktor ketidakpatuhan Wajib Pajak dalam membayar pajak yaitu, karena kurangnya pemahaman mengenai peraturan perpajakan, kurangnya penegakan sanksi perpajakan. Kemudian kesadaran Wajib Pajak yang belum memahami akan manfaat dari pajak, serta pelayanan pajak yang belum maksimal.

Abstract

Beragam bentuk pelanggaran HAM yang terjadi di sekolah telah memunculkan keprihatinan nasional yang harus direspon dengan cepat, tepat, dan benar. Respon tersebut sangat diperlukan agar kasus-kasus serupa tidak lagi muncul di masa depan. Beberapa cara dan upaya telah ditempuh kementerian / lembaga untuk menghapus kasus-kasus pelanggaran HAM di sekolah. Tapi, upaya tersebut belum mampu menunjukkan hasil yang optimal. Persoalannya karena upaya tersebut dijalankan secara sektoral, tematik, tidak terintegratif, tidak partisipatif, dan tidak berkelanjutan. Artikel ini menggunakan metodologi penelitian hukum normatif. Hasil penelitian menunjukan bahwa Sekolah Ramah HAM / Human Rights Friendly School (SRH) merupakan pendekatan baru dan berbeda untuk menyelesaikan beragam pelanggaran HAM di sekolah. SRH adalah sebuah sekolah yang mengintegrasikan nilai-nilai HAM sebagai prinsip- prinsip inti dalam organisasi dan pengelolaan sekolah. Nilai  atau prinsip hak asasi manusia merupakan inti atau ruh dari proses dan pengalaman pembelajaran, dan tercermin dalam segala aspek. Sendi kehidupan sekolah. Pendekatan konsep SRH yang dipadukan dengan konsep pendidikan, diharapkan mampu memberikan jawaban riil untuk menyelesaikan beragam persoalan HAM yang ada di sekolah. Implementasi Konsep SRH akan berjalan optimal bila dilakukan secara sungguh-sungguh oleh Kementerian Pendidikan dan Kebudayaan dengan dukungan Komisi Nasional Hak Aasai Manusia (Komnas HAM), kementerian/lembaga terkait, masyarakat, para tokoh agama, tokoh masyarakat, lembaga-lembaga internasional, dan partisipasi aktif dari seluruh stake holder yang terkait dengan sekolah.

Abstract

Definition of customary law community, a unit whose members: 1) Behave and behave as a unit towards the outside world, 2) Have a fixed and eternal structure. In the community there is no thought to dissolve the community, 3) The residents respect the life of the group as a natural thing. Customary law communities are formed naturally (natural nature), 4) Have separate property from their citizens, 5) Have authority and coercive power in the creation and development of the law (have institutions and sanctions). On May 16, 2013, the Constitutional Court issued a decision No. 35/PUU-X/2012 regarding the review of the Forestry Law. The petitioners in this case are the Alliance of Indigenous Peoples of the Archipelago (AMAN), the Indigenous Peoples of Kenegerian Kuntu, Kampar Regency, Riau Province and the Indigenous Peoples of Kasepuhan Cisitu, Lebak Regency, Banten Province. Constitutional Court Decision No. 35/PUU-IX/2012 is an important decision because it overturns the classic understanding in Indonesia about forests, forest areas and the position of customary forests. In essence, the Constitutional Court's decision concerns two constitutional issues, first regarding customary forests and secondly regarding the conditional recognition of the existence of indigenous peoples. The decision granted the request relating to customary forests, but rejected the request to abolish the conditions for recognizing the existence of indigenous peoples contained in the Forestry Law.Keywords: Customary Law Society, Positive Law, Indonesia.

Abstract

Seperti yang kita ketahui, bangunan dengan denah yang rumit tidak di anjurkan karena memiliki risiko yang sangat tinggi untuk collaps jika terjadi gempa. Dalam proses analisis ini model bangunan di bagi menjadi 4 model struktur yaitu model tanpa dilatasi (utuh dengan denah H) dan dengan dilatasi di bagi menjadi 3 bagian yang di sebut bangunan A,  B , dan C. Semua model di desain dengan sistem ganda, SRPMK dan shere wall. Dari hasil analisa struktur di dapatkan bahwa dinding geser sangat berpengaruh pada simpangan antar lantai yang terjadi pada bangunan dilatasi dan tanpa dilatasi, yang mana di dapatkan dicplacement pada bangunan berpengaruh pada jarak dilatasi yang diberikan sebesar 150 mm. Gaya dalam yang terjadi pada kolom dan balok juga menunjukkan hasil yang signifikan terutama pada kolom dengan struktur tanpa dilatasi di banding kan menggunakan dilatasi. Di mana Kolom tanpa dilatasi setelah di analisis gaya dalamnya menggunakan program bantu sp colomn  menunjukkan hasil kebutuhan tulangan sebanyak (36 D36) buah tulangan dengan dimensi kolom 850 x 850 mm. Sedangkan di bangunan dengan dilatasi hanya membutuhkan tulangan sebanyak (24 D36) buah tulangan dengan dimensi yang sama.Kata Kunci: Sistem Dilatasi

Abstract

The implementation of regional government functions will be carried out optimally if the administration of government affairs is followed by providing adequate sources of revenue to the regions, with reference to the Law on Financial Balance between the Central Government and Regional Governments, where the amount is adjusted and harmonized with the division of authority between the government and the regions. All financial sources attached to every government affair that are handed over to the regions become a source of regional finance. Local government finance is a very decisive factor in the administration of local government. Regional financial capacity is determined by the existence of regional income sources and their lucrative level. The lucrative level of local revenue sources is determined by the extent to which the tax base is responsive to inflation, population growth and economic growth. In general, developed countries that implement decentralization policies tend to give greater authority to regions to manage lucrative sources of income. On the other hand, in developing countries, lucrative financial resources are controlled by the center. Local governments only manage financial resources that have less potential.

Abstract

The government program makes a policy on School Operational Assistance (BOS) which is basically to provide funding for non-operational costs for basic education as an organizer of 9-year compulsory education. SDN 08 Padang Besi, Padang City, one of which received School Operational Assistance (BOS) funds. This research uses descriptive qualitative method, with purposive sampling technique. Collecting data by library method, interview, observation and literature review. This study uses the theory of George C. Edward III because the indicators are in accordance with the research. The formulation of the research problem is how the government's policy in School Operational Assistance (BOS) regarding the financing of 9-year compulsory education at SDN 08 Padang Besi, Padang City, is the obstacle in government policy on School Operational Assistance (BOS) regarding the financing of 9-year compulsory education at SDN 08 Padang Besi, Padang City, how are the efforts made to overcome the obstacles in the government's policy on School Operational Assistance (BOS) regarding the financing of 9-year compulsory education at SDN 08 Padang Besi, Padang City. The results showed that the policy had not been effective, it happened because not all policies were implemented by SDN 08 Padang Besi, Padang City. The lack of resources, both inadequate human resources from experts, both from facilities and infrastructure resources to support the implementation of services, and from elements service communication that has not been maximized and the attitude of the implementer who has not been committed to carrying out their duties. And finally, the need for SDN 08 Padang Besi, Padang City to fix the online service system during the corona virus 19 pandemic. The conclusion is that the policy carried out by SDN 08 Padang Besi Padang City is basically to help underprivileged students in financing 9-year compulsory education so that students those who are less able can receive learning well in the teaching and learning process at SDN 08 Padang Besi, Padang City.

Abstract

While the variable impact of a reduction in the three variables: the variable X2.4, X2.6 and X2.19, because communalitiesnya test value <0.5 and variables that pass the test can form the 4 factors were grouped into Positive Economic Impact factor, factor Social impact Positive factors Negative impact of Economic and Social Negative impact factor, it is obtained through a loading factor. Abstract

Provisions in law, marriage must be carried out by fulfilling the requirements and pillars of marriage. One of the requirements of the marriage is an agreement between the parties who want to carry out the marriage, including knowing the identity of each party. This means that the marriage is prohibited if it does not meet the requirements, while such a marriage which has already been (already) implemented can be annulled. Based on Article 1 of Law Number 1 of 1974, marriage is an inner and outer bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on the One Godhead. The purpose of marriage is to form a happy and eternal family with the intention of obtaining legal offspring, marriage also aims to live together with the community in a family bond. Marriage is not only a medium to realize the fulfillment of biological needs, but also in the context of worship and draw closer to God. The desire to marry will be very evident when a person has reached adulthood, namely the desire to live together between the opposite sex in a marriage bond as a means to carry out their offspring. The fact of life in pairs is explained by Allah SWT in the Qur'an Surah Addzariat verse 49 which means: And everything We created in pairs so that you remember the greatness of Allah. Marriage is regulated by religious law, so someone who will carry out a marriage must be guided by the rules regarding marriage that have been outlined by his religious law, as regulated in Article 2 paragraph (1) of Law no. 1 of 1974 which states that marriage is legal if it is carried out according to the law of each religion and belief. What is meant by the law of each religion and belief as long as it does not contradict or is not stipulated otherwise in this law.Keywords: Legal Marriage, Law, Positive Law, Indonesia.
