Surat dakwaan dalam hukum acara pidana sangat penting karena merupakan dasar pemeriksaan di sidang pengadilan. Pemeriksaan yang dilakukan oleh hakim terbatas pada apa yang didakwakan penuntut umum. Penyusunan rumusan surat dakwaan mesti cermat dan tepat agar tidak ada lubang bagi terdakwa untuk terlepas dari pertanggung jawaban hukum atas tindak pidana yang dilakukannya. Dari rumusan tersebut dapat dilihat bahwa surat dakwaan yang dibuat oleh penuntut umum yang berisi identitas terdakwa/para terdakwa. Syarat materiil, menyebutkan waktu dan tempat tindak pidana dilakukan; memuat uraian secara cermat, jelas, dan lengkap mengenai tindak pidana yang didakwakan

Larangan berpoligami dengan saudara sekandung isteri secara eksplisit diatur dalam Pasal 8 huruf e Undang-Undang Perkawinan dan Pasal 41 ayat (1) KHI. Pelanggaran terhadap larangan perkawinan itu oleh Undang-Undang Perkawinan maupun KHI tentunya menimbulkan implikasi hukum. Pelanggaran syarat-syarat perkawinan memberikan wewenang kepada pihak tertentu atau pejabat yang berkepentingan untuk mengajukan pembatalan perkawinan ke pengadilan. Berdasarkan hal tersebut, perlu dilakukan analisis terkait dengan pembatalan perkawinan dalam putusan Pengadilan Agama Pandan No. 34/Pdt. G/2011/PA. Pdn. Permasalahan dalam penelitian ini, mengenai bagaimana pengaturan tentang pembatalan perkawinan poligami yang dilakukan dengan saudara kandung isteri ditinjau dari undang-undang perkawinan dan Kompilasi Hukum Islam? Bagaimana pertimbangan hukum hakim terkait dengan pembatalan perkawinan poligami yang dilakukan dengan saudara kandung isteri dalam Putusan Pengadilan Agama Pandan Nomor : 34/Pdt.G/2011/PA. Pdn? Bagaimana akibat hukum yang akan ditimbulkan dari pembatalan perkawinan poligami yang dilakukan dengan saudara kandung isteri berdasarkan Putusan Pengadilan Agama Pandan Nomor : 34/Pdt.G/2011/ PA. Pdn? Metode penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan undang-undang, pendekatan konseptual dan pendekatan kasus. Sumber data penelitian ini terdiri dari data primer dan data sekunder. Penelitian ini bersifat deskriptif analitis dengan menggunakan analisis data kualitatif. Kesimpulan, pembatalan perkawinan poligami dengan saudara kandung isteri didasari pada ketentuan Pasal 8 huruf e Undang-Undang Perkawinan jo Pasal 41 Ayat (1) KHI dan syariat Islam. Terhadap pelanggaran pasal-pasal tersebut Undang-Undang Perkawinan dan KHI memberikan wewenang kepada pihak-pihak tertentu atau pihak yang mempunyai kepentingan hukum untuk mengajukan pembatalan perkawinan ke pengadilan. Pertimbangan hakim dalam mengabulkan permohonan pembatalan yang diajukan oleh pemohon, didasari pada kedudukan hukum (legal standing) pemohon, kemudian dalil-dalil permohonan pemohon, keterangan para Termohon dan alat-alat bukti serta saksi-saksi yang diajukan oleh pemohon. Pembatalan perkawinan pada putusan Putusan Pengadilan Agama Pandan Nomor: 34/Pdt.G/2011/PA. Pdn, menimbulkan akibat hukum batalnya perkawinan Termohon I dan Termohon II, karena bertentangan dengan hukum islam dan peraturan perundang-undangan yang berlaku.

According the Batak adat (customary) law, the validity of transaction should meet three elements: in cash, real, and transparent. People in Baktiraja Sub-district still do land transaction based on adat law. It is made in a letter on embossed stamped paper signed by the seller and the buyer and witnessed by a village head although this method is rarely done today. The research problems are as follows: what factors which cause the implementation of land transaction is done based on adat law, how about the legality of land transaction based on adat law, and how about the resolution of any dispute in land transaction based on adat law in the people in Baktiraja Sub-district, Humbang Hasundutan Regency.The research used juridical empirical method. The data were obtained from primary, secondary, and tertiary legal materials. They were gathered by conducting library research and field research as well as interviews and analyzed qualitatively.The result of the research shows that some factors which cause land transaction is based on adat law in the people in Baktiraja Sub-district are legal factor since there is no PPAT (Official Empowered to Draw up Land Deeds) and non-legal factor since in tradition the implementation is easy, simple, and affordable. Land transaction in Baktiraja Sub-district is valid because it meets material requirement as it is specified in Article 1320 of the Civil Code. Any dispute in land transaction based on adat law in this Sub-district is resolved in a family manner.It is recommended that the Local Government provide counseling for the people about getting PRONA (Agrarian National Operation). The village heads should get involved in facilitating resolution in any disputes. The local people should do any land transaction in written forms.

In banking practice, a loan is usually realized in form of an agreement of acknowledgment of debt by debtor to creditor, in which the creditor acknowledges to have made a loan of some amount of money to a bank, under particular terms. When a debtor defaults, a creditor can file a request to Head of Court for execution of the contents of their agreement with a grosse deed because it has executorial force. However, in this research, the creditor does not directly execute the guarantee when the debtor defaults. Instead, they issue a Letter of Declaration of Willingness to discharge the rights over the collateral that is guaranteed and signed by the debtor. The research problems are how about the legal force of execution of collateral in a deed of acknowledgement of debt in a loan agreement, how about the legal consequences for the debtor in the deed of acknowledgement of debt in case of a default in a loan agreement in Matang Geulumpang Dua Village, and how about the legal efforts that can be made by the creditor in the execution of the collateral in the deed of acknowledgment of debt in the loan agreement.

Transfer of land title is a legal action to transfer one’s land title to another. It can only be registered if it is proven with a deed issued by Officials Empowered to Draw up Land Deeds (PPAT). The drawing up of PPAT deeds have to be attended by all parties involved in the legal action, but in the case stated in ruling number 48/G/2014/PTUN/Mdn, PPAT issues a Sale and Purchase Deed without the attendance of the land title holder. This thesis discusses about how the process of land title transfer according to the prevailing laws and regulations in Indonesia, how about the legal protection for land title holders against the land title transfer that is made by PPAT without their attendance, and how about the liabilities of PPAT for the land title transfer that is made without the attendance of the land title holder. This is a normative juridical research with descriptive analysis. The data used to answer the research problems consist of primary and secondary data sourced from library and field research. The results of this research provides conclusion, process of land title transfer pursuant to the prevailing laws and regulations that can be made through sales and purchases, exchanges, grants, income in companies and the other legal actions to transfer rights, except the transfer of rights through an auction. If PPAT issues or draws up a deed of sale and purchase on transfer of land title without the attendance of all parties or the land title holder, the deed becomes null and the land title certificate cannot be transferred if the owner does not want it; and the land title holder is rightful to file a claim to take his rights back if it is taken or transferred to another party without his permission. Due to the negligence and mistakes of PPAT in issuing a deed of transfer, PPAT shall be liable for his actions civilly, criminally and administratively in case his legal action in the transfer of land title has harmed any party or the land title holder. In this case, the PPAT has good intentions, acknowledges his mistakes and is willing to become a witness at the state administrative court to provide testimony on truth of the facts put in the deed that he has issued.

Creditors as bidders of hypothecation object frequently encounter obstacles such as: the auction objectclearance is impeded by debtor’s or third party’s resistance, debtor’s denial for havingneglected his duty to the creditor, creditor’s statement that it is not the time for creditor to execute the mortgage, and debtor’s denial to the amount of debt including all costs previously expended by creditor for the hypothecation. The research used descriptive analytic method with juridical empirical approach. The data were sourced from secondary data. This research was conducted at KPKNL, Medan as the research location. The data were collected by conducting library research and field research. The data were collected through document study or library research and interviews. The instruments used to collect data consisted of document study or library research and interview. The datawere analyzed by using qualitative data analysis method. The conclusion was drawn deductively. The result of the research demonstrates that auction minutes are an authentic deed which has complete evidence force. Any obstacles encountered and efforts made by KPKNLto overcome the obstacles in implementing foreclosure sale on hypothecation in KPKNL have to be well handled, and auction bidders who have good faith have to be protected by the law.

Land plays a vital role in human life as land and human are inseparable one to another. Human beings live on land (reside) and acquire food by making use of land. Furthermore, land is also emotionally related to human. Everbody does not only need lan when they are alive, but they also need it when they die as a place to rest for good. The research problems are how about the mechanism of transfer of ownership rights over inherited land based on the Civil Law and Islamic Laws, how about the legak protection for heirs’ position in a dispute over ownership rights over inherited land in litigation process at court, and how about the analysis of the case in Lubuk Pakam Distric Court No. 51/Pdt.G/2015/PN.Lbp in conjunction with medan High Court No. 220/PDT/2016/PT.MDN. This is a normative juridical research which studies the prevailing laws and regulations such as the Civil Code, Ruling of Determination of heirs No. 27/Pdt.p/2006/PA-Lpk, Lubuk Pakam District Court Ruling Court No. 51/Pdt.G/2015/PN.Lbp in conjunction with medan High Court No. 220/PDT/2016/PT.MDN. this research problems to draw conclusions as the solution to problems. The results demonstrate that transfer ownership rights over inherited land in the civil laws is implemented by classifying heirs in accordance with inheritance system. Once the classification is established, it is possible to determine whome are rightful for the inheritance. In case of any dispute over the status of the valid heirs at court, the legal certainty is provided by Arcticle 171 of Civil Code which states that inheritance law is the law that regulates the transfer of ownership rights over a testator’s property, determines whom are rightful to be heirs, and to determine each person’s part. Tuhs, it is obvious that inheritance law refers to the civil law which explains that every person is rightful to become heors of a legal subject as a testator who are legally related in accordance with family law, that the testator and heirs actually have true and real close relationship.

One’s land does not only function for its owner, but also for all Indonesian people in general. Consequently, the land use is not only oriented to the land title holder’s benefit, but it also has to notice and consider the sake of society, in order to implement balance of interests principle. The research problems are how the implementation of indemnity for the land used for village development in Sumber Mufakat Village is in line with the Regulations of the President of the republic of Indonesia Number 148/2015 on the Fourth Amendment to the Regulation of the President Number 71/2012 on Implementation of Land Procurement for Development of Public Interest; what factors impede the implementation of indemnity stipulated for village development in Sumber Mufakat Village, and about the legal efforts made related to the problems in indemnity for the land used for village development in Sumber Mufakat Village. This is a normative juridical research with descriptive analysis. The data used in this research consist of secondary data. They are collected through library study and field research. Qualitative analysis is employed of the data analysis. There are some types and forms of indemnity stipulated in the law such as Article 74 of the Regulation of the president Number 71/2012 on Land procurement for the development of public interest by Government or Regional Government. The obstacles are encountered in determining the form and amount of indemnity for road widening in Sumber Mufakat Village which come in variety. The object of land procurement is being disputed in the court, the indemnity is taken by the rightful party in the secretariat of the Court after there is a court ruling with permanent legal enforcement or a deed of reconciliation, and a covering letter from the Head of Land Procurement Execution (Regional Office of National Land Office in Province of Head of Land office in Regency/District). It is suggested that Government notice the interest of land title’s holder in the road widening at Sumber Mufakat Village. In addition, it is necessary to make approaches and provide opportunities to land title owner to choose which type and form of indemnity is preferred for the road widening in Sumber Mufakat Village. It is recommended that every institution implement the law in line with the prevailing regulation impartially. It is expected that every institution to not take side to any particular government institution with higher position. It is also advised that the court implement legal regulations to achieve legal purpose, namely justice, certainty and usefulness.

Increased economic development activities lead to the increases need for funding. Some business activities can finance its business activities through its own budget, and some do not have enough funds to finance it that they require funding from other parties. To maintain the smooth return of these funds, there must be a guarantee if in the future the debtor experiences bankrupt and break promises then the lender can hold and sell the collateral. In Article 1 Paragraph 1, UUJF is security rights over objects moving either tangible or intangible and immovable particular building can not be encumbered encumbrance. UUK-PKPU Article 1 (1) which states that: "bankruptcy is common to all the wealth confiscated the bankruptcy debtor and pemberesannya maintenance performed by curators under the supervision of the Supervisory Judge as set out in the legislation. In general, bankruptcy is the conditions faced by the debtor, in the form of a general confiscation of all his assets as a result of inability to pay off its debt payment obligations, to be distributed in proportion to its creditors. UUK-PKPU newly formed has a wider coverage in terms of norms, the scope of the material, and the process of settlement of debts. The purpose of this study was to determine how the provisions of fiduciary law in Indonesia, to find out how the provisions of the bankruptcy law in Indonesia and to know how to position fiduciary-PKPU after the birth of the Labor Law. The research approached the problem through legislation and regulations, and use supporting theory to complete this study and attempt to explain how the nature of normative legal fiduciary position after the bankruptcy decision-PKPU terms of the Labor Law.
