Law, Development & Justice Review baru terindeks melalui Google Scholar saja dan belum masuk sebagai jurnal bereputasi. Abstract

Ekspresi budaya tradisional mencakup berbagai bentuk kreasi budaya baik berupa benda ataupun tak benda, yang diwariskan secara turun-temurun oleh masyarakat adat dan dimiliki secara komunal. Namun sistem hukum yang berlaku saat ini, khususnya Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta belum sepenuhnya memberikan perlindungan yang memadai terhadap bentuk Ekspresi Budaya Tradisional (EBT). Hal ini disebabkan UU Hak Cipta menerapkan perlindungan hak individual yang diketahui siapa penciptanya, sementara EBT merupakan warisan budaya yang dimiliki secara komunal, sehingga diperlukan suatu perlindungan yang bersifat sui generis terhadap pengetahuan tradisional dan EBT. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan studi kasus. Sumber data utama berasal dari UU Hak Cipta serta regulasi lain yang terkait dengan perlindungan EBT. Permasalahan yang muncul adalah problematika perlindungan EBT sehingga urgensi atas Rancangan Undang-Undang Masyarakat Adat dan Rancangan Undang-Undang Pengetahuan Tradisional dan Ekspresi Budaya Tradisional perlu segera disahkan

Abstract

The development of modern industrialization has created new tensions in the social structure, which have weakened human values and the moral legitimacy of law. This study aims to analyze the relationship between dehumanization in production relations and the crisis of legal consciousness, as well as to identify the sociological roots of the loss of morality in legal practice in the modern industrial era. This research is useful in enriching the study of legal sociology and providing a conceptual basis for strengthening the humanistic approach in legal policy and education. This study employs a qualitative method with a literature study approach, analyzing both classical and contemporary theories, as well as secondary data from books and national and international journals related to industrialization, dehumanization, and the transformation of legal consciousness. The findings reveal that the transition from mechanical to organic solidarity has shifted the orientation of law toward a more instrumental and formalistic character. Consequently, law has lost its moral essence and its function as a social balancer, being replaced by the logic of productivity and efficiency that generates anomie and weakens the fulfillment of humanistic values within production relations. The implications of this study emphasize the importance of rehumanizing the law through ethics-based legal education, strengthening community participation in the formation and implementation of law, and promoting legal policies that balance economic interests with social justice and human dignity. The recommendation is that it is very important to implement the concept of legal rehumanization based on social solidarity as a transformative solution to the crisis of moral legitimacy in law in the modern industrial era.

Abstract

Weaknesses in contract drafting often cause legal uncertainty and lead to breach of contract disputes. This study focuses on South Jakarta District Court Decision No. 171/Pdt.G/2020/PN.Jkt.Sel. to analyze how inadequate drafting contributes to contractual violations and how it can be prevented. The research aims to identify the legal principles neglected in the case and to propose preventive measures for improving contract drafting quality. Using a normative juridical method with statutory and case approaches, the study examines the imbalance of legal positions, ambiguity of clauses, and disregard of fundamental principles such as good faith and contractual justice. The findings show that poor drafting and unequal bargaining positions weaken the binding force of agreements, resulting in breach of contract. The study concludes that applying prudential drafting principles and proportional supervision is essential to ensure fairness, legal certainty, and the prevention of similar contractual disputes.

Abstract

Implementing good notary services can increase public trust in the notary institution itself. Reputation and trust are very important in the business world. However, not all people in Indonesia have the same economic capabilities, there are also less well-off people. Legal services in the notary sector are needed by all levels of society. Article 37 Paragraph (1) of the Law on the Position of Notaries states that Notaries must provide protection and guarantee legal certainty to the public regardless of the economic capacity of their clients. This research aims to determine the factors behind notaries providing free legal services to people who cannot afford it in accordance with Article 37 paragraph (1) UUJN, as well as to determine the legal consequences for notaries who do not carry out these obligations. The method used is a normative legal research method with a legal concept analysis approach and a legislative approach. The research results show that there are several factors behind notaries providing free legal services to people who cannot afford them, namely human factors, the notary's confidence, and the client's candor. These three factors encourage notaries to provide free legal services. In addition, if a notary does not provide free legal services to people who cannot afford it, the notary may be subject to sanctions. Acceptable sanctions include verbal warnings, written warnings, temporary dismissal, honorable dismissal, or dishonorable dismissal.
