Abstract

This study delves deep into the impact of social stigma experienced by individuals with disabilities serving their sentences at Semarang Class I Penitentiary. Employing a qualitative approach, this research involved in-depth interviews with various stakeholders, including inmates with disabilities, prison officers who interact directly with them, and other parties involved in the correctional system. The results demonstrate that the social stigma experienced by individuals with disabilities within the penitentiary is complex and significantly impacts their quality of life. They often encounter social isolation, feeling ostracized, and struggling to build healthy social relationships with other inmates and prison officers. Stigma can also lower their self-esteem and make them feel powerless. Consequently, the process of social rehabilitation, which should be the primary goal of correctional institutions, is hindered. Individuals with disabilities may find it difficult to participate in various correctional programs due to physical barriers or discrimination. The findings of this study highlight the importance of efforts to change societal perceptions, including those of prison officers, towards individuals with disabilities. A paradigm shift is needed, one that views individuals with disabilities as individuals with equal rights and equal potential to contribute to society. Additionally, efforts must be made to create an inclusive prison environment where all inmates, including those with disabilities, can live and function with dignity and without discrimination.

Abstract

In this article, the author raises issues related to the fulfillment of accessibility rights for inmates with disabilities in correctional institutions. The background for choosing this topic is the author's interest in discussing the rights of inmates, particularly in the context of accessibility rights for inmates with disabilities in correctional institutions. Based on this background, the author raises several research questions, namely: Have the accessibility rights for inmates with disabilities, as regulated in Law No. 8 of 2016 on Persons with Disabilities, fulfilled the principle of equal treatment and service as stipulated in Law No. 22 of 2022 on Correctional Services? And Do the inmates' rights regulated in Law No. 22 of 2022 on Correctional Services already accommodate the rights of inmates with disabilities? This research uses a normative juridical method with a statutory approach. The research results show that the majority of correctional institutions in Indonesia have not fully implemented the principle of equal treatment and service because the accessibility rights for inmates with disabilities have not been adequately fulfilled. This is due to the lack of knowledge among officers, weak supervision, and limited government participation. Furthermore, the inmates' rights regulated in Law No. 22 of 2022 are not yet in line with the rights of inmates with disabilities as stipulated in Law No. 8 of 2016 due to the ongoing barriers in terms of facilities, infrastructure, regulations, and resources for inmates with disabilities.

Abstract

The presence of BUMDes is expected that the village will become more independent and the community will become more prosperous. But considering that BUMDes is still a new thing in its existence, it is inevitable that in practice, several obstacles arise precisely related to the process of its formation. the existence of BUMDes, both in terms of the role and regulation of the law and in the implementing regulations, there are still deficiencies, especially its position as a form of business entity. The problem of this research is what is the position of BUMDes in the legal system of the national economy and what is the role of BUMDes in the national economic system. The research method used is normative legal research. The conclusions obtained from research on BUMDes regulations have existed since the promulgation of Law Number 22 of 1948 concerning Principles of Regional Government, then successively regulated in Law Number 1 of 1957 concerning Principles of Regional Government, Law Number 18 of 1965 regarding Principles of Regional Government, Law Number 19 of 1965 concerning Praja Villages as a Transitional Form to Accelerate the Realization of Level III Regions throughout the Territory of the Republic of Indonesia, Law Number 5 of 1974 concerning Principles of Governance in the Regions, Law Number 5 of 1979 concerning Village Government, Law Number 22 of 1999 regarding Regional Government, Law Number 32 of 2004 regarding Regional Government. Separate arrangements are made through the promulgation of Law Number 6 of 2014 concerning Village Administration. As a business entity, BUMDes plays an important role in the development and progress of the economy at the village level as the basis for the agricultural industry. The presence of BUMDes can be a tool for social engineering in the field of welfare which will function to engineer the standard of living of stagnant rural communities towards better progress in the welfare of their people.

Abstract

Law Number 1 of 2023 concerning the Criminal Code (KUHP) as a replacement for the Dutch Criminal Code has been passed and is currently undergoing a socialization period until 2026. The new Criminal Code, which is considered to be in accordance with the character of the Indonesian nation's spirit, is still reaping pros and cons among society. The expansion of the principle of legality by accommodating existing laws in society and Article 411 concerning adultery has become a polemic among society, especially the Minangkabau indigenous community. According to the beliefs of the Minangkabau indigenous people, the benchmark for the act of adultery is not only the presence of sexual intercourse outside of marriage, but more so the presence of moral norms that are violated by the perpetrator. Article 411, which is an absolute complaint offense, indirectly closes the role of the Minangkabau indigenous community in eradicating and resolving adultery cases. The Nan Salapan Law, which is the basis for enforcing Minangkabau customary criminal law, is overridden by the national criminal law because as long as an act has been regulated in the national Criminal Code, the laws that exist in society can no longer be applied. This research uses normative research methods, namely research that focuses on statutory regulations or research based on norms that apply in society.

Abstract

The Indonesian government issued the Government Regulation in Lieu of Law Number 1 of 2016 concerning additional castration penalties, becoming Law Number 17 of 2016. Since the issuance of the regulation, there have been several court decisions that have sentenced perpetrators of sexual violence against children to additional chemical castration penalties. However, legal problems arise when competent doctors openly refuse to be executors of chemical castration. This study focuses on: How is the regulation of the implementation of additional castration penalties by doctors for perpetrators of sexual violence against children? And what are the legal problems found in the additional castration penalty regulations for perpetrators of sexual violence against children? The research method used is a normative research method in the form of a bibliography. Hasil penelitian: there is a need to review Government Regulation Number 70 of 2020, because many articles are not clearly explained so as not to cause problems when chemical castration is carried out; and the problems of doctors who refuse to be chemical castration is carried out, and the unclear specialist doctors who have the competence to be executors.

Abstract

Laws must continue to be updated in order to keep up with the dynamics of societal development. This also applies to the current Indonesian Criminal Code so that the determination of punishment can effectively achieve community welfare. The purpose of punishment in Articles 51-52 of the National Criminal Code shows that punishment is not only aimed at providing a sense of deterrence, but also as rehabilitation for prisoners. In this case, BAPAS plays a role in guiding correctional clients so they can return to society. However, the scope of the work area is too broad so that coaching cannot be maximized. BAPAS Class One Surabaya has a working area covering five regions including Surabaya, Sidoarjo, Gresik, Jombang and Mojokerto. The method used in this research is empirical juridical conducted through interviews. The collected data will be analyzed descriptively-analytically. The research results show that to optimize the recovery of correctional clients, BAPAS formed Griya Abhipraya as a forum for correctional clients to develop their independence and skills.

Abstract

Permen-LHK No. 6 Tahun 2021 Tentang Tata Cara Persyaratan dan bentuk pengelolaan termasuk penyimpanan jangka waktu limbah B3. Peraturan tersebut menjadi dasar proteksi bagi pemerintah kepada subjek hukum termasuk perusahaan dalam penyimpanan limbah B3. Akan tetapi, dalam praktiknya Putusan hakim Nomor 79/Pid.B/LH/2021/PT.SMG, yaitu PT. Sinar Agung Sukses Selalu melakukan tindak pidana menghasilkan limbah bahan berbahaya dan beracun dan tidak melakukan pengelolaan serta melakukan dumping ke media lingkungan hidup tanpa izin. Metode yang digunakan adalah yuridis-normatif yaitu mengkaji permasalahan dari aspek peraturan baik secara horizontal dan vertikal. Berdasarkan hasil penelitian implementasi dari putusan tersebut menimbulkan ketidaksesuaian penegakan hukum sesuai dengan Permen-LHK No. 6 Tahun 2021, selain itu dalam pasal 103 Undang-Undang Nomor 32 Tahun 2009 Tentang Perlindungan Dan Pengelolaan Lingkungan Hidup seseorang yang menghasilkan limbah B3 dan tidak mengelolanya dapat di pidana kurungan 1 (satu) tahun dan paling lama 3 (tiga) tahun namun dalam putusannya tidak sesuai dengan aturan hukum yang berlaku. Dimana hakim dalam memutus perkara tersebut berpandangan bahwa berlandasakan prinsip hukum lingkungan berkelanjutan denda ada putusan pertama tidak relevan sehingga diatur dalam pengadilan tinggi akan tetapi analisis pandangan peneliti seharusnya dalam pengadilan tinggi dapat menetapkan ganti rugi lebih tinggi dan prinsip cemar lingkungan.

Abstract

This study aims to examine the implementation of the Rice Farming Insurance Programme (AUTP) in Karawang Regency as part of the legal protection provided by the government. Karawang Regency is known as a rice-producing area and a national granary that has significantly contributed to the national rice supply. However, geographically, Karawang Regency is relatively low-lying and susceptible to flooding, where a portion of the rice fields experiences inundation during the rainy season, resulting in crop failure (puso). Consequently, the AUTP programme is highly beneficial for farmers in managing risks and losses. This research employs an empirical normative legal methodology, focusing on the analysis of legal norms as well as their application and implementation. The findings indicate that the AUTP programme in Karawang Regency serves as legal protection for farmers against the risks of crop failure due to flood disasters. From 2020 to 2024, the local government allocated a budget of IDR 3.203.843.040 for the AUTP programme, with claims made for 1.914,96 hectares and a total indemnity paid amounting to IDR 11.492.160.000. Furthermore, in 2024, the local government of Karawang Regency allocated IDR 1.440.000.000 in the regional budget for 40.000 hectares of rice fields within the AUTP programme. Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum ahli waris yang mengundurkan diri dari hak warisnya berdasarkan ketentuan Kitab Undang-Undang Hukum Perdata (KUHPerdata), serta bagaimana pengunduran diri tersebut dipertimbangkan oleh hakim dalam putusan Pengadilan Agama Indramayu Nomor 468/Pdt.G/2022/PA.IM. Metode penulisan ini dilakukan dengan penelitian yuridis normatif, yaitu penelitian yang difokuskan dengan menerapkan kaidah-kaidah atau norma-norma dalam hukum positif. Sumber data yang digunakan dalam penelitian ini adalah bahan primer, sekunder, dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa ahli waris memiliki hak penuh untuk menerima atau menolak warisan, namun penolakan harus dilakukan secara tegas di hadapan pengadilan agar memiliki kekuatan hukum. Dalam kasus yang dikaji, meskipun pengunduran diri dilakukan melalui surat pernyataan di bawah tangan, hakim menilai bahwa pernyataan tersebut memiliki kekuatan pembuktian karena telah diakui, di-warmeging oleh notaris, dan dijadikan dasar pembagian warisan oleh ahli waris lain selama lebih dari sepuluh tahun. Oleh karena itu, hakim menyatakan bahwa ahli waris yang telah menyatakan pengunduran diri kehilangan legal standing untuk menuntut hak waris di kemudian hari. Penelitian ini memberikan kontribusi bagi pengembangan ilmu hukum waris serta praktik penerapan hukum dalam penyelesaian sengketa waris di pengadilan.

Abstract

Intellectual property rights for health products constitute a crucial instrument in protecting innovation within the pharmaceutical and medical device sectors. In Indonesia, the acquisition procedure for intellectual property rights in health products encounters various obstacles that impede innovation effectiveness and commercialization processes. This analysis endeavors to identify and examine problems occurring in intellectual property rights acquisition procedures for health products, while providing recommendations for optimization. The research employs normative juridical methodology with a conceptual approach through examination of prevailing regulations and doctrines. Findings indicate that procedural complexity, extended processing duration, inadequate socialization, and coordination deficiencies among institutions represent primary impediments. Proposed solutions encompass procedural simplification, digital system implementation, capacity enhancement for human resources, and regulatory harmonization.
