Shooting on sight and Human Right. The practice of shooting on sight was implementedin the past, Indonesia is a consitutional country (rechstaat) and not authoritarian country (machstaat).The Dead Penalty in Indonesia is mentioned in article 10 KUHP, and was implemented, but theprocess should be implemented in the sense of presumption of innocence, initiated by investigationand ended with binding decisions. Through the amandement of UUD 1945, it was estabilished a Regional Refresentataives Council or Senate (DPD) beside the Legislative Council or House of Refresentative (DPR). However, the establishing of DPD less to lead the significant changes, it is caused by the limitation of its authority. The limitation of DPD authority has been regulated be fore in UUD 1945. The limitation of DPD authority in legislative side, DPD is not involved to approve the constitution design (RUU) which is inline with the regional authority eventhough the constitution design proposed by DPD, in funding side DPD only has right to consider, mean while on controlling side, all of it controls must be reforted to DPR to be followed up. The asimetric relationship does not reflect the check and balances system in parliament. It is contradicted with the principle of democracy that recuires the functioning of parliament as the refresentatives institution. If it is happen, can caese arrogant, dominant, and the authority monopoliezed by majority groups in DPR. The regulation of DPD authority in the future can be done through the amandemen of UUD 1945. DPD should be gevin the veto right in legislation, and interppelation right, questionnaire and the state the opinion in controlling side. With these right, it is hoped that DPD can become the counterpart for DPR dan President in the paradigm of check and balances, so DPD can its function as regional refresentative productively for strengthening the principle of regional autonomy.

In Gorontalo city there is a tradition of dutu in his traditional marriage. This tradition certainly has philosophical reasons behind it, and one method of knowing the philosophy behind a rule is to use maqaid al-shari'ah al-Syaṭibi. The focus of this research is (1) How is the implementation of fiqh principles in the Hulondhalo tribe in the implementation of the tradition of dutu in customary marriage in the city of Gorontalo (2) How is the review of maqashid al-shari'ah on the tradition of traditional marriage dutu in the Hulondalo tribe in Gorontalo at a very expensive cost. This type of research is qualitative research, and the form of field research. The results of this study concluded that: (1) the implementation of the fiqh method was evidenced by the implementation of the tradition of the dutu whose procedure was to deliver 1 package of dowry and custom attributes delivered to the bride's house. For the tradition of dutu in the context of modernity, family position is a measure of the value of dowry for the bride and the social achievement of the woman. The higher the social value, the higher the value of the dowry. This is in accordance with the arguments of the hadith of the Prophet. (2) The review of maqashid al-shari'ah in this tradition includes the category of maqaṣid hajiyyat which safeguards maqaṣid dharuriyyatnya. Marriage as a form of hifz al-nasl which is commanded by Allah. The price of the dowry is in the position of ma'aid taḥsīniyyat to glorify a woman as a manifestation of maintaining religion, soul, mind, lineage, and wealth.

Implementing the Discount rate to settle Murabahah debt at Syariah Banking. This paperanalyzing the discount system determined by shariah bank in settling the murabahah debt before thedeadline. This paper were made in demand of sharia bank customers who felt disappoint when theywanted to settle the murabahah debt before the deadline, because the customers have to pay all theresidue of basic debt and residue of margin, but in some case the bank provide discount rate accordingto the bank provision. This system caused a burden to customers and many customers compare thesharia bank system with the conventional bank where in conventional bank the customers will begiven a penalty of one time interest rate. After a deep analysis the writer came to a conclusion that thedecision of discount rate in sharia bank is approppriate with the instruction of DSN MUI Number :23/DSN-MUI/III/2002 related to the discount rate for settling the murabahah debt before the deadline.It mentioned that “If the customer of murabahah settle the debt earlier or before the time as perprevious agreement, the financial institution may provide a discount from the obligation of paymentbut it must not be mentioned during the previous agreement.” The amount of discount is considereddepending on the provision of the Sharia Financial Institutions

Memahami sistem ekonomi Islam secara utuh dan komprehensif, selain memerlukan pemahaman tentang Islam juga memerlukan pemahaman yang memadai tentang pengetahuan ekonomi umum mutakhir. Keterbatasan dalam pemahaman Islam akan berakibat pada tidak dipahaminya sistem ekonomi Islam secara utuh dan menyeluruh, mulai dari aspek fundamental ideologis sampai pemahaman konsep serta aplikasi praktis. Akibatnya tidak jarang pemahaman yang muncul, hanya menganggap bahwa sistem ekonomi Islam tidak berbeda dengan sistem ekonomi umum yang selama ini ada hanya minus sistem ribawi ditambah dengan zis (zakat, infak, sedekah) juga disertai adanya prinsip-prinsip akhlak yang diperlukan dalam kegiatan ekonomi.

This study discusses the issue of hoaxes which have been troubling the community. One reason for the rise of hoax news is that the handling is only from the side of positive law without involving religious elements, whereas religious teachings are very effective for preventive actions because if there are religious elements in the handling, people will always be watched and afraid of sinning if they violate. The subject of this study is how to set ta'zir sanctions for hoax makers and disseminators in the perspective of Islamic law. This study is included in the literature research category, while the approach used in this study is a normative approach. The data collection technique used is documentation technique. After an in-depth study was obtained a conclusion that there were three categories of ta'zir sanctions, namely minor, moderate and severe sanctions. Minor sanctions are given to perpetrators and disseminators of hoaxes with motives of ignorance and victims of technological and information developments. While giving sanctions is being given to the perpetrators and disseminators of the hoax with the motive for the absence of legal certainty. Then hoax makers and spreaders who have motives for malicious intentions and politics are given the heaviest sanctions

Abstract: Islamic teaching that is a straight path but not a rigid religion, it is a line-giver to the problems encountered by humans in the course of their lives. Muslims should have a concept that contains a way of life to face the development and progress of the times with various problems. One area that is always warm to talk about is the economy. This problem is getting wider, more varied and more complex. It is not uncommon to find it complicated, especially when confronted with Islamic law. One of them is about the capital market. This journal tries to examine from the perspective of jurisprudence about the jala of the existing capital markets. If we look at the system of stock bidding mechanisms in the capital market, it will be clear that there is a similarity with the capital system contained in the conception of Islamic fiqh, known as mudharabah or qirodh. It is seen from the investors, executors, the nature of capital, capital, and profit sharing of the same shape. Thus, the system of buying and selling of shares in the stock market is clearly visible equation with mudharabah in Islamic jurisprudence.

Islam sangat mengutamakan keadilan dalam semua perkara. Keadilan juga harusditegakkan kepada siapa saja. Artinya Islam pasti juga mengatur keadilan dalam bidang ekonomi.Penelitian ini mengungkapkan bahwa salah satu bentuk keadilan yang sangat ditekankan olehIslam ialah keadilan dalam distribusi harta. Banyak ahli menyebutkan bahwa ini adalah bentukkeadilan sosial Islam. Hal ini dibuktikan dengan banyaknya instrumen keuangan dalam Islam yangdijadikan sebagai instrumen pemberian baik wajib maupun sukarela kepada yang tidak mampu.Seperti zakat, infak, sedekah, dan wakaf. Dalam pelaksanaannya konsep keadilan sosial Islam ialahbahwa setiap individu mendapat hak-haknya dan di waktu yang sama ia juga perlu melaksanakansegala tanggungjawabnya untuk merealisasikan keadilan dalam hidupnya
