Abstract

The problem of inheritance that is often a problem in society is when a deceased leaves only daughters so that the father's brother gets the inheritance because there is no barrier to inheritance. In general, the deceased's wife and daughter are not willing to leave the inherited property due to the role of the father's biological brother as long as the deceased (father) does not play a maximum role as guardian. However, if the biological uncle's share is not given, it is feared that there will be damage to the family relationship between the biological uncle and the deceased daughter. So later, in Binjai City, the biological uncle was still given the inheritance, but only part of the actual portion. This study analyzes the practice of inheritance settlement between uncles and daughters in the Binjai City community and the legal arguments of religious leaders who play a role in it. The research method used is field-qualitative with a normative approach and legal sociology. This research found that in solving the distribution of inheritance between daughters when dealing with paternal brothers in Binjai City, there are generally two ways of settlement, namely: First, the clergy want to remain consistent in applying the provisions of inheritance law by traditional fiqh, namely the father's biological brother gets the share of the heir when dealing with an only daughter. Second, scholars try to update the meaning of Islamic inheritance law by placing the position that a daughter can wear the hijab from her father's brotherMasalah waris yang kerap menjadi persoalan di tengah masyarakat adalah ketika mayit hanya meninggalkan anak perempuan, sehingga saudara laki-laki dari pihak ayah mendapatkan harta warisan disebabkan tidak terdapat penghalang waris. umumnya pihak isteri si mayit dan anak perempuannya tidak rela harta warisan keluar dari rumah disebabkan peran saudara laki-laki kandung pihak ayah selama si mayit (ayah) tidak berperan maksimal sebagai wali. Namun jika bagian paman kandung tidak diberikan, dikhawatirkan terjadi rusaknya hubungan keluarga antara paman kandung dengan anak perempuan mayit. Maka kemudian di Kota Binjai, paman kandung masih diberi harta warisan namun hanya sebagian dari bagian sebenarnya. Penelitian ini menganalisis praktik penyelesaian kewarisan antara paman dan anak perempuan pada masyarakat Kota Binjai dan argumentasi hukum tokoh agama yang berperan di dalamnya. Metode penelitian yang digunakan adalah kualitatif-lapangan dengan pendekatan normatif dan sosiologi hukum. Penelitian ini menemukan bahwa penyelesaian pembagian waris antara anak perempuan disaat berhadapan dengan saudara laki-laki dari pihak ayah di Kota Binjai, umumnya terdapat dua cara penyelesaian, yaitu: Pertama, ulama ingin tetap konsisten menerapkan ketentuan hukum waris sesuai dengan fikih tradisonal yaitu saudara laki-laki kandung dari pihak ayah mendapatkan bagian dari ahli waris ketika berhadapan dengan anak perempuan tunggal. Kedua, ulama mencoba memperbarui makna hukum kewarisan Islam itu sendiri dengan menempatkan posisi anak perempuan dapat menghijab saudara laki-laki dari pihak ayah

Abstract

The existence of a rehabilitation centre for addicts and victims of narcotics abuse is considered an effective formula to protect the law. In contrast, currently, prisons are considered inappropriate and safe for narcotics addicts to undergo healing. This study examines the worship approach used in the rehabilitation process and the application of legal protection for someone involved in narcotics abuse at the Baitu Syifa Rehabilitation Center from the perspective of the Narcotics Law Number 35 of 2009. This qualitative research uses statutory, case and conceptual approaches. The study results found that the rehabilitation program at Baitu Syifa did not conflict with the provisions in Article 57 of the Law. Number 35 of 2009 states that residents' recovery can be carried out through a religious approach. The recovery of victims of narcotics abuse in Baitu Syifa is in the form of routine activities with Islamic nuances based on the Al-Quran and As-sunnah, which include Islamic Treatment Community (TC), Scientific Islamic Studies, pious practices such as performing obligatory prayers, sunnah services, the Nabawi treating and reading the Koran. The development of worship approach methods at the Baitu Syifa Rehabilitation Center has been adapted to Islamic law.Keberadaan panti rehabilitasi bagi pecandu dan korban penyalahgunaan narkotika dianggap sebagai formula jitu sebagai upaya perlindungan hukum dimana saat ini penjara dianggap sudah tidak tepat dan aman bagi pecandu narkotika untuk menjalani penyembuhan. Penelitian ini mengkaji pendekatan ibadah yang digunakan pada proses rehabilitasi dan dan penerapan perlindungan hukum bagi seseorang yang terlibat penyalahgunaan narkotika di Panti Rehabilitasi Baitu Syifa dalam perspektif Undang-Undang Narkotika Nomor 35 tahun 2009. Penelitian kualitatif ini menggunakan pendekatan perundang-undangan, kasus, dan konseptual. Hasil penelitian menemukan bahwa program rehabilitasi di Baitu Syifa tidak menyelisihi aturan yang terdapat pada pasal 57 UU. Nomor 35 Tahun 2009 yaitu yang menyatakan bahwa pemulihan residen  dapat diselenggarakan melalui pendekatan keagamaan. Pemulihan korban penyalahgunaan narkotika di Baitu Syifa berupa rutinitas kegiatan bernuansa Islami berdasarkan Al-Quran dan As-sunnah yang meliputi Treatment Community (TC) Islami,  Kajian Islam Ilmiah, amalan amalan sholeh seperti melakukan ibadah-ibadah wajib, ibadah-ibadah sunnah, pengobatan thibun Nabawi dan membaca Alquran. Pengembangan metode pendekatan ibadah di Panti Rehabilitasi Baitu Syifa telah disesuaikan dengan Hukum Islam

Abstract

There are the forms of attention to children's religious values that cannot be implemented properly in polygamous families in Langkat Regency. Responding to the polygamy cases in Langkat Regency, this is an interesting phenomenon to study regarding the protection of the child's religion in the family. This study was field research, with its approach normative. religious protection for children based on Law number 35 of 2014 in several articles, namely articles 6, 25, 26, 39 and 43. The impact on child victims of polygamy who do not receive religious protection in Langkat Regency is that the child is psychologically disturbed. Never again did he hear calls or invitations to pray in congregation, recite the Koran or the advice he had received from his parents. Plus, friends who lack good morals. So that children often find their solutions to all the problems they face. Children become misdirected due to promiscuity and experience depression, so few are trapped in the diseased environment of society. However, not all children who are victims of polygamy at this level become wrong associations. There are also those whose personality is getting better. Because attention from his father is still given, although not like before, his mother at home is also protective of his association. The surrounding community and religious leaders also play a role in embracing him so that he remains in an association that brings terdapat bentuk-bentuk perhatian terhadap nilai-nilai agama anak yang belum dapat dilaksanakan dengan baik pada keluarga poligami di Kabupaten Langkat. Menanggapi kasus poligami di Kabupaten Langkat, hal ini menjadi fenomena yang menarik untuk dikaji terkait perlindungan agama anak dalam keluarga. Penelitian ini merupakan penelitian lapangan dengan pendekatan normatif. perlindungan agama bagi anak berdasarkan Undang-Undang nomor 35 Tahun 2014 pada beberapa pasal yaitu pasal 6, 25, 26, 39 dan 43. Dampak terhadap anak korban poligami yang tidak mendapatkan perlindungan agama di Kabupaten Langkat adalah anak terganggu secara psikologis . Tidak pernah lagi dia mendengar panggilan atau ajakan untuk sholat berjamaah, mengaji atau nasehat yang dia terima dari orang tuanya. Ditambah lagi teman-teman yang akhlaknya kurang baik. Sehingga anak sering menemukan solusinya atas segala permasalahan yang dihadapinya. Anak-anak menjadi salah arah akibat pergaulan bebas dan mengalami depresi, sehingga sedikit yang terjebak dalam lingkungan masyarakat yang sakit. Masyarakat sekitar dan tokoh agama juga berperan untuk merangkulnya agar tetap dalam pergaulan yang membawa kemaslahatan

Abstract

This study examines the violence of educators against their students that occurred in the Asahan District. This case is interesting to study because educators should not perpetrate violence against their students, and students should receive guaranteed protection from such acts of violence. The focus of the problems studied is: 1) forms of legal protection provided by Law No. 35 of 2014 for students, and 2) the role of the government, school supervisors and education staff in providing legal protection for students who experience acts of abuse by educators in the school environment. This type of research is qualitative with a juridical and normative approach. This study found that the role of the Asahan District Government in efforts to prevent acts of abuse and violence against students/children both within the school environment and outside the school environment is by establishing a Child-Friendly District (LKA) as a form of concern for child growth and development and safe and comfortable life For children. Legal protection for children that has been carried out, if based on Law No. 35 of 2014, more serious efforts are needed so that the realization of the values of the law can be realized properly.Penelitian ini mengkaji kekerasan para pendidik terhadap para siswanya yang terjadi di Kabupaten Asahan. Kasus ini menarik diteliti karena kekerasan tidak seharusnya dilakukan oleh pendidik terhadap peserta didiknya, dan peserta didik seharusnya mendapat jaminan perlindungan dari tindak kekerasan tersebut. Fokus permasalahan yang dikaji adalah: 1) bentuk-bentuk perlindungan hukum yang diberikan oleh Undang-Undang No 35 Tahun 2014 bagi peserta didik, dan 2) peran pemerintah, pengawas sekolah dan tenaga kependidikan dalam memberikan perlindungan hukum bagi peserta didik yang mengalami tindak penganiayaan oleh tenaga pendidik dilingkungan sekolah. Jenis penelitian ini adalah kualitatif dengan pendekatan yuridis dan normatif. Penelitian ini menemukan bahwa peranan Pemerintah Kabupaten Asahan dalam upaya pencegahan tindakan penganiayaan maupun kekerasan terhadap peserta didik/anak baik dilingkungan sekolah maupun diluar lingkungan sekolah yaitu dengan membentuk Kabupaten Layak Anak (LKA) sebagai wujud kepedulian terhadap tumbuh kembang anak dan keberlangsungan hidup yang aman dan nyaman bagi anak. Peranan Pemerintah Kabupaten Asahan dalam upaya pencegahan tindakan penganiayaan maupun kekerasan terhadap peserta didik/anak baik dilingkungan sekolah maupun diluar lingkungan sekolah yaitu dengan membentuk Kabupaten Layak Anak (LKA) sebagai wujud kepedulian terhadap tumbuh kembang anak dan keberlangsungan hidup yang aman dan nyaman bagi anak. Perlindungan hukum terhadap anak yang sudah dilakukan, jika berdasarkan UU No 35 tahun 2014, perlu upaya lebih serius agar perwujudan dari nilai-nilai UU tersebut dapat terealisasikan dengan baik.

Abstract

Religious moderation still creates difficulties for some people; this can be seen in the emergence of intolerance, radicalism, disputes, and societal conflicts because of diversity. Therefore, a strategy for the Forum for Religious Harmony is needed to neutralize this. This research will map and describe FKUB's strategy for increasing religious moderation. Using a descriptive qualitative method, data sources were obtained from primary and secondary data from District/City and Provincial FKUB institutions. The primary data includes profiling, motivation, types of difficulties, and solutions taken by FKUB administrators and members for every difficulty they experience managing the FKUB. The results of the study can be concluded that there has been an increase in religious moderation in Bengkulu Province; it can be seen that the cooperation pattern of FKUB and the community has been implemented, has carried out work programs, has carried out coordination with religious leaders and community leaders, has carried out socialization of laws and regulations that synergize safe community life, peaceful and serene, and has carried out surveillance. However, there are still several FKUBs experiencing difficulties because they do not yet have their own secretariat office, are still in boarding status, and the facilities and infrastructure are also inadequate, so the implementation of the work program is only adjusted to the existing budget from the government, even administrators spend personal funds to continue religious moderation activities. So this paper needs to conduct further research by examining comparative aspects regionally and based on varied data and methods to resolve the difficulties of FKUB's strategy in increasing religious moderationModerasi beragama masih menimbulkan kesulitan bagi sebagian orang; Hal ini terlihat dari munculnya intoleransi, radikalisme, perselisihan, dan konflik masyarakat karena keberagaman. Oleh karena itu, diperlukan strategi Forum Kerukunan Umat Beragama untuk menetralisasi hal tersebut. Penelitian ini akan memetakan dan mendeskripsikan strategi FKUB dalam meningkatkan moderasi beragama. Dengan menggunakan metode deskriptif kualitatif, sumber data diperoleh dari data primer dan sekunder dari lembaga FKUB Kabupaten/Kota dan Provinsi. Data primer meliputi profiling, motivasi, jenis kesulitan, dan solusi yang diambil oleh pengurus dan anggota FKUB untuk setiap kesulitan yang dialami dalam mengelola FKUB. Hasil penelitian dapat disimpulkan bahwa telah terjadi peningkatan moderasi beragama di Provinsi Bengkulu; terlihat bahwa pola kerjasama FKUB dengan masyarakat telah dilaksanakan, telah menjalankan program kerja, telah melakukan koordinasi dengan tokoh agama dan tokoh masyarakat, telah melakukan sosialisasi peraturan perundang-undangan yang mensinergikan kehidupan masyarakat yang aman, tentram dan tenteram, serta telah melakukan pengawasan. Namun masih ada beberapa FKUB yang mengalami kesulitan karena belum memiliki kantor sekretariat sendiri, masih berstatus asrama, serta sarana dan prasarana juga belum memadai, sehingga pelaksanaan program kerja hanya disesuaikan dengan anggaran yang ada dari pemerintah, bahkan pengurus mengeluarkan dana pribadi untuk melanjutkan kegiatan moderasi keagamaan. Maka tulisan ini perlu melakukan penelitian lebih lanjut dengan mengkaji aspek komparatif secara regional dan berdasarkan berbagai data dan metode untuk mengatasi kesulitan strategi FKUB dalam meningkatkan moderasi beragama

Abstract

The Director General of Islamic Religious Institutional Development again issued Circular Number P-005 / DJ. III/Hk.00.7/10/2021 concerning marriage during the iddah period, according to the provisions of the circular "an ex-husband man can marry another woman when the iddah period of his ex-wife has ended". This article attempts to further analyze the waiting period for men due to talak raj'i divorce using Jamaluddin Aṭiyah's theory of maqashid as-sharia. This research is normative legal research. In the perspective of Maqashid As-Sharia proposed by Jamaluddin Aṭiyah, the regulation of waiting periods for men after divorce not only reflects aspects of Islamic law governing divorce, but also serves as a means to achieve broader goals in the lives of individuals, families, communities, and humanity by Islamic values. With this approach, the regulation has a profound impact on various aspects of life-related to divorce.Dirjen Pembinaan Kelembagaan Agama Islam kembali mengeluarkan surat Edaran Nomor P-005/DJ.III/Hk.00.7/10/2021 tentang pernikahan dalam masa iddah, menurut ketentuan edaran tersebut “laki-laki bekas suami dapat melakukan pernikahan dengan perempuan lain apabila telah selesai masa iddah bekas isterinya”. Artikel ini mencoba menganalisis lebih jauh terkait masa tunggu bagi laki-laki akibat perceraian talak raj’i dengan menggunakan teori maqashid as-syariah Jamaluddin Aṭiyah. Penelitian ini merupakan penelitian hukum normatif. Hasil penelitian ini menunjukan bahwa Dalam perspektif Maqashid As-Syariah yang dikemukakan oleh Jamaluddin Aṭiyah, regulasi masa tunggu bagi laki-laki setelah bercerai tidak hanya mencerminkan aspek hukum Islam yang mengatur peristiwa perceraian, tetapi juga berfungsi sebagai sarana untuk mencapai tujuan-tujuan yang lebih luas dalam kehidupan individu, keluarga, masyarakat, dan kemanusiaan sesuai dengan nilai-nilai Islam. Abstract

Along with the increasing number of publications in the field of digital zakat, it is necessary to study and research related to zakat management to obtain general concepts that are used as policy standards by zakat management practitioners and national zakat regulators that aim to provide knowledge about zakat management in an easy, flexible, transparent and right on target manner. This study is field research that observes actual events in society and aims to describe the state or status of a phenomenon using empirical legal research methods and an interdisciplinary approach, namely sociological and ethnographic studies. The results of this study state that the correct distribution of zakat requires an understanding of its fiqh, which is based on the arguments contained in shari'a texts that are explored through a linguistic approach (al-qowâid al-lughawiyyah) as well as an objective shari'a approach (maqâshid asy-syarî'ah). In addition, collecting zakat funds by national amil zakat agencies and institutions in Indonesia must be by the times and technology as an alternative that will make it easier for muzakkī's to meet their needs.
