Abstract

This article discusses the Baitulmal of Majlis Islam Wilayah Persekutuan (MAIWP) Malaysia and the implementation of zakat as an instrument of social security especially in Federal Territory of Kuala Lumpur. Considering the experiences and achievements of the institution in the past, this article discusses the possibility of formulating zakat as an instrument of social security for the whole Malaysia.

Abstract

The contribution and the influence of Parsi in Nusantara appears in the prayers, rituals and Sufi trend of thoughts; vocabulary, writing style of a saga, poetry, patterned work history, manners, kanun law and religious treatises, commonly called literary books. Splendor of this highly motivated Parsi influence back to the chronicles in the 15th century AD; territory controlled by Persia Timurid dynasty, which greatly promotes the development of culture and literature. Parsi literary and intellectual fields in general retracing its development peak, while the Arabic literary declined. Meanwhile institutionalization of Islam in Nusantara began to grow in the 13th – 15th century, for example in Samudra Pasai (1272-1516 AD) and Malacca (1400-1511 AD). In this article, it will present four Malay literature that assessed many literary works influenced by Parsi, such as the Taj al-Salatin, Hikayat Amir Hamzah, Hikayat Muhammad Ali Hanafiyah, and the Hikayat Burung Pingai.

Abstract

Islamic exertion (ijtihad) is a tool which makes Islamic law be compatible and relevant to the current progress of time. Some contemporary problems which are being faced by human are needed to be solved from Islamic law perspective. In this regard, to intensify Islamic exertion collectively by involving all scientists from various backgrounds of science and knowledge is a way to solve such kinds of contemporary problems which being faced by mankind generally and Muslim particularly.

Abstract

Zakat is one of the instruments in Islamic economics which play roles to increase a socio-economic development of Islam in general and asnaf in particular. The increase in socio- economic policy needs to include recipients, especially the poor and needy recipients. Among the most important as well as the need to eat, shelter and clothing, education is also very important because education can enhance the capabilities of the poor and needy recipients as well as the Muslim community in order to improve the factors of production out of mustahiq and become to muzzaki. Which problems in recipients of zakat funds for education do? How does the distribution of zakat funds to education can be done by the management of zakat institutions to the target group intended? What conclusion can be made to the role of the Board of Zakat Pulau Pinang (ZPP) for its contribution to education in Penang? Methods in implementing this writing, is to use secondary data and content analysis. Therefore, this article aims to examine the appropriate recipients for the distribution of zakat in education. Second, identify program implementation zakat management education institutions in Penang and eventually formulate ZPP role in contributing to education. Research findings tell us that zakat distribution for educational purposes basically through pi sabilillah asnaf. However, the programs were implemented by the Penang Zakat Management in dissemination the education of the Muslim community is not only through asnaf pi sabilillah, but also through poor and needy asnaf, ghoramin and mualaf (conversion). Conclusion the zakat contributions relating to education given to asnaf to enhance the syiar of Islam and closer to Allah SWT, especially to educational activities through formal education, preaching, counseling, training / courses, management and administration.

Abstract

Application of Islamic Shari'a in Aceh introduced flogging as punishment for the perpetrators of violations of Islamic law, gambling, seclusion, and alcohol. Rejection comes from some quarters that assesses punishment cruel and inhumane, and because it violates human rights. Proponents argue that caning is a part of God's law and therefore does not violate human rights. This article contains the philosophical and judicial caning in Aceh, the public perception and its relation to human rights. The result, on the one hand, the attitude of counter flogging occurred because the wrong perception of the Islamic Shari'a. Here another, caning is not of rigid and highly conditional. He is only one alternative punishment that is now considered the most able to achieve the purpose of punishment in Islam.

Abstract

The study of the establishment of economic building program of Baitul Qiradh Bina Insan Mandiri (BQ-BIMA) Banda Aceh aimed at analysing the type of the establishment of community economic building program in Banda Aceh and intended to examine Syariah principle implemented by BQ- BIMA when financing for business capital to clients. In achieving this goals, the researcher used interview and observation as the primary source in collecting data while books, journals, magazines and other sources related to the issue of this study are regarded as secondary references. In addition, inductive and deductive analysis of qualitative method were used in analysing the data. Inductive analysis in the form of interview initiated the type of economic building program established by BQ-BIMA Banda Aceh. Indeed, deductive method from observation, books, journals and other related sources added more information in summaryzing the type of establishment of this program. Through investigation and analysis it was found that the program run by BQ-BIMA Banda Aceh was funding project for home industry and peniaga kecil aman dari terjadinya keredit macet. BQ-BIMA Banda Aceh applies the following procedure in giving the loan: understanding the characteristic of consumer need, undertanding (human capacity), (capital), (economic condition), (collateral), and the right implementation of Fiqh principles. Furthermore, BQ-BIMA also supervised the client that they are able to return the loan in time, the bond was physically conquered, administration of debitor company was made neat and organized as well as supervised. Abstract

There are various definitions of poverty in the teachings of Islam. In principle the poor are defined as those whose needs are insufficient. Thus, Islamic institutions in Malaysia play a variety of socioeconomic roles such as poverty alleviation. To perform this role, these institutions face a major task in identifying the poverty group. Most of these institutions measure and operationalize poverty from the monetary perspective using variables such as income, expenditure or consumption. In practice, most Islamic institutions in Malaysia use the monetary approach in measuring poverty through the conventional Poverty Line Income (PLI) method and also the Islamic based Had Al-Kifayah (HAK) method. The objective of the paper is to present a non-monetary shariah based poverty measurement, Islamic Poverty Index (IPI), consisting of maqasid-al sharia (objective of the religion) elements, namely religion, knowledge, physical-self, offspring and wealth. The IPI, calculated using the weighted index method is expected to exemplify poverty from a multidimensional perspective. In addition, a comparison with the HAK method was highlighted. A survey aided by a structured questionnaire using expert review was carried out on 258 selected head of households in the state of Selangor, the most populated state in Malaysia. Poverty groups identified from each of the methods were highlighted using descriptive statistics. In addition, regression analysis revealed that unemployment was the common significant determinant of poverty according to both the IPI and HAK method.

Abstract

Waqf higher education was an important asset in developing knowledgeable intellectuals. This waqf higher education was a successful institution that uses waqf as it source of operation. It can be seen through the model of College University Bestari (UCB) in the implementation of higher education waqf. The objective of this writing is to focus on the historical background, the development of waqf asset, contribution and beneficial distribution of waqf property as well as challenges and prospects of higher education in Malaysia. The analysis result found that UCB had been successfully expanded the waqf funds through the waqf scheme of land lot by getting approval from Terengganu Islamic Religious and Malay Customs Council (MAIDAM). Thus, the implementation of educational waqf held by UCB can be used as a model to other educational institutions in order to develop waqf property and generate revenue. Therefore, the model that existed in this waqf institution need to be systematically planned and implemented to ensure that it can be a guarantee and catalyst towards education finance system of the Muslim community.

Abstract

Selain daerah kawasan tsunami, selama sebelas hari kami berkeliling mengunjungi lima Lembaga Pendidikan Dasar, Menengah dan Atas, satu Universitas, serta dua kuil bersejarah di delapan kota lain dalam lima wilayah prefektur (propinsi) Jepang, yaitu; kota Sendai dan Ichinoseki (Sendai Prefecture), Kota Osaka dan Kobe (Osaka Prefecture), kota Hiroshima (Hiroshima Prefecture), kota Kyoto (Kyoto Prefecture), dan kota Nara (Nara Prefecture). Berbagai tempat bersejarah tujuan wisata juga sempat dikunjungai selain tentunya kota Tokyo sendiri sebagai ibukota Jepang. Atas penilaian peserta sejak gelombang pertama hingga terakhir, program ini dinilai sangat berhasil dan selalu direkomendasikan untuk terus dilanjutkan atau bahkan dikembangkan. Terutama dalam bentuk kerjasama langsung antara lembaga-lembaga pendidikan di Jepang dengan Pondok Pesantren di Indonesia, seperti program pertukaran pelajar dan guru maupun bantuan manajemen Informasi & Teknologi bagi pesantren sebagaimana yang saya sampaikan langsung kepada Mr. Kazama, Wakil Menteri Luar Negeri Jepang ketika menyambut kami di Tokyo.

Abstract

This study aims to look at the comparative perspective of hudud to sexual intercourse after married. This is based on Qur’anic and Hadith that makes a clear punishment for muhsan and ghairu muhsan. However, in this study has found that there are difference opinion of ulama toward the limit of hudud which referred to contradictive Hadith. In this study, the author conducts the critical sanad as a problem solver to the issue.
