Abstract

The current analysis of utility maximization is affected by changes in income and prices. It refers to material standards which measured by numerical score representing the satisfaction that a consumer gets from a bundle of goods. Apparently, it is only to satisfy a human desire which is subjectively determined by self-interest. However, Muslim’s utility is not merely to maximize man’s satisfaction, but to achieve God pleasure as much as possible with conform his consumption to the pattern of maqashid shari’ah. This paper uses the literature review to develop a tool analysis based on maqashid shari’ah dimensions for Muslim’s utility maximization and its impact on Muslim consumption behaviors. It will address the issues of current utility concept that has been developed, the counter arguments analyse based on maqashid shari’ah within five dimensions of dharuriyah namely; preservation of faith (ad-dien), life (an-nafs), intellect (al-‘aql), progeny (an-nasl), and wealth (al-maal). Accordingly, Muslim’s maximum utility would be achieved when he spends the whole budget as closest as conform to maqashid shari’ah dimensions. Furthermore, it also objected to assist assessment of our current knowledge base, to identify misconceptions and knowledge gaps and to indicate direction for further research on the issue microeconomics especially from an Islamic perspective.

Abstract

Treatment nasty case in Banda Aceh, Aceh province could also be implemented through Local Customary Courts. Settlement through customary courts always be informal or through peace way. On the other hand, Aceh Qanun No. 14 of nasty arranges it as well, in which the nasty cases will be resolved by the Syar’iyah Court. This study aimed to see, if the Local Customary Court has the authority to deal with nasty case, and whether the decision made by the Local Customary Court shall be final and tight. The study was conducted by interviewing Local Customary Court judges, Wilayatul Hisbah and Communities. The method used was a qualitative study. The result showed that both the Local Customary Courts and the Syar‘iyah Court have the same authority in handling the nasty case in Banda Aceh. In fact, sometimes, the local customary courts also resolve cases that have been categorized as adultery. Treatment cases of nasty, with local customary court have no final and strong legal force, because if the parties are not satisfied with the decision of the Customary Court, they can still bring the Government of Aceh in order to perform an amendment to the articles of those Qanun. Then, the special cases that are categorized as adultery should immediately be resolved by the Syar’iyah Court.

Abstract

This study aims to look at the Indonesian government’s strategy in improving the process of Human rights democratization. Democracy and human rights are two things that can not be separated. However this study has found that besides providing legal penalties to the perpetrators, Indonesian government should also pay attention to the development of social dynamics and the tendency of other countries to understand human rights issues. In this study the author recommend that holistic paradigm is a suitable paradigm offered in human rights issues to be developed in Indonesia.

Abstract

Al-Gharimin merupakan salah satu daripada delapan asnaf yang berhak menerima zakat. Pada zahirnya, al-gharimin didefinisikan sebagai orang yang berutang. Namun, asnaf al- gharimin ini telah didefinisikan dengan berbagai tafsiran oleh para fuqaha klasik dan kontemporari. Kesan daripada perbedaan definisi ini menyebabkan pengagihan zakat melalui asnaf ini dilaksanakan secara meluas. Di samping itu, perubahan zaman dan kondisi saat ini menuntut suatu transformasi dalam perkembangan asnaf al-gharimin bagi menjawab keperluan sosioekonomi masyarakat Islam hari ini. Oleh itu, penelitian ini mencadangkan pelaksanaan qard hasan (pinjaman berkebajikan tanpa riba) kepada golongan yang memerlukan berasaskan asnaf al-gharimin. Penelitian ini memfokuskan kepada dua perkara utama. Pertama, mengenal pasti definisi-definisi al-Gharimin dari perspektif fuqaha. Kedua, menganalisis definisi al-gharimin untuk dijadikan sebagai asas pelaksanaan qard hasan. Penelitian ini berbentuk penelitian perpustakaan. Melalui analisis tekstual, penelitian ini cuba meneliti pandangan fuqaha melalui kitab klasik dan kontemporari bagi melihat asas dan sandaran bagi agihan al-Gharimin dalam bentuk pinjaman kewangan. Pandangan ini seterusnya akan dinilai melalui perspektif maslahat dan maqasid syariah. Penelitian ini mendapati terdapat pelbagai definisi yang didukung oleh para fuqaha terhadap asnaf al-gharimin. Implimentasi penelitian juga mendapati terdapat ruang yang luas dalam menginovasi asnaf al-gharimin kepada pinjaman kewangan berbentuk qard hasan. Dengan pelaksanaan pinjaman keuangan berbentuk qard hasan ini diharap dapat menyumbang kepada perkembangan ekonomi umat Islam dan keberlanjutan pusat-pusat zakat di Malaysia.

Abstract

This article sheds light on thoughts of the Liberal Islam proponents concerning to the way they view about the Islamic law application in Aceh. In doing so, it explains the strategies that liberal Islam takes to disseminate their beliefs among Moslems and then how their positions are criticised among western thinkers in the post modern era. The second part of this work will elucidate their views on the Acehnese Sharia and the way their opinions are countered by traditionalists. Finally, this article will offer some possible solutions for dealing with the divergents of Islamic thought that leads to cultural conflict. The discussion will eventually bring the method of Freire’s conscientizacao as the way out from the cultural conflict.

Abstract

Islam adalah agama yang sangat sempurna mengatur seluruh aspek kehidupan manusia untuk mewujudkan kebahagiaan hidup manusia dunia akhirat selama manusia itu mengamalkan ajaran Islam secara benar. Dalam bidang hukum dan peradilan, ajaran Islam menuntut para hakim agar memutuskan perkara dengan hukum Islam baik dalam perkara perdata maupun dalam perkara pidana. Kenyataannya di Indonesia sekarang ini, perkara-perkara yang diputuskan di Peradilan tidak berdasarkan hukum Islam, kecuali beberapa perkara saja yang menjadi wewenang Peradilan Agama, padahal sebagian besar hakim di Indonesia beragama Islam. Secara realita memang hakim tidak mungkin memutuskan perkara dengan hukum yang tidak dipositifikasikan di suatu negara, artinya hakim tidak mungkin menerapkan hukum yang tidak menjadi hukum posistif yang berlaku di negara tersebut. Lantas bagaimana dengan perintah agama Islam yang mengharuskan setiap orang (hakim) yang memutuskan perkara supaya memutuskan perkara berdasarkan hukum Islam. Tulisan ini ingin meneliti bagaimana sanksi yang dijatuhkan terhadap para hakim yang tidak menerapkan hukum Islam dalam mengadili dan memutuskan perkara. Kemudian apakah keadaan-keadaan dan halangan-halangan yang ada --berupa sistem peradilan dan pemerintahan yang berlaku yang menimbulkan hambatan bagi hakim untuk menerapkan hukum Islam--dapat membebaskan mereka dari ancaman hukuman tersebut. Selanjutnya tulisan ini juga membahas bagaimana tugas dan tanggung jawab setiap pribadi muslim dalam mendakwahkan hukum Islam agar hukum Islam diterima dan diamalkan dalam masyarakat dan menjadi norma hukum yang diterapkan secara resmi di setiap negara terutama Negara Republik Indonesia.

Abstract

There are, at least,three provincial regulations (qanun) have been enacted and stipulated by Aceh Government dealing with jinayah (Islamic penal rules) during Islamic sharia law implementation in Aceh, i.e. qanun khamar (drunk), qanun maisir (gambling), and qanun khalwat (immoral). From 2004 to 2008, much of the conflict subjects with the qanun jinayah have been determined by judge of Islamic Court (Mahkamah Syar’iyah) Aceh, such as whip or fine. Since 2009 until now, some cases regarding qanun khalwat have been sentenced through adat (tradition) court of Aceh. The important questions arise here: what are the obstacle factors of qanun jinayah enforcement in Aceh? What are implications of those obstacle factors within qanun jinayah enforcement in Aceh? And the last question, what kind of legal system within qanun jinayah enforcement in Aceh? By using qualitative research method, data resources gained from interview, library and observation, this research result indicates at least 6 (six) factors that could be obstacle factors of qanun jinayah enforcement in Aceh, namely, the substance of qanun jinayah is very weak; “political will” of Aceh Government to implement the regulations seems not seriously; there are many different perceptions about qanun jinayah around Aceh citizens and students; integrity and morality of law enforcer are very weak; public pressure is very restricted; and budgeting for Islamic sharia law implementation is very small. The implication from this causes trend toward unclear of law, escalating radicalism to subject conflict of qanun jinayah, and debate about qanun jinayah enforcement. For khalwat cases, the legal system enforcement in Aceh due to adat judicial system. Meanwhile, for maisir (gambling) and khamar (drunk) cases based on Mahkamah Syar’iyah system.

Abstract

Zakat is believed to be addressing the problem of poverty, but why poverty among Muslims is still high? According to The Nation (July, 29, 2014), rather than the 1.7 billion poor people in the world in the year 2011, 44 percent thereof living in Muslim countries. What realities which are not subjected to the control of up to present zakat poverty among Muslims in Muslim countries are still not able to overcome? This paper examines this issue with three realities that has association with charity and poverty. The Three realities are that the nature of zakat, zakat pentadbiran structure, and the poverty measure used. Third-three is believed to reality is a factor that should be restraint in the care of poverty through zakat. Almost all the argument in this paper is based on the experience in Malaysia.
